373.1 An electric water heater that is manufactured on or after May 6, 2028 and before May 6, 2029 is deemed to satisfy the requirements of sections 372 and 373 if it satisfies the requirements of those sections that would have applied to the electric water heater if it had been manufactured on or after May 6, 2029.

374 The following definitions apply in this Subdivision.

CSA P.3-04

CSA P.3-04 means the CSA standard CAN/CSA-P.3-04 entitled Testing Method for Measuring Energy Consumption and Determining Efficiencies of Gas-Fired Storage Water Heaters. (CSA P.3-04)

replacement unit

replacement unit means a commercial gas-fired storage water heater that is marked for replacement installations only. (unité de remplacement)

374.1 For the purpose of these Regulations, a gas-fired storage water heater is one of the following types:

• (a) household, if it has an input rate of less than or equal to 21.97 kW (75,000 Btu/h); or

• (b) commercial, if it is has an input rate of greater than 21.97 kW (75,000 Btu/h).

• 375 (1) A gas-fired storage water heater is prescribed as an energy-using product.

• Marginal note:Limits

  (2) However, for the purposes of sections 4, 5 and 376, a gas-fired storage water heater is not considered to be an energy-using product unless

  • (a) it is a household gas-fired storage water heater that is manufactured on or after February 3, 1995; or

  • (b) it is a commercial gas-fired storage water heater that is manufactured on or after July 1, 2023.

Marginal note:Energy-efficiency standards — household

• 376 (1) The energy efficiency standards set out in column 3 of Table 1 to this section apply to household gas-fired storage water heaters described in column 1 that are manufactured during the periods set out in column 4.

• Marginal note:Testing standard — household

  (2) A household gas-fired storage water heater complies with the energy efficiency standard if it meets that standard when tested in accordance with testing procedures established by the standard set out in column 2 of Table 1 that are applicable to a gas-fired storage water heater as defined in subsection 369(1).

• Marginal note:Energy efficiency standards — commercial

  (3) The energy efficiency standards set out in column 3 of Table 2 to this section apply to commercial gas-fired storage water heaters described in column 1 that are manufactured on or after July 1, 2023.

• Marginal note:Testing standard — commercial

  (4) A commercial gas-fired storage water heater complies with the energy efficiency standard if it meets that standard when tested in accordance with testing procedures established by the standard set out in column 2 of Table 2 that are applicable to a gas-fired storage water heater as defined in subsection 369(1).

377 For the purpose of subsection 5(1) of the Act, the information set out in column 3 of the table to this section must be collected in accordance with the standard set out in column 2 and provided to the Minister in respect of a gas-fired storage water heater described in column 1.
