Regulations Respecting Zoning at Stratford Municipal Airport

Whereas, pursuant to section 5.5Footnote * of the Aeronautics Act, a copy of the proposed Regulations respecting zoning at Stratford Municipal Airport, substantially in the form annexed hereto, was published in two successive issues of the Canada Gazette Part I, on June 24 and July 1, 1995, and in two successive issues of the Stratford Beacon Herald on June 28 and 29, 1995, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 5.4Footnote ** of the Aeronautics Act, is pleased hereby to make the annexed Regulations respecting zoning at Stratford Municipal Airport.

Short Title
1 These Regulations may be cited as the Stratford Municipal Airport Zoning Regulations.
Interpretation
2 (1) In these Regulations,
- airport
airport means the Stratford Municipal Airport, in the Township of North Easthope, County of Perth, in the Province of Ontario; (aéroport)
- airport reference point
airport reference point means the point described in Part I of the schedule; (point de référence de l’aéroport)
- approach surfaces
approach surfaces means the imaginary inclined planes that extend upward and outward from each end of a strip, which planes are more particularly described in Part II of the schedule; (surfaces d’approche)
- outer surface
outer surface means an imaginary plane located above and in the immediate vicinity of the airport, which plane is more particularly described in Part III of the schedule; (surface extérieure)
- strip
strip means the rectangular portion of the landing area of the airport, including the runway, that is prepared for the take-off and landing of aircraft in a particular direction, which rectangular portion is more particularly described in Part IV of the schedule; (bande)
- transitional surfaces
transitional surfaces means the imaginary inclined planes that extend upward and outward from the lateral limits of a strip and the approach surfaces, which planes are more particularly described in Part V of the schedule. (surfaces de transition)
(2) For the purposes of these Regulations, the elevation of the airport reference point is 367.7 m above sea level.
Application
3 These Regulations apply to all land, including public road allowances, that is adjacent to or in the vicinity of the airport, which land is more particularly described in Part VI of the schedule.
Building Restrictions
4 No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point
(a) the approach surfaces;
(b) the outer surface; or
(c) the transitional surfaces.
Aeronautical Facilities
5 No owner or lessee of any land to which these Regulations apply shall permit any part of that land to be used or developed in a manner that causes interference with any signals or communications to and from
(a) any aircraft; or
(b) any facilities used to provide services relating to aeronautics.
Natural Growth
6 Where an object of natural growth that is on any land to which these Regulations apply grows to a height that exceeds in elevation at the location of the object any of the surfaces referred to in section 4, the Minister of Transport may require that the owner or lessee of the land remove the excess growth.
SCHEDULE(Sections 2 and 3)
PART IDescription of the Airport Reference Point
The airport reference point, shown on Stratford Municipal Airport Zoning Plan No. 31-009 89-064, dated August 29, 1994, is a point that may be located by:
commencing at the threshold of runway 05, being the southwesterly end of runway 05-23 at Stratford Municipal Airport, which has Universal Transverse Mercator (UTM) coordinates of N 4 806 218.75 and E 504 852.60;
thence northeasterly along the centre line of runway 05-23, 762.94 m to a point;
thence northwesterly and perpendicular to the centre line of runway 05-23, 64.94 m to the airport reference point, having UTM coordinates of N 4 806 823.84 and E 505 321.24.
PART IIDescription of the Approach Surfaces
The approach surfaces, shown on Stratford Municipal Airport Zoning Plan No. 31-009 89-064, dated August 29, 1994, are planes abutting each end of the strips associated with runways 05-23 and 17-35 and are described as follows:
(a) an inclined plane abutting the end of the strip associated with the approach to runway 05 having a ratio of 1 m measured vertically to 40 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 525 m from the projected centre line; said imaginary horizontal line being 75 m above elevation at the end of the strip;
(b) an inclined plane abutting the end of the strip associated with the approach to runway 23 having a ratio of 1 m measured vertically to 40 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 1 776 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 341.4 m from the projected centre line; said imaginary horizontal line being 44.4 m above the elevation at the end of the strip;
(c) an inclined plane abutting the end of the strip associated with the approach to runway 17 having a ratio of 1 m measured vertically to 30 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 1 350 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 180 m from the projected centre line; said imaginary horizontal line being 45 m above the elevation at the end of the strip; and
(d) an inclined plane abutting the end of the strip associated with the approach to runway 35 having a ratio of 1 m measured vertically to 30 m measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 1 311 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 176.1 m from the projected centre line; said imaginary horizontal line being 43.7 m above the elevation at the end of the strip.
PART IIIDescription of the Outer Surface
The outer surface, shown on Stratford Municipal Airport Zoning Plan No. 31-009 89-064, dated August 29, 1994, is an imaginary plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that plane is less than 9 m above the surface of the ground, the outer surface is located at 9 m above the surface of the ground.
PART IVDescription of the Strips
The strips, shown on Stratford Municipal Airport Zoning Plan No. 31-009 89-064, dated August 29, 1994, are described as follows:
(a) the strip associated with runway 05-23 is 150 m in width, 75 m being on each side of the centre line of the runway, and 1 646.11 m in length; and
(b) the strip associated with runway 17-35 is 90 m in width, 45 m being on each side of the centre line of the runway, and 1 095 m in length.
PART VDescription of the Transitional Surfaces
Each transitional surface, shown on Stratford Municipal Airport Zoning Plan No. 31-009 89-064, dated August 29, 1994, is an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of each strip, extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or with another transitional surface of an adjoining strip.
The elevation of a point on the lower edge of each transitional surface between the thresholds is equal to the elevation of the nearest point on the centre line. The elevation of a point on the lower edge of each transitional surface between the threshold and the end of the strip is equal to the elevation of the threshold.
PART VIDescription of the Lands to Which These Regulations Apply
The outer boundary of the land to which these Regulations apply, shown on Stratford Municipal Airport Zoning Plan No. 31-009 89-064, dated August 29, 1994, is described as follows:
In the Townships of Ellice and North Easthope and the City of Stratford, all in the County of Perth;
commencing at the eastern corner of Lot 1, Concession 10, in the Township of Ellice;
thence northeasterly in a straight line across the road allowance between the Townships of Ellice and North Easthope to the north corner of Lot 36, Concession 9, in the Township of North Easthope;
thence southerly along the eastern boundary of Lot 36, Concession 9, to the southeastern corner of Lot 36, Concession 9;
thence easterly in a straight line across the road allowance between Lots 36 and 35, Concession 9, to the southwestern corner of Lot 35, Concession 9;
thence easterly along the southern boundaries of Lots 35 and 34 in Concession 9, to the southeastern corner of Lot 34, Concession 9;
thence southerly in a straight line across the road allowance between Concession 9 and Concession 8, to the northwestern corner of Lot 33, Concession 8;
thence easterly along the northern boundaries of Lots 33 and 32 in Concession 8 to the northeastern corner of Lot 32, Concession 8;
