Regulations Respecting Zoning at Weyburn Airport

Whereas, pursuant to section 5.5 of the Aeronautics Act, a copy of the proposed Zoning Regulations respecting Weyburn Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette Part I, on December 15th and 22nd, 1990, and in two successive issues of the Weyburn Review on January 23rd and 30th, 1991, and reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 5.4 of the Aeronautics Act, is pleased hereby to make the annexed Regulations respecting zoning at Weyburn Airport.

Short Title

 These Regulations may be cited as the Weyburn Airport Zoning Regulations.

Interpretation

  •  (1) In these Regulations,

    airport

    airport means the Weyburn Airport, in the vicinity of Weyburn in the Province of Saskatchewan; (aéroport)

    airport reference point

    airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

    approach surface

    approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)

    Minister

    Minister means the Minister of Transport; (ministre)

    outer surface

    outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)

    strip

    strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)

    transitional surface

    transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)

  • (2) For the purposes of these Regulations, the elevation of the airport reference point is 586.5 m above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part VI of the schedule.

General

 No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point

  • (a) the approach surfaces;

  • (b) the outer surface; or

  • (c) the transitional surfaces.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may require that the owner or occupier of the land on which that object is growing remove the excessive growth.

Disposal of Waste

 No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.

SCHEDULE(Sections 2 and 3)

PART IDescription of Airport Reference Point

The airport reference point shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is a point located on the centre line of runway 12-30 distant 609.5 m from the threshold of runway 12.

PART IIDescription of the Approach Surfaces

The approach surfaces, shown on Weyburn Airport Zoning Plan No. E.2702, dated November 14, 1988, are surfaces abutting each end of the strip associated with the runway designated 12-30, and are described as follows:

  • (a) a surface abutting the end of the strip associated with runway approach 12 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295.0 m from the projected centre line; said imaginary horizontal line being 83.3 m above the elevation at the end of the strip; and

  • (b) a surface abutting the end of the strip associated with runway approach 30 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295.0 m from the projected centre line; said imaginary horizontal line being 83.3 m above the elevation at the end of the strip.

PART IIIDescription of the Outer Surface

The outer surface, shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground.

PART IVDescription of the Strip

The strip associated with runway 12-30 shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is 90 m in width, 45 m being on each side of the centre line of the runway, and 1 339 m in length.

PART VDescription of Each Transitional Surface

Each transitional surface, shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface.

PART VIDescription of the Lands to Which These Regulations Apply

The boundary of the outer limits of lands, shown on Weyburn Airport Zoning Plan No. E.2702 dated November 14, 1988, is described as follows:

COMMENCING at the northeast corner of the southeast quarter Section 13, Township 9, Range 14, West of the Second Meridian;

THENCE southerly along the easterly limit of said southeast quarter Section 13 and across the intervening road allowance to the northeast corner of Section 12;

THENCE easterly across the intervening road allowance and along the northerly limit of the northwest quarter Section 7, Township 9, Range 13, West of the Second Meridian to the northeast corner of the northwest quarter Section 7;

THENCE southerly along the easterly limit of the northwest quarter of Section 7, to the southeast corner of the northwest quarter Section 7;

THENCE easterly along the northerly limit of the southeast quarter Section 7 to the northeast corner of the southeast quarter Section 7;

THENCE southerly along the easterly limits of the southeast quarter of Section 7, Section 6, Section 31, Township 8, Range 13, West of the Second Meridian, northeast quarter Section 30 and across the intervening road allowance to the southeast corner of the northeast quarter Section 30;

THENCE westerly along the southerly limit of the northeast quarter Section 30 to the southwest corner of the northeast quarter Section 30;

THENCE southerly along the easterly limit of the southwest quarter Section 30 to an intersection with the northerly limit of Registered Plan F.U. 895;

THENCE westerly along the northerly limit of Registered Plan F.U. 895, across the intervening road allowance to an intersection with the easterly limit of Section 25, Township 8, Range 14, West of the Second Meridian;

THENCE southerly across Registered Plan F.U. 895 and along the easterly limit of the northeast quarter Section 24 to the southeast corner of the northeast quarter Section 24;

THENCE westerly along the southerly limits of the north halves of Sections 24, 23, the northeast quarter of Section 22 and across the intervening road allowance to the southwest corner of the northeast quarter Section 22;

THENCE northerly along the westerly limit of the northeast quarter Section 22 to an intersection with the northerly limit of Eaglesham Avenue as shown on Registered Plan 77-R-35154;

THENCE westerly along the northerly limit of Eaglesham Avenue to an intersection with the easterly limit of Eighteenth Street as shown on Registered Plan 75-R-37762;

THENCE northerly along the easterly limit of Eighteenth Street to an intersection with the northerly limit of Warren Avenue as shown on Registered Plan 78-R-51308;

THENCE westerly along the northerly limit of Warren Avenue to the southwest corner of Parcel A, Registered Plan 64-R-36228;

THENCE northerly along the westerly limit of Parcel A, Registered Plan 64-R-36228 to an intersection with the westerly production of the northerly limit of Block 1, Registered Plan 70-R-08477;

THENCE northwesterly to a point being the most southerly corner of Lot 38, Block 22, Registered Plan 75-R-46688;

THENCE northwesterly along the southwesterly limit of Lot 38 to the most westerly corner of Lot 38;

THENCE northerly and westerly respectively along the easterly and northerly limits of Staveley Crescent and the production thereof westerly across Thirteenth Street to an intersection with the easterly limit of Block 26, Registered Plan 77-R-51120;

THENCE northerly along the easterly limit of Block 26 to the northeast corner of Lot 1, Block 26, Registered Plan 77-R-51120;

THENCE northwesterly to a point being the northwesterly corner of Public Reserve R2, Registered Plan 77-R-51120;

THENCE northerly on the production of the westerly limit of Public Reserve R2 to an intersection with the northerly limit of Douglas Road as shown on Registered Plan 68-R-13707;

THENCE westerly along the northerly limit of Douglas Road to the easterly limit of McLelland Street as shown on Registered Plan 67-R-25483;

THENCE northerly along the easterly limit of McLelland Street and its production across fifth Avenue North to an intersection with the southerly limit of Parcel F, Registered Plan 78-R-24931;

THENCE westerly along the southerly limit of Parcel F to the southwest corner of Parcel F;

THENCE northerly along the westerly limit of Parcel F to the northwest corner of Parcel F;

THENCE westerly along the northerly limit of Parcel G, Registered Plan 78-R-24930 to the northwest corner of Parcel G;

THENCE northerly along the easterly limit of Parcel A, Registered Plan A.X. 3122 to the northeast corner of Parcel A;

THENCE westerly along the northerly limits of Parcel A and Parcel B, Registered Plan A.V. 4770 to an intersection with the easterly limit of Registered Plan 81-R-41533;

THENCE northerly along the easterly limit of Registered Plan 81-R-41533 to an intersection with the southerly limit of Parcel A, Registered Plan G.C. 3077;

THENCE westerly along the southerly limit of Parcel A, Registered Plan G.C. 3077 to the southeast corner of Parcel Z, Plan 81-R-41533;

THENCE northerly along the easterly limit of Parcel Z and the northerly production of the easterly limit of Parcel Z to an intersection with the southeasterly limit of Registered Plan D.M. 5570;

THENCE northerly to a point being the intersection of the southerly production of the easterly limit of Registered Plan 81-R-19627 with the northwesterly limit of Registered Plan D.M. 5570;

THENCE northerly along the said southerly production, the easterly limits of Registered Plans 81-R-19627 and 81-R-22222 respectively and across the intervening road allowance to an intersection with the southerly limit of the northwest quarter Section 9, Township 9, Range 14, West of the Second Meridian;

THENCE easterly along the southerly limit of the northwest quarter Section 9 to the southeast corner of the northwest quarter Section 9;

THENCE northerly along the easterly limit of the northwest quarter Section 9 to the northeast corner of the northwest quarter Section 9;

THENCE easterly along the northerly limit of the northeast quarter Section 9 and across the intervening road allowance to the northwest corner of Section 10;

THENCE northerly across the intervening road allowance and along the westerly limit of Section 15 to the northwest corner of the southwest quarter Section 15;

THENCE easterly along the northerly limits of the south halves of Section 15, 14, 13 and across the intervening road allowances to the point of commencement.
