Regulations Respecting the Fees To Be Paid by the Commissioner of the Bermuda Police Force for Services Provided by the Forensic Laboratory Services and Identification Services of the Royal Canadian Mounted Police

Whereas the Governor in Council is of the opinion that the cost of services provided to persons by the Royal Canadian Mounted Police should be borne by the persons using those services.

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Solicitor General of Canada and the Treasury Board, pursuant to section 19 of the Financial Administration Act, is pleased hereby to revoke Order in Council P.C. 1980-14/2323 of August 27, 1980Footnote * and, pursuant to paragraph 19(a) of the said act, to make the annexed Regulations respecting the fees to be paid by the Commissioner of the Bermuda Police Force for services provided by the Forensic Laboratory Services and Identification Services of the Royal Canadian Mounted Police.

Short Title

 These Regulations may be cited as the Royal Canadian Mounted Police Case Examination Fees (Bermuda) Regulations.

Interpretation

 In these Regulations,

case examination

case examination means the examination, photography and analysis of exhibits that have been collected during an investigation by the Bermuda Police Force, which investigation has been authorized by the Commissioner of the Bermuda Police Force and are presented to the Royal Canadian Mounted Police at one time as part of a single investigation; (examen judiciaire)

Commissioner of the Bermuda Police Force

Commissioner of the Bermuda Police Force means the person who is in charge of the operation of the police force for Bermuda; (commissaire de la police des Bermudes)

member

member means a member as defined in the Royal Canadian Mounted Police Act. (membre)

Fees

 The Commissioner of the Bermuda Police Force shall pay the following fees expressed in Canadian dollars for the services specified:

  • (a) for each case examination performed by the Forensic Laboratory Services of the Royal Canadian Mounted Police, one thousand dollars;

  • (b) for each case examination performed by the Identification Services of the Royal Canadian Mounted Police, two hundred and fifty dollars; and

  • (c) for the presence in Bermuda of a member for the purpose of testifying in court in respect of a service provided pursuant to paragraph (a) or (b),

    • (i) one hundred and seventy-five dollars per day, including travelling time, and

    • (ii) all transportation, lodging and meal expenses of the member that relate to the court appearance, at Government of Canada rates as set out in the Treasury Board Personnel Management Manual, Chapter 370, Appendix C, dated April 1989.
