Regulations Respecting Zoning at Abbotsford Airport

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 6 of the Aeronautics Act, is pleased hereby to approve the revocation made by the Minister of Transport of the Abbotsford Airport Zoning Regulations, C.R.C., c. 74, and to approve the annexed Regulations Respecting zoning at Abbotsford Airport, made by the Minister of Transport, in accordance with the schedule hereto.
Short Title
1 These Regulations may be cited as the Abbotsford Airport Zoning Regulations.
Interpretation
2 In these Regulations,
- airport
airport means Abbotsford Airport, in the District of Matsqui, in the Province of British Columbia; (aéroport)
- airport reference point
airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)
- approach surface
approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part III of the schedule; (surface d’approche)
- Minister
Minister means the Minister of Transport; (ministre)
- outer surface
outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (surface extérieure)
- strip
strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (bande)
- transitional surface
transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part VI of the schedule. (surface de transition)
3 For the purposes of these Regulations, the assigned elevation of the airport reference point is 50.6 m above sea level.
Application
4 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, that consist of
(a) the lands within, and
(b) the lands directly under that portion of an approach surface that extends beyond
the outer limits described in Part II of the schedule.
General
5 No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point, any
(a) approach surface;
(b) outer surface; or
(c) transitional surface.
Natural Growth
6 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 5(a), (b) and (c), the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.
Disposal of Waste
7 No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.

PART IDescription of the Airport Reference Point
Being a point distant 448.621 m measured northerly at right angle to the centre line of runway 06-24 from a point thereon distant 951.465 m measured easterly along the centre line from the end of the strip associated with runway approach 06, which distances are ground level distances.
PART IIDescription of the Outer Limits of Lands
The following described boundaries are the outer limits of lands:
COMMENCING at the intersection of the southerly production of the west boundary of Lot 1, Plan 22917 of Section 3, Township 13, N.W.D. with the International Boundary; thence, northerly along the said southerly production and the said west boundary of the said Plan 22917 and Plan 5981 to the northwest corner of Lot 1 of the said Plan 5981; thence, westerly along the north boundary of Plan 9379 and Plan 28496 to the northwest corner of Lot 31 of the said Plan 28496; thence, northerly along the east limit of Aberdeen Road to an intersection with the southerly limit of the approach surface associated with Runway Approach 06; thence, on a bearing of 355°17′10″ to an intersection with the northerly limit of the said approach surface; thence, easterly on a bearing of 93°49′01″ along the said northerly limit to the westerly boundary of Parcel A, R.P. 11534 of the West 1/2 of the Southwest 1/4, Section 10, Township 13, N.W.D.; thence on a bearing of 175°17′10″ along the said line to the said point of intersection; thence, southerly along the said northerly production to the northeast corner of the said North 1/2 of Lot 19, Plan 5211; thence, westerly along the south limit of Huntingdon Road to the northwest corner of Lot 34, Plan 26793; thence, westerly across Gladwin Road to the Northeast corner of District Lot 641, Group 2, N.W.D.; thence, southerly along the west limit of Gladwin Road and the southerly production thereof to an intersection with the International Boundary; thence, westerly along the International Boundary to the point of commencement;
which outer limits of land are shown outlined yellow on Department of Transport Plan No. (Z) B.C. 1414 dated the 7th day of November, 1980.
PART IIIDescription of the Approach Surfaces
The approach surfaces, shown on Department of Transport Abbotsford Airport Zoning Plan No. (Z) B.C. 1414 dated November 7, 1980 are surfaces abutting each end of the strips associated with runways designated 06-24, 12-30 and 18-36 and are described as follows:
(a) a surface abutting the end of the strip associated with runway approach 06 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an intersection with the outer surface; thence, the approach surface shall be horizontal and contiguous to the outer surface to an intersection with an imaginary horizontal line drawn at right angles to the projected centre line of the strip, which horizontal line commences at the intersection of the southerly limit of the approach surface associated with runway approach 06 with the west boundary of Lot 3 of Section 3, Township 13, Plan 11852; thence, the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 277.3 m above the end of the strip;
(b) a surface abutting the end of the strip associated with runway approach 24 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an intersection with the outer surface; thence, the approach surface shall be horizontal and contiguous to the outer surface to an intersection with an imaginary horizontal line drawn at right angles to the projected centre line of the strip, which horizontal line commences at the intersection of the northerly production of the east boundary of the North 1/2 of Lot 19, Plan 5211 of Section 4, Township 16, N.W.D., with the southerly limit of the approach surface associated with runway approach 24; thence, the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 262.38 m above the end of the strip;
(c) a surface abutting the end of the strip associated with runway approach 12 consisting of an inclined plane having a ratio of 1 m measured vertically to 20 m measured horizontally rising to an intersection with the outer surface; thence, the approach surface shall be horizontal and contiguous to the outer surface to an intersection with an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 345 m from the projected centre line; said imaginary horizontal line being 41 m above the end of the strip;
(d) a surface abutting the end of the strip associated with runway approach 30 consisting of an inclined plane having a ratio of 1 m measured vertically to 20 m measured horizontally rising to an intersection with the outer surface; thence, the approach surface shall be horizontal and contiguous to the outer surface to an intersection with the imaginary horizontal line drawn contiguous to the International border; said imaginary horizontal line being 41 m above the end of the strip;
(e) a surface abutting the end of the strip associated with runway approach 18 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an intersection with the outer surface; thence, the approach surface shall be horizontal and contiguous to the outer surface to an intersection with an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 450 m from the projected centre line; said imaginary horizontal line being 41 m above the end of the strip; and
(f) a surface abutting the end of the strip associated with runway approach 36 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an intersection with the outer surface; thence, the approach surface shall be horizontal and contiguous to the outer surface to an intersection with an imaginary horizontal line drawn contiguous to the International border; said imaginary horizontal line being 41 m above the end of the strip.
PART IVDescription of the Outer Surface
The outer surface, shown on Department of Transport Abbotsford Airport Zoning Plan No. (Z) B.C. 1414 dated November 7, 1980 is an imaginary surface located at a common plane established at a constant elevation of 45 m above the assigned elevation of the airport reference point except where that common plane is less than 9 m above the surface of the ground, the imaginary surface is located at 9 m above the surface of the ground.
PART VDescription of the Strips
The strips, shown on Department of Transport Abbotsford Airport Zoning Plan No. (Z) B.C. 1414 dated November 7, 1980 are described as:
(a) the strip associated with runway 06-24 is 300 m in width, 150 m being on each side of the centre line of the runway, and 2 558.37 m in length;
(b) the strip associated with runway 12-30 is 90 m in width, 45 m being on each side of the centre line of the runway, and 1 726.974 m in length; and
(c) the strip associated with runway 18-36 is 300 m in width, 150 m being on each side of the centre line of the runway, and 1 726.769 m in length.
PART VIDescription of Each Transitional Surface
Each transitional surface, shown on Department of Transport Abbotsford Airport Zoning Plan No. (Z) B.C. 1414 dated November 7, 1980 is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and centre line produced of each strip and extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.
