Regulations Providing for the Restricting of Property Located in the Municipality of Central Saanich in the Province of British Columbia that ss Infested With the Golden Nematode from the Production of Eggplants and Tomatoes

His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture, pursuant to section 4 of the Plant Quarantine Act, is pleased hereby to make the annexed Regulations providing for the restricting of property located in the Municipality of Central Saanich in the Province of British Columbia that is infested with the Golden Nematode from the production of eggplants and tomatoes.
Short Title
1 These Regulations may be cited as the Eggplants and Tomatoes Production (Central Saanich) Restriction Regulations.
Restriction
2 Subject to section 3, no person shall plant from seed or by transplant, grow, produce or harvest any eggplants or tomatoes in that portion of the Municipality of Central Saanich in the Province of British Columbia east of the West Saanich Road, other than property located in the South Saanich land district in the Province of British Columbia, namely, all the property included in Plans 617R, 642R and 643R, Parcel “A” north of Wallace Drive in the western half of Section 10 and all of Sections 11 and 12 in Range 2 East.
Exception
3 Section 2 does not apply to any person who plants from seed or by transplant, grows, produces or harvests eggplants or tomatoes if
(a) the eggplants or tomatoes are for his own consumption, within the limits of the property on which they were harvested and if the property was not used, at any time prior to the coming into force of these Regulations, for the production of potatoes, eggplants or tomatoes; or
(b) the eggplants or tomatoes are produced in artificial medium or sterilized soil in a greenhouse located on property that was not used, at any time prior to the coming into force of these Regulations, for the field production of potatoes, eggplants or tomatoes.
