His Excellency the Governor General in Council, on the recommendation of the Associate Minister of National Defence, pursuant to Vote 545 of the Appropriation Act No. 5, 1961, is pleased hereby to revoke the order made by Order in Council P.C. 1962-761 of 28th May, 1962Footnote (1), and to make the annexed Pensionable Service Order in substitution therefor.

 This Order may be cited as the Pensionable Service Order.

 Where a person

  • (a) has elected to come under Part V of the Militia Pension Act or the Defence Services Pension Act, and

  • (b) has, while subject to Parts I and IV of either of those Acts, made a payment to the Receiver General that purported to be a deduction under any of those Parts in respect of a period of service,

that period of service shall be deemed to be pensionable service to his credit for the purposes of the Canadian Forces Superannuation Act, if

  • (c) the payment referred to in paragraph (b) is sufficient to pay in full the amount of contributions required by section 3; or

  • (d) where the payment referred to in paragraph (b) is not sufficient to pay in full the amount of contributions required by section 3, the person has paid the difference between the amount of contributions required by section 3 and the payment referred to in paragraph (b) in a lump sum to the Receiver General to the credit of the Canadian Forces Superannuation Account.

 The amount of contributions required in respect of a period of service described in section 2 is five per cent of the aggregate amount of pay, as defined in paragraph (g) of section 36 of the Defence Services Pension Continuation Act, received by the contributor during the period of service.
