Accessible Transportation for Persons with Disabilities Regulations Application Exemption Order

Whereas the Canadian Transportation Agency has made the Accessible Transportation for Persons with Disabilities RegulationsFootnote a, which set out requirements applicable to transportation service providers;

And whereas, due to the coronavirus disease 2019 (COVID-19) pandemic and its severe financial and operational repercussions on air, marine and bus carriers and certain terminal operators, the Canadian Transportation Agency is of the opinion that it is necessary to exempt those entities for a limited period from the application of certain provisions of those Regulations that will come into force on June 25, 2020;

And whereas, pursuant to subsection 36(2) of the Canada Transportation ActFootnote b, the Canadian Transportation Agency has given the Minister of Transport notice of the annexed Order;

Therefore, pursuant to subsection 170(3) of the Canada Transportation ActFootnote b, the Canadian Transportation Agency makes the annexed Accessible Transportation for Persons with Disabilities Regulations Application Exemption Order.

Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to subsection 170(3) of the Canada Transportation ActFootnote a, approves the annexed Accessible Transportation for Persons with Disabilities Regulations Application Exemption Order, made by the Canadian Transportation Agency.

Definition

Marginal note:Definition of Regulations

 In this Order, Regulations means the Accessible Transportation for Persons with Disabilities Regulations.

Exemptions

Marginal note:Air carriers

 Air carriers are exempted until December 31, 2020 from the application of the following provisions of the Regulations:

  • (a) section 4;

  • (b) section 9;

  • (c) sections 15 to 23;

  • (d) sections 39 and 81; and

  • (e) sections 58 and 59.

Marginal note:Marine carriers

 Marine carriers are exempted until December 31, 2020 from the application of the following provisions of the Regulations:

  • (a) sections 15 to 23; and

  • (b) sections 39 and 164.

Marginal note:Bus carriers

 Bus carriers are exempted until December 31, 2020 from the application of the following provisions of the Regulations:

  • (a) section 9;

  • (b) sections 15 to 23; and

  • (c) sections 39 and 205.

Marginal note:Terminal operators

 Terminal operators referred to in paragraph 212(a) of the Regulations are exempted until December 31, 2020 from the application of the following provisions of the Regulations:

  • (a) section 9;

  • (b) subsection 10(2);

  • (c) sections 15 to 23;

  • (d) section 216; and

  • (e) subsections 227(1), (2) and (3).
