International Joint Commission Immunity Order

FOREIGN MISSIONS AND INTERNATIONAL ORGANIZATIONS ACT
Order Respecting the Immunities of the International Joint Commission
Short Title
1 This Order may be cited as the International Joint Commission Immunity Order.
Interpretation
2 In this Order,
- Convention
Convention means the Convention on the Privileges and Immunities of the United Nations; (Convention)
- Organization
Organization means the International Joint Commission created pursuant to the 1909 Boundary Water Treaty. (Organisation)

Immunity
3 The Organization shall have in Canada, to such extent as may be required for the performance of its functions, immunity from every form of legal process except in so far as in any particular case it has expressly waived its immunity.
3.1 The Commissioners and members of the staff of the Organization shall have immunity in Canada from every form of legal process in respect of words spoken or written and all acts performed by them in their official capacity, as set out in Article V of the Convention, except in so far as in any particular case they have expressly waived their immunity.

3.2 The experts performing missions for the Organization shall, to such extent as may be necessary for the independant exercise of their functions, have immunity in Canada from every form of legal process in respect of words spoken or written and all acts done by them in the course of performing their missions, as set out in Article VI of the Convention, except in so far as in any particular case they have expressly waived their immunity.

4 Nothing in this Order extends immunity to the Organization in respect of judicial proceeding commenced before the making of this Order.
