Regulations Respecting Measures to Give Effect to the Resolution of the Security Council of the United Nations Concerning Rwanda

His Excellency the Governor General in Council, on the recommendation of the Secretary of State for External Affairs, pursuant to sections 2 and 3 of the United Nations Act, is pleased hereby to make the annexed Regulations respecting measures to give effect to the Resolution of the Security Council of the United Nations concerning Rwanda.
Short Title
1 These Regulations may be cited as the United Nations Rwanda Regulations.
Interpretation
2 In these Regulations,
- aircraft
aircraft includes a helicopter; (aéronef)
- arms or related materials
arms or related materials means any type of weapon, ammunition, military vehicle, military equipment or paramilitary police equipment, and includes any spare parts therefor; (armes et matériel connexe)
- Canadian
Canadian means an individual who is a citizen within the meaning of the Citizenship Act or a body corporate incorporated by or continued under the laws of Canada or a province; (Canadien)
- Canadian ship
Canadian ship has the same meaning as in section 2 of the Canada Shipping Act; (navire canadien)
- Committee of the Security Council
Committee of the Security Council means the Committee of the Security Council of the United Nations established by the Security Council Resolution; (Comité du Conseil de sécurité)
- person
person means an individual, a body corporate, a trust, a partnership, a fund, an unincorporated association or organization or a foreign state; (personne)
- Rwanda
Rwanda means the Rwandese Republic, and includes
(a) any political subdivision of Rwanda,
(b) the government, and any department, of Rwanda or of a political subdivision of Rwanda, and
(c) any agency of Rwanda or of a political subdivision of Rwanda; (Rwanda)
- Security Council Resolution
Security Council Resolution means Resolution 918 (1994) of the Security Council of the United Nations, adopted May 17, 1994; (résolution du Conseil de sécurité)
- UNAMIR
UNAMIR means the United Nations Assistance Mission for Rwanda; (MINUAR)
- UNOMUR
UNOMUR means the United Nations Observation Mission in Uganda and Rwanda. (MONUOR)
Application
3 These Regulations are binding on her Majesty in right of Canada or a province.
Prohibitions
4 No person in Canada and no Canadian outside Canada shall knowingly export, sell, supply or ship arms or related materials, wherever situated, to any person in Rwanda.
5 No owner or master of a Canadian ship and no operator of an aircraft registered in Canada or operated under a Canadian air service licence shall knowingly carry or cause to be carried, or permit to be carried, arms or related materials destined for any person in Rwanda.
6 No person in Canada and no Canadian outside Canada shall knowingly do anything that causes, assists or promotes, or is intended to cause, assist or promote, any act or thing prohibited by sections 4 and 5.
Exclusions
7 Articles 4 to 6 do not apply in respect of activities related to UNAMIR or UNOMUR.
Punishments
8 Subject to section 9, the punishment for the contravention of any of sections 4 to 6 is
(a) on summary conviction, a fine of two hundred dollars or imprisonment for a term of three months, or both; or
(b) on conviction on indictment, a fine of five thousand dollars or imprisonment for a term of five years, or both.
9 No person is subject to a punishment pursuant to section 8 for doing any act or thing that may be prohibited by these Regulations if, before that person does that act or thing, the Secretary of State for External Affairs issues a certificate to the person stating that, in the opinion of the Secretary of State for External Affairs,
(a) the Security Council Resolution does not intend that such an act or thing be prohibited; or
(b) such an act or thing has been approved by the Security Council of the United Nations or by the Committee of the Security Council.
