Regulations Naming Persons to a Roster of Candidates for Selection to, and Providing for the Appointment of Members of, Extraordinary Challenge Committees and Special Committees Under Chapter Nineteen of the North American Free Trade Agreement

Whereas, pursuant to paragraphs 4 and 5 of Article 1905 and paragraph 1 of Annex 1904.13 to Chapter Nineteen of the North American Free Trade Agreement, the parties to that Agreement have consulted in developing a roster of persons to serve as members of extraordinary challenge committees and special committees;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of International Trade and the Minister of Finance, pursuant to section 77.018Footnote *, subsection 77.023(2)* and paragraphs 77.035(c)* and (d)* of the Special Import Measures Act, is pleased hereby to make the annexed Regulations naming persons to a roster of candidates for selection to, and providing for the appointment of members of, extraordinary challenge committees and special committees under Chapter Nineteen of the North American Free Trade Agreement.

Short Title
1 These Regulations may be cited as the Members of Committees and Special Commitees (NAFTA) Regulations.
Interpretation
2 In these Regulations,
- committee roster
committee roster means the roster established pursuant to paragraph 1 of Annex 1904.13 to Chapter Nineteen of the North American Free Trade Agreement. (liste des candidats)
Committee Roster
3 For the purposes of paragraph 1 of Annex 1904.13 to Chapter 19 of the North American Free Trade Agreement, the persons listed in the schedule are named to the committee roster as candidates for selection to serve during good behaviour on committees and special committees for a period of five years, commencing on the day on which this section comes into force.

Appointment of Members of Committees and Special Committees
4 Where, pursuant to paragraph 1 of Annex 1904.13 to Chapter Nineteen of the North American Free Trade Agreement, a person is to be selected by Canada to serve as a member of a committee or special committee, the person shall be selected from the committee roster by a board that
(a) is chaired by the Minister; and
(b) includes the Minister of Finance and such other ministers of the Queen’s Privy Council for Canada as may from time to time be designated by the Prime Minister for that purpose.
5 Where a person has been selected pursuant to section 4 to serve as a member of a committee or special committee, the Minister shall appoint the person to serve as a member of that committee.
