28 (1) Section 27 does not apply in respect of a roe herring gill net that is marked by means of a roe herring gill net licence validation tab issued pursuant to the Pacific Fishery Regulations, 1993.

(2) Where a roe herring gill net is marked as set out in subsection (1), no person shall set, operate or leave unattended in the water that net unless the validation tab is legible and readily visible at all times without the necessity of raising the net from the water.
