Regulations Respecting the Stabilization of the Price of Winter Pears Grown and Marketed In 1976

His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture and the Treasury Board, pursuant to section 2, paragraph 8.2(1)(b), subsection 9(1), paragraph 10(1)(b) and section 11 of the Agricultural Stabilization Act, is pleased hereby to make the annexed Regulations respecting the stabilization of the price of winter pears grown and marketed in 1976.

Short Title

 These Regulations may be cited as the Winter Pears Stabilization Regulations.

Interpretation

 In these Regulations,

Act

Act means the Agricultural Stabilization Act; (version anglaise seulement)

producer

producer means a person residing in Canada and producing winter pears; (producteur)

winter pears

winter pears means pears grown in Canada in 1976 and marketed on or before March 31, 1977 other than summer pears in respect of which payments have been or may be made pursuant to the Summer Pears Stabilization Regulations. (poires d’hiver)

Designated Commodity

 Winter pears are hereby designated as an agricultural commodity for the purposes of the Agricultural Stabilization Act.

Prescribed Price

 The prescribed price for winter pears shall be the aggregate of

  • (a) 90 per cent of the base price thereof; and

  • (b) the index applicable thereto calculated in the manner set out in the Production Cost Index Regulations.

Payment to Producers

 The amount to be paid by the Board under paragraph 10(1)(b) of the Act in respect of winter pears is 4.2 cents per pound of winter pears grown in the Province of British Columbia for which no payment has been made pursuant to the Summer Pears Stabilization Regulations and is payable to producers in that Province.

Prescribed Period

 Payments made pursuant to section 5 shall be made during the period commencing on the date of the coming into force of these Regulations and terminating on the 7th day of November, 1978.
