Order Respecting the Withdrawal from Disposal of Certain Lands (Ukkusiksalik National Park, Nunavut)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands Act, hereby makes the annexed Order Respecting the Withdrawal from Disposal of Certain Lands (Ukkusiksalik National Park, Nunavut).

Purpose

 The purpose of this Order is to withdraw certain lands from disposal in order to establish the Ukkusiksalik National Park in Nunavut.

Lands Withdrawn from Disposal

 Subject to section 3, the tracts of territorial lands set out in the schedule, including the surface and subsurface rights to the lands, are withdrawn from disposal for the period beginning on the day on which this Order is made and ending on October 1, 2009.

Existing Rights and Interests

 For greater certainty, section 2 does not apply to

  • (a) the locating of a mineral claim by the holder of a prospecting permit granted before the day on which this Order is made;

  • (b) the recording of a mineral claim referred to in paragraph (a) or that was located before the day on which this Order is made;

  • (c) the granting of a lease under the Canada Mining Regulations to a person with a recorded claim if the lease covers an area within the recorded claim;

  • (d) the issuance of a significant discovery licence under the Canada Petroleum Resources Act to a holder of an exploration licence that was issued before the day on which this Order is made if the significant discovery licence covers an area subject to the exploration licence;

  • (e) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of a significant discovery licence referred to in paragraph (d) if the production licence covers an area subject to the significant discovery licence;

  • (f) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before the day on which this Order is made if the production licence covers an area subject to the exploration licence or the significant discovery licence;

  • (g) the granting of a surface lease under the Territorial Lands Act to a holder of a recorded claim under the Canada Mining Regulations or of an interest under the Canada Petroleum Resources Act if the surface lease is required to allow the holder to exercise rights under the claim or interest; or

  • (h) the renewal of an interest.

In Nunavut;

Adjacent to Roes Welcome Sound in Hudson Bay;

All that parcel including Wager Bay, in the vicinity of Roes Welcome Sound, more properly described as follows: All coordinates are referred to the North American Datum 1983.

Commencing at a point on the ordinary low water mark of the western shoreline of Roes Welcome Sound at latitude 65°10′53″ and approximate longitude 86°58′23″; (1)

Thence southwesterly to a point at latitude 65°10′21″ and longitude 86°59′51″; (2)

Thence westerly to a point at latitude 65°09′50″ and longitude 87°05′02″; (3)

Thence southwesterly to a point at latitude 65°07′05″ and longitude 87°17′01″; (4)

Thence southwesterly to a point at latitude 65°01′00″ and longitude 87°33′17″; (5)

Thence westerly to a point at latitude 65°01′37″ and longitude 87°54′45″; (6)

Saving and excepting therefrom and reserving thereout Inuit Owned Land Parcel RE-32 as shown on a plan recorded in the Canada Lands Surveys Records at Ottawa as 81597, a copy of which is filed in the Land Titles Office at Iqaluit as 3271;

Including all shoals, islands, sandbars and spits that may be periodically exposed at low tide;

Including all mines and minerals, including hydrocarbons, whether solid, liquid or gaseous, and rights to work the same; and

Including any substances or materials that may be disposed of pursuant to the Territorial Quarrying Regulations.

Said Ukkusiksalik National Park of Canada containing an area of approximately 20 558 km2.
