Canada Turkey Marketing Levies Order

FARM PRODUCTS AGENCIES ACT

Order Providing for the Fixing and Imposing of Turkey Marketing Levies and for the Collection of Those Levies

Short Title

 This Order may be cited as the Canada Turkey Marketing Levies Order.

Interpretation

 In this Order,

Agency

Agency means the Canadian Turkey Marketing Agency; (Office)

Commodity Board

Commodity Board means in respect of the Province of

  • (a) Nova Scotia, the Nova Scotia Turkey Marketing Board,

  • (b) Quebec, the Fédération des producteurs de volailles du Québec,

  • (c) Ontario, The Ontario Turkey Producers’ Marketing Board,

  • (d) Manitoba, The Manitoba Turkey Producers’ Marketing Board,

  • (e) Saskatchewan, the Saskatchewan Turkey Producers’ Marketing Board,

  • (f) Alberta, the Alberta Turkey Growers’ Marketing Board,

  • (g) British Columbia, the British Columbia Turkey Marketing Board,

  • (h) New Brunswick, the New Brunswick Turkey Marketing Board; (Office de commercialisation)

Plan

Plan means the marketing plan the terms of which are set out in Part II of the schedule to the Canadian Turkey Marketing Agency Proclamation; (Plan)

processor

processor means any person engaged in the slaughtering of turkeys; (transformateur)

producer

producer means any person engaged in the production of turkeys in the regulated area; (producteur)

regulated area

regulated area means the Provinces of Nova Scotia, New Brunswick, Quebec, Ontario, Manitoba, Saskatchewan, Alberta and British Columbia; (région réglementée)

turkey

turkey means a turkey of any variety, grade or class. (dindon)

Levies

  •  (1) Each producer shall pay, on each kilogram live weight of turkey marketed by that producer in interprovincial or export trade, a levy of

    • (a) in the Province of Ontario, 2.9 cents;

    • (b) in the Province of Quebec, 4.07 cents;

    • (c) in the Province of Nova Scotia, 6.75 cents;

    • (d) in the Province of New Brunswick, 3 cents;

    • (e) in the Province of Manitoba, 4.25 cents;

    • (f) in the Province of British Columbia, 4.75 cents;

    • (g) in the Province of Saskatchewan, 4.6 cents; and

    • (h) in the Province of Alberta, 4.3 cents.

  • (2) The levy imposed by subsection (1) shall, where the turkeys are sold or otherwise disposed of

    • (a) to a person who is not a processor, be paid by the producer; or

    • (b) to a processor, be collected by the processor to whom they are delivered, by the deduction by him of the amount of the levy from the moneys payable by him to that producer for the turkeys.

  • (3) The levies referred to in subsection (2) shall be paid by the producer or processor to the Commodity Board in the province in which the producer is engaged in the production of turkeys at such address and at such times as the Commodity Board may direct.

Commodity Boards

 The Commodity Board for each province having concurred, the Agency, pursuant to subsection 10(4) of the Plan, hereby appoints each such Commodity Board to collect on behalf of the Agency the levies imposed by section 3 of this Order on the producers in that province.

 The Commodity Board for each province shall pay all of the levies received pursuant to subsection 3(3) to the Agency not later than the last day of the month in which the levies are received by the Commodity Board.

 This Order ceases to have effect on December 31, 2002.
