Version of section 63 from 2026-01-01 to 2026-03-17:

  •  (1) To determine whether a person is the spouse, common-law partner, child or parent of an applicant, contributor or other person subject to a division or whether a person is deceased, the Minister must use

    • (a) any information or evidence obtained under subsections (2) to (4);

    • (b) any information made available to the Minister by the Canada Employment Insurance Commission under subsection 28.2(5) of the Department of Employment and Social Development Act; or

    • (c) any other information that the Minister may obtain.

  • (2) The applicant or beneficiary must furnish the Minister with any certificate of marriage, birth, baptism or death, a copy of any such document, or a copy of any act of marriage, birth, baptism or death, as the case may be, that may enable the Minister to make a determination referred to in subsection (1).

  • (3) If there are reasonable grounds to doubt the validity of the copy of a document referred to in subsection (2), the Minister may require that the original of the document or, if applicable, the copy of the act issued by the competent authority be furnished.

  • (4) For the purposes of subsection (1), if none of the documents referred to in subsection (2) are available or adequate, the applicant or beneficiary must, at the Minister’s request, furnish the Minister with any other information or evidence that is available respecting their relationship with the person referred to in subsection (1).
