Regulations Respecting the Sheltered Employment of Veterans and Other Persons
Short Title
1 These Regulations may be cited as the Vetcraft Shops Regulations.
Interpretation
2 In these Regulations,
- overtime
overtime means the time worked by a worker in excess of 40 hours in a week; (surtemps)
- vetcraft shop
vetcraft shop means a sheltered employment workshop operated by the Minister; (atelier d’anciens combattants)
- worker
worker means a person employed on an hourly basis in a vetcraft shop. (travailleur)
Rate of Pay
3 A worker in a vetcraft shop shall be paid at an hourly rate recommended by the Minister and approved by the Treasury Board.
4 A worker shall be paid for each completed hour of overtime at a rate equal to 1 1/2 times the rate of normal pay that would be payable to him for that work if it had been performed during normal working hours.
Holidays
5 (1) Subject to subsection 2, the following days shall be holidays with pay for workers:
(a) New Year’s Day;
(b) Good Friday;
(c) Easter Monday;
(d) the Queen’s Birthday, the first Monday immediately preceding May 25th;
(e) Dominion Day;
(f) Labour Day;
(g) Thanksgiving Day, the second Monday in October;
(h) Remembrance Day;
(i) Christmas Day; and
(j) one other holiday to be selected by the Deputy Minister from among the remaining holidays observed in the area of employment.
(2) Where New Year’s Day, Dominion Day, Remembrance Day or Christmas Day falls on a Saturday or Sunday, it shall not be a holiday with pay, but the next following Monday shall be a holiday with pay.
Annual Leave
6 (1) Every worker who has been a worker for six months or more shall be granted, in respect of each fiscal year, annual vacation leave with pay.
(2) The number of days of annual vacation leave that shall be granted to a worker pursuant to subsection (1) in respect of a fiscal year shall be determined as follows:
(a) where the worker has been a worker for 15 years or less, 1 day of leave for each 200 working hours (other than overtime hours) for which the worker has been paid during the fiscal year; and
(b) where the worker has been a worker for more than 15 years, 1 1/2 days leave for each 200 working hours (other than overtime hours) for which the worker has been paid during the fiscal year.
Sick Leave
7 (1) Subject to subsection (3), where the manager of a vetcraft shop is satisfied that a worker employed in the shop is unable, by reason of his illness or injury, to perform his duties, the manager may grant leave of absence with pay (hereinafter in these Regulations referred to as sick leave) to the worker for such number of days as he considers necessary, but the total number of days sick leave granted to the worker shall not exceed
(a) the number of such days that the worker has earned in accordance with subsection (2),
minus
(b) the number of such days that have been previously granted to the worker pursuant to this subsection.
(2) Every worker shall earn sick leave at the rate of 1 day for each 200 working hours (other than overtime hours) for which the worker has been paid, except that the worker shall not earn any sick leave at any time when
(a) the number of days of sick leave that he has earned,
minus
(b) the number of days of sick leave granted to him pursuant to subsection (1),
equals 65.
(3) The manager of a vetcraft shop may, where he considers it necessary or advisable, require as a condition of granting sick leave that the worker who is seeking the grant of such leave obtain from a qualified medical practitioner a certificate stating that the worker was unable, by reason of his illness or injury, to perform his duties during the period for which he seeks the grant of sick leave.
Special Leave
8 (1) Where a member of the immediate family of a worker dies, the manager of the vetcraft shop in which the worker is employed may grant special leave with pay to the worker for a period not exceeding three days, but the amount of such special leave granted to the worker in a fiscal year shall not exceed six days.
(2) In this section, immediate family in relation to a worker means the husband or wife of the worker, any child, parent, foster parent, brother or sister of the worker and any other relative of the worker
(a) who ordinarily resided with the worker, or
(b) with whom the worker ordinarily resided,
at the time of the death of such relative.
Severance Pay
9 Where a worker ceases to be employed in a vetcraft shop, he may be granted severance pay in an amount not exceeding the amount obtained by multiplying
(a) the number of working hours represented by the number of days of earned and unused sick leave standing to his credit on the day that he ceases to be employed,
by
(b) his hourly rate of pay on that day.
10 Where a worker who has been a worker continuously for a period of at least 30 days, but for less than six months, ceases to be a worker, he shall be paid an amount equal to four per cent of the amount of pay earned by him during the period that he was a worker.
General
11 A worker shall, while in receipt of pay from the Department of Veterans Affairs, be deemed to be an employee in the service of Her Majesty within the meaning of and for the purposes of the Government Employees Compensation Act.
12 The Minister may, where he deems it necessary, supplement the production of workers in the workshops operated by him by contracting for work to be done outside such shops on a piece-work basis at a rate of pay to be determined by him.
13 A worker who lives in Montreal or vicinity and works at the vetcraft shop at Ste. Anne’s Hospital may be paid a transportation allowance at the rate of $0.03 per mile for the distance, as determined by the Minister, between the boundary of the community in which he resides and the vetcraft shop, less five miles each way, up to a maximum distance of 30 miles each day.
