lims:id="464281">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2018-12-13" lims:fid="464282" lims:id="464282"><Label>(1)</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2019-07-29" lims:enacted-date="2017-06-22" lims:fid="1192386" lims:id="1192386"><Text><DefinedTermEn>Board</DefinedTermEn> means the Canada Industrial Relations Board established by section 9 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>. (<DefinedTermFr>Conseil</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-12-13" lims:fid="464283" lims:id="464283"><Text><DefinedTermEn>eligible wages</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2018-12-13" lims:fid="464284" lims:id="464284"><Label>(a)</Label><Text>wages other than termination pay and severance pay that were earned during the longer of the following periods:</Text><Subparagraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="464285" lims:id="1328198"><Label>(i)</Label><Text>the six-month period ending on the date of the bankruptcy or the first day on which there was a receiver in relation to the former employer,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-12-13" lims:fid="464286" lims:id="464286"><Label>(ii)</Label><Text>the period beginning on the day that is six months before one of the following days and ending on the date of the bankruptcy or the first day on which there was a receiver in relation to the former employer:</Text><Clause lims:inforce-start-date="2018-12-13" lims:fid="464287" lims:id="464287"><Label>(A)</Label><Text>the day on which a proposal is filed by or in respect of the employer under Division I of Part III of the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal> or, if a notice of intention to make a proposal is filed by or in respect of the employer under that Division, the day on which the notice of intention is filed,</Text></Clause><Clause lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="464288" lims:id="1328199"><Label>(B)</Label><Text>the day on which the most recent proceedings under the <XRefExternal reference-type="act" link="C-36">Companies’ Creditors Arrangement Act</XRefExternal> are commenced, and</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328195" lims:id="1328195"><Label>(iii)</Label><Text>the period beginning on the day that is six months before one of the following days and ending on the day on which a court makes a determination under subsection 5(5):</Text><Clause lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328196" lims:id="1328196"><Label>(A)</Label><Text>the day on which a proposal is filed by or in respect of the employer under Division I of Part III of the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal> or, if a notice of intention to make a proposal is filed by or in respect of the employer under that Division, the day on which the notice of intention is filed,</Text></Clause><Clause lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328197" lims:id="1328197"><Label>(B)</Label><Text>the day on which the most recent proceedings under the <XRefExternal reference-type="act" link="C-36">Companies’ Creditors Arrangement Act</XRefExternal> are commenced; and</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-12-13" lims:fid="464289" lims:id="464289"><Label>(b)</Label><Text>termination pay and severance pay that relate to employment that ended</Text><Subparagraph lims:inforce-start-date="2018-12-13" lims:fid="464290" lims:id="464290"><Label>(i)</Label><Text>during the period referred to in paragraph (a), or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-12-13" lims:fid="464291" lims:id="464291"><Label>(ii)</Label><Text>during the period beginning on the day after the day on which the period referred to in paragraph (a) ends and ending on the day on which the trustee is discharged or the receiver completes their duties, as the case may be. (<DefinedTermFr>salaire admissible</DefinedTermFr>)</Text></Subparagraph></Paragraph></Definition><Definition lims:inforce-start-date="2018-12-13" lims:fid="464292" lims:id="464292"><Text><DefinedTermEn>wages</DefinedTermEn> includes salaries, commissions, compensation for services rendered, vacation pay, termination pay, severance pay and any other amounts prescribed by regulation. (<DefinedTermFr>salaire</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2018-12-13" lims:fid="464293" lims:id="464293"><MarginalNote lims:inforce-start-date="2018-12-13" lims:fid="464294" lims:id="464294">Precision</MarginalNote><Label>(1.1)</Label><Text>For the purpose of the definition <DefinitionRef>eligible wages</DefinitionRef>, a proposal does not include a proposal for which a certificate is given under section 65.3 of the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal> and a notice of intention to make a proposal does not include a notice of intention in respect of a proposal for which such a certificate is given.</Text></Subsection><Subsection lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328200" lims:id="1328200"><MarginalNote lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328201" lims:id="1328201">Meaning of <DefinitionRef>trustee</DefinitionRef></MarginalNote><Label>(1.2)</Label><Text>In this Act, <DefinedTermEn>trustee</DefinedTermEn> includes a <DefinitionRef>monitor</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-36">Companies’ Creditors Arrangement Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2018-12-13" lims:fid="464295" lims:id="464295"><MarginalNote lims:inforce-start-date="2018-12-13" lims:fid="464296" lims:id="464296">Employers subject to a receivership</MarginalNote><Label>(2)</Label><Text>For the purposes of this Act, an employer is subject to a receivership when any property of the employer is under the possession or control of a receiver.</Text></Subsection><Subsection lims:inforce-start-date="2018-12-13" lims:fid="464297" lims:id="464297"><MarginalNote lims:inforce-start-date="2018-12-13" lims:fid="464298" lims:id="464298">Meaning of <DefinitionRef>receiver</DefinitionRef></MarginalNote><Label>(3)</Label><Text>In this Act, <DefinedTermEn>receiver</DefinedTermEn> means a receiver within the meaning of subsection 243(2) of the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2018-12-13" lims:fid="464299" lims:id="464299"><MarginalNote lims:inforce-start-date="2018-12-13" lims:fid="464300" lims:id="464300">Words and expressions</MarginalNote><Label>(4)</Label><Text>Unless otherwise provided, words and expressions used in this Act have the same meaning as in the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2018-12-13" lims:fid="464301" lims:id="464301"><MarginalNote lims:inforce-start-date="2018-12-13" lims:fid="464302" lims:id="464302">Related persons</MarginalNote><Label>(5)</Label><Text>Despite subsection 4(5) of the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal>,</Text><Paragraph lims:inforce-start-date="2018-12-13" lims:fid="464303" lims:id="464303"><Label>(a)</Label><Text>for the purposes of paragraph 6(d), an individual is considered to deal at arm’s length with a related person if the Minister is satisfied that, having regard to the circumstances — including the terms and conditions of the individual’s employment with the former employer, their remuneration and the duration, nature and importance of the work performed for the former employer — it is reasonable to conclude that the individual would have entered into a substantially similar contract of employment with the former employer if they had been dealing with each other at arm’s length; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-13" lims:fid="464304" lims:id="464304"><Label>(b)</Label><Text>for the purposes of subsection 21(4), individuals who are related to each other are, in the absence of evidence to the contrary, deemed not Payments</TitleText></Heading><Section lims:inforce-start-date="2009-03-12" lims:lastAmendedDate="2021-11-20" lims:fid="464314" lims:id="464314"><MarginalNote lims:inforce-start-date="2009-03-12" lims:fid="464315" lims:id="464315">Conditions of eligibility</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328213" lims:id="1328213"><Label>(1)</Label><Text>An individual is eligible to receive a payment if</Text><Paragraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328214" lims:id="1328214"><Label>(a)</Label><Text>the individual’s employment ended for a reason prescribed by regulation;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328215" lims:id="1328215"><Label>(b)</Label><Text>one of the following applies:</Text><Subparagraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328216" lims:id="1328216"><Label>(i)</Label><Text>the former employer is bankrupt,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328217" lims:id="1328217"><Label>(ii)</Label><Text>the former employer is subject to a receivership,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328218" lims:id="1328218"><Label>(iii)</Label><Text>the former employer is the subject of a foreign proceeding that is recognized by a court under subsection 270(1) of the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal> and</Text><Clause lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328219" lims:id="1328219"><Label>(A)</Label><Text>the court determines under subsection (2) that the foreign proceeding meets the criteria prescribed by regulation, and</Text></Clause><Clause lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328220" lims:id="1328220"><Label>(B)</Label><Text>a trustee is appointed, or</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328221" lims:id="1328221"><Label>(iv)</Label><Text>the former employer is the subject of proceedings under Division I of Part III of the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal> or under the <XRefExternal reference-type="act" link="C-36">Companies’ Creditors Arrangement Act</XRefExternal> and a court determines under subsection (5) that the criteria prescribed by regulation are met; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328222" lims:id="1328222"><Label>(c)</Label><Text>the individual is owed eligible wages by the former employer.</Text></Paragraph><Paragraph lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328223" lims:id="1328223"><Label>(d)</Label><Text><Repealed>[Repealed, 2009, c. 2, s. 343]</Repealed></Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328224" lims:id="1328224"><MarginalNote lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328225" lims:id="1328225">Prescribed criteria — foreign proceeding</MarginalNote><Label>(2)</Label><Text>On application by any person, a court may, in a proceeding under Part XIII of the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal>, determine that the foreign proceeding meets the criteria prescribed by regulation. If the court determines that the foreign proceeding meets the prescribed criteria, the court may appoint a trustee for the purposes of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328226" lims:id="1328226"><MarginalNote lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328227" lims:id="1328227">Employment in Canada</MarginalNote><Label>(3)</Label><Text>An individual who is eligible to receive a payment because of subparagraph (1)(b)(iii) is only eligible to receive a payment in respect of eligible wages earned for employment in Canada and termination pay and severance pay that relate to that employment.</Text></Subsection><Subsection lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328228" lims:id="1328228"><MarginalNote lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328229" lims:id="1328229">Deemed bankruptcy</MarginalNote><Label>(4)</Label><Text>For the purposes of this Act, if all of the conditions set out in subparagraph (1)(b)(iii) are met, the former employer is deemed to be bankrupt and the date of the bankruptcy is deemed to be the day on which all of those conditions are met.</Text></Subsection><Subsection lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328230" lims:id="1328230"><MarginalNote lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328231" lims:id="1328231">Prescribed criteria — other proceedings</MarginalNote><Label>(5)</Label><Text>On application by any person, a court may, in proceedings under Division I of Part III of the <XRefExternal reference-type="act" link="B-3">Bankruptcy and Insolvency Act</XRefExternal> or under the <XRefExternal reference-type="act" link="C-36">Companies’ Creditors Arrangement Act</XRefExternal>, determine that the former employer meets the criteria prescribed by regulation.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-03-12" lims:fid="464321" lims:id="464321">2005, c. 47, s. 1 “5”; 2007, c. 36, s. 84; 2009, c. 2, s. 343</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2021-11-20" lims:enacted-date="2018-12-13" lims:fid="1328232" lims:id="1328232" lims:enactId="1040868">2018, c. 27, s. 629</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-12-13" lims:lastAmendedDate="2018-12-13" lims:fid="464322" lims:id="464322"><MarginalNote lims:inforce-start-date="2018-12-13" lims:fid="464323" lims:id="464323">Exceptions</MarginalNote><Label>6</Label><Text>An individual is not eligible to receive a payment in respect of any wages earned during, or that otherwise relate to, a period in which the individual</Text><Paragraph lims:inforce-start-date="2018-12-13" lims:fid="464324" lims:id="464324"><Label>(a)</Label><Text>was an officer or director of the former employer;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-13" lims:fid="464325" lims:id="464325"><Label>(b)</Label><Text>had a controlling interest within the meaning of the regulations in the business of the former employer;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-13" lims:fid="464326" lims:id="464326"><Label>(c)</Label><Text>occupied a managerial position within the meaning of the regulations with the former employer; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-12-13" lims:fid="464327" lims:id="464327"><Label>(d)</Label><Text>was not dealing at arm’s length with</Text><Subparagraph lims:inforce-start-date="2018-12-13" lims:fid="464328" lims:id="464328"><Label>(i)</Label><Text>an officer or director of the former employer,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-12-13" lims:fid="464329" lims:id="464329"><Label>(ii)</Label><Text>a person who had a controlling interest within the meaning of the regulations in the business of the former employer, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-12-13" lims:fid="464330" lims:id="464330"><Label>(iii)</Label><Text>an individual who occupied a managerial position within the meaning of the regulations with the former employer.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-12-13" lims:fid="464332" lims:id="464332">2005, c. 47, s. 1 “6”; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464440" lims:id="464440"><Label>(c)</Label><Text>require any person to provide an affidavit or a statutory declaration attesting to the truth of any information provided by the person.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-07-07" lims:fid="464441" lims:id="464441"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464442" lims:id="464442">Taking oaths, etc.</MarginalNote><Label>(2)</Label><Text>Any person, if designated by the Minister for the purpose, may administer oaths and take and receive affidavits, statutory declarations and solemn affirmations for the purpose of or incidental to the administration of this Act. Every person so designated has, with respect to any such oath, affidavit, declaration or affirmation, all the powers of a commissioner for administering oaths or taking affidavits.</Text></Subsection><Subsection lims:inforce-start-date="2008-07-07" lims:fid="464443" lims:id="464443"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464444" lims:id="464444">Acceptance of oaths, etc.</MarginalNote><Label>(3)</Label><Text>The Minister may, for the purposes of administering this Act, accept any oath administered or any affidavit, statutory declaration or solemn affirmation taken or received by any person who has the powers of a commissioner for taking affidavits and who is an officer or employee of</Text><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464445" lims:id="464445"><Label>(a)</Label><Text>a department or other portion of the federal public administration specified in any of Schedules I, IV and V to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464446" lims:id="464446"><Label>(b)</Label><Text>a department of the government of a province.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2008-07-07" lims:lastAmendedDate="2008-07-07" lims:fid="464447" lims:id="464447"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464448" lims:id="464448">Inspections</MarginalNote><Label>25</Label><Subsection lims:inforce-start-date="2008-07-07" lims:fid="464449" lims:id="464449"><Label>(1)</Label><Text>A person designated by the Minister for the purpose may, at any reasonable time, enter any place in which he or she reasonably believes there is any information or document relevant to the administration of this Act and may, in that place,</Text><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464450" lims:id="464450"><Label>(a)</Label><Text>inspect any books, records, electronic data or other documents that he or she reasonably believes may contain information that is relevant to the administration of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464451" lims:id="464451"><Label>(b)</Label><Text>use or cause to be used any computer system to examine any data contained in or available to the computer system;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464452" lims:id="464452"><Label>(c)</Label><Text>reproduce or cause to be reproduced any record from the data in the form of a print-out or other intelligible output;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464453" lims:id="464453"><Label>(d)</Label><Text>take any document or other thing from the place for examination or, in the case of a document, for copying; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464454" lims:id="464454"><Label>(e)</Label><Text>use or cause to be used any copying equipment to make copies of any documents.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-07-07" lims:fid="464455" lims:id="464455"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464456" lims:id="464456">Prior authorization</MarginalNote><Label>(2)</Label><Text>If any place referred to in subsection (1) is a dwelling-house, the designated person may not enter the dwelling-house without the consent of the occupant, except under the authority of a warrant issued under subsection (3).</Text></Subsection><Subsection lims:inforce-start-date="2008-07-07" lims:fid="464457" lims:id="464457"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464458" lims:id="464458">Warrant to enter dwelling-house</MarginalNote><Label>(3)</Label><Text>A judge may issue a warrant authorizing the designated person to enter a dwelling-house subject to the conditions specified in the warrant if, on <Language xml:lang="la">ex parte</Language> application, the judge is satisfied by information on oath that</Text><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464459" lims:id="464459"><Label>(a)</Label><Text>there are reasonable grounds to believe that the dwelling-house is a place referred to in subsection (1);</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464460" lims:id="464460"><Label>(b)</Label><Text>entry into the dwelling-house is necessary for any purpose related to the administration of this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464461" lims:id="464461"><Label>(c)</Label><Text>entry into the dwelling-house has been, or there are reasonable grounds to believe that entry will be, refused.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-07-07" lims:fid="464462" lims:id="464462"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464463" lims:id="464463">Orders if entry not authorized</MarginalNote><Label>(4)</Label><Text>If the judge is not satisfied that entry into the dwelling-house is necessary for any purpose related to the administration of this Act, the judge may, to the extent that access was or may be expected to be refused and that information or documents are or may be expected to be kept in the dwelling-house,</Text><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464464" lims:id="464464"><Label>(a)</Label><Text>order the occupant of the dwelling-house to provide the Minister, or a person designated by the Minister for the purpose, with reasonable access to any information or document that is or should be kept in the dwelling-house; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464465" lims:id="464465"><Label>(b)</Label><Text>make any other order that is appropriate in the circumstances to carry out the purposes of this Act.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2008-07-07" lims:lastAmendedDate="2008-07-07" lims:fid="464466" lims:id="464466"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464467" lims:id="464467">Duty to assist</MarginalNote><Label>26</Label><Text>The owner or person in charge of a place that is entered by the designated person and every person found there must</Text><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464468" lims:id="464468"><Label>(a)</Label><Text>give the designated person all reasonable assistance to enable him or her to exercise his or her powers and perform his or her duties; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-07" lims:fid="464469" lims:id="464469"><Label>(b)</Label><Text>provide the designated person with any information relevant to the administration of this Act that he or she requires.</Text></Paragraph></Section><Section lims:id="464483"><Label>(1)</Label><Text>Subject to subsections (2) to (4), the Minister may, on his or her initiative, conduct an audit of any application for payment under this Act.</Text></Subsection><Subsection lims:inforce-start-date="2008-07-07" lims:fid="464484" lims:id="464484"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464485" lims:id="464485">Applications with payment</MarginalNote><Label>(2)</Label><Text>An audit of an application in respect of which a payment was made may be conducted at any time within three years after the day on which the payment was made.</Text></Subsection><Subsection lims:inforce-start-date="2008-07-07" lims:fid="464486" lims:id="464486"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464487" lims:id="464487">Exception</MarginalNote><Label>(3)</Label><Text>If the Minister has reasonable grounds to believe that a payment was made on the basis of any false or misleading information, an audit of the application in respect of which the payment was made may be conducted at any time within six years after the payment was made.</Text></Subsection><Subsection lims:inforce-start-date="2008-07-07" lims:fid="464488" lims:id="464488"><MarginalNote lims:inforce-start-date="2008-07-07" lims:fid="464489" lims:id="464489">Other applications</MarginalNote><Label>(4)</Label><Text>An audit of an application in respect of which no payment was made may be conducted at any time within three years after the day on which the applicant was sent a notice informing the applicant that he or she was not eligible to receive a payment.</Text></Subsection></Section><Section lims:inforce-start-date="2018-12-13" writing, of any action or other proceeding, other than the one in respect of which the individual received the payment, to recover eligible wages, including an action or other proceeding that is commenced by another person or organization and of which the individual is aware. The notice shall contain any information prescribed by regulation.</Text></Subsection><Subsection lims:inforce-start-date="2018-12-13" lims:fid="464574" lims:id="464574"><MarginalNote lims:inforce-start-date="2018-12-13" lims:fid="464575" lims:id="464575">Notice to Minister — decision or order</MarginalNote><Label>(1.2)</Label><Text>Unless the Minister directs otherwise, an individual who received a payment under this Act shall also notify the Minister, in writing, of any final decision or order, of which they are aware, respecting the recovery of eligible wages.
