V-1, s. 3; 2000, c. 34, s. 94(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2011-12-15" lims:fid="463849" lims:id="463849" level="1"><TitleText>Powers, Duties and Functions of the Minister</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="463850" lims:id="463850"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="463851" lims:id="463851">Powers, duties and functions of Minister</MarginalNote><Label>4</Label><Text>The powers, duties and functions of the Minister extend and apply to</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="463852" lims:id="463852"><Label>(a)</Label><Text>the administration of such Acts of Parliament, and of such orders of the Governor in Council, as are not by law assigned to any other department of the Government of Canada or any Minister thereof, relating to</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="463853" lims:id="463853"><Label>(i)</Label><Text>the care, treatment or re-establishment in civil life of any person who served in the Canadian Forces or merchant navy or in the naval, army or air forces or merchant navies of Her Majesty, of any person who has otherwise engaged in pursuits relating to war, and of any other person designated by the Governor in Council, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="463854" lims:id="463854"><Label>(ii)</Label><Text>the care of the dependants or survivors of any person referred to in subparagraph (i); and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="463855" lims:id="463855"><Label>(b)</Label><Text>all such other matters and such boards and other bodies, subjects, services and properties of the Crown as may be designated, or assigned to the Minister, by the Governor in Council.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="463857" lims:id="463857">R.S., 1985, c. any property and moneys that are conveyed to the Minister for the benefit of a class or subclass of persons referred to in subparagraph 4(a)(i) or (ii), on such terms and conditions as are set out in lims:inforce-start-date="2018-04-01" lims:fid="463864" lims:id="463864">Regulations</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="463865" lims:id="463865"><Label /><Text>The Governor in Council may make regulations</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463866" lims:id="463866"><Label>(a)</Label><Text>specifying the persons or classes of persons, from within those referred to in subparagraphs 4(a)(i) and (ii), who are entitled to any or all of the care, treatment or other benefits authorized by regulations made under this section, and respecting the circumstances in which a person may receive any such care, treatment or other benefit;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463867" lims:id="463867"><Label>(b)</Label><Text><Repealed>[Repealed, 2017, c. 20, s. 291]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463868" lims:id="463868"><Label>(c)</Label><Text>respecting the care, treatment or other benefits to be provided or that the Minister will pay for in whole or in part, the circumstances in which the Minister will pay in whole or in part and the circumstances in which the Minister may cease to pay in whole or in part;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463869" lims:id="463869"><Label>(c.1)</Label><Text>respecting</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463870" lims:id="463870"><Label>(i)</Label><Text>the circumstances in which a person is required to make payments in respect of all or part of the cost of accommodation and meals in a hospital, home or other institution,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463871" lims:id="463871"><Label>(ii)</Label><Text>the calculation of the payments referred to in subparagraph (i), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463872" lims:id="463872"><Label>(iii)</Label><Text>the method and arrangement for making the payments referred to in subparagraph (i);</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463873" lims:id="463873"><Label>(d)</Label><Text>for the receipt and retention of any properties or moneys held or payable by the Crown or any other authority, person or persons on behalf of any persons or their dependants whenever such persons are being or have been cared for under the provisions of this Act, either by medical treatment, training or otherwise, and for giving therefor a valid receipt, and in the case of insane persons who are being or have been so cared for under this Act, the assumption or authorization of guardianship in whole or in part in respect of such properties or moneys, and for the disposal of such properties or moneys to such persons or their dependants, or as may be deemed expedient or the disposal thereof to the estates of such persons if deceased;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463874" lims:id="463874"><Label>(e)</Label><Text>respecting payments, grants or allowances to be made to persons and their dependants and survivors whenever such persons are receiving or have received care, treatment or other benefits under</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463875" lims:id="463875"><Label>(i)</Label><Text>regulations made under this section, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463876" lims:id="463876"><Label>(ii)</Label><Text>any other enactment that incorporates by reference regulations made under this section;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463877" lims:id="463877"><Label>(e.1)</Label><Text>respecting occasional financial assistance to be given to persons and their dependants and survivors to meet emergencies or unexpected financial contingencies or to relieve financial distress;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463878" lims:id="463878"><Label>(f)</Label><Text>with respect to reciprocal or other arrangements with the government of any country for</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463879" lims:id="463879"><Label>(i)</Label><Text>the care, treatment and other benefits for persons who have served in the naval, army or air forces or merchant navy of any such government,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463880" lims:id="463880"><Label>(ii)</Label><Text>the issue of payments, grants or allowances to the persons mentioned in subparagraph (i) and their dependents and survivors,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463881" lims:id="463881"><Label>(iii)</Label><Text>the assumption or authorization of guardianship in respect of properties or moneys of the persons mentioned in subparagraph (i) or of any persons who may be the beneficiaries of any of the said governments and the dependants of such persons, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463882" lims:id="463882"><Label>(iv)</Label><Text>the disposal of the properties or moneys contemplated in subparagraph (iii) to the persons therein mentioned or to the estates of those persons if deceased;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463883" lims:id="463883"><Label>(g)</Label><Text>for furnishing persons with the following benefits:</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463884" lims:id="463884"><Label>(i)</Label><Text>free transportation in Canada, in the case of a person pensioned for total blindness or for a disability necessitating an escort when travelling, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463885" lims:id="463885"><Label>(ii)</Label><Text>the treatment of persons classified as wholly incurable, or chronically recurrent cases needing institutional care;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463886" lims:id="463886"><Label>(g.1)</Label><Text>for providing, maintaining and replacing gravemarkers and for providing financial assistance towards the expenses of last sickness, funeral, burial and cremation, in respect of a person, in cases where</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463887" lims:id="463887"><Label>(i)</Label><Text>the death of the person was caused wholly or in part by a disability in respect of which an award was payable under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> or under any enactment incorporating that Act by reference,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-06-21" lims:fid="463888" lims:id="1121252"><Label>(i.1)</Label><Text>the person died of an injury or a disease for which a disability award, pain and suffering compensation or a death benefit was payable under the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463889" lims:id="463889"><Label>(ii)</Label><Text>the person was, at the time of death, in receipt of care or treatment in respect of a disability described in subparagraph (i),</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463890" lims:id="463890"><Label>(iii)</Label><Text>there are insufficient funds, as determined under the regulations, for the person’s funeral, burial or cremation, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463891" lims:id="463891"><Label>(iv)</Label><Text>another department or agency of the Government of Canada, or the government of another country, requests the Department to provide any gravemarker, service or assistance referred to in this paragraph and agrees in writing to reimburse the Department for the cost;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463892" lims:id="463892"><Label>(g.2)</Label><Text>for determining what constitutes insufficient funds for the purposes of subparagraph (g.1)(iii);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463893" lims:id="463893"><Label>(g.3)</Label><Text>respecting procedures and terms and conditions relating to the provision of any gravemarker, service or assistance referred to in paragraph (g.1);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463894" lims:id="463894"><Label>(g.4)</Label><Text>establishing standards relating to any gravemarker, service or assistance referred to in paragraph (g.1);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463895" lims:id="463895"><Label>(g.5)</Label><Text>authorizing the Minister to establish, subject to any regulation made under paragraph (g.4), standards relating to any gravemarker, service or assistance referred to in paragraph (g.1);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463896" lims:id="463896"><Label>(g.6)</Label><Text>providing for the Minister to enter into agreements with any body under which that body undertakes to administer the provision of any or all gravemarkers, services or assistance referred to in paragraph (g.1);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463897" lims:id="463897"><Label>(g.7)</Label><Text>respecting matters that must be included in agreements referred to in paragraph (g.6);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463898" lims:id="463898"><Label>(h)</Label><Text>respecting</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463899" lims:id="463899"><Label>(i)</Label><Text>the provision of benefits, similar to those provided under regulations made under paragraphs (b) to (g.7) or to those provided under Acts and orders referred to in paragraph 4(a), to persons who were employees or agents of the Government of Canada during World War II as that war is defined in subsection 3(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, and to their dependants and survivors, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="463900" lims:id="463900"><Label>(ii)</Label><Text>the application of any of the provisions of the Acts and orders referred to in paragraph 4(a) to those benefits, persons, dependants and survivors; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463901" lims:id="463901"><Label>(i)</Label><Text><Repealed>[Repealed, 2000, c. 34, s. 13]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="463902" lims:id="463902"><Label>(j)</Label><Text>for the purpose of carrying out the provisions of this Act with respect to any matter placed under the control and management of the or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="463917" lims:id="463917"><Label>(b)</Label><Text>if a payment was paid to a person in respect of that period that was in excess of the amount of the payment to which the person was entitled under the regulations made under section 5, the amount of that excess.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="463918" lims:id="463918"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="463919" lims:id="463919">Recovery of overpayments</MarginalNote><Label>(2)</Label><Text>If, through any cause, an overpayment is paid to a person, the overpayment is a debt due to Her Majesty by that person or by that person’s estate or succession, and</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="463920" lims:id="463920"><Label>(a)</Label><Text>may be recovered by deduction from any future payments made under the regulations made under section 5 to that person or to that person’s estate or succession;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="463921" lims:id="463921"><Label>(b)</Label><Text>may be recovered in accordance with section 155 of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>;
