harmonious and cooperative relations based on the principles of justice, democracy, respect for human rights, non-discrimination and good faith;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301550" lims:id="1301550" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the rights and principles affirmed in the Declaration constitute the minimum standards for the survival, dignity and well-being of Indigenous peoples of the world, and must be implemented in Canada;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301551" lims:id="1301551" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas, in the outcome document of the high-level plenary meeting of the General Assembly of the United Nations known as the World Conference on Indigenous Peoples, Canada and other States reaffirm their solemn commitment to respect, promote and advance the rights of Indigenous peoples of the world and to uphold the principles of the Declaration;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301552" lims:id="1301552" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas, in its document entitled <Emphasis style="italic">Calls to Action</Emphasis>, the Truth and Reconciliation Commission of Canada calls upon federal, provincial, territorial and municipal governments to fully adopt and implement the Declaration as the framework for reconciliation, and the Government of Canada is committed to responding to those Calls to Action;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301553" lims:id="1301553" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas, in its document entitled <Emphasis style="italic">Calls for Justice</Emphasis>, the National Inquiry into Missing and Murdered Indigenous Women and Girls calls upon federal, provincial, territorial, municipal and Indigenous governments to implement the Declaration, and the Government of Canada is committed to responding to those Calls for Justice;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301554" lims:id="1301554" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas First Nations, Inuit and the Métis Nation have, throughout history and to this day, lived in the lands that are now in Canada with their distinct identities, cultures and ways of life;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301555" lims:id="1301555" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas Indigenous peoples have suffered historic injustices as a result of, among other things, colonization and dispossession of their lands, territories and resources;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301556" lims:id="1301556" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the implementation of the Declaration must include concrete measures to address injustices, combat prejudice and eliminate all forms of violence, racism and discrimination, including systemic racism and discrimination, against Indigenous peoples and Indigenous elders, youth, children, women, men, persons with disabilities and gender-diverse persons and two-spirit persons;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301557" lims:id="1301557" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas all doctrines, policies and practices based on or advocating the superiority of peoples or individuals on the basis of national origin or racial, religious, ethnic or cultural differences, including the doctrines of discovery and <Language xml:lang="la">terra nullius</Language>, are racist, scientifically false, legally invalid, morally condemnable and socially unjust;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301558" lims:id="1301558" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada rejects all forms of colonialism and is committed to advancing relations with Indigenous peoples that are based on good faith and on the principles of justice, democracy, equality, non-discrimination, good governance and respect for human rights;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301559" lims:id="1301559" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Declaration emphasizes the urgent need to respect and promote the inherent rights of Indigenous peoples of the world which derive from their political, economic and social structures and from their cultures, spiritual traditions, histories, philosophies and legal systems, especially their rights to their lands, territories and resources;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301560" lims:id="1301560" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada recognizes that all relations with Indigenous peoples must be based on the recognition and implementation of the inherent right to self-determination, including the right of self-government;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301561" lims:id="1301561" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada is committed to taking effective measures — including legislative, policy and administrative measures — at the national and international level, in consultation and cooperation with Indigenous peoples, to achieve the objectives of the Declaration;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301562" lims:id="1301562" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada is committed to exploring, in consultation and cooperation with Indigenous peoples, measures related to monitoring, oversight, recourse or remedy or other accountability measures that will contribute to the achievement of those objectives;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301563" lims:id="1301563" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the implementation of the Declaration can contribute to supporting sustainable development and responding to growing concerns relating to climate change and its impacts on Indigenous peoples;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301564" lims:id="1301564" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada acknowledges that provincial, territorial and municipal governments each have the ability to establish their own approaches to contributing to the implementation of the Declaration by taking various measures that fall within their authority;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301565" lims:id="1301565" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada welcomes opportunities to work cooperatively with those governments, Indigenous peoples and other sectors of society towards achieving the objectives of the Declaration;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301566" lims:id="1301566" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Declaration is affirmed as a source for the interpretation of Canadian law;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301567" lims:id="1301567" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the protection of Aboriginal and treaty rights — recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal> — is an underlying principle and value of the Constitution of Canada, and Canadian courts have stated that such rights are not frozen and are capable of evolution and growth;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301568" lims:id="1301568" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas there is an urgent need to respect and promote the rights of Indigenous peoples affirmed in treaties, agreements and other constructive arrangements, and those treaties, agreements and arrangements can contribute to the implementation of the Declaration;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301569" lims:id="1301569" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas respect for human rights, the rule of law and democracy are underlying principles of the Constitution of Canada which are interrelated, interdependent and mutually reinforcing and are also recognized in international law;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301570" lims:id="1301570" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And whereas measures to implement the Declaration in Canada must take into account the diversity of Indigenous peoples and, in particular, the diversity of the identities, cultures, languages, customs, practices, rights and legal traditions of First Nations, Inuit and the Métis and of their institutions and governance structures, their relationships to the land and Indigenous knowledge;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301571" lims:id="1301571"><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301572" lims:id="1301572" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2021-06-21" cited as the <XRefExternal reference-type="act" link="U-2.2">United Nations Declaration on the Rights of Indigenous Peoples Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301577" lims:id="1301577" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:lastAmendedDate="2024-11-27" lims:fid="1301578" lims:id="1301578"><MarginalNote lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301579" lims:id="1301579">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301580" lims:id="1301580"><Label>(1)</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301581" lims:id="1301581"><Text><DefinedTermEn>Declaration</DefinedTermEn> means the United Nations Declaration on the Rights of Indigenous Peoples that was adopted by the General Assembly of the United Nations as General Assembly Resolution 61/295 on September 13, 2007 and that is set out in the schedule. (<DefinedTermFr>Déclaration</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301582" lims:id="1301582"><Text><DefinedTermEn>Indigenous peoples</DefinedTermEn> has the meaning assigned by the definition <DefinitionRef>aboriginal peoples of Canada</DefinitionRef> in subsection 35(2) of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>. (<DefinedTermFr>peuples autochtones</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301583" lims:id="1301583"><Text><DefinedTermEn>Minister</DefinedTermEn>, for the purposes of any provision of this Act, means the federal minister designated as the Minister for the purposes of that provision Declaration</TitleText></Heading><Section lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:lastAmendedDate="2021-06-21" lims:fid="1301597" lims:id="1301597"><MarginalNote lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301598" lims:id="1301598">Consistency</MarginalNote><Label>5</Label><Text>The Government of Canada must, in consultation and cooperation with Indigenous peoples, take all measures necessary to ensure that the laws of Canada are consistent with the Declaration.</Text></Section><Section must include</Text><Paragraph lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301604" lims:id="1301604"><Label>(a)</Label><Text>measures to</Text><Subparagraph lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301605" lims:id="1301605"><Label>(i)</Label><Text>address injustices, combat prejudice and eliminate all forms of violence, racism and discrimination, including systemic racism and discrimination, against Indigenous peoples and Indigenous elders, youth, children, women, men, persons with disabilities and elements</MarginalNote><Label>(3)</Label><Text>The action plan must also include measures related to monitoring the implementation of the plan and reviewing and amending the format-ref="indent-0-0" language-align="no" list-item="no"><Text><Emphasis style="italic">Believing</Emphasis> that this Declaration is a further important step forward for the recognition, promotion and protection of the rights and freedoms of indigenous peoples and in the development of relevant activities of the United Nations system in this field,</Text></Provision><Provision lims:id="1301669" format-ref="group4"><TitleText><Emphasis style="italic">Article 3</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301670" lims:id="1301670" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples have the right to self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301671" lims:id="1301671" format-ref="group4"><TitleText><Emphasis style="italic">Article 4</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301672" lims:id="1301672" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples, in exercising their right to self-determination, have the right to autonomy or self-government in matters relating to their internal and local affairs, as well as ways and means for financing their autonomous functions.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301673" lims:id="1301673" format-ref="group4"><TitleText><Emphasis style="italic">Article 5</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301674" lims:id="1301674" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples have the right to maintain and strengthen their distinct political, legal, economic, social and cultural institutions, while retaining their right to participate fully, if they so choose, in the political, economic, social and cultural life of the State.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301675" lims:id="1301675" format-ref="group4"><TitleText><Emphasis style="italic">Article 6</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301676" lims:id="1301676" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Every indigenous individual has the right to a nationality.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301677" lims:id="1301677" format-ref="group4"><TitleText><Emphasis style="italic">Article 7</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301678" lims:id="1301678" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous individuals have the rights to life, physical and mental integrity, liberty and security of person.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301679" lims:id="1301679" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>Indigenous peoples have the collective right to live in freedom, peace and security as distinct peoples and shall not be subjected to any act of genocide or any other act of violence, including forcibly removing children of the group to another group.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301680" lims:id="1301680" format-ref="group4"><TitleText><Emphasis style="italic">Article 8</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301681" lims:id="1301681" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples and individuals have the right not to be subjected to forced assimilation or destruction of their culture.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301682" lims:id="1301682" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall provide effective mechanisms for prevention of, and redress for:</Text><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301683" lims:id="1301683" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>Any action which has the aim or effect of depriving them of their integrity as distinct peoples, or of their cultural values or ethnic identities;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301684" lims:id="1301684" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>Any action which has the aim or effect of dispossessing them of their lands, territories or resources;</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301685" lims:id="1301685" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>Any form of lims:enacted-date="2021-06-21" lims:fid="1301688" lims:id="1301688" format-ref="group4"><TitleText><Emphasis style="italic">Article 9</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301689" lims:id="1301689" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples and individuals have the right to belong to an indigenous community or nation, in accordance with the traditions and customs of the community or nation concerned. No discrimination of any kind may arise from the exercise of such a right.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301690" lims:id="1301690" format-ref="group4"><TitleText><Emphasis style="italic">Article 10</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301691" lims:id="1301691" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples shall not be forcibly removed from their lands or territories. No relocation shall take place without the free, prior and informed consent of the indigenous peoples concerned and after agreement on just and fair compensation and, where possible, with the option of return.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301692" lims:id="1301692" format-ref="group4"><TitleText><Emphasis style="italic">Article 11</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301693" lims:id="1301693" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to practise and revitalize their cultural traditions and customs. This includes the right to maintain, protect and develop the past, present and future manifestations of their cultures, such as archaeological and historical sites, artefacts, designs, ceremonies, technologies and visual and performing arts and literature.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301694" lims:id="1301694" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall provide redress through effective mechanisms, which may include restitution, developed in conjunction with indigenous peoples, with respect to their cultural, intellectual, religious and spiritual property taken without their free, prior and informed consent or in violation of their laws, traditions and customs.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301695" lims:id="1301695" format-ref="group4"><TitleText><Emphasis style="italic">Article 12</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301696" lims:id="1301696" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to manifest, practise, develop and teach their spiritual and religious traditions, customs and ceremonies; the right to maintain, protect, and have access in privacy to their religious and cultural sites; the right to the use and control of their ceremonial objects; and the right to the repatriation of their human remains.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301697" lims:id="1301697" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall seek to enable the access and/or repatriation of ceremonial objects and human remains in their possession through fair, transparent and effective mechanisms developed in conjunction with indigenous peoples concerned.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301698" lims:id="1301698" format-ref="group4"><TitleText><Emphasis style="italic">Article 13</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301699" lims:id="1301699" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to revitalize, use, develop and transmit to future generations their histories, languages, oral traditions, philosophies, writing systems and literatures, and to designate and retain their own names for communities, places and persons.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301700" lims:id="1301700" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall take effective measures to ensure that this right is protected and also to ensure that indigenous peoples can understand and be understood in political, legal and administrative proceedings, where necessary through the provision of interpretation or by other appropriate means.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301701" lims:id="1301701" format-ref="group4"><TitleText><Emphasis style="italic">Article 14</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301702" lims:id="1301702" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to establish and control their educational systems and institutions providing education in their own languages, in a manner appropriate to their cultural methods of teaching and learning.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301703" lims:id="1301703" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>Indigenous individuals, particularly children, have the right to all levels and forms of education of the State without discrimination.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301704" lims:id="1301704" format-ref="indent-0-0" language-align="no" list-item="no"><Label>3.</Label><Text>States shall, in conjunction with indigenous peoples, take effective measures, in order for indigenous individuals, particularly children, including those living outside their communities, to have access, when possible, to an education in their own culture and provided in their own language.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301705" lims:id="1301705" format-ref="group4"><TitleText><Emphasis style="italic">Article 15</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301706" lims:id="1301706" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to the dignity and diversity of their cultures, traditions, histories and aspirations which shall be appropriately reflected in education and public information.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301707" lims:id="1301707" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall take effective measures, in consultation and cooperation with the indigenous peoples concerned, to combat prejudice and eliminate discrimination and to promote tolerance, understanding and good relations among indigenous peoples and all other segments of society.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301708" lims:id="1301708" format-ref="group4"><TitleText><Emphasis style="italic">Article 16</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301709" lims:id="1301709" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to establish their own media in their own languages and to have access to all forms of non-indigenous media without discrimination.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301710" lims:id="1301710" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall take effective measures to ensure that State-owned media duly reflect indigenous cultural diversity. States, without prejudice to ensuring full freedom of expression, should encourage privately owned media to adequately reflect indigenous cultural diversity.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301711" lims:id="1301711" format-ref="group4"><TitleText><Emphasis style="italic">Article 17</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301712" lims:id="1301712" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous individuals and peoples have the right to enjoy fully all rights established under applicable international and domestic labour law.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301713" lims:id="1301713" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall in consultation and cooperation with indigenous peoples take specific measures to protect indigenous children from economic exploitation and from performing any work that is likely to be hazardous or to interfere with the child’s education, or to be harmful to the child’s health or physical, mental, spiritual, moral or social development, taking into account their special vulnerability and the importance of education for their empowerment.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301714" lims:id="1301714" format-ref="indent-0-0" language-align="no" list-item="no"><Label>3.</Label><Text>Indigenous individuals have the right not to be subjected to any discriminatory conditions of labour and, inter alia, employment or salary.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301715" lims:id="1301715" format-ref="group4"><TitleText><Emphasis style="italic">Article 18</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301716" lims:id="1301716" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples have the right to participate in decision-making in matters which would affect their rights, through representatives chosen by themselves in accordance with their own procedures, as well as to maintain and develop their own indigenous decision-making institutions.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301717" lims:id="1301717" format-ref="group4"><TitleText><Emphasis style="italic">Article 19</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301718" lims:id="1301718" format-ref="indent-0-0" language-align="no" list-item="no"><Text>States shall consult and cooperate in good faith with the indigenous peoples concerned through their own representative institutions in order to obtain their free, prior and informed consent before adopting and implementing legislative or administrative measures that may affect them.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301719" lims:id="1301719" format-ref="group4"><TitleText><Emphasis style="italic">Article 20</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301720" lims:id="1301720" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to maintain and develop their political, economic and social systems or institutions, to be secure in the enjoyment of their own means of subsistence and development, and to engage freely in all their traditional and other economic activities.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301721" lims:id="1301721" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>Indigenous peoples deprived of their means of subsistence and development are entitled to just and fair redress.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301722" lims:id="1301722" format-ref="group4"><TitleText><Emphasis style="italic">Article 21</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301723" lims:id="1301723" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right, without discrimination, to the improvement of their economic and social conditions, including, inter alia, in the areas of education, employment, vocational training and retraining, housing, sanitation, health and social security.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301724" lims:id="1301724" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall take effective measures and, where appropriate, special measures to ensure continuing improvement of their economic and social conditions. Particular attention shall be paid to the rights and special needs of indigenous elders, women, youth, children and persons with disabilities.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301725" lims:id="1301725" format-ref="group4"><TitleText><Emphasis style="italic">Article 22</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301726" lims:id="1301726" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Particular attention shall be paid to the rights and special needs of indigenous elders, women, youth, children and persons with disabilities in the implementation of this Declaration.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301727" lims:id="1301727" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall take measures, in conjunction with indigenous peoples, to ensure that indigenous women and children enjoy the full protection and guarantees against all forms of violence and discrimination.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301728" lims:id="1301728" format-ref="group4"><TitleText><Emphasis style="italic">Article 23</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301729" lims:id="1301729" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples have the right to determine and develop priorities and strategies for exercising their right to development. In particular, indigenous peoples have the right to be actively involved in developing and determining health, housing and other economic and social programmes affecting them and, as far as possible, to administer such programmes through their own institutions.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301730" lims:id="1301730" format-ref="group4"><TitleText><Emphasis style="italic">Article 24</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301731" lims:id="1301731" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to their traditional medicines and to maintain their health practices, including the conservation of their vital medicinal plants, animals and minerals. Indigenous individuals also have the right to access, without any discrimination, to all social and health services.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301732" lims:id="1301732" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>Indigenous individuals have an equal right to the enjoyment of the highest attainable standard of physical and mental health. States shall take the necessary steps with a view to achieving progressively the full realization of this right.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301733" lims:id="1301733" format-ref="group4"><TitleText><Emphasis style="italic">Article 25</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301734" lims:id="1301734" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples have the right to maintain and strengthen their distinctive spiritual relationship with their traditionally owned or otherwise occupied and used lands, territories, waters and coastal seas and other resources and to uphold their responsibilities to future generations in this regard.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301735" lims:id="1301735" format-ref="group4"><TitleText><Emphasis style="italic">Article 26</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301736" lims:id="1301736" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to the lands, territories and resources which they have traditionally owned, occupied or otherwise used or acquired.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301737" lims:id="1301737" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>Indigenous peoples have the right to own, use, develop and control the lands, territories and resources that they possess by reason of traditional ownership or other traditional occupation or use, as well as those which they have otherwise acquired.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301738" lims:id="1301738" format-ref="indent-0-0" language-align="no" list-item="no"><Label>3.</Label><Text>States shall give legal recognition and protection to these lands, territories and resources. Such recognition shall be conducted with due respect to the customs, traditions and land tenure systems of the indigenous peoples concerned.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301739" lims:id="1301739" format-ref="group4"><TitleText><Emphasis style="italic">Article 27</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301740" lims:id="1301740" format-ref="indent-0-0" language-align="no" list-item="no"><Text>States shall establish and implement, in conjunction with indigenous peoples concerned, a fair, independent, impartial, open and transparent process, giving due recognition to indigenous peoples’ laws, traditions, customs and land tenure systems, to recognize and adjudicate the rights of indigenous peoples pertaining to their lands, territories and resources, including those which were traditionally owned or otherwise occupied or used. Indigenous peoples shall have the right to participate in this process.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301741" lims:id="1301741" format-ref="group4"><TitleText><Emphasis style="italic">Article 28</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301742" lims:id="1301742" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to redress, by means that can include restitution or, when this is not possible, just, fair and equitable compensation, for the lands, territories and resources which they have traditionally owned or otherwise occupied or used, and which have been confiscated, taken, occupied, used or damaged without their free, prior and informed consent.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301743" lims:id="1301743" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>Unless otherwise freely agreed upon by the peoples concerned, compensation shall take the form of lands, territories and resources equal in quality, size and legal status or of monetary compensation or other appropriate redress.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301744" lims:id="1301744" format-ref="group4"><TitleText><Emphasis style="italic">Article 29</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301745" lims:id="1301745" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to the conservation and protection of the environment and the productive capacity of their lands or territories and resources. States shall establish and implement assistance programmes for indigenous peoples for such conservation and protection, without discrimination.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301746" lims:id="1301746" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall take effective measures to ensure that no storage or disposal of hazardous materials shall take place in the lands or territories of indigenous peoples without their free, prior and informed consent.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301747" lims:id="1301747" format-ref="indent-0-0" language-align="no" list-item="no"><Label>3.</Label><Text>States shall also take effective measures to ensure, as needed, that programmes for monitoring, maintaining and restoring the health of indigenous peoples, as developed and implemented by the peoples affected by such materials, are duly implemented.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301748" lims:id="1301748" format-ref="group4"><TitleText><Emphasis style="italic">Article 30</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301749" lims:id="1301749" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Military activities shall not take place in the lands or territories of indigenous peoples, unless justified by a relevant public interest or otherwise freely agreed with or requested by the indigenous peoples concerned.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301750" lims:id="1301750" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall undertake effective consultations with the indigenous peoples concerned, through appropriate procedures and in particular through their representative institutions, prior to using their lands or territories for military activities.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301751" lims:id="1301751" format-ref="group4"><TitleText><Emphasis style="italic">Article 31</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301752" lims:id="1301752" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to maintain, control, protect and develop their cultural heritage, traditional knowledge and traditional cultural expressions, as well as the manifestations of their sciences, technologies and cultures, including human and genetic resources, seeds, medicines, knowledge of the properties of fauna and flora, oral traditions, literatures, designs, sports and traditional games and visual and performing arts. They also have the right to maintain, control, protect and develop their intellectual property over such cultural heritage, traditional knowledge, and traditional cultural expressions.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301753" lims:id="1301753" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>In conjunction with indigenous peoples, States shall take effective measures to recognize and protect the exercise of these rights.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301754" lims:id="1301754" format-ref="group4"><TitleText><Emphasis style="italic">Article 32</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301755" lims:id="1301755" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to determine and develop priorities and strategies for the development or use of their lands or territories and other resources.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301756" lims:id="1301756" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States shall consult and cooperate in good faith with the indigenous peoples concerned through their own representative institutions in order to obtain their free and informed consent prior to the approval of any project affecting their lands or territories and other resources, particularly in connection with the development, utilization or exploitation of mineral, water or other resources.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301757" lims:id="1301757" format-ref="indent-0-0" language-align="no" list-item="no"><Label>3.</Label><Text>States shall provide effective mechanisms for just and fair redress for any such activities, and appropriate measures shall be taken to mitigate adverse environmental, economic, social, cultural or spiritual impact.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301758" lims:id="1301758" format-ref="group4"><TitleText><Emphasis style="italic">Article 33</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301759" lims:id="1301759" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to determine their own identity or membership in accordance with their customs and traditions. This does not impair the right of indigenous individuals to obtain citizenship of the States in which they live.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301760" lims:id="1301760" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>Indigenous peoples have the right to determine the structures and to select the membership of their institutions in accordance with their own procedures.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301761" lims:id="1301761" format-ref="group4"><TitleText><Emphasis style="italic">Article 34</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301762" lims:id="1301762" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples have the right to promote, develop and maintain their institutional structures and their distinctive customs, spirituality, traditions, procedures, practices and, in the cases where they exist, juridical systems or customs, in accordance with international human rights standards.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301763" lims:id="1301763" format-ref="group4"><TitleText><Emphasis style="italic">Article 35</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301764" lims:id="1301764" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples have the right to determine the responsibilities of individuals to their communities.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301765" lims:id="1301765" format-ref="group4"><TitleText><Emphasis style="italic">Article 36</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301766" lims:id="1301766" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples, in particular those divided by international borders, have the right to maintain and develop contacts, relations and cooperation, including activities for spiritual, cultural, political, economic and social purposes, with their own members as well as other peoples across borders.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301767" lims:id="1301767" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>States, in consultation and cooperation with indigenous peoples, shall take effective measures to facilitate the exercise and ensure the implementation of this right.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301768" lims:id="1301768" format-ref="group4"><TitleText><Emphasis style="italic">Article 37</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301769" lims:id="1301769" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Indigenous peoples have the right to the recognition, observance and enforcement of treaties, agreements and other constructive arrangements concluded with States or their successors and to have States honour and respect such treaties, agreements and other constructive arrangements.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301770" lims:id="1301770" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>Nothing in this Declaration may be interpreted as diminishing or eliminating the rights of indigenous peoples contained in treaties, agreements and other constructive arrangements.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301771" lims:id="1301771" format-ref="group4"><TitleText><Emphasis style="italic">Article 38</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301772" lims:id="1301772" format-ref="indent-0-0" language-align="no" list-item="no"><Text>States, in consultation and cooperation with indigenous peoples, shall take the appropriate measures, including legislative measures, to achieve the ends of this Declaration.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301773" lims:id="1301773" format-ref="group4"><TitleText><Emphasis style="italic">Article 39</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301774" lims:id="1301774" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples have the right to have access to financial and technical assistance from States and through international cooperation, for the enjoyment of the rights contained in this Declaration.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301775" lims:id="1301775" format-ref="group4"><TitleText><Emphasis style="italic">Article 40</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301776" lims:id="1301776" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Indigenous peoples have the right to access to and prompt decision through just and fair procedures for the resolution of conflicts and disputes with States or other parties, as well as to effective remedies for all infringements of their individual and collective rights. Such a decision shall give due consideration to the customs, traditions, rules and legal systems of the indigenous peoples concerned and international human rights.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301777" lims:id="1301777" format-ref="group4"><TitleText><Emphasis style="italic">Article 41</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301778" lims:id="1301778" format-ref="indent-0-0" language-align="no" list-item="no"><Text>The organs and specialized agencies of the United Nations system and other intergovernmental organizations shall contribute to the full realization of the provisions of this Declaration through the mobilization, inter alia, of financial cooperation and technical assistance. Ways and means of ensuring participation of indigenous peoples on issues affecting them shall be established.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301779" lims:id="1301779" format-ref="group4"><TitleText><Emphasis style="italic">Article 42</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301780" lims:id="1301780" format-ref="indent-0-0" language-align="no" list-item="no"><Text>The United Nations, its bodies, including the Permanent Forum on Indigenous Issues, and specialized agencies, including at the country level, and States shall promote respect for and full application of the provisions of this Declaration and follow up the effectiveness of this Declaration.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301781" lims:id="1301781" format-ref="group4"><TitleText><Emphasis style="italic">Article 43</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301782" lims:id="1301782" format-ref="indent-0-0" language-align="no" list-item="no"><Text>The rights recognized herein constitute the minimum standards for the survival, dignity and well-being of the indigenous peoples of the world.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301783" lims:id="1301783" format-ref="group4"><TitleText><Emphasis style="italic">Article 44</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301784" lims:id="1301784" format-ref="indent-0-0" language-align="no" list-item="no"><Text>All the rights and freedoms recognized herein are equally guaranteed to male and female indigenous individuals.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301785" lims:id="1301785" format-ref="group4"><TitleText><Emphasis style="italic">Article 45</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301786" lims:id="1301786" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Nothing in this Declaration may be construed as diminishing or extinguishing the rights indigenous peoples have now or may acquire in the future.</Text></Provision><GroupHeading lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301787" lims:id="1301787" format-ref="group4"><TitleText><Emphasis style="italic">Article 46</Emphasis></TitleText></GroupHeading><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301788" lims:id="1301788" format-ref="indent-0-0" language-align="no" list-item="no"><Label>1.</Label><Text>Nothing in this Declaration may be interpreted as implying for any State, people, group or person any right to engage in any activity or to perform any act contrary to the Charter of the United Nations or construed as authorizing or encouraging any action which would dismember or impair, totally or in part, the territorial integrity or political unity of sovereign and independent States.</Text></Provision><Provision lims:inforce-start-date="2021-06-21" lims:enacted-date="2021-06-21" lims:fid="1301789" lims:id="1301789" format-ref="indent-0-0" language-align="no" list-item="no"><Label>2.</Label><Text>In the exercise of the rights enunciated in the present Declaration, human rights and fundamental freedoms of all shall be respected. The exercise of the rights set forth in this Declaration shall be subject only to such limitations as are determined by law and in accordance with international human rights obligations.
