(<DefinedTermFr>quai d’approche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951294" lims:id="951294" generate-in-text="no"><Text><DefinedTermEn>boater campground</DefinedTermEn><Repealed>[Repealed, SOR/2015-134, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951295" lims:id="951295" generate-in-text="no"><Text><DefinedTermEn>campground</DefinedTermEn> means an area in a historic canal where the public is permitted to camp; (<DefinedTermFr>terrain de camping</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951296" lims:id="951296" generate-in-text="no"><Text><DefinedTermEn>commercial craft</DefinedTermEn> means a vessel that carries persons or goods for hire or reward or that is used to provide another service for hire or reward, and includes a vessel chartered or hired for the purpose of pleasure by or on behalf of the persons carried on the vessel; (<DefinedTermFr>embarcation commerciale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951297" lims:id="951297" generate-in-text="no"><Text><DefinedTermEn>cultural resource</DefinedTermEn> means any work of nature or of human hand that is primarily of interest for its palaeontological, archeological, historic, cultural, scientific or aesthetic value, and includes, but is not limited to, a palaeontological, archeological, historic or natural site, structure or object or any remains, restoration or reconstruction thereof; (<DefinedTermFr>ressource culturelle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951298" lims:id="951298" generate-in-text="no"><Text><DefinedTermEn>dredge</DefinedTermEn> means to remove, by digging, gathering, pulling out or otherwise removing, any material from a historic canal, particularly from water or wetlands, for the purpose of creating new channels or boat slips, making land, constructing or placing any in-water structures such as boat-houses, wharves or retaining walls, or maintaining previously dredged areas or openings to any upland mooring basins; (<DefinedTermFr>draguer</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951299" lims:id="951299" generate-in-text="no"><Text><DefinedTermEn>employee</DefinedTermEn> means a person appointed under the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal> to work at a historic canal; (<DefinedTermFr>employé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951300" lims:id="951300" generate-in-text="no"><Text><DefinedTermEn>fill</DefinedTermEn> means to place any material in water or wetlands for the purpose of making land, constructing wharves, stabilizing the shoreline, revetting or constructing works, building beaches or constructing foundations for boat-houses or other structures; (<DefinedTermFr>remblayer</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951301" lims:id="951301" generate-in-text="no"><Text><DefinedTermEn>historic canal</DefinedTermEn> means a canal set out in column I of Schedule I and includes the waters and any works or lands that belong to Canada and that are appertaining or incidental to the canal; (<DefinedTermFr>canal historique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951302" lims:id="951302" generate-in-text="no"><Text><DefinedTermEn>length</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="951303" lims:id="951303"><Label>(a)</Label><Text>in the case of a registered vessel, the length shown on the Certificate of Registry, and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="951304" lims:id="951304"><Label>(b)</Label><Text>in the case of any other vessel, the length from the fore part of the head of the stem to the after part of the head of the stern post; (<DefinedTermFr>longueur</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951305" lims:id="951305" generate-in-text="no"><Text><DefinedTermEn>lock</DefinedTermEn> includes a liftlock and a marine railway; (<DefinedTermFr>écluse</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951306" lims:id="951306" generate-in-text="no"><Text><DefinedTermEn>lying up</DefinedTermEn> means the continuous occupation by a vessel during the navigation season of an area in a historic canal designated for that purpose; (<DefinedTermFr>séjour</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951307" lims:id="951307" generate-in-text="no"><Text><DefinedTermEn>moor</DefinedTermEn> means to secure a vessel to a wharf, buoy or canal wall, or to another vessel that is so secured, and includes to beach, store or anchor a vessel; (<DefinedTermFr>amarrer</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951308" lims:id="951308" generate-in-text="no"><Text><DefinedTermEn>natural resource</DefinedTermEn> means any soil, sand, gravel, rock, mineral, fossil or other natural material, and includes flora; (<DefinedTermFr>ressource naturelle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951309" lims:id="951309" generate-in-text="no"><Text><DefinedTermEn>navigation channel</DefinedTermEn> means a navigable passage of water in a historic canal that is</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="951310" lims:id="951310"><Label>(a)</Label><Text>in the case of an artificial channel, delimited by the shoreline, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="951311" lims:id="951311"><Label>(b)</Label><Text>in any other case,</Text><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="951312" lims:id="951312"><Label>(i)</Label><Text>delimited by aids to navigation, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-02-13" lims:fid="951313" lims:id="951313"><Label>(ii)</Label><Text>where not delimited by aids to navigation, 15 m in width along each side of a line that indicates a navigation channel on Canadian Hydrographic Service charts; (<DefinedTermFr>chenal de navigation</DefinedTermFr>)</Text></Subparagraph></Paragraph></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951314" lims:id="951314" generate-in-text="no"><Text><DefinedTermEn>non-profit charitable organization</DefinedTermEn> means an organization that is operated for purposes other than profit, no part of the income of which is payable to or otherwise available for the personal benefit of any proprietor, member or shareholder of the organization; (<DefinedTermFr>organisme de bienfaisance sans but lucratif</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951315" lims:id="951315" generate-in-text="no"><Text><DefinedTermEn>owner</DefinedTermEn>, in respect of a vessel or vehicle, includes the authorized agent of the owner; (<DefinedTermFr>propriétaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951316" lims:id="951316" generate-in-text="no"><Text><DefinedTermEn>peace officer</DefinedTermEn> means a peace officer as defined in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>; (<DefinedTermFr>agent de la paix</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951317" lims:id="951317" generate-in-text="no"><Text><DefinedTermEn>person in charge</DefinedTermEn>, in respect of a vessel, means</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="951318" lims:id="951318"><Label>(a)</Label><Text>where the owner of the vessel is on board, the owner and the operator of the vessel, and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="951319" lims:id="951319"><Label>(b)</Label><Text>where the owner of the vessel is not on board, the operator of the vessel; (<DefinedTermFr>responsable</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951320" lims:id="951320" generate-in-text="no"><Text><DefinedTermEn>pleasure craft</DefinedTermEn> means a vessel other than a commercial craft; (<DefinedTermFr>embarcation de plaisance</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951321" lims:id="951321" generate-in-text="no"><Text><DefinedTermEn>possession</DefinedTermEn> has the same meaning as that term is given in subsection 4(3) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>; (<DefinedTermFr>possession</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951322" lims:id="951322" generate-in-text="no"><Text><DefinedTermEn>superintendent</DefinedTermEn> means a person appointed under the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal> who holds the office of superintendent and who has the responsibility for a historic canal, and includes any other person appointed under that Act who is authorized by that person to act on their behalf; (<DefinedTermFr>directeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951323" lims:id="951323" generate-in-text="no"><Text><DefinedTermEn>traffic control device</DefinedTermEn> means a sign, signal, marker or other device that regulates, warns or guides vessels, vehicles or pedestrians; (<DefinedTermFr>dispositif de réglementation de la circulation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951324" lims:id="951324" generate-in-text="no"><Text><DefinedTermEn>vessel</DefinedTermEn> means an amphibious craft, boat, canoe, air cushion vehicle, raft, ship, or other type of floating craft, and includes an aircraft while on the water, except when landing or taking off; (<DefinedTermFr>bâtiment</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951325" lims:id="951325" generate-in-text="no"><Text><DefinedTermEn>waste</DefinedTermEn> means an organic or inorganic waste material, but does not include</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="951326" lims:id="951326"><Label>(a)</Label><Text>liquid that is free of solids and is derived from water used on a pleasure craft for household purposes, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="951327" lims:id="951327"><Label>(b)</Label><Text>engine-cooling water and bilge water; (<DefinedTermFr>déchets</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2017-02-13" lims:fid="951328" lims:id="951328" generate-in-text="no"><Text><DefinedTermEn>wintering</DefinedTermEn> means the continuous occupation by a vessel during the non-navigation season of an area in a historic canal designated for that purpose. SOR/2017-21, s. 13(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951331" lims:id="951331" level="1"><Label>PART I</Label><TitleText>General</TitleText></Heading><Heading lims:inforce-start-date="2015-06-05" lims:fid="951332" lims:id="951332" level="2"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951333" lims:id="951333"><Label>3</Label><Text>Except as otherwise provided in Part V, these Regulations apply in respect of all historic canals and any person, goods, vehicle or vessel in the historic canals.</Text></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951334" lims:id="951334" level="2"><TitleText>Duties of the superintendent</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951336" lims:id="951336">SOR/2002-191, s. 5(E)</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951337" lims:id="951337"><Label>4</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951338" lims:id="951338"><Label>(1)</Label><Text>The superintendent shall, before issuing a permit under these Regulations authorizing the applicant to engage in an activity, and in order to determine the terms and conditions specified in a permit, take into account the effects of the activity on</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951339" lims:id="951339"><Label>(a)</Label><Text>cultural resources, natural resources, structures, equipment and objects in the historic canal;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951340" lims:id="951340"><Label>(b)</Label><Text>the safe navigation of vessels and the safe operation of locks, dams and bridges in the historic canal;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951341" lims:id="951341"><Label>(c)</Label><Text>the safety of persons in the historic canal;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951342" lims:id="951342"><Label>(d)</Label><Text>wildlife and the eggs and habitat of wildlife in the historic canal; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951343" lims:id="951343"><Label>(e)</Label><Text>the historic character of the historic canal.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951344" lims:id="951344"><Label>(2)</Label><Text>The superintendent may</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951345" lims:id="951345"><Label>(a)</Label><Text>post, in a historic canal, signs that are necessary to</Text><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951346" lims:id="951346"><Label>(i)</Label><Text>protect cultural resources, natural resources, structures, equipment and objects,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951347" lims:id="951347"><Label>(ii)</Label><Text>ensure the safe navigation of vessels and the safe operation of locks, dams and bridges,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951348" lims:id="951348"><Label>(iii)</Label><Text>ensure the safety of persons, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951349" lims:id="951349"><Label>(iv)</Label><Text>protect wildlife or the eggs or habitat of wildlife;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951350" lims:id="951350"><Label>(b)</Label><Text>close, restrict or open to public use any area in a historic canal for the purposes of</Text><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951351" lims:id="951351"><Label>(i)</Label><Text>ensuring the safe navigation of vessels and the safe operation of locks, dams and bridges,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951352" lims:id="951352"><Label>(ii)</Label><Text>maintaining the historic canal,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951353" lims:id="951353"><Label>(iii)</Label><Text>holding events or activities referred to in subsection 16(1),</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951354" lims:id="951354"><Label>(iv)</Label><Text>protecting cultural resources, natural resources, structures, equipment and objects,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951355" lims:id="951355"><Label>(v)</Label><Text>ensuring the safety of persons, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951356" lims:id="951356"><Label>(vi)</Label><Text>protecting wildlife or the eggs or habitat of wildlife;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951357" lims:id="951357"><Label>(c)</Label><Text>restrict or schedule any activity in a historic canal for the purposes of</Text><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951358" lims:id="951358"><Label>(i)</Label><Text>ensuring the safe navigation of vessels and the safe operation of locks, dams and bridges,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951359" lims:id="951359"><Label>(ii)</Label><Text>protecting cultural resources, natural resources, structures, equipment and objects,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951360" lims:id="951360"><Label>(iii)</Label><Text>ensuring the safety of persons, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951361" lims:id="951361"><Label>(iv)</Label><Text>protecting wildlife or the eggs or habitat of wildlife;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951362" lims:id="951362"><Label>(d)</Label><Text>give notice of the closing, restricting, opening or scheduling referred to in paragraph (b) or (c) by</Text><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951363" lims:id="951363"><Label>(i)</Label><Text>posting signs in the historic canal, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-06-05" lims:fid="951364" lims:id="951364"><Label>(ii)</Label><Text>using such other means as are likely to bring notice of the closing, restricting, opening or scheduling to the attention of persons affected by it; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951365" lims:id="951365"><Label>(e)</Label><Text>place, maintain, alter or remove traffic control devices in a historic canal.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951367" lims:id="951367">SOR/2002-191, s. 5(E); SOR/2015-134, s. 2(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951368" lims:id="951368" level="2"><TitleText>Powers of a Peace Officer</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951369" lims:id="951369"><Label>5</Label><Text>A peace officer may arrest without warrant any person found committing an act in contravention of these Regulations.</Text></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951370" lims:id="951370" level="2"><TitleText>Permits</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951371" lims:id="951371"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951372" lims:id="951372"><Label>(1)</Label><Text>Every person to whom a permit is issued under these Regulations shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951373" lims:id="951373"><Label>(a)</Label><Text>where the permit is issued authorizing the person or a vessel in the charge of the person to engage in an activity, ensure that the permit is carried</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="951374" lims:id="951374"><Label>(i)</Label><Text>on the person while the person is engaged in the activity, where the permit is issued under subsection 11(2), 14(2), 15(2), 16(2), 19(2), 22(2), 44(2) or 45(2), or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="951375" lims:id="951375"><Label>(ii)</Label><Text>on board while the person or the vessel is engaged in the activity, where the permit is issued under subsection 13(2), 17(2), 39(2), 40(5), 42(2) or 43(2);</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951376" lims:id="951376"><Label>(b)</Label><Text>produce the permit at the request of the superintendent or an employee;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951377" lims:id="951377"><Label>(c)</Label><Text>comply with the terms and conditions specified in the permit; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951378" lims:id="951378"><Label>(d)</Label><Text>notify the superintendent of any corrections to information provided in an application to obtain the permit as soon as possible after learning of them.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951379" lims:id="951379"><Label>(2)</Label><Text>No permit is transferable to any other person or vessel.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951380" lims:id="951380"><Label>(3)</Label><Text>The superintendent may cancel a permit where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951381" lims:id="951381"><Label>(a)</Label><Text>the purpose for which the permit was issued no longer applies; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951382" lims:id="951382"><Label>(b)</Label><Text>the person to whom the permit is issued</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="951383" lims:id="951383"><Label>(i)</Label><Text>contravenes or fails to comply with the terms and conditions of the permit or these Regulations, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="951384" lims:id="951384"><Label>(ii)</Label><Text>provides incorrect, false or misleading information to the superintendent in an application to obtain the permit.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951385" lims:id="951385"><Label>(4)</Label><Text>The superintendent may amend a permit at no cost to the applicant.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="951387" lims:id="951387">SOR/2002-191, s. 5(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951388" lims:id="951388"><Label>6.1</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951389" lims:id="951389"><Label>(1)</Label><Text>If the superintendent cancels a permit, the superintendent shall, as soon as feasible after making the decision, provide written notice of the cancellation, including reasons, to the permit holder.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951390" lims:id="951390"><Label>(2)</Label><Text>Any person whose permit has been cancelled may submit a written request for a review of that decision to the Chief Executive Officer of the Parks Canada Agency within 30 days after the date of the notice.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951391" lims:id="951391"><Label>(3)</Label><Text>The Chief Executive Officer shall, within 30 days after the day on which the request is received, complete the review and provide written notice of the decision, including reasons, to the person who requested it.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951393" lims:id="951393">SOR/2015-134, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951394" lims:id="951394" level="1"><Label>PART II</Label><TitleText>Controlled Activities and Areas</TitleText></Heading><Heading lims:inforce-start-date="2015-06-05" lims:fid="951395" lims:id="951395" level="2"><TitleText>Prohibited Conduct</TitleText></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951396" lims:id="951396"><Label>7</Label><Text>No person shall</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951397" lims:id="951397"><Label>(a)</Label><Text>do anything that unreasonably disturbs or interferes with any person’s use or enjoyment of a historic canal;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951398" lims:id="951398"><Label>(b)</Label><Text>behave in a manner that endangers the safety of any person in a historic canal;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951399" lims:id="951399"><Label>(c)</Label><Text>cause excessive noise in a historic canal between 11:00 p.m. and 6:00 a.m.;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951400" lims:id="951400"><Label>(d)</Label><Text>operate a lock, lift or swing bridge, dam or wasteweir in a historic canal, or the gates or sluices of those structures, unless authorized to do so; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951401" lims:id="951401"><Label>(e)</Label><Text>fish within 10 m of a lock or approach wharf or from a bridge over a navigation channel.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951403" lims:id="951403">SOR/2015-134, s. 4(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951404" lims:id="951404"><Label>8</Label><Text>Every person shall comply with any sign posted or traffic control device placed in a historic canal pursuant to subsection 4(2).</Text></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951405" lims:id="951405" level="2"><TitleText>Restricted Activities and Areas</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951406" lims:id="951406"><Label>9</Label><Text>No person, other than a peace officer or an employee acting in the course of employment, shall, in a historic canal, engage in an activity that is restricted or enter into an area that is closed, where notice of the restriction or closure has been given in accordance with paragraph 4(2)(d).</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951407" lims:id="951407"><Label>10</Label><Text>Except at times and in areas designated by means of a sign or notice, no person shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951408" lims:id="951408"><Label>(a)</Label><Text>in a navigation channel or within 100 m of a structure in a historic canal, water-ski, ride a tube or kneeboard, engage in any activity that involves being towed behind a vessel or operate a vessel towing a water-skier or person riding a tube or kneeboard;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951409" lims:id="951409"><Label>(b)</Label><Text>dive, jump, scuba-dive, swim or bathe in a navigation channel or within 40 m of a lock gate or a dam in a historic canal;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951410" lims:id="951410"><Label>(c)</Label><Text>dive or jump from a bridge over a historic canal, or from the abutments of such a bridge; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951411" lims:id="951411"><Label>(d)</Label><Text>operate a vessel within 40 m of a dam in a historic canal, unless the vessel is in the navigation channel.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951412" lims:id="951412" level="2"><TitleText>Resource Protection</TitleText></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951413" lims:id="951413"><Label>11</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951414" lims:id="951414"><Label>(1)</Label><Text>No person shall</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951415" lims:id="951415"><Label>(a)</Label><Text>deposit in a historic canal, snow that has been collected during snow removal;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951416" lims:id="951416"><Label>(b)</Label><Text>discard waste in a historic canal, except in a receptacle designated for that purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951417" lims:id="951417"><Label>(c)</Label><Text>discharge the contents of a holding tank in a historic canal, except at a pumpout station designated for that purpose; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951418" lims:id="951418"><Label>(d)</Label><Text>abandon or discard any other thing in a historic canal.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951419" lims:id="951419"><Label>(2)</Label><Text>No person shall, except in accordance with a permit issued under subsection (3), remove, alter or destroy any cultural resource, natural resource, structure, equipment or object in a historic canal.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951420" lims:id="951420"><Label>(3)</Label><Text>The superintendent may, on receipt of an application, issue a permit authorizing the applicant to remove, alter or destroy a cultural resource, natural resource, structure, equipment or object, where the removal, alteration or destruction is necessary for</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951421" lims:id="951421"><Label>(a)</Label><Text>scientific purposes; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951422" lims:id="951422"><Label>(b)</Label><Text>the management of water levels or flows.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951423" lims:id="951423"><Label>(4)</Label><Text>A permit issued under subsection (3) shall specify</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951424" lims:id="951424"><Label>(a)</Label><Text>the cultural resource, natural resource, structure, equipment or object, or the amount thereof, that may be removed, altered or destroyed and the location from which it may be removed or at which it may be altered or destroyed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951425" lims:id="951425"><Label>(b)</Label><Text>the period for which the permit is valid.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951427" lims:id="951427">SOR/2002-191, s. 5(E); SOR/2015-134, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951428" lims:id="951428"><Label>12</Label><Text>Every person who uses or occupies a property or facility in a historic canal shall, on vacating the property or facility, leave it in a clean and orderly condition.</Text></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951429" lims:id="951429" level="2"><TitleText>Transportation of Dangerous Goods</TitleText></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951430" lims:id="951430"><Label>13</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951431" lims:id="951431"><Label>(1)</Label><Text>No person in charge of a vessel shall allow the vessel to transport any dangerous goods as defined in section 2 of the <XRefExternal reference-type="act" link="T-19.01">Transportation of Dangerous Goods Act, 1992</XRefExternal> in a historic canal, except in accordance with a permit issued under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951432" lims:id="951432"><Label>(2)</Label><Text>The superintendent may, on receipt of an application, issue a permit authorizing the applicant to transport dangerous goods in a historic canal.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951433" lims:id="951433"><Label>(3)</Label><Text>A permit issued under subsection (2) shall specify</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951434" lims:id="951434"><Label>(a)</Label><Text>the type of dangerous goods to be transported;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951435" lims:id="951435"><Label>(b)</Label><Text>the dates and times when, and the route along which, the goods may be transported; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951436" lims:id="951436"><Label>(c)</Label><Text>the period for which the permit is valid.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951438" lims:id="951438">SOR/94-580, s. 1; SOR/2002-191, s. 5(E); SOR/2015-134, s. 6(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951439" lims:id="951439" level="2"><TitleText>Dredge and Fill Operations</TitleText></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951440" lims:id="951440"><Label>14</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951441" lims:id="951441"><Label>(1)</Label><Text>No person shall dredge, fill or dredge and fill in a historic canal, except in accordance with a permit issued under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951442" lims:id="951442"><Label>(2)</Label><Text>The superintendent may, on receipt of an application, issue a permit authorizing the applicant to dredge, fill or dredge and fill in a historic canal.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951443" lims:id="951443"><Label>(3)</Label><Text>A permit issued under subsection (2) shall specify</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951444" lims:id="951444"><Label>(a)</Label><Text>the dates and times when, the location at which, and the extent to which the dredging, filling or dredging and filling may be carried out; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951445" lims:id="951445"><Label>(b)</Label><Text>the period for which the permit is valid.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951446" lims:id="951446"><Label>(4)</Label><Text>The superintendent may issue a stop work order, a restore order or both to a person who</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951447" lims:id="951447"><Label>(a)</Label><Text>contravenes or fails to comply with the terms and conditions specified in a permit issued under subsection (2); or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951448" lims:id="951448"><Label>(b)</Label><Text>dredges, fills or dredges and fills in a historic canal without a permit.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951449" lims:id="951449"><Label>(5)</Label><Text>Where the superintendent issues a stop work order to a person, the person shall comply with the stop work order until such time as the superintendent issues a restore order.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951450" lims:id="951450"><Label>(6)</Label><Text>Where the superintendent issues a restore order to a person, the person shall</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951451" lims:id="951451"><Label>(a)</Label><Text>in the case of a person to whom a permit was issued, restore at the person’s risk and expense that part of the historic canal that was dredged, filled or dredged and filled, contrary to the terms and conditions of the permit, to the condition that it was in prior to the dredging, filling or dredging and filling or, where applicable, to the condition that was specified in the permit; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951452" lims:id="951452"><Label>(b)</Label><Text>in the case of a person without a permit, restore at the person’s risk and expense the historic canal to the condition that it was in prior to the dredging, filling or dredging and filling.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951454" lims:id="951454">SOR/94-580, s. 2; SOR/2002-191, s. 5(E); SOR/2015-134, s. 7(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951455" lims:id="951455" level="2"><TitleText>Signs and Structures</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951456" lims:id="951456"><Label>15</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951457" lims:id="951457"><Label>(1)</Label><Text>No person shall erect a sign, structure or object over or in a historic canal, except in accordance with a permit issued under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951458" lims:id="951458"><Label>(2)</Label><Text>The superintendent may, on receipt of an application, issue a permit authorizing the applicant to erect a sign, structure or object over or in a historic canal.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951459" lims:id="951459"><Label>(3)</Label><Text>A permit issued under subsection (2) shall specify</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951460" lims:id="951460"><Label>(a)</Label><Text>the location at which the sign, structure or object may be erected; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951461" lims:id="951461"><Label>(b)</Label><Text>the date before which the sign, structure or object must be removed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951462" lims:id="951462"><Label>(4)</Label><Text>Every person who erects a sign, structure or object under this section shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951463" lims:id="951463"><Label>(a)</Label><Text>erect it at the person’s risk and expense; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951464" lims:id="951464"><Label>(b)</Label><Text>remove it at the person’s risk and expense before the date specified in the permit.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="951466" lims:id="951466">SOR/2002-191, s. 5(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951467" lims:id="951467" level="2"><TitleText>Organized Events</TitleText></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951468" lims:id="951468"><Label>16</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951469" lims:id="951469"><Label>(1)</Label><Text>No person shall convene an organized race, competition, regatta, fair, exhibition, demonstration or any other such organized event or activity in a historic canal, except in accordance with a permit issued under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951470" lims:id="951470"><Label>(2)</Label><Text>The superintendent may, on receipt of an application, issue a permit authorizing the applicant to convene an organized race, competition, regatta, fair, exhibition, demonstration or other such organized event or activity in a historic canal.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951471" lims:id="951471"><Label>(3)</Label><Text>A permit issued under subsection (2) shall specify</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951472" lims:id="951472"><Label>(a)</Label><Text>the type of race, competition, regatta, fair, exhibition, demonstration or other such organized event or activity that may be convened and the dates and times when, and the location at which, it may be convened; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951473" lims:id="951473"><Label>(b)</Label><Text>the period for which the permit is valid.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951475" lims:id="951475">SOR/94-580, s. 3; SOR/2002-191, s. 5(E); SOR/2015-134, s. 8(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951476" lims:id="951476" level="2"><TitleText>Aircraft Operations</TitleText></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951477" lims:id="951477"><Label>17</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951478" lims:id="951478"><Label>(1)</Label><Text>Except in the case of an emergency, no person shall take off, land or moor an aircraft</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951479" lims:id="951479"><Label>(a)</Label><Text>on the navigation channel of a historic canal;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951480" lims:id="951480"><Label>(b)</Label><Text>on historic canal waters within 100 m of a lock, bridge or dam; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951519" lims:id="951519"><Label>(b)</Label><Text>in a portable stove or other similar device in a place designated, by means of a sign or notice, for that purpose.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951520" lims:id="951520"><Label>(2)</Label><Text>No person who lights or maintains a fire on historic canal lands shall leave the fire unattended.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951521" lims:id="951521"><Label>(3)</Label><Text>Every person who lights or maintains a fire on historic canal lands shall extinguish the fire when it is no longer required.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951522" lims:id="951522" level="2"><TitleText>Domestic Animals</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951523" lims:id="951523"><Label>24</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951524" lims:id="951524"><Label>(1)</Label><Text>Every person who brings a pet onto historic canal lands shall ensure that the pet is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951525" lims:id="951525"><Label>(a)</Label><Text>restrained by a harness or a leash that is no longer than 3 m; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951538" lims:id="951538"><Label>(b)</Label><Text>any fender attached to the vessel is securely fastened to the vessel and made of material that will float.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951539" lims:id="951539" level="2"><TitleText>Condition and Operation of Vessels</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951540" lims:id="951540"><Label>28</Label><Text>No person in charge of a vessel shall operate the vessel in a historic canal where the dimensions, configuration, draught or condition of the vessel or the goods or equipment on the vessel may</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951541" lims:id="951541"><Label>(a)</Label><Text>damage the historic canal;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951542" lims:id="951542"><Label>(b)</Label><Text>endanger the safety of persons using the historic canal; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951543" lims:id="951543"><Label>(c)</Label><Text>delay or obstruct navigation.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951544" lims:id="951544"><Label>29</Label><Text>Every person in charge of a vessel that is in a historic canal shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951545" lims:id="951545"><Label>(a)</Label><Text>obey all traffic control devices; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951546" lims:id="951546"><Label>(b)</Label><Text>comply with the instructions of employees and peace officers in respect of the safe and orderly use of locks and navigation channels.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951547" lims:id="951547"><Label>30</Label><Text>Every person in charge of a vessel that is in a historic canal shall operate the vessel in a manner that ensures that its wake is minimized and that the vessel and its wake do not compromise the safety of persons or vessels or cause damage to the shoreline or to any vessel, works, equipment or object.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951549" lims:id="951549">SOR/2015-134, s. 13</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951550" lims:id="951550" level="2"><TitleText>Meeting and Overtaking of Vessels</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951551" lims:id="951551"><Label>31</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951552" lims:id="951552"><Label>(1)</Label><Text>Where two vessels are approaching a bridge in a historic canal from opposite directions and passage by the bridge can only be made by one vessel at a time, the person in charge of the upbound vessel shall hold back and give way to the downbound vessel and shall ensure that the vessels pass each other at least 100 m downstream of the bridge.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951553" lims:id="951553"><Label>(2)</Label><Text>Where two vessels are approaching a bend in a narrow navigation channel from opposite directions, the person in charge of the upbound vessel shall hold back and give way to the downbound vessel and shall ensure that the vessels pass each other downstream of the bend.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951554" lims:id="951554"><Label>(3)</Label><Text>No person in charge of a vessel in a historic canal shall attempt to overtake another vessel while within 300 m of a lock, guard gate or bridge, unless directed to do so by the superintendent or a peace officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951555" lims:id="951555"><Label>(4)</Label><Text>The person in charge of a vessel shall decrease the speed of the vessel to dead slow when the vessel is passing employees working on historic canal waters.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="951557" lims:id="951557">SOR/2002-191, s. 5(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951558" lims:id="951558" level="2"><TitleText>Precedence at Swing and Lift Bridges</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951559" lims:id="951559"><Label>32</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951560" lims:id="951560"><Label>(1)</Label><Text>The superintendent shall give precedence to trains at a railway swing or lift bridge.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951561" lims:id="951561"><Label>(2)</Label><Text>The superintendent shall give precedence to vessels at a highway swing or lift bridge during the hours in which the bridge is scheduled to operate.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="951563" lims:id="951563">SOR/2002-191, s. 5(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951564" lims:id="951564" level="2"><TitleText>Vessels Passing a Swing or Lift Bridge</TitleText></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951565" lims:id="951565"><Label>33</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951566" lims:id="951566"><Label>(1)</Label><Text>Subject to subsection (2) and section 34, no person in charge of a vessel in a historic canal shall attempt to pass the vessel through a swing or lift bridge until the bridge is fully open and</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951567" lims:id="951567"><Label>(a)</Label><Text>no red light is shown by the traffic control device on the bridge; or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="951582" lims:id="951582"><Label>(b)</Label><Text>the person in charge of the vessel is directed by an employee to proceed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="951583" lims:id="951583"><Label>(2)</Label><Text>Every person in charge of a vessel waiting to enter a lock of a historic canal shall give way to vessels leaving the lock.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="951584" lims:id="951584"><Label>(3)</Label><Text>No person in charge of a vessel shall allow the vessel to pass through a lock of a historic canal unless the vessel is equipped in accordance with section 27.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-02-13" lims:fid="951586" lims:id="951586">SOR/2015-134, s. 16; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951590" lims:id="951590"><Label>(c)</Label><Text>the engine compartment blower or exhaust fan is operating.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951591" lims:id="951591"><Label>37</Label><Text>During the period that any vessel is passing through a lock of a historic canal, no person shall smoke or have an open flame on the coping wall or lock gate.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951592" lims:id="951592"><Label>38</Label><Text>No person shall, while on a vessel that is passing through a lock of a historic canal,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951593" lims:id="951593"><Label>(a)</Label><Text>smoke or have an open flame including a pilot light;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951594" lims:id="951594"><Label>(b)</Label><Text>turn on or off, or attempt to turn on or off, any appliance; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951595" lims:id="951595"><Label>(c)</Label><Text>until directed to do so by an employee, operate or attempt to operate an engine.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951596" lims:id="951596"><Label>39</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951597" lims:id="951597"><Label>(1)</Label><Text>Subject to subsection (4), no person in charge of a vessel shall, except in accordance with a permit issued under subsection (2), allow the vessel to pass through a lock of the Saint-Ours, Chambly, Sainte-Anne-de-Bellevue, Carillon, Rideau or Lachine Canal or a lock of the Trent-Severn Waterway.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951598" lims:id="951598"><Label>(2)</Label><Text>The superintendent may, on receipt of an application, issue a permit authorizing the applicant to pass the vessel through a lock of a historic canal referred to in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951599" lims:id="951599"><Label>(3)</Label><Text><Repealed>[Repealed, SOR/2015-134, s. 17]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951600" lims:id="951600"><Label>(4)</Label><Text>The person in charge of a vessel may pass through a lock of a historic canal named in subsection (1) for the purpose of obtaining a permit, if the person does not proceed further along the historic canal than to a lock station at which permits are issued.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951602" lims:id="951602">SOR/94-580, s. 8; SOR/2002-191, ss. 3, 5(E); SOR/2015-134, s. 17</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951603" lims:id="951603" level="2"><TitleText>Mooring of Vessels</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951604" lims:id="951604"><Label>40</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951605" lims:id="951605"><Label>(1)</Label><Text>No person in charge of a vessel shall moor the vessel or allow it to be moored in a historic canal in a manner that obstructs navigation.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951606" lims:id="951606"><Label>(2)</Label><Text>No person in charge of a vessel shall moor the vessel or allow it to be moored along an approach wharf during the hours of operation of the lock, unless the vessel is waiting to enter the lock.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951607" lims:id="951607"><Label>(3)</Label><Text>No person shall affix a mooring line to a structure or object at a lock station, other than a structure or object designed for that purpose.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951608" lims:id="951608"><Label>(4)</Label><Text>No person shall, except in accordance with a permit issued under subsection (5), moor a vessel at a place designated by means of a sign or notice as requiring a mooring permit.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951609" lims:id="951609"><Label>(5)</Label><Text>The superintendent may, on receipt of an application, issue a mooring permit.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951610" lims:id="951610"><Label>(6)</Label><Text>Where a space at a wharf is designated by means of a sign or notice as being reserved for a certain period for a particular type or class of vessel, no person shall moor a vessel in the space during that period unless the vessel is of that type or class.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951611" lims:id="951611"><Label>(7)</Label><Text>No person shall moor a vessel at a wharf for a period that exceeds the period designated for that wharf.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951612" lims:id="951612"><Label>(8)</Label><Text>No person in charge of a vessel that has been moored at a lock station shall return to moor the vessel at the same lock station until a period of 24 hours has elapsed from the time of the vessel’s departure from the lock station.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="951614" lims:id="951614">SOR/94-580, s. 9; SOR/2002-191, s. 5(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951615" lims:id="951615"><Label>41</Label><Text>No person in charge of a vessel shall allow the vessel to be moored in a navigation channel except in case of an emergency and only for such time as the emergency exists.</Text></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951616" lims:id="951616" level="2"><TitleText>Wintering and Lying Up of Vessels</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="951617" lims:id="951617"><Label>42</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951618" lims:id="951618"><Label>(1)</Label><Text>No person in charge of a vessel shall winter the vessel in a historic canal except in accordance with a permit issued under subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951619" lims:id="951619"><Label>(2)</Label><Text>The superintendent may, on receipt of an application, issue a permit authorizing the applicant to winter a vessel in a historic canal.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951620" lims:id="951620"><Label>(3)</Label><Text>A permit issued under subsection (2) shall specify</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951621" lims:id="951621"><Label>(a)</Label><Text>the type and size of vessel that the applicant may winter;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951622" lims:id="951622"><Label>(b)</Label><Text>the location at which the applicant may winter the vessel; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951641" lims:id="951641"><Label>(d)</Label><Text>except in accordance with a permit issued under subsection (2), set out a buoy.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951642" lims:id="951642"><Label>(2)</Label><Text>The superintendent may, on receipt of an application, issue a permit authorizing the applicant to set out a buoy in a historic canal.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="951643" lims:id="951643"><Label>(3)</Label><Text>A permit issued under subsection (2) shall specify</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="951644" lims:id="951644"><Label>(a)</Label><Text>the type, placement and characteristics of the buoy in accordance with the <XRefExternal reference-type="regulation" link="SOR-99-335">Private Buoy Regulations</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951653" lims:id="951653"><Label>(b)</Label><Text>a gross weight exceeding the posted load capacity of the bridge.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951654" lims:id="951654"><Label>(2)</Label><Text>The superintendent may, on receipt of an application, issue a permit authorizing the applicant to operate, on a bridge over a historic canal,</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951655" lims:id="951655"><Label>(a)</Label><Text>if the surface of the bridge is protected against damage, a vehicle that has crawler tractor treads or other treads; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951656" lims:id="951656"><Label>(b)</Label><Text>if the bridge is protected against structural damage, a vehicle that has a gross weight exceeding the posted load capacity of the bridge.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951657" lims:id="951657"><Label>(3)</Label><Text>A permit issued under subsection (2) shall specify the bridge on which, and the dates and times when, the applicant may operate the vehicle.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951658" lims:id="951658"><Label>(4)</Label><Text>No person shall proceed over a bridge that has a safety gate or other device used for closing the bridge, unless the gate or other device is fully open.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951660" lims:id="951660">SOR/2002-191, s. 5(E); SOR/2015-134, s. 19</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951676" lims:id="951676" level="2"><TitleText>Seizure and Detention</TitleText></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951677" lims:id="951677"><Label>49</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951678" lims:id="951678"><Label>(1)</Label><Text>The superintendent shall seize and detain, at the owner’s risk, any vessel or goods if the superintendent has reasonable grounds to believe that</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951679" lims:id="951679"><Label>(a)</Label><Text>dues that have accrued on the vessel or goods have not been paid;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951680" lims:id="951680"><Label>(b)</Label><Text>damage has occurred to the historic canal and the cost of repairing the damage has not been paid or the security for payment of the cost has not been provided;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951681" lims:id="951681"><Label>(c)</Label><Text>a fine that has been imposed in respect of the vessel or goods has not been paid; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951682" lims:id="951682"><Label>(d)</Label><Text>these Regulations have been contravened in respect of the vessel or goods.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951683" lims:id="951683"><Label>(2)</Label><Text>The superintendent shall, as soon as feasible after seizing the vessel or goods, inform, in writing, the owner and the person in whose possession they were at the time of the seizure of</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951684" lims:id="951684"><Label>(a)</Label><Text>the reason for the seizure;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951685" lims:id="951685"><Label>(b)</Label><Text>an estimate of the cost of repairing any damage that has been caused to the historic canal; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951686" lims:id="951686"><Label>(c)</Label><Text>if they are not detained in the place where they were seized, the location at which they are detained.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951687" lims:id="951687"><Label>(3)</Label><Text>The superintendent shall release the seized and detained vessel or goods as soon as feasible after</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951688" lims:id="951688"><Label>(a)</Label><Text>the dues have been paid;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951689" lims:id="951689"><Label>(b)</Label><Text>the cost of repairing the damage has been paid or security for payment of that cost has been provided; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951690" lims:id="951690"><Label>(c)</Label><Text>the fine has been paid.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951691" lims:id="951691"><Label>(4)</Label><Text>The superintendent shall, at the request of the person from whom the vessel or goods were seized and detained, allow that person or any person authorized by that person to examine, at any reasonable time, the vessel or goods.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951693" lims:id="951693">SOR/94-580, s. 12; SOR/2002-191, s. 5(E); SOR/2015-134, s. 20</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-06-05" lims:fid="951694" lims:id="951694" level="2"><TitleText>Sale of Seized Vessel or Goods</TitleText></Heading><Section lims:inforce-start-date="2015-06-05" lims:lastAmendedDate="2015-06-05" lims:fid="951695" lims:id="951695"><Label>50</Label><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951696" lims:id="951696"><Label>(1)</Label><Text>Subject to subsection (2), the superintendent shall sell any vessel or goods seized and detained under subsection 49(1) if, within 30 days after the day on which the vessel or goods are seized,</Text><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951697" lims:id="951697"><Label>(a)</Label><Text>the dues have not been paid;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951698" lims:id="951698"><Label>(b)</Label><Text>the cost of repairing the damage has not been paid or the security for payment of that cost has not been provided; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-05" lims:fid="951699" lims:id="951699"><Label>(c)</Label><Text>the fine has not been paid.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951700" lims:id="951700"><Label>(2)</Label><Text>The owner of the seized and detained vessel or goods may, before they are sold, apply in writing to the Chief Executive Officer of the Parks Canada Agency for a review of the decision to seize and detain.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-05" lims:fid="951701" lims:id="951701"><Label>(3)</Label><Text>The Chief Executive Officer shall, within 90 days after the day on which the application is received, make a decision and provide written notice of it, including reasons, to the owner.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-05" lims:fid="951703" lims:id="951703">SOR/2002-191, s. 5(E);
