(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-11-20" lims:fid="929986" lims:id="929986" generate-in-text="no"><Text><DefinedTermEn>appellant</DefinedTermEn> means an employee or employer, or the representative of either of them, who appeals under section 28 of the Act; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-11-20" lims:fid="929991" lims:id="929991" generate-in-text="no"><Text><DefinedTermEn>Registrar</DefinedTermEn> means the person appointed as Registrar of the Court by the Chief Administrator of the Courts Administration Service in consultation with the Chief Justice; lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="929997" lims:id="929997"><Label>4</Label><Text>These rules apply to appeals brought under section 28 of the Act.</Text></Section><Heading lims:inforce-start-date="2023-07-05" lims:enacted-date="2023-06-23" lims:fid="1418687" lims:id="1418687" level="1"><TitleText>Associate Judges</TitleText></Heading><Section lims:inforce-start-date="2023-07-05" lims:enacted-date="2023-06-23" lims:lastAmendedDate="2023-07-05" lims:fid="1418688" lims:id="1418688"><Label>4.1</Label><Subsection lims:inforce-start-date="2023-07-05" lims:enacted-date="2023-06-23" lims:fid="1418689" lims:id="1418689"><Label>(1)</Label><Text>An associate judge of the Court has all the powers of a judge of the Court under these Rules.</Text></Subsection><Subsection lims:inforce-start-date="2023-07-05" lims:enacted-date="2023-06-23" lims:fid="1418690" lims:id="1418690"><Label>(2)</Label><Text>Any associate judge may sit and act at any time and at any place in Canada for the transaction of the business of the Court, and, where the associate judge so sits or acts, that associate judge constitutes the Court.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2023-07-05" lims:enacted-date="2023-06-23" lims:id="929998" level="1"><TitleText>Filing a Notice of Appeal</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-02-07" lims:fid="930000" lims:id="930000">SOR/2008-305, s. 2</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2008-11-20" lims:lastAmendedDate="2008-11-20" lims:fid="930001" lims:id="930001"><Label>5</Label><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930002" lims:id="930002"><Label>(1)</Label><Text>An appeal by an appellant from a ruling or a decision made by, or a decision on an appeal to, the Minister shall be instituted within the time period set out in subsection 28(1) of the Act, which is 90 days after the ruling or decision is communicated to the appellant, or within any longer time that the Court on application made to it within 90 days after the expiration of those 90 days allows.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930003" lims:id="930003"><Label>(2)</Label><Text>Where a ruling or decision referred to in subsection (1) is communicated by mail, the date of communication is the date it is mailed and, in the absence of evidence to the contrary, the date of mailing is that date specified on the ruling or decision.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930004" lims:id="930004"><Label>(3)</Label><Text>An appeal referred to in subsection (1) shall be made in writing and shall set out, in general terms, the reasons for the appeal and the relevant facts, but no special form of pleadings is required.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930005" lims:id="930005"><Label>(4)</Label><Text>An appeal referred to in subsection (1) shall be instituted by filing a notice of appeal, which may be in the form set out in Schedule 5, using one of the following methods:</Text><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="930006" lims:id="930006"><Label>(a)</Label><Text>depositing the notice with the Registry;</Text></Paragraph><Paragraph directed by the Court, the date of filing of a document is deemed to be</Text><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="930021" lims:id="930021"><Label>(a)</Label><Text>in the case of a document filed with the Registry or sent by mail or by fax, the date shown by the date received stamp placed on the document by the Registry at the time it is received; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="930022" lims:id="930022"><Label>(b)</Label><Text>in the case of a document filed by electronic filing, the date shown on Filing</TitleText></Heading><Section lims:inforce-start-date="2008-11-20" lims:lastAmendedDate="2008-11-20" lims:fid="930026" lims:id="930026"><Label>5.3</Label><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930027" lims:id="930027"><Label>(1)</Label><Text>Except as otherwise provided in these rules and unless otherwise directed by the Court, when a document is filed by electronic filing, the copy of the document that is printed by the Registry and placed in the Court file is deemed to be the original version of the document.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930028" lims:id="930028"><Label>(2)</Label><Text>A party who files a document by electronic filing shall, if required by these rules or at the request of a party or the Court, provide a paper copy of the document and file it with the Registry.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930029" lims:id="930029"><Label>(3)</Label><Text>If the Registry has no record of the receipt of a document, it is deemed not to have been filed, unless the Court directs otherwise.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2008-11-20" lims:fid="930031" lims:id="930031">SOR/2008-305, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="930032" lims:id="930032" level="1"><TitleText>Extension of Time</TitleText></Heading><Section lims:inforce-start-date="2014-02-07" lims:lastAmendedDate="2014-02-07" lims:fid="930033" lims:id="930033"><Label>6</Label><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930034" lims:id="930034"><Label>(1)</Label><Text>An application for an order extending the time within which an appeal may be instituted may be in the form set out in Schedule 6.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930035" lims:id="930035"><Label>(2)</Label><Text>An application under subsection (1) shall be made by filing with the Registrar, in the manner provided in section 5.1, three copies of the application accompanied by three copies of the notice of appeal.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930036" lims:id="930036"><Label>(3)</Label><Text>No application shall be granted under this section to an applicant unless</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930037" lims:id="930037"><Label>(a)</Label><Text>the application is made within 90 days after the expiration of 90 days after the day on which the Minister communicated his or her decision to the applicant; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930038" lims:id="930038"><Label>(b)</Label><Text>the applicant demonstrates that</Text><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="930039" lims:id="930039"><Label>(i)</Label><Text>within the initial 90-day period specified in paragraph (a), the applicant</Text><Clause lims:inforce-start-date="2014-02-07" lims:fid="930040" lims:id="930040"><Label>(A)</Label><Text>was unable to act or to instruct another to act in the applicant’s name, or</Text></Clause><Clause lims:inforce-start-date="2014-02-07" lims:fid="930041" lims:id="930041"><Label>(B)</Label><Text>had a good faith intention to appeal,</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="930042" lims:id="930042"><Label>(ii)</Label><Text>given the reasons set out in the application and the circumstances of the case, it would be just and equitable to grant the application,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="930043" lims:id="930043"><Label>(iii)</Label><Text>the application was made as soon as circumstances permitted it to be made, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-02-07" lims:fid="930044" lims:id="930044"><Label>(iv)</Label><Text>there are reasonable grounds for appealing the decision.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930045" lims:id="930045"><Label>(4)</Label><Text>After having given the Minister an opportunity to make representations, the Court shall dispose of the application on the basis of the representations contained in it and any additional information, if any, that the Court may require.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930046" lims:id="930046"><Label>(5)</Label><Text>The Registrar, on being informed of the decision of the Court in respect of the application, shall inform the applicant and the Minister of the decision.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930047" lims:id="930047"><Label>(6)</Label><Text>The application pursuant to subsection (1) is deemed to have been filed on the date of its receipt by the Registry, even if the application is not accompanied by the notice of appeal referred to in subsection (2), provided that the notice of appeal is filed within 30 days after that date or within any reasonable time that the Court establishes.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-02-07" lims:id="930051"><Label>7</Label><Subsection lims:inforce-start-date="2007-06-14" lims:fid="930052" lims:id="930052"><Label>(1)</Label><Text>The Registrar shall serve the Minister with a copy of the notice of appeal referred to in section 5 and notice of the Registry in which it was filed or to which it was mailed.</Text></Subsection><Subsection lims:inforce-start-date="2007-06-14" lims:fid="930053" lims:id="930053"><Label>(2)</Label><Text>The material referred to in subsection (1) may be served personally, and personal service on the Commissioner of Revenue is deemed to be personal service on the Minister, or by mail addressed to the Minister, and if served by mail, the date of service is the date it is mailed and, in the absence of evidence to the contrary, the date of mailing is that date appearing on the communication from the Registrar accompanying the material.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-06-14" Minister, on receipt of a copy of the notice of appeal referred to in section 7, shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930058" lims:id="930058"><Label>(a)</Label><Text>serve a copy of the notice of appeal and notice of the Registry in which it was filed or to which it was mailed on every person to whom a notification was sent pursuant to subsection 27(5) of the Act in respect of the determination or decision that is the subject of the appeal, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930059" lims:id="930059"><Label>(b)</Label><Text>serve notice at the Registry in which the notice of appeal was filed or to which it was mailed of the name and address of every person who may be served personally or by mail, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930065" lims:id="930065"><Label>(b)</Label><Text>in paragraph (1)(b) may be served service is the date it is mailed and, in the absence of evidence to the contrary, the date of mailing is that date appearing on the communication from the Minister accompanying the level="1"><TitleText>Intervention</TitleText></Heading><Section lims:inforce-start-date="2008-11-20" lims:lastAmendedDate="2008-11-20" lims:fid="930068" lims:id="930068"><Label>9</Label><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930069" lims:id="930069"><Label>(1)</Label><Text>A person affected by a decision of the Minister may intervene as a party in an appeal by filing with the Registry a notice of intervention that may be in the form set out in Schedule 9.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930070" lims:id="930070"><Label>(2)</Label><Text>The notice of intervention shall be filed within 45 days after the day on which the notice of appeal was served on the intervener under section 8.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930071" lims:id="930071"><Label>(3)</Label><Text>An intervener may state in the notice of intervention that the intervener intends to rely on the reasons set out in the notice of appeal received by the intervener or the reasons set out in the notice of intervention of another intervener.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930072" lims:id="930072"><Label>(4)</Label><Text>The Registrar shall serve the Minister and the appellant with a copy of any notice of intervention received by the Registrar.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930073" lims:id="930073"><Label>(5)</Label><Text>The lims:id="930077"><Label>10</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930078" lims:id="930078"><Label>(1)</Label><Text>Where there are two or more appeals commenced in accordance with these rules, the Court may, upon application by the Minister or an appellant or by an intervener, direct that the appeals be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930079" lims:id="930079"><Label>(a)</Label><Text>consolidated on such terms as it may direct,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930080" lims:id="930084"><Label>(2)</Label><Text>An application referred to in subsection (1) shall be filed in or mailed to the Registry in which the notices of appeal were filed or to which they were mailed and shall be served on the other parties to the appeals.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="930085" lims:id="930085" level="1"><TitleText>Consolidation of Interventions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="930086" lims:id="930086"><Label>11</Label><Text>Where there are two or more notices of intervention served under these rules, the Court may direct that one notice of intervention be filed and served on behalf of all interveners if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930087" lims:id="930087"><Label>(a)</Label><Text>there is a common question of law or fact in both or all notices of intervention, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930088" lims:id="930088"><Label>(b)</Label><Text>it is desirable in the interests of justice.</Text></Paragraph></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="930089" lims:id="930089" level="1"><TitleText>Reply</TitleText></Heading><Section lims:inforce-start-date="2014-02-07" lims:lastAmendedDate="2014-02-07" lims:fid="930090" lims:id="930090"><Label>12</Label><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930091" lims:id="930091"><Label>(1)</Label><Text>The Minister shall reply in writing to every notice of appeal or notice of intervention filed with or mailed to a Registry under subsection 5(4) or 9(1).</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930092" lims:id="930092"><Label>(2)</Label><Text>(a) The Minister shall file the reply at the Registry and serve it on the appellant or intervener, or both, as the case may be, within 60 days from the day on which the notice of appeal or notice of intervention was served on the Minister, or within such longer time as the Court, on application made to it within those 60 days, may allow.</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930093" lims:id="930093"><Label>(b)</Label><Text>The reply shall be filed in the Registry in which the notice of appeal or notice of intervention was filed or to which it was mailed, and it may be served on the appellant or intervener personally or by mail.</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930094" lims:id="930094"><Label>(b.1)</Label><Text>A reply may be filed under paragraph (b) by mailing it to the appropriate Registry described in that paragraph.</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930095" lims:id="930095"><Label>(c)</Label><Text>If the reply is served by mail, the date of service is the date it is mailed and, in the absence of evidence to the contrary, the date of mailing is that date appearing on the communication from the Minister accompanying the reply.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930096" lims:id="930096"><Label>(3)</Label><Text>The reply referred to in subsection (1) shall</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930097" lims:id="930097"><Label>(a)</Label><Text>admit or deny the facts alleged in the notice of appeal or notice of intervention, and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930098" lims:id="930098"><Label>(b)</Label><Text>contain a statement of any further allegations of fact on which the Minister intends to rely.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930099" lims:id="930099"><Label>(4)</Label><Text>An application for an extension of time under paragraph (2)(a) shall be made by serving at the Registry an application setting out</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930100" lims:id="930100"><Label>(a)</Label><Text>the date on which the notice of appeal or notice of intervention was served on the Minister,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930101" lims:id="930101"><Label>(b)</Label><Text>the additional time required, and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930102" lims:id="930102"><Label>(c)</Label><Text>the reasons therefor.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930103" lims:id="930103"><Label>(5)</Label><Text>The application to extend time may be served by filing it in the Registry in which the notice of appeal or notice of intervention was filed or to which it was mailed, or by sending a letter, telegram, telex or fax to that Registry.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930104" lims:id="930104"><Label>(6)</Label><Text>If the application to extend time is served by telegram, telex or fax, the date of service is the date that the telegram, telex or fax is transmitted and, if the application is served by mail, the date of service is the date stamped on the envelope at the post office and, if there is more than one such date, the date of service shall be deemed to be the earliest date.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930105" lims:id="930105"><Label>(7)</Label><Text>The Court shall dispose of the application on the basis of the representations contained in it and such additional information, if any, as the Court may require and after having given the appellant or intervener an opportunity to make on the Registrar and thereupon the appeal is deemed to be dismissed in whole or in part.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930130" lims:id="930130"><Label>(2)</Label><Text>The Registrar shall forthwith serve any intervener or other person who may be directly affected by a notice of withdrawal served under subsection (1) with a copy of the notice of withdrawal.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="930131" lims:id="930131"><Label>17</Label><Text>After hearing an appeal, the Court may vacate, confirm or vary a decision on an appeal under section 27 of the Act or an assessment that is the subject of an appeal under section 27.1 of the Act or, in the case of an appeal under section 27.1 of the Act, may refer the matter back to the Minister for reconsideration and reassessment, and shall without delay</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930132" lims:id="930132"><Label>(a)</Label><Text>notify the parties to the appeal in writing of its decision; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930133" lims:id="930133"><Label>(b)</Label><Text>give reasons for its decision, but, except where the Court deems it or other application that determines in whole or in part any substantive right in dispute between or among the parties by rendering a judgment and shall dispose of any other interlocutory or other application by issuing an order.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930139" lims:id="930139"><Label>(2)</Label><Text>A judgment shall be dated on the day it is signed and that day is the date of the pronouncement of the judgment.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930140" lims:id="930140"><Label>(3)</Label><Text>A judgment and the reasons relating to it, if any, shall be deposited with the Registry without lims:id="930145"><Label>(1)</Label><Text>After the time limited for replying under section 12 has expired, the Court may, on application by any party to an appeal, direct</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930146" lims:id="930146"><Label>(a)</Label><Text>any other party to the appeal to make discovery on oath of the documents that are or have been in that party’s possession, control or power relevant to any matter in question between them in the appeal,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930147" lims:id="930147"><Label>(b)</Label><Text>that the applicant is authorized to examine on oath, for the purposes of discovery, any other party to the appeal, or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930148" lims:id="930148"><Label>(c)</Label><Text>that there shall be both discovery of documents and examination for discovery.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930149" lims:id="930149"><Label>(2)</Label><Text>The Court may specify the form of affidavit to be used for the purpose of discovery of documents.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930150" lims:id="930150"><Label>(3)</Label><Text>The person to be examined for discovery shall be</Text><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930151" lims:id="930151"><Label>(a)</Label><Text>if the other party is an individual, that individual,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-02-07" lims:fid="930152" lims:id="930152"><Label>(b)</Label><Text>if the other party is a corporation or any body or group of persons empowered by law to sue or to be sued, either in its own name or in the name of any officer thereof or any other person, any member or officer of such corporation, body or lims:id="930154"><Label>(d)</Label><Text>a person who has been agreed upon by the examining party and the party to be examined with the consent of such person.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930155" lims:id="930155"><Label>(4)</Label><Text>The Court may designate the person before whom the examination for discovery is to be conducted and direct the manner in which it shall be conducted.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930156" lims:id="930156"><Label>(5)</Label><Text>All evidence given at an examination for discovery shall be recorded by a court reporter.</Text></Subsection><Subsection lims:inforce-start-date="2014-02-07" lims:fid="930157" lims:id="930157"><Label>(6)</Label><Text>Any party may, at the hearing of an appeal, use in evidence against another party any part of the examination for discovery of that other party, but, on the application of an adverse party, the Court may direct that any other part of the examination, that in the opinion of the Court, is so connected with the part to be used that the last-mentioned part ought not to be used without such other part, be put in evidence by the party seeking to use such examinations.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-02-07" lims:fid="930159" lims:id="930159">SOR/2008-305, s. 7; SOR/2014-26, s. 37</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="930160" lims:id="930160" level="1"><TitleText>Hearing of Appeals</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="930161" lims:id="930161"><Label>19</Label><Text>The Court may, on application by the Minister or an appellant or by an intervener or of its own motion, fix the date, time and place for the hearing of an appeal.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="930162" lims:id="930162"><Label>20</Label><Text>When the Court has fixed the date for a hearing, the Registrar shall, no later than 30 days before that date, send by registered mail to all parties, or have served on all parties to the appeal, a notice of hearing.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="930163" lims:id="930163"><Label>21</Label><Text>The Court may, on application by the Minister or an appellant or by an intervener or of its own motion, adjourn an appeal on such terms as in its opinion the circumstances of the case require.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="930164" lims:id="930164"><Label>22</Label><Text>The Court, upon the application of a party to an appeal or of its own motion and after giving every party an opportunity to be heard, may, at any stage of the appeal, give directions for the further conduct of the appeal.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="930165" lims:id="930165"><Label>23</Label><Text>All parties to an appeal may appear in person or may be represented by counsel or an agent.</Text></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="930166" lims:id="930166" level="1"><TitleText>Subpoena</TitleText></Heading><Section lims:inforce-start-date="2007-06-14" lims:lastAmendedDate="2007-06-14" lims:fid="930167" lims:id="930167"><Label>24</Label><Subsection lims:inforce-start-date="2007-06-14" lims:fid="930168" lims:id="930168"><Label>(1)</Label><Text>A party who requires the attendance of a person as a witness at a hearing may serve the person with a subpoena requiring the person to attend the hearing at the time and place stated in the subpoena and the subpoena may also require the person to produce at the hearing the documents or other things in the person’s possession, control or power relating to the matters in question in the appeal that are specified in the subpoena.</Text></Subsection><Subsection lims:inforce-start-date="2007-06-14" lims:fid="930169" lims:id="930169"><Label>(2)</Label><Text>On the request of a party or of counsel, the Registrar, or some other person authorized by the Chief Justice, shall sign, seal and issue a blank subpoena and the party or counsel may complete the subpoena and insert the names of any number of witnesses.</Text></Subsection><Subsection lims:inforce-start-date="2007-06-14" lims:fid="930170" lims:id="930170"><Label>(3)</Label><Text>A subpoena shall be served on a witness personally and, at the same time, witness fees and expenses in accordance with subsection (4) shall be paid or tendered to the witness.</Text></Subsection><Subsection lims:inforce-start-date="2007-06-14" lims:fid="930171" lims:id="930171"><Label>(4)</Label><Text>A witness, other than a witness who appears to give evidence as an expert, is entitled to be paid by the party who arranged for his or her attendance $75 per day, plus reasonable and proper transportation and living expenses.</Text></Subsection><Subsection lims:inforce-start-date="2007-06-14" lims:fid="930172" lims:id="930172"><Label>(5)</Label><Text>An amount is not payable under subsection (4) in respect of an appellant, a respondent or a person who has intervened under section 9 unless the appellant, respondent or person has been called upon to testify by another party to the level="1"><TitleText>Evidence</TitleText></Heading><Section lims:inforce-start-date="2008-11-20" lims:lastAmendedDate="2008-11-20" lims:fid="930176" lims:id="930176"><Label>25</Label><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930177" lims:id="930177"><Label>(1)</Label><Text>A party to an appeal may, prior to the hearing thereof or at any time during the hearing, apply to the Court for a direction permitting all facts or any particular fact or facts to be proved by other than oral evidence and the Court may give such direction as in its opinion the circumstances of the case require.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930178" lims:id="930178"><Label>(2)</Label><Text>All evidence given at the hearing of an appeal shall be recorded in a manner approved by the Registrar.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930179" lims:id="930179"><Label>(3)</Label><Text>Any person who swears an affidavit to be used in an appeal may be required to appear before a person appointed by the Court for that purpose to be cross-examined thereon.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930180" lims:id="930180"><Label>(4)</Label><Text>Where a party intends to call an expert witness at the hearing of an appeal, that party shall, as soon as practicable and not later than 20 days before the date of the hearing of the appeal, serve at the Registry and on every other party a copy of the report signed by that expert containing the expert’s name, address and qualifications and a statement of the substance of that expert’s proposed testimony.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930181" lims:id="930181"><Label>(5)</Label><Text>A copy of a report by an expert witness shall be served</Text><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="930182" lims:id="930182"><Label>(a)</Label><Text>by filing it in the Registry in which the notice of appeal was filed or to which it was mailed or by sending the report by mail or fax to that Registry, and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-11-20" lims:fid="930183" lims:id="930183"><Label>(b)</Label><Text>on every other party to an appeal by personal service or by sending the report to that party by mail or fax</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2008-11-20" lims:fid="930184" lims:id="930184"><Text>and, if a copy of the report is served by fax, the date of service is the date of the transmission of the fax, or if it is served by mail, the date of service is the date stamped on the envelope at the post office and, if there is more than one such date, the date of service shall be deemed to be the earliest date.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930185" lims:id="930185"><Label>(6)</Label><Text>A party who has failed to comply with subsection (4) is not permitted to call an expert witness without leave of the Court.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930186" lims:id="930186"><Label>(7)</Label><Text>Subsections (4) and (6) do not apply to evidence in rebuttal.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930187" lims:id="930187"><Label>(8)</Label><Text>The Court may, with the consent of all parties, receive in evidence at the hearing of the appeal a report served under subsection (4) without requiring the expert to attend and give oral evidence.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930188" lims:id="930188"><Label>(9)</Label><Text>Where it is impracticable or inconvenient for an expert witness to attend at the hearing of an appeal, the party intending to call the witness may, with leave of the Court or the consent of the parties, examine the witness under oath prior to the hearing of the appeal before a court reporter appointed by the Registrar for the purpose of having the evidence of that expert available for use at the hearing of the appeal.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930189" lims:id="930189"><Label>(10)</Label><Text>An expert witness who is examined under subsection (9) may be examined, cross-examined by a party adverse in interest, or re-examined in the same manner as a witness at the hearing of an appeal and, if any dispute arises during the course of the examination, any party to the appeal may make application to the Court to resolve the dispute.</Text></Subsection><Subsection lims:inforce-start-date="2008-11-20" lims:fid="930190" lims:id="930190"><Label>(11)</Label><Text>Where the evidence of an expert witness has been taken under subsections (9) and (10), that witness shall not be called to give evidence at the hearing of the appeal, except with leave of the Court or unless the Court requires the attendance of that witness at the hearing of the lims:id="930210"><Label>26.1</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930211" lims:id="930211"><Label>(1)</Label><Text>For the purpose of calculating a time limit established under these rules, the period beginning on December 21 in any year and ending on January 7 of the next year shall be excluded.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930212" lims:id="930212"><Label>(2)</Label><Text>Where the time limited for the doing of a thing under these rules expires or falls on a holiday or a Saturday, the thing may be done on the make restricting access to a particular file by persons other than the parties to a matter before the Court, any person may, subject to appropriate supervision and when the facilities of the Court permit without interfering with the ordinary work of the Court,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930217" lims:id="930217"><Label>(a)</Label><Text>inspect any Court file relating to a matter before the Court; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930218" lims:id="930218"><Label>(b)</Label><Text>on payment of $0.40 per page, lims:inforce-start-date="2006-03-22" lims:fid="930222" lims:id="930222"><Label>(1)</Label><Text>Failure to comply with these rules shall not render any proceedings void unless the Court so directs, but such proceedings may be set aside either in whole or in part as irregular and may be amended or otherwise dealt with in such manner and upon such terms as, in the opinion of the Court, the circumstances of the case require.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930223" lims:id="930223"><Label>(2)</Label><Text>Where a person makes an application to set aside a proceeding for irregularity, the objections intended to be put forward shall be stated clearly in the application.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930224" lims:id="930224"><Label>(3)</Label><Text>The Court may, where and as necessary in the interests of justice, dispense with compliance with any rule at any time.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930225" lims:id="930225"><Label>(4)</Label><Text>Where matters are not provided for in these rules, the practice shall be determined by the Court, either on a motion for directions or after the event if no such motion has been made.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="930227" lims:id="930227">SOR/2004-98, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2014-02-07" lims:fid="930228" lims:id="930228" level="1"><TitleText>Contempt of Court</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="930229" lims:id="930229"><Label>28</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930230" lims:id="930230"><Label>(1)</Label><Text>A person is guilty of contempt of court who</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930231" lims:id="930231"><Label>(a)</Label><Text>at a hearing of the Court fails to maintain a respectful attitude, remain silent or refrain from showing approval or disapproval of the proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930232" lims:id="930232"><Label>(b)</Label><Text>wilfully disobeys a process or order of the Court;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930233" lims:id="930233"><Label>(c)</Label><Text>acts in such a way as to interfere with the orderly administration of justice or to impair the authority or dignity of the Court;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930234" lims:id="930234"><Label>(d)</Label><Text>is an officer of the Court and fails to perform his or her duties;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930235" lims:id="930235"><Label>(e)</Label><Text>is a sheriff or bailiff and does not execute a writ forthwith or does not make a return thereof; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930236" lims:id="930236"><Label>(f)</Label><Text>contrary to these rules and without lawful excuse,</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="930237" lims:id="930237"><Label>(i)</Label><Text>refuses or neglects to obey a subpoena or to attend at the time and place appointed for his or her examination for discovery,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="930238" lims:id="930238"><Label>(ii)</Label><Text>refuses to be sworn or to affirm or to answer any question put to him or her,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="930239" lims:id="930239"><Label>(iii)</Label><Text>refuses or neglects to produce or permit to be inspected any document or other property, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="930240" lims:id="930240"><Label>(iv)</Label><Text>refuses or neglects to answer interrogatories or to make discovery of documents.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930241" lims:id="930241"><Label>(2)</Label><Text>Subject to subsection (6), before a person may be found in contempt of court, the person alleged to be in contempt shall be served with an order, made on the motion of a person who has an interest in the proceeding or at the Court’s own initiative, requiring the person alleged to be in contempt</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930242" lims:id="930242"><Label>(a)</Label><Text>to appear before a judge at a time and place stipulated in the order;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930243" lims:id="930243"><Label>(b)</Label><Text>to be prepared to hear proof of the act with which the person is charged, which shall be described in the order with sufficient particularity to enable the person to know the nature of the case against the person; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930244" lims:id="930244"><Label>(c)</Label><Text>to be prepared to present any defence that the person may have.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930245" lims:id="930245"><Label>(3)</Label><Text>A motion for an order under subsection (2) may be made <Language xml:lang="la">ex parte</Language>.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930246" lims:id="930246"><Label>(4)</Label><Text>An order may be made under subsection (2) if the Court is satisfied that there is a <Language xml:lang="la">prima facie</Language> case that contempt has been committed.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930247" lims:id="930247"><Label>(5)</Label><Text>An order under subsection (2) shall be personally served, together with any supporting documents, unless otherwise ordered by the Court.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930248" lims:id="930248"><Label>(6)</Label><Text>In a case of urgency, a person may be found in contempt of court for an act committed in the presence of a judge in the exercise of his or her functions and condemned at once, provided that the person has first been called on to justify his or her behaviour.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930249" lims:id="930249"><Label>(7)</Label><Text>A finding of contempt shall be based on proof beyond a reasonable doubt.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930250" lims:id="930250"><Label>(8)</Label><Text>A person alleged to be in contempt may not be compelled to testify.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930251" lims:id="930251"><Label>(9)</Label><Text>Where the Court considers it necessary, it may request the assistance of the Attorney General of Canada or any other person in relation to any proceedings for contempt.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="930252" lims:id="930252"><Label>(10)</Label><Text>Where a person is found to be in contempt, a judge may order, in addition to any other order made in respect of the proceedings, any or all of the following:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930253" lims:id="930253"><Label>(a)</Label><Text>that the person be imprisoned for a period of less than two years;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930254" lims:id="930254"><Label>(b)</Label><Text>that the person pay a fine;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930255" lims:id="930255"><Label>(c)</Label><Text>that the person do or refrain from doing any act;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930256" lims:id="930256"><Label>(d)</Label><Text>that the person’s property be sequestered; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="930257" lims:id="930257"><Label>(e)</Label><Text>that the person pay costs.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:fid="930260" lims:id="930260" level="1"><TitleText>Costs in Vexatious Proceedings</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22"
