(<Emphasis style="italic">agent en chef des douanes</Emphasis>)</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="888373" lims:id="888373" level="1"><TitleText>Special Services</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="888374" lims:id="888374"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="888375" lims:id="888375"><Label>(1)</Label><Text>Subject to subsection (2), the following services performed by an officer at the request of a person in charge of imported goods or goods destined for exportation shall be considered to be special services:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888376" lims:id="888376"><Label>(a)</Label><Text>any services performed outside the hours fixed by the Deputy Minister for the performance of that service;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888377" lims:id="888377"><Label>(b)</Label><Text>any service performed in a place outside the area served by a customs office; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888378" lims:id="888378"><Label>(c)</Label><Text>any service performed outside the ordinary course of the officer’s duties.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="888379" lims:id="888379"><Label>(2)</Label><Text>The following services performed by an officer are not special services:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888380" lims:id="888380"><Label>(a)</Label><Text>the examination of or acceptance of reports in respect of a military conveyance, unless that conveyance is being used in a commercial operation;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888381" lims:id="888381"><Label>(b)</Label><Text>the release of human remains;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888382" lims:id="888382"><Label>(c)</Label><Text>the release of perishable goods needed for the preservation of human life or health; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888383" lims:id="888383"><Label>(d)</Label><Text>the release of non-perishable goods urgently needed for the preservation of human life or health.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="888384" lims:id="888384" level="1"><TitleText>Special Services Charges</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="888385" lims:id="888385"><Label>4</Label><Text>Every person for whom a special service is performed by an officer other than an officer referred to in section 5 shall pay $25 for the performance of that service.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="888386" lims:id="888386"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="888387" lims:id="888387"><Label>(1)</Label><Text>Where an officer is called in on duty to perform a special service for a person, that person shall pay</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888388" lims:id="888388"><Label>(a)</Label><Text>$54 for the first two hours or portion thereof spent in the performance of that service; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888389" lims:id="888389"><Label>(b)</Label><Text>$27 for each additional hour or portion thereof spent in the performance of that service.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="888390" lims:id="888390"><Label>(2)</Label><Text>No charge is payable for the time spent by an officer referred to in subsection (1) on meals and rest.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="888391" lims:id="888391"><Label>(3)</Label><Text>Where more than one officer referred to in subsection (1) is required to perform a special service, the chargeable time in respect of that service shall be the aggregate of the time spent by all those officers in the performance of that service.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="888392" lims:id="888392" level="1"><TitleText>Transportation, Accommodation and Meals</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="888394" lims:id="888394">SOR/95-200, s. 1(F)</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="888395" lims:id="888395"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="888396" lims:id="888396"><Label>(1)</Label><Text>Subject to subsections (2) to (4), where a special service is to be performed by an officer, the person requesting that service shall provide the officer with such transportation, accommodation and meals as may be required for that officer to perform that service.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="888397" lims:id="888397"><Label>(2)</Label><Text>For the purposes of subsection (1), the transportation, accommodation and meals provided shall be comparable in quality to those that would otherwise be authorized by the Treasury Board <XRefExternal reference-type="other">Travel Directive</XRefExternal> in effect at the time that the special service is provided.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="888398" lims:id="888398"><Label>(3)</Label><Text>Where a person requesting a special service does not provide an officer with accommodation, meals or transportation and the officer is required to obtain accommodation, meals or commercial transportation, the person requesting the special service shall pay, in respect thereof, an amount based on the rates and allowances set out in the Treasury Board <XRefExternal reference-type="other">Travel Directive</XRefExternal> in effect at the time that the special service is provided.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="888399" lims:id="888399"><Label>(4)</Label><Text>Where a person requesting a special service does not provide an officer with transportation and the officer is required to use a privately owned conveyance, or a conveyance owned or leased by the Government of Canada, the person requesting the service shall pay, in respect of the use of that conveyance, the greater of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888400" lims:id="888400"><Label>(a)</Label><Text>an amount based on the allowances for the use of privately owned conveyances that are set out in the Treasury Board <XRefExternal reference-type="other">Travel Directive</XRefExternal> in effect at the time that the special service is provided; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="888401" lims:id="888401"><Label>(b)</Label><Text>five dollars.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="888403" lims:id="888403">SOR/95-200, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="888404" lims:id="888404" level="1"><TitleText>Security</TitleText></Heading><Section lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:lastAmendedDate="2024-10-21" lims:fid="888405" lims:id="1492585"><Label>7</Label><Text>If the chief officer of customs for the place or area in which a special service is to be performed is of the opinion that security is required to guarantee the payment of charges incurred in providing that service, the person requesting that service must give security in accordance with the requirements of the <XRefExternal reference-type="regulation" link="SOR-2024-42">Financial Security (Electronic Means) Regulations</XRefExternal> and in an amount determined by the Minister.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="888418" lims:id="888418">SOR/91-274;
