lims:id="1495279"><Text><DefinedTermEn>Chief Executive Officer</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal>. (<DefinedTermFr>directeur général</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495280" lims:id="1495280"><Text><DefinedTermEn>Indigenous peoples</DefinedTermEn> has the meaning assigned by the definition <DefinitionRef>aboriginal peoples of Canada</DefinitionRef> in subsection 35(2) of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>. (<DefinedTermFr>peuples autochtones</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495281" lims:id="1495281"><Text><DefinedTermEn>land use agreement</DefinedTermEn> means a lease or licence of occupation, a grant, letters patent for public lands or any agreement between a person and His Majesty in right of Canada in respect of the use of land or a condominium unit in a park. (<DefinedTermFr>entente d’utilisation des terres</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495282" lims:id="1495282"><Text><DefinedTermEn>occupancy authorization</DefinedTermEn> means an authorization referred to in section <XRefInternal>17</XRefInternal>. (<DefinedTermFr>autorisation d’occupation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495283" lims:id="1495283"><Text><DefinedTermEn>parcel</DefinedTermEn> means any land or condominium unit that is the subject of a land use agreement. (<DefinedTermFr>parcelle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495284" lims:id="1495284"><Text><DefinedTermEn>permit</DefinedTermEn> means a permit issued under section <XRefInternal>11</XRefInternal>. (<DefinedTermFr>permis</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495285" lims:id="1495285"><Text><DefinedTermEn>project</DefinedTermEn> means any work or activity that is prohibited under subsection <XRefInternal>3</XRefInternal>(1). (<DefinedTermFr>projet</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495286" lims:id="1495286"><Text><DefinedTermEn>structure</DefinedTermEn> means any temporary or permanent physical work, such as any building, facility, fence or sign. (<DefinedTermFr>structure</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495287" lims:id="1495287"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495288" lims:id="1495288">Interpretation of “park”</MarginalNote><Label>(2)</Label><Text>In these Regulations, a reference to a “park” includes a reference to a “park reserve”.</Text></Subsection></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495289" lims:id="1495289" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495290" lims:id="1495290"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495291" lims:id="1495291">Exception — Banff</MarginalNote><Label>2</Label><Text>These Regulations do not apply in the town of Banff.</Text></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495292" lims:id="1495292" level="1"><TitleText>Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495293" lims:id="1495293"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495294" lims:id="1495294">Works, activities and land uses</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495295" lims:id="1495295"><Label>(1)</Label><Text>It is prohibited to do any of the following, other than in accordance with an authorization or permit issued by the superintendent:</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495296" lims:id="1495296"><Label>(a)</Label><Text>change the use of any land or structure, including by changing the intensity of that use;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495297" lims:id="1495297"><Label>(b)</Label><Text>construct, install, alter, move, remove or demolish a structure;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495298" lims:id="1495298"><Label>(c)</Label><Text>excavate the ground or dump fill;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495299" lims:id="1495299"><Label>(d)</Label><Text>materially alter the grade of the land or surface drainage patterns;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495300" lims:id="1495300"><Label>(e)</Label><Text>landscape an area with non‑living materials such as paving stones or make alterations to such landscaping;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495301" lims:id="1495301"><Label>(f)</Label><Text>plant a non‑native or fruit‑bearing plant species;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495302" lims:id="1495302"><Label>(g)</Label><Text>fell, move or damage a tree that</Text><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495303" lims:id="1495303"><Label>(i)</Label><Text>in the case of a deciduous tree, has a height of at least 4 m and, if measured from a height of 1 m above the ground, a diameter of at least 6 cm, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495304" lims:id="1495304"><Label>(ii)</Label><Text>in the case of a coniferous tree, has a height of at least 2.5 m;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495305" lims:id="1495305"><Label>(h)</Label><Text>install exterior lights, other than temporarily for the purpose of a seasonal event.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495306" lims:id="1495306"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495307" lims:id="1495307">Occupancy</MarginalNote><Label>(2)</Label><Text>It is prohibited to occupy a building, or any part of it, other than in accordance with an occupancy authorization.</Text></Subsection></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495308" lims:id="1495308"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495309" lims:id="1495309">Exceptions</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495310" lims:id="1495310"><Label>(1)</Label><Text>Subsection <XRefInternal>3</XRefInternal>(1) does not apply in respect of any of the following:</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495311" lims:id="1495311"><Label>(a)</Label><Text>a work or activity that is carried out solely for the purpose of maintaining or repairing a structure and that does not alter the colour or finish of the structure’s exterior;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495312" lims:id="1495312"><Label>(b)</Label><Text>a work or activity that is carried out solely for the purpose of altering the interior of a structure, unless it includes a work or activity that, if it were not carried out on public lands, would be subject to the requirements set out in any building, fire, plumbing, electrical or energy efficiency code that applies in the province where the park is located;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495313" lims:id="1495313"><Label>(c)</Label><Text>the moving, removal or demolition of a structure, unless it includes a work or activity that, if it were not carried out on public lands, would be subject to the requirements set out in any building, fire, plumbing, electrical or energy efficiency code that applies in the province where the park is located;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495314" lims:id="1495314"><Label>(d)</Label><Text>a work or activity that is carried out solely for the purpose of constructing, installing, maintaining or repairing a public roadway or utility;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495315" lims:id="1495315"><Label>(e)</Label><Text>the installation, for a period of less than 10 days, of an individual tent or group of tents if the tent or group of tents, as the case may be, occupy a total floor area of less than 10 m<Sup>2</Sup>, do not contain any commercial cooking equipment and are located more than 3 m from any structure other than a sign;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495316" lims:id="1495316"><Label>(f)</Label><Text>a work or activity that is carried out by the superintendent or by a person who is acting on behalf of the superintendent in accordance with any conditions specified by the superintendent.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495317" lims:id="1495317"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495318" lims:id="1495318">Exception — occupancy</MarginalNote><Label>(2)</Label><Text>Subsection <XRefInternal>3</XRefInternal>(2) does not apply in respect of the temporary occupancy of a building by the federal government or a provincial or municipal government or the temporary occupancy of a building for the purpose of an election, referendum or census.</Text></Subsection></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495319" lims:id="1495319"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495320" lims:id="1495320">Exception — public safety or emergency</MarginalNote><Label>5</Label><Text>Section <XRefInternal>3</XRefInternal> does not apply in respect of an activity carried out for the purpose of public safety or in response to an emergency.</Text></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495321" lims:id="1495321" level="1"><TitleText>Authorizations</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495322" lims:id="1495322"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495323" lims:id="1495323">Issuance</MarginalNote><Label>6</Label><Text>The superintendent may issue an authorization for any person to construct, install or alter a structure or to landscape an area with non‑living materials or make alterations to such landscaping, and may make the authorization subject to any conditions that the superintendent considers appropriate, unless</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495324" lims:id="1495324"><Label>(a)</Label><Text>it includes a work or activity that, if it were not carried out on public lands, would be subject to the requirements set out in any building, fire, plumbing, electrical or energy efficiency code that applies in the province where the park is located; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495325" lims:id="1495325"><Label>(b)</Label><Text>it includes a change to the use of any land or structure, including by changing the intensity of that use.</Text></Paragraph></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495326" lims:id="1495326" level="1"><TitleText>Permits</TitleText></Heading><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495327" lims:id="1495327" level="2"><TitleText>Application and Consultation</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495328" lims:id="1495328"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495329" lims:id="1495329">Application</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495330" lims:id="1495330"><Label>(1)</Label><Text>Any person who has a land use agreement may apply to the superintendent, in the form approved by the superintendent, for a permit to carry out a project.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495331" lims:id="1495331"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495332" lims:id="1495332">Requirements</MarginalNote><Label>(2)</Label><Text>The application must be accompanied by any fee payable in respect of that application under the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal> and must include</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495333" lims:id="1495333"><Label>(a)</Label><Text>the name of the applicant and their contact information;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495334" lims:id="1495334"><Label>(b)</Label><Text>a description of the project that the applicant proposes to carry out, including</Text><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495335" lims:id="1495335"><Label>(i)</Label><Text>its estimated costs,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495336" lims:id="1495336"><Label>(ii)</Label><Text>its location, including its municipal address, if any,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495337" lims:id="1495337"><Label>(iii)</Label><Text>a description of the project site that includes any existing structures and land features and their current uses,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495338" lims:id="1495338"><Label>(iv)</Label><Text>an indication of the type of structures proposed to be constructed, if any, and their proposed uses, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495339" lims:id="1495339"><Label>(v)</Label><Text>any alterations proposed to be made to any existing structures, including their removal, and any changes proposed to be made to their uses;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495340" lims:id="1495340"><Label>(c)</Label><Text>information demonstrating that the proposed project is in conformity with the provisions of the Act and these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495341" lims:id="1495341"><Label>(d)</Label><Text>in the case where the proposed project includes a work or activity that, if it were not carried out on public lands, would be subject to any building, fire, plumbing, electrical or energy efficiency code that applies in the province where the park is located, information demonstrating that the project meets the requirements set out in</Text><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495342" lims:id="1495342"><Label>(i)</Label><Text>any such code, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495343" lims:id="1495343"><Label>(ii)</Label><Text>any code on the same subject matter that is published by the National Research Council of Canada or by the Canadian Standards Association;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495344" lims:id="1495344"><Label>(e)</Label><Text>information demonstrating that the proposed project is in the interests of the park, having regard to</Text><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495345" lims:id="1495345"><Label>(i)</Label><Text>the nature and extent of the project,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495346" lims:id="1495346"><Label>(ii)</Label><Text>the park management plan and, in the case of a park community, the community plan,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495347" lims:id="1495347"><Label>(iii)</Label><Text>principles of environmental stewardship and heritage conservation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495348" lims:id="1495348"><Label>(iv)</Label><Text>any potential impact on natural and cultural resources in the park, including any proposed mitigation measures; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495349" lims:id="1495349"><Label>(f)</Label><Text>information concerning any potential impact of the proposed project on the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495350" lims:id="1495350"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495351" lims:id="1495351">Pre-application meeting</MarginalNote><Label>8</Label><Text>A person who wishes to apply for a permit to carry out a project may consult with the superintendent with respect to the land use planning process before submitting the application, if the proposed project includes</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495352" lims:id="1495352"><Label>(a)</Label><Text>the construction, installation, alteration, demolition or removal of a structure;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495353" lims:id="1495353"><Label>(b)</Label><Text>a change to the use of land or of a structure;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495354" lims:id="1495354"><Label>(c)</Label><Text>the installation, alteration or removal of a public utility;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495355" lims:id="1495355"><Label>(d)</Label><Text>the construction, alteration or removal of a public roadway, railroad, gondola or ski lift; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495356" lims:id="1495356"><Label>(e)</Label><Text>a work, activity or use that has any potential impact on the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>.</Text></Paragraph></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495357" lims:id="1495357"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495358" lims:id="1495358">Public consultation</MarginalNote><Label>9</Label><Text>The superintendent may consult with the public with respect to a proposed project before making a decision in respect of the issuance of the permit.</Text></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495359" lims:id="1495359"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495360" lims:id="1495360">Consultation with Indigenous peoples</MarginalNote><Label>10</Label><Text>If a proposed project has any potential impact on the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>, the superintendent must consult with the Indigenous peoples who may be affected before making a decision in respect of the issuance of the permit.</Text></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495361" lims:id="1495361" level="2"><TitleText>Issuance</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495362" lims:id="1495362"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495363" lims:id="1495363">Superintendent</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495364" lims:id="1495364"><Label>(1)</Label><Text>The superintendent may, on application, issue or amend a permit that authorizes a person to carry out a proposed project if</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495365" lims:id="1495365"><Label>(a)</Label><Text>the project is in conformity with the provisions of the Act and any Regulations made under it;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495366" lims:id="1495366"><Label>(b)</Label><Text>the project is in conformity with any land use agreement in respect of the parcel on which the project is to be located;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495367" lims:id="1495367"><Label>(c)</Label><Text>the project is in the interests of the park, having regard to</Text><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495368" lims:id="1495368"><Label>(i)</Label><Text>the nature and extent of the project,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495369" lims:id="1495369"><Label>(ii)</Label><Text>the park management plan and, in the case of a park community, the community plan,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495370" lims:id="1495370"><Label>(iii)</Label><Text>principles of responsible environmental stewardship and heritage conservation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495371" lims:id="1495371"><Label>(iv)</Label><Text>any potential impact on natural and cultural resources in the park, including any proposed mitigation measures; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495372" lims:id="1495372"><Label>(d)</Label><Text>in the case where the superintendent has carried out the consultation referred to in section <XRefInternal>10</XRefInternal>, the superintendent is satisfied that any potential impact on the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal> has been identified and taken into account in the permit application.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495373" lims:id="1495373"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495374" lims:id="1495374">Impact assessment</MarginalNote><Label>(2)</Label><Text>If the application for a permit concerns a project for which an impact assessment is required under the <XRefExternal reference-type="act" link="I-2.75">Impact Assessment Act</XRefExternal>, the <XRefExternal reference-type="act" link="M-0.2">Mackenzie Valley Resource Management Act</XRefExternal>, the <XRefExternal reference-type="act" link="Y-2.2">Yukon Environmental and Socio-economic Assessment Act</XRefExternal> or the <XRefExternal reference-type="act" link="N-28.75">Nunavut Planning and Project Assessment Act</XRefExternal>, a permit must not be issued until a final determination has been made under the applicable Act.</Text></Subsection></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495375" lims:id="1495375"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495376" lims:id="1495376">Conditions of permit</MarginalNote><Label>12</Label><Text>The superintendent may make a permit subject to any conditions that the superintendent considers appropriate, including any of the following:</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495377" lims:id="1495377"><Label>(a)</Label><Text>that certain types of plans, drawings, specifications or studies be prepared in respect of the project;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495378" lims:id="1495378"><Label>(b)</Label><Text>that certain types of work or activities be carried out by persons with a particular professional qualification, such as a professional accreditation or membership in a provincial licensing body;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495379" lims:id="1495379"><Label>(c)</Label><Text>that no plans, drawings or specifications that have been approved by the superintendent be altered unless the alteration is approved in writing by the superintendent and that the project is carried out in accordance with the approved plans, drawings and specifications;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495380" lims:id="1495380"><Label>(d)</Label><Text>that no person occupy or use any land or structure, or part of a structure, on the parcel where the project is carried out until the superintendent issues a certificate of completion in respect of the project;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495381" lims:id="1495381"><Label>(e)</Label><Text>that measures be implemented to mitigate the impact of the project.</Text></Paragraph></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495382" lims:id="1495382"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495383" lims:id="1495383">Mandatory condition</MarginalNote><Label>13</Label><Text>The superintendent must make every permit subject to a condition that the project meet the requirements set out in any building, fire, plumbing, electrical or energy efficiency code that applies in the province where the project is carried out or that is published by the National Research Council of Canada or by the Canadian Standards Association.</Text></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495384" lims:id="1495384"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495385" lims:id="1495385">Security</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495386" lims:id="1495386"><Label>(1)</Label><Text>The superintendent may make a permit subject to a condition that the permit holder deposit with the superintendent any security that the superintendent considers necessary as a guarantee that the permit holder will comply with the conditions of the permit and with these Regulations.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495387" lims:id="1495387"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495388" lims:id="1495388">Prohibition</MarginalNote><Label>(2)</Label><Text>It is prohibited for a permit holder to begin carrying out a project before the security specified by the permit has been deposited with the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495389" lims:id="1495389"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495390" lims:id="1495390">Return of security</MarginalNote><Label>(3)</Label><Text>The superintendent must return the security to the permit holder after the certificate of completion is issued with respect to the project.</Text></Subsection></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495391" lims:id="1495391" level="2"><TitleText>Expiry and Renewal</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495392" lims:id="1495392"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495393" lims:id="1495393">Expiry of permit</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495394" lims:id="1495394"><Label>(1)</Label><Text>A permit expires on the earlier of the second anniversary of the day on which the permit is issued or the expiry day specified in the permit.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495395" lims:id="1495395"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495396" lims:id="1495396">Renewal of permit</MarginalNote><Label>(2)</Label><Text>The superintendent may, if the conditions referred to in paragraphs <XRefInternal>11</XRefInternal>(1)(a) to (d) are met, renew a permit for a period of no more than 12 months and may make that permit subject to any additional conditions that the superintendent considers appropriate.</Text></Subsection></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495397" lims:id="1495397" level="1"><TitleText>Certificate of Completion</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495398" lims:id="1495398"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495399" lims:id="1495399">Issuance</MarginalNote><Label>16</Label><Text>The superintendent must issue a certificate of completion with respect to a project if the superintendent is satisfied that the permit holder has completed the project and has complied with all of the conditions of the permit and the requirements of these Regulations.</Text></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495400" lims:id="1495400"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495401" lims:id="1495401">Occupancy authorization</MarginalNote><Label>17</Label><Text>The superintendent may include, in the certificate of completion, an authorization for the occupancy of any building, or any part of a building, and may make the authorization subject to conditions, such as that the occupancy be for a particular purpose.</Text></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495402" lims:id="1495402" level="1"><TitleText>Suspension and Revocation</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495403" lims:id="1495403"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495404" lims:id="1495404">Suspension</MarginalNote><Label>18</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495405" lims:id="1495405"><Label>(1)</Label><Text>The superintendent may suspend a permit or an occupancy authorization if the person who holds the permit or authorization has contravened a requirement of these Regulations or any condition of the permit or occupancy authorization.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495406" lims:id="1495406"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495407" lims:id="1495407">Period of suspension</MarginalNote><Label>(2)</Label><Text>The permit or occupancy authorization is suspended until the day on which the superintendent notifies the person who holds the permit or authorization that it is reinstated.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495408" lims:id="1495408"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495409" lims:id="1495409">Reinstatement</MarginalNote><Label>(3)</Label><Text>The superintendent must reinstate a suspended permit or occupancy authorization</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495410" lims:id="1495410"><Label>(a)</Label><Text>if the contravention that led to the suspension has been corrected;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495411" lims:id="1495411"><Label>(b)</Label><Text>after a period of 30 days from the date of the suspension, unless proceedings have been instituted before the end of that period in respect of the alleged contravention; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495412" lims:id="1495412"><Label>(c)</Label><Text>if proceedings have been instituted, after the person who holds the permit or occupancy authorization has been found not guilty of an offence in respect of the alleged contravention or after the proceedings against them have been discontinued.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495413" lims:id="1495413"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495414" lims:id="1495414">Revocation</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495415" lims:id="1495415"><Label>(1)</Label><Text>The superintendent may revoke a permit or occupancy authorization if</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495416" lims:id="1495416"><Label>(a)</Label><Text>the superintendent has reasonable grounds to believe that the person who holds the permit or occupancy authorization has provided false or misleading information to the superintendent;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495417" lims:id="1495417"><Label>(b)</Label><Text>the person who holds the permit or occupancy authorization is convicted of an offence in respect of a contravention of any provision of these Regulations or any condition of the permit or occupancy authorization; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495418" lims:id="1495418"><Label>(c)</Label><Text>the permit or occupancy authorization has been suspended twice during the period for which it was issued, other than in any case where it was subsequently reinstated under paragraph <XRefInternal>18</XRefInternal>(3)(b) or (c).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495419" lims:id="1495419"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495420" lims:id="1495420">Conditions</MarginalNote><Label>(2)</Label><Text>The superintendent must not revoke a permit or occupancy authorization under paragraph (1)(a) unless the superintendent has given the holder of the permit or authorization written reasons and an opportunity to be heard, by written representation, in respect of the proposed revocation.</Text></Subsection></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495421" lims:id="1495421" level="1"><TitleText>Notice of Superintendent’s Decision</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495422" lims:id="1495422"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495423" lims:id="1495423">Notice</MarginalNote><Label>20</Label><Text>If the superintendent refuses to issue, amend or renew a permit or refuses to issue an occupancy authorization, or suspends or revokes a permit or occupancy authorization, the superintendent must provide notice in writing of their decision, including the reasons, to the applicant or to the holder of the permit or authorization, as the case may be.</Text></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495424" lims:id="1495424" level="1"><TitleText>Review of Superintendent’s Decision</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495425" lims:id="1495425"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495426" lims:id="1495426">Request for review</MarginalNote><Label>21</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495427" lims:id="1495427"><Label>(1)</Label><Text>Any person whose application for the issuance, amendment or renewal of a permit has been refused or whose permit has been suspended or revoked by the superintendent may request a review of the superintendent’s decision no later than the 30th day after the day on which they receive the notice referred to in section <XRefInternal>20</XRefInternal>. The request must be submitted in writing to the Chief Executive Officer and include the reasons for the request.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495428" lims:id="1495428"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495429" lims:id="1495429">Decision of Chief Executive Officer</MarginalNote><Label>(2)</Label><Text>The Chief Executive Officer must direct the superintendent to issue or reinstate the permit if, after carrying out the review, the Chief Executive Officer reaches a decision that differs from the superintendent’s decision with respect to</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495430" lims:id="1495430"><Label>(a)</Label><Text>in the case of a refusal to issue, amend or renew a permit, the requirements and matters to be considered under section <XRefInternal>11</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495431" lims:id="1495431"><Label>(b)</Label><Text>in the case of a suspension or revocation of a permit, the reasons set out in section <XRefInternal>18</XRefInternal> or <XRefInternal>19</XRefInternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495432" lims:id="1495432"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495433" lims:id="1495433">Conformity with codes</MarginalNote><Label>(3)</Label><Text>A decision of the superintendent is not reviewable by the Chief Executive Officer under this section if it is with respect to the conformity of a structure with any building, fire, plumbing, electrical or energy efficiency code that applies in the province where the project is carried out or that is published by the National Research Council of Canada or by the Canadian Standards Association.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495434" lims:id="1495434"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495435" lims:id="1495435">Notice of decision</MarginalNote><Label>(4)</Label><Text>The Chief Executive Officer must provide written notice of their decision, including the reasons, to the person who requested the review.</Text></Subsection></Section><Heading lims:inforce-start-date="2024-11-22" lims:enacted-date="2024-11-22" lims:fid="1495436" lims:id="1495436" level="1"><TitleText>Maintenance Standards and Other Requirements</TitleText></Heading><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495437" lims:id="1495437"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495438" lims:id="1495438">Maintenance</MarginalNote><Label>22</Label><Text>Every person who has a land use agreement for a parcel must ensure that any structure located on the parcel is maintained in good repair, including by ensuring that</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495439" lims:id="1495439"><Label>(a)</Label><Text>the structure is maintained in a structurally sound condition, capable of safely sustaining its own weight and any load to which it may be subject;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495440" lims:id="1495440"><Label>(b)</Label><Text>materials that have been damaged or that show evidence of rot or other deterioration are repaired or replaced;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495441" lims:id="1495441"><Label>(c)</Label><Text>exterior walls are maintained to prevent deterioration due to weather, rot or insects, including by painting, restoring or repairing the walls, coping and flashing and by weatherproofing joints;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495442" lims:id="1495442"><Label>(d)</Label><Text>the roof, including its fascia board, soffit, cornice and flashing, is maintained in a watertight condition to prevent leakage of water into the structure;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495443" lims:id="1495443"><Label>(e)</Label><Text>rotted or damaged doors, door frames, window frames, sashes and casings, broken glass and missing or defective door and window hardware are repaired or replaced;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495444" lims:id="1495444"><Label>(f)</Label><Text>outside stairs, porches, patios and decks are maintained free from defects that constitute a hazard, and all treads, risers and supporting structural members that are rotted or deteriorated are repaired or replaced;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495445" lims:id="1495445"><Label>(g)</Label><Text>all plumbing, drain pipes, water pipes and plumbing fixtures are maintained in good working order and are free from leaks and defects;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495446" lims:id="1495446"><Label>(h)</Label><Text>the electrical wiring and all electrical fixtures are maintained in good working order; The application must be accompanied by any fee payable in respect of that application under the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495471" lims:id="1495471"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495472" lims:id="1495472">Issuance</MarginalNote><Label>(2)</Label><Text>The superintendent must, on application, issue a compliance report in respect of the conformity of the structure or of the use with the requirements of these Regulations.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" compliance with the conditions of an authorization or permit or with the provisions of these Regulations, enter any place in a park</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495479" lims:id="1495479"><Label>(a)</Label><Text>in order to inspect a project carried out in accordance with an authorization or permit; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495480" lims:id="1495480"><Label>(b)</Label><Text>if the superintendent believes on reasonable grounds that a project has been, is being or is likely to be carried out in that place without an authorization or permit.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495481" lims:id="1495481"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495482" lims:id="1495482">Duty to assist</MarginalNote><Label>(2)</Label><Text>The owner or person in charge of the place, and every person in the place, must give all assistance that is reasonably required for the superintendent to exercise their powers or carry out their duties and functions under subsection (1) and must provide the superintendent with any information that the superintendent may reasonably require for that purpose.</Text></Subsection></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" order the taking of any action in the park that the superintendent considers appropriate to counter a threat to public health or to remedy the consequences of a contravention of these Regulations, including ordering a person to</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495486" lims:id="1495486"><Label>(a)</Label><Text>stop work on a project;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495487" lims:id="1495487"><Label>(b)</Label><Text>stop the use or occupation of a structure, in whole or in part; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495488" lims:id="1495488"><Label>(c)</Label><Text>demolish, remove, repair or replace a structure.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495489" lims:id="1495489"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495490" lims:id="1495490">Taking of action by superintendent</MarginalNote><Label>(2)</Label><Text>Subject to section <XRefInternal>30</XRefInternal>, if the action ordered by the superintendent under subsection (1) is not taken, the superintendent may, at any reasonable time and on reasonable notice, enter any place, including any structure, in which the action was to be taken, and may take that <DefinitionRef>subdivision</DefinitionRef></MarginalNote><Label>31</Label><Text>In sections <XRefInternal>32</XRefInternal> to <XRefInternal>40</XRefInternal>, <DefinedTermEn>subdivision</DefinedTermEn> means the division of a parcel into two or more parcels, the consolidation of two or more parcels or an alteration to the boundaries of parcels where they are adjoining.</Text></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495496" lims:id="1495496"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495497" lims:id="1495497">Application for preliminary approval</MarginalNote><Label>32</Label><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495498" lims:id="1495498"><Label>(1)</Label><Text>Any person who has a land use agreement may apply to the Minister, in the form approved by the Minister, for the preliminary approval of a subdivision.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495499" lims:id="1495499"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495500" lims:id="1495500">Requirements</MarginalNote><Label>(2)</Label><Text>The application must be accompanied by any fee payable in respect of that application under the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal> and must include</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495501" lims:id="1495501"><Label>(a)</Label><Text>the name of the applicant and their contact lims:id="1495503"><Label>(i)</Label><Text>its location, including the municipal address, if any,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495504" lims:id="1495504"><Label>(ii)</Label><Text>a description of the project site that includes a description of any existing structures and land features, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495505" lims:id="1495505"><Label>(iii)</Label><Text>an indication of the type of proposed structures, if any, and their proposed uses;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495506" lims:id="1495506"><Label>(c)</Label><Text>information demonstrating that the proposed subdivision is in the interests of the park, having regard to</Text><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495507" lims:id="1495507"><Label>(i)</Label><Text>the nature and extent of any proposed project,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495508" lims:id="1495508"><Label>(ii)</Label><Text>the park management plan and, in the case of a park community, the community plan, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495509" lims:id="1495509"><Label>(iii)</Label><Text>principles of responsible environmental stewardship and heritage conservation; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495510" lims:id="1495510"><Label>(d)</Label><Text>a description of the proposed subdivision, including</Text><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495511" lims:id="1495511"><Label>(i)</Label><Text>a site plan of the existing parcels and a description of their uses,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495512" lims:id="1495512"><Label>(ii)</Label><Text>a site plan of the parcels resulting from the subdivision and a description of their proposed uses, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495513" lims:id="1495513"><Label>(iii)</Label><Text>information demonstrating that the land subject to the subdivision is suitable for the proposed recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>, the superintendent must consult with the Indigenous peoples who may be affected before making a decision in respect of the preliminary approval of the subdivision.</Text></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:id="1495521">Preliminary approval</MarginalNote><Label>36</Label><Text>The Minister may grant a preliminary approval for a subdivision if</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495522" lims:id="1495522"><Label>(a)</Label><Text>each parcel that results from the subdivision has direct access to a public roadway;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495523" lims:id="1495523"><Label>(b)</Label><Text>any proposed project referred to in paragraph <XRefInternal>32</XRefInternal>(2)(b) is in conformity with the provisions of the Act and these Regulations; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495524" lims:id="1495524"><Label>(c)</Label><Text>the subdivision is in the interests of the park, having regard to</Text><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495525" lims:id="1495525"><Label>(i)</Label><Text>the nature and extent of any proposed project referred to in paragraph <XRefInternal>32</XRefInternal>(2)(b),</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495526" lims:id="1495526"><Label>(ii)</Label><Text>the park management plan and, in the case of a park community, the community plan, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495527" lims:id="1495527"><Label>(iii)</Label><Text>principles of responsible environmental stewardship and heritage conservation.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495528" lims:id="1495528"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495529" lims:id="1495529">Conditions of preliminary approval</MarginalNote><Label>37</Label><Text>The Minister may make the preliminary approval of the subdivision subject to any conditions that the Minister considers appropriate, including that the applicant</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495530" lims:id="1495530"><Label>(a)</Label><Text>make a request under the <XRefExternal reference-type="regulation" link="SOR-92-25">National Parks of Canada Lease and Licence of Occupation Regulations</XRefExternal> to amend or surrender a lease or licence of occupation for purposes relating to the subdivision before applying for a permit under subsection <XRefInternal>7</XRefInternal>(1) of these Regulations for a project that the applicant proposes to carry out on the land subject to the subdivision; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495531" lims:id="1495531"><Label>(b)</Label><Text>apply for the permit under subsection <XRefInternal>7</XRefInternal>(1) within one year after the day on which the preliminary approval is granted.</Text></Paragraph></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495532" lims:id="1495532"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495533" lims:id="1495533">Revocation of preliminary approval</MarginalNote><Label>38</Label><Text>The Minister may revoke the preliminary approval of the subdivision if</Text><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495534" lims:id="1495534"><Label>(a)</Label><Text>the Minister has reasonable grounds to believe that the applicant has provided false or misleading information; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495535" lims:id="1495535"><Label>(b)</Label><Text>the applicant is convicted of an offence in respect of a contravention of any provision of these Regulations or any condition of the preliminary a subdivision expires on the earlier of the second anniversary of the day on which the approval is granted by the Minister under section <XRefInternal>36</XRefInternal> or the day specified by the Minister in the approval.</Text></Section><Section lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:lastAmendedDate="2024-12-04" lims:fid="1495538" lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495540" lims:id="1495540"><Label>(1)</Label><Text>The Minister may, on application, grant a final approval of a subdivision that has received a preliminary approval under section <XRefInternal>36</XRefInternal> and make the final approval subject to any conditions that the Minister considers appropriate.</Text></Subsection><Subsection lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495541" lims:id="1495541"><MarginalNote lims:inforce-start-date="2024-12-04" lims:enacted-date="2024-11-22" lims:fid="1495542" lims:id="1495542">Fee</MarginalNote><Label>(2)</Label><Text>The application for the final approval must be accompanied by any fee payable in respect of that application under the <XRefExternal reference-type="act" link="P-0.4">Parks Canada Agency Act</XRefExternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2024-11-22" lims:id="1495546"><Label>(1)</Label><Text>It is prohibited for a person who holds a lease or licence of occupation for a parcel to enter into or be a party to a timeshare agreement in respect of the Regulations come into force between a person who holds a lease or licence of occupation for a parcel and another person that confers rights on the other person with respect to the use of the parcel or a structure located on the parcel for one or more periods in each year, whether the agreement is for a fixed or unfixed number of years.</Text></Subsection></Section><Heading any of the former regulations that is valid immediately before the day on which these Regulations come into force continues in effect for the remainder of the period during which it would have been in effect had these Regulations not come into force, unless it is suspended or revoked in accordance with these Regulations.</Text></Section><Section lims:inforce-start-date="2024-12-04" force is deemed to meet the requirements of section <XRefInternal>23</XRefInternal> and subsection <XRefInternal>26</XRefInternal>(1) with respect to the structure if, immediately before the day on which these Regulations come into force, the requirements applicable with respect to the structure under the former regulations were met.</Text></Subsection><Subsection
