(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-11-29" lims:fid="799927" lims:id="799927" generate-in-text="no"><Text><DefinedTermEn>competent authority</DefinedTermEn> means the <Emphasis style="italic">Ministerio de Comercio Exterior y Turismo</Emphasis>, the <Emphasis style="italic">Superintendencia Nacional de Administración Tributaria</Emphasis> or, if Peru provides written notice to Canada of their replacement, their successors. (<DefinedTermFr>autorité compétente</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-11-29" lims:fid="799928" lims:id="799928" generate-in-text="no"><Text><DefinedTermEn>customs administration</DefinedTermEn> means the authority responsible under the laws of Canada for the administration of customs laws and regulations. (<DefinedTermFr>administration douanière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-11-29" lims:fid="799929" lims:id="799929" generate-in-text="no"><Text><DefinedTermEn>goods</DefinedTermEn> means goods for which preferential tariff treatment under the CPFTA is claimed. (<DefinedTermFr>marchandises</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-11-29" lims:fid="799930" lims:id="799930" generate-in-text="no"><Text><DefinedTermEn>material</DefinedTermEn> means a good that is used in the production of another good, and includes a part or ingredient. (<DefinedTermFr>matière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-11-29" lims:fid="799931" lims:id="799931" generate-in-text="no"><Text><DefinedTermEn>verification letter</DefinedTermEn> means a letter that contains a request for information regarding the origin of goods that are the subject of a verification of origin. (<DefinedTermFr>lettre de vérification</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-11-29" lims:fid="799932" lims:id="799932" generate-in-text="no"><Text><DefinedTermEn>verification questionnaire</DefinedTermEn> means a questionnaire that contains requests for information regarding the origin of goods that are the subject of a verification of origin. (<DefinedTermFr>questionnaire de vérification</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-11-29" lims:fid="799933" lims:id="799933" generate-in-text="no"><Text><DefinedTermEn>verification visit</DefinedTermEn> means the entry into premises or a place for the purpose of conducting a verification of origin of goods under paragraph 42.1(1)(a) of the Act. (<DefinedTermFr>visite de vérification</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799934" lims:id="799934" level="1"><TitleText>Manner of Conducting a Verification of Origin</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799935" lims:id="799935"><Label>2</Label><Text>In addition to a verification visit, a verification of origin of goods may be conducted by reviewing the following:</Text><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799936" lims:id="799936"><Label>(a)</Label><Text>a verification questionnaire completed by</Text><Subparagraph lims:inforce-start-date="2013-11-29" lims:fid="799937" lims:id="799937"><Label>(i)</Label><Text>the exporter or producer of the goods, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-11-29" lims:fid="799938" lims:id="799938"><Label>(ii)</Label><Text>a producer or supplier of a material;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799939" lims:id="799939"><Label>(b)</Label><Text>a written response received from a person referred to in paragraph (a) to a verification letter; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799940" lims:id="799940"><Label>(c)</Label><Text>any other information received from a person referred to in paragraph (a).</Text></Paragraph></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799941" lims:id="799941" level="1"><TitleText>Verification Letters and Verification Questionnaires</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799942" lims:id="799942"><Label>3</Label><Text>A verification letter or verification questionnaire must</Text><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799943" lims:id="799943"><Label>(a)</Label><Text>identify the customs administration and the name and title of the officer sending the letter or questionnaire;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799944" lims:id="799944"><Label>(b)</Label><Text>describe the goods or materials that are the subject of the verification of origin; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799945" lims:id="799945"><Label>(c)</Label><Text>specify the period within which the letter must be answered or the questionnaire must be completed and returned, with the period being a minimum of 30 days beginning on the day on which the letter or the questionnaire is received.</Text></Paragraph></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799946" lims:id="799946" level="1"><TitleText>Extension of Time</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799947" lims:id="799947"><Label>4</Label><Text>A person who receives a verification letter or verification questionnaire may, on a single occasion and within the period specified in the letter or questionnaire, make a written request to the customs administration, asking for an extension of that period. The extension shall be granted for a further period of not more than 30 days.</Text></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799948" lims:id="799948" level="1"><TitleText>Verification Visit</TitleText></Heading><Heading lims:inforce-start-date="2013-11-29" lims:fid="799949" lims:id="799949" level="2"><TitleText>Premises</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799950" lims:id="799950"><Label>5</Label><Text>The following premises in Peru may be entered for the purposes of a verification visit:</Text><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799951" lims:id="799951"><Label>(a)</Label><Text>the premises of an exporter or producer of goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799952" lims:id="799952"><Label>(b)</Label><Text>the premises of a producer or supplier of a material.</Text></Paragraph></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799953" lims:id="799953" level="2"><TitleText>Conditions</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799954" lims:id="799954"><Label>6</Label><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799955" lims:id="799955"><Label>(1)</Label><Text>It is prohibited for an officer to conduct a verification visit until the following conditions are satisfied:</Text><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799956" lims:id="799956"><Label>(a)</Label><Text>an officer sends a written notice of the intention to conduct the visit to</Text><Subparagraph lims:inforce-start-date="2013-11-29" lims:fid="799957" lims:id="799957"><Label>(i)</Label><Text>the person whose premises are to be the subject of the visit,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-11-29" lims:fid="799958" lims:id="799958"><Label>(ii)</Label><Text>the competent authority, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-11-29" lims:fid="799959" lims:id="799959"><Label>(iii)</Label><Text>if requested by Peru, the Embassy of Peru located in Canada; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799960" lims:id="799960"><Label>(b)</Label><Text>the person whose premises are to be the subject of the visit consents in writing to the visit.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799961" lims:id="799961"><Label>(2)</Label><Text>The written notice of the verification visit shall specify</Text><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799962" lims:id="799962"><Label>(a)</Label><Text>the identity of the customs administration on behalf of which the notice is sent;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799963" lims:id="799963"><Label>(b)</Label><Text>the name and title of the officer who will conduct the visit;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799964" lims:id="799964"><Label>(c)</Label><Text>the name of the person whose premises are the subject of the visit;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799965" lims:id="799965"><Label>(d)</Label><Text>the date and the place of the visit;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799966" lims:id="799966"><Label>(e)</Label><Text>the object and scope of the visit, including a description of the goods or materials that are the subject of the verification of origin; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799967" lims:id="799967"><Label>(f)</Label><Text>the legal authority for the visit.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799968" lims:id="799968" level="2"><TitleText>Postponement</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799969" lims:id="799969"><Label>7</Label><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799970" lims:id="799970"><Label>(1)</Label><Text>A verification visit is postponed if, within 15 days after the day on which it receives a notice under subparagraph 6(1)(a)(ii), Peru sends a written request to the officer who sent the notice.</Text></Subsection><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799971" lims:id="799971"><Label>(2)</Label><Text>The postponement of the visit shall be for a period not exceeding 60 days, beginning on the day on which the notice is received, or for any longer period agreed to by Peru and the customs administration.</Text></Subsection><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799972" lims:id="799972"><Label>(3)</Label><Text>A person who receives a notice under subparagraph 6(1)(a)(i) may, on a single occasion and within 15 days after the day on which the notice is received, request the postponement of the verification visit by sending a written request for postponement to the officer who sent the notice.</Text></Subsection><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799973" lims:id="799973"><Label>(4)</Label><Text>A postponement of the visit shall be for a period not exceeding 60 days, beginning on the day on which the notice is received, or for any longer period agreed to by the customs administration.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799974" lims:id="799974" level="2"><TitleText>Observers</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799975" lims:id="799975"><Label>8</Label><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799976" lims:id="799976"><Label>(1)</Label><Text>A person who receives a notice under subparagraph 6(1)(a)(i) may designate two observers to be present during the verification visit.</Text></Subsection><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799977" lims:id="799977"><Label>(2)</Label><Text>Participation of the observers during the visit is limited to observation.</Text></Subsection><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799978" lims:id="799978"><Label>(3)</Label><Text>A person who designates observers must identify them to the officer conducting the verification visit.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799979" lims:id="799979" level="1"><TitleText>Denial or Withdrawal of Preferential Tariff Treatment Under Cpfta</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799980" lims:id="799980"><Label>9</Label><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799981" lims:id="799981"><Label>(1)</Label><Text>For the purpose of subsection 42.1(2) of the Act, the exporter and the producer of goods are, in relation to a verification of origin under paragraph 42.1(1)(a) of the Act, required to</Text><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799982" lims:id="799982"><Label>(a)</Label><Text>maintain, in accordance with the applicable laws of the country in which the verification of origin is conducted, records relevant to the determination of origin with respect to the goods that are required to be maintained under those laws;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799983" lims:id="799983"><Label>(b)</Label><Text>provide the officer conducting the verification of origin with access to those records; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-11-29" lims:fid="799984" lims:id="799984"><Label>(c)</Label><Text>reply to each verification letter or complete and return each verification questionnaire to the officer within the period specified under paragraph 3(c) or section 4, as the case may be.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799985" lims:id="799985"><Label>(2)</Label><Text>For the purpose of subsection 42.1(2) of the Act, consent to the verification visit shall be provided in writing by the exporter or producer within 30 days after the day on which the notice sent under subparagraph 6(1)(a)(i) is received.</Text></Subsection></Section><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799986" lims:id="799986"><Label>10</Label><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799987" lims:id="799987"><Label>(1)</Label><Text>An officer must send a written notice of the intent to re-determine the origin of goods under subsection 59(1) of the Act with any statement that is provided to an exporter or producer of goods pursuant to subsection 42.2(1) of the Act and that states that the goods that are the subject of a verification of origin are not eligible for preferential tariff treatment under the CPFTA.</Text></Subsection><Subsection lims:inforce-start-date="2013-11-29" lims:fid="799988" lims:id="799988"><Label>(2)</Label><Text>The written notice must specify the date after which preferential tariff treatment under the CPFTA may be denied or withdrawn in respect of the goods that are the subject of the verification of origin and the period during which the exporter or producer of the goods may provide written comments or additional information regarding the origin of those goods.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799989" lims:id="799989" level="1"><TitleText>Means of Communication</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799990" lims:id="799990"><Label>11</Label><Text>A verification letter, a verification questionnaire and the notices referred to in paragraph 6(1)(a) and section 10 must be sent by any means that produces confirmation of receipt.</Text></Section><Heading lims:inforce-start-date="2013-11-29" lims:fid="799991" lims:id="799991" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2013-11-29" lims:lastAmendedDate="2013-11-29" lims:fid="799992" lims:id="799992"><Label>12</Label><Text>These Regulations are deemed to have come into force on August 1, 2009.</Text></Section></Body></Regulation>
