lims:id="783306">Purpose</MarginalNote><Label>1</Label><Subsection lims:inforce-start-date="2013-01-01" lims:fid="783307" lims:id="783307"><Label>(1)</Label><Text>These Regulations establish a regime for the reduction of carbon dioxide (CO<Sub>2</Sub>) emissions that result from the production of electricity by means of thermal energy using coal as a fuel, whether in conjunction with other fuels or not.</Text></Subsection><Subsection lims:inforce-start-date="2013-01-01" lims:fid="783308" lims:id="783308"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="783309" lims:id="783309">Contents</MarginalNote><Label>(2)</Label><Text>These Regulations are divided into four Parts as follows:</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783310" lims:id="783310"><Label>(a)</Label><Text>Part 1 sets out a performance standard for the intensity of CO<Sub>2</Sub> emissions from regulated units and provides for exceptions based on the substitution of units and for temporary exemptions in relation to emergencies and units integrated with carbon capture and storage systems;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783311" lims:id="783311"><Label>(b)</Label><Text>Part 2 sets out requirements for the reporting, sending, recording and retention of information;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783312" lims:id="783312"><Label>(c)</Label><Text>Part 3 sets out quantification rules for determining the intensity of CO<Sub>2</Sub> emissions from regulated units; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783313" lims:id="783313"><Label>(d)</Label><Text>Part 4 provides dates for the coming into force of these Regulations and, in particular, delays the coming into force of the performance standard in respect of standby units until January 1, 2030.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2012-08-30" lims:fid="783314" lims:id="783314" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2018-11-30" lims:lastAmendedDate="2018-11-30" lims:fid="783315" lims:id="783315"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783316" lims:id="783316">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783317" lims:id="783317"><Label>(1)</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2018-11-30" lims:fid="783318" lims:id="783318" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="C-15.31">Canadian Environmental Protection Act, 1999</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783319" lims:id="783319" generate-in-text="no"><Text><DefinedTermEn>ASTM</DefinedTermEn> means ASTM International, formerly known as the American Society for Testing and Materials. (<DefinedTermFr>ASTM</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783320" lims:id="783320" generate-in-text="no"><Text><DefinedTermEn>auditor</DefinedTermEn> means a person who</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783321" lims:id="783321"><Label>(a)</Label><Text>is independent of the responsible person who is to be audited; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783322" lims:id="783322"><Label>(b)</Label><Text>has demonstrated knowledge of and experience in</Text><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783323" lims:id="783323"><Label>(i)</Label><Text>the certification, operation and relative accuracy test audit (RATA) of continuous emission monitoring systems, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783324" lims:id="783324"><Label>(ii)</Label><Text>quality assurance and quality control procedures in relation to those systems. (<DefinedTermFr>vérificateur</DefinedTermFr>)</Text></Subparagraph></Paragraph></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783325" lims:id="783325" generate-in-text="no"><Text><DefinedTermEn>authorized official</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783326" lims:id="783326"><Label>(a)</Label><Text>in respect of a responsible person that is a corporation, an officer of the corporation who is authorized to act on its behalf;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783327" lims:id="783327"><Label>(b)</Label><Text>in respect of a responsible person that is an individual, that person or a person authorized to act on that individual’s behalf; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783328" lims:id="783328"><Label>(c)</Label><Text>in respect of a responsible person that is another entity, a person authorized to act on that other entity’s behalf. (<DefinedTermFr>agent autorisé</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783329" lims:id="783329" generate-in-text="no"><Text><DefinedTermEn>biomass</DefinedTermEn> means a fuel that consists only of non-fossilized, biodegradable organic material that originates from plants or animals but does not come from a geological formation, and includes gases and liquids recovered from organic waste. (<DefinedTermFr>biomasse</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783330" lims:id="783330" generate-in-text="no"><Text><DefinedTermEn>calendar year</DefinedTermEn><Repealed>[Repealed, SOR/2018-263, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783331" lims:id="783331" generate-in-text="no"><Text><DefinedTermEn>capacity factor</DefinedTermEn>, in respect of a unit in a calendar year, means the ratio of the quantity of electricity referred to in section <XRefInternal>19</XRefInternal> that is produced by the unit to the quantity of electricity that would be produced by the unit in the calendar year if it were to operate at its production capacity at all times during the calendar year. (<DefinedTermFr>facteur de capacité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783332" lims:id="783332" generate-in-text="no"><Text><DefinedTermEn>coal</DefinedTermEn> includes petroleum coke and synthetic gas that is derived from coal or petroleum coke. (<DefinedTermFr>charbon</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783333" lims:id="783333" generate-in-text="no"><Text><DefinedTermEn>commissioning date</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783334" lims:id="783334"><Label>(a)</Label><Text>for an electricity generator that began producing electricity by means of thermal energy using a fuel other than coal, and not in conjunction with coal, but that was converted into a unit before June 23, 2010, the day on which that generator began to produce electricity for sale to the electric grid using fuel other than coal, and not in conjunction with coal; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783335" lims:id="783335"><Label>(b)</Label><Text>in any other case, the day on which a unit begins to produce electricity for sale to the electric grid. (<DefinedTermFr>date de mise en service</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783336" lims:id="783336" generate-in-text="no"><Text><DefinedTermEn>existing unit</DefinedTermEn> means a unit that is neither an old unit nor a new unit. (<DefinedTermFr>groupe existant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783337" lims:id="783337" generate-in-text="no"><Text><DefinedTermEn>fossil fuel</DefinedTermEn> means a fuel other than biomass. (<DefinedTermFr>combustible fossile</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783338" lims:id="783338" generate-in-text="no"><Text><DefinedTermEn>front end engineering design study</DefinedTermEn> means a collection of studies that provide the necessary details to support the carrying out of a construction project for the capture element of a carbon capture and storage system, including</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783339" lims:id="783339"><Label>(a)</Label><Text>technical drawings and documents that describe the capture element in sufficient detail to permit the tendering of a contract for its construction;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783340" lims:id="783340"><Label>(b)</Label><Text>an estimation of the capital cost of the capture element with a margin of error of ± 20%;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783341" lims:id="783341"><Label>(c)</Label><Text>a safety review of the capture element;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783342" lims:id="783342"><Label>(d)</Label><Text>a risk assessment of the carbon capture and storage system, namely an assessment of the risks that may delay or prevent the completion of the construction of the system, including technical, economic, environmental, legal and labour-related risks;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783343" lims:id="783343"><Label>(e)</Label><Text>a strategy to mitigate those risks; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783344" lims:id="783344"><Label>(f)</Label><Text>a detailed plan to carry out the construction of the carbon capture and storage system, including a schedule for the completion of its major steps. (<DefinedTermFr>étude d’ingénierie d’avant-projet détaillé</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783345" lims:id="783345" generate-in-text="no"><Text><DefinedTermEn>gasification system</DefinedTermEn> includes a gasification system that is in part located underground. (<DefinedTermFr>système de gazéification</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783346" lims:id="783346" generate-in-text="no"><Text><DefinedTermEn>GPA</DefinedTermEn> means the Gas Processors Association of the United States. (<DefinedTermFr>GPA</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783347" lims:id="783347" generate-in-text="no"><Text><DefinedTermEn>major equipment</DefinedTermEn> means a boiler, gasifier, shift reactor, turbine, air pollution control device, air separation unit, compressor, CO<Sub>2</Sub> separation system or other equipment that</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783348" lims:id="783348"><Label>(a)</Label><Text>is manufactured in accordance with specifications in its purchase order and takes more than 12 months after the date of the purchase order to be manufactured and delivered; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783349" lims:id="783349"><Label>(b)</Label><Text>costs $10,000,000 or more. (<DefinedTermFr>équipement majeur</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783350" lims:id="783350" generate-in-text="no"><Text><DefinedTermEn>new unit</DefinedTermEn> means a unit, other than an old unit, whose commissioning date is on or after July 1, 2015. (<DefinedTermFr>groupe nouveau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783351" lims:id="783351" generate-in-text="no"><Text><DefinedTermEn>old unit</DefinedTermEn> means a unit that has reached the end of its useful life but continues to produce electricity. (<DefinedTermFr>groupe en fin de vie utile</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783352" lims:id="783352" generate-in-text="no"><Text><DefinedTermEn>operator</DefinedTermEn> means the person that operates or has the charge, management or control of a unit. (<DefinedTermFr>exploitant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783353" lims:id="783353" generate-in-text="no"><Text><DefinedTermEn>power plant</DefinedTermEn> means all units, buildings and other structures and all stationary equipment — including equipment for the separation and initial pressurization of CO<Sub>2</Sub> of the capture element of a carbon capture and storage system — on a single site, or on adjacent sites that function as a single integrated site, whose primary purpose is the production of electricity for sale to the electric grid. (<DefinedTermFr>centrale électrique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783354" lims:id="783354" generate-in-text="no"><Text><DefinedTermEn>production capacity</DefinedTermEn>, in relation to a unit and a calendar year, means</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783355" lims:id="783355"><Label>(a)</Label><Text>the maximum continuous rating of the unit, expressed in MW, as most recently reported to a provincial authority of competent jurisdiction or to the electric system operator in the province where the unit is located; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783356" lims:id="783356"><Label>(b)</Label><Text>if no report has been made, the most electricity that was produced for sale by the unit, expressed in MW, during two continuous hours in that calendar year. (<DefinedTermFr>capacité de production</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783357" lims:id="783357" generate-in-text="no"><Text><DefinedTermEn>Reference Method</DefinedTermEn> means the document entitled <XRefExternal reference-type="standard">Reference Method for Source Testing: Quantification of Carbon Dioxide Releases by Continuous Emission Monitoring Systems from Thermal Power Generation</XRefExternal>, June 2012, published by the Department of the Environment. (<DefinedTermFr>Méthode de référence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783358" lims:id="783358" generate-in-text="no"><Text><DefinedTermEn>responsible person</DefinedTermEn> means an owner or operator of a unit. (<DefinedTermFr>personne responsable</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783359" lims:id="783359" generate-in-text="no"><Text><DefinedTermEn>standard m<Sup>3</Sup></DefinedTermEn> has the meaning assigned to a cubic metre at standard pressure and standard temperature by the definition <DefinitionRef>standard volume</DefinitionRef> in subsection 2(1) of the <XRefExternal reference-type="regulation" link="SOR-86-131">Electricity and Gas Inspection Regulations</XRefExternal>. (<DefinedTermFr>m<Sup>3</Sup> normalisé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783360" lims:id="783360" generate-in-text="no"><Text><DefinedTermEn>standby unit</DefinedTermEn> means an old unit that, for a given calendar year, operates at a capacity factor of 9% or less. (<DefinedTermFr>groupe de réserve</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783361" lims:id="783361" generate-in-text="no"><Text><DefinedTermEn>unit</DefinedTermEn> means physically connected equipment located in a power plant — including boilers and other combustion devices, gasifiers, reactors, turbines, generators and emission control devices — that operates together to produce electricity by means of thermal energy using coal as a fuel, whether in conjunction with other fuels or not. (<DefinedTermFr>groupe</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-11-30" lims:fid="783362" lims:id="783362" generate-in-text="no"><Text><DefinedTermEn>useful life</DefinedTermEn>, in respect of a unit, means the period that begins on the commissioning date and ends on</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783363" lims:id="783363"><Label>(a)</Label><Text>for a unit other than a unit referred to in paragraph (a) of the definition <DefinitionRef>commissioning date</DefinitionRef>,</Text><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783364" lims:id="783364"><Label>(i)</Label><Text>in the case of a unit whose commissioning date is before 1975, the earlier of</Text><Clause lims:inforce-start-date="2018-11-30" lims:fid="783365" lims:id="783365"><Label>(A)</Label><Text>December 31 of the calendar year that is 50 years after the commissioning date, and</Text></Clause><Clause lims:inforce-start-date="2018-11-30" lims:fid="783366" lims:id="783366"><Label>(B)</Label><Text>December 31, 2019, and</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783367" lims:id="783367"><Label>(ii)</Label><Text>in the case of a unit whose commissioning date is after 1974, the earlier of</Text><Clause lims:inforce-start-date="2018-11-30" lims:fid="783368" lims:id="783368"><Label>(A)</Label><Text>December 31 of the calendar year that is 50 years after the commissioning date, and</Text></Clause><Clause lims:inforce-start-date="2018-11-30" lims:fid="783369" lims:id="783369"><Label>(B)</Label><Text>December 31, 2029; and</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783370" lims:id="783370"><Label>(b)</Label><Text>for a unit referred to in paragraph (a) of the definition <DefinitionRef>commissioning date</DefinitionRef>, 18 months after the applicable date described in paragraph (a). (<DefinedTermFr>vie utile</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783371" lims:id="783371"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783372" lims:id="783372">Interpretation of incorporated documents</MarginalNote><Label>(2)</Label><Text>For the purposes of interpreting documents incorporated by reference into these Regulations, “should” must be read to mean “must” and any recommendation or suggestion must be read as an obligation.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783373" lims:id="783373"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783374" lims:id="783374">Standards incorporated by reference</MarginalNote><Label>(3)</Label><Text>Any standard of the ASTM or GPA that is incorporated by reference into these Regulations is incorporated as amended from time to time.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-11-30" lims:fid="783376" lims:id="783376">SOR/2018-263, s. must not, on average, emit with an intensity of more than 420 tonnes CO<Sub>2</Sub> emissions from the combustion of fossil fuels in the unit for each GWh of electricity produced by the unit during a calendar year.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783382" lims:id="783382"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783383" lims:id="783383">Quantification of electricity and emissions</MarginalNote><Label>(2)</Label><Text>The quantity of</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783384" lims:id="783384"><Label>(a)</Label><Text>electricity referred to in subsection (1) is to be determined in accordance with section <XRefInternal>19</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783385" lims:id="783385"><Label>(b)</Label><Text>emissions referred to in subsection (1) are to be determined in accordance with the applicable emissions released from the use of sorbent to control the emission of sulphur dioxide from a unit are to be included as CO<Sub>2</Sub> emissions from the combustion of fossil fuels in that unit for lims:inforce-start-date="2018-11-30" lims:fid="783391" lims:id="783391">CCS excluded</MarginalNote><Label>(5)</Label><Text>The CO<Sub>2</Sub> emissions from a unit referred to in subsection (1) do not include emissions that</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783392" lims:id="783392"><Label>(a)</Label><Text>are captured in accordance with the laws of Canada or a province that regulate that capture;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783393" lims:id="783393"><Label>(b)</Label><Text>are transported and stored in accordance with the laws of Canada or a province, or of the United States or one of its states, that regulate that transportation or storage, as the case may be; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783394" lims:id="783394"><Label>(c)</Label><Text>are not subsequently released into the atmosphere.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783395" lims:id="783395"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783396" lims:id="783396">Partial year application</MarginalNote><Label>(6)</Label><Text>For greater certainty, if subsection (1) applies in respect of a unit only for a period during a calendar year, that period is considered to be the unit must register the new unit by sending to the Minister, on or before 30 days after its commissioning date, a registration report that contains the information set out in Schedule lims:id="783404">Registration number</MarginalNote><Label>(2)</Label><Text>On receipt of the registration report, the Minister must assign a registration number to the unit and inform the responsible person of that registration number.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783405" lims:id="783405"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783406" lims:id="783406">Change of information</MarginalNote><Label>(3)</Label><Text>If the information provided in the registration report changes or if the unit is decommissioned, the responsible person must, not later than 30 days after the change or decommissioning, send to the Minister a notice that provides the updated information or that indicates the unit has been decommissioned, as the case may be, along with the date of the decommissioning.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-11-30" lims:fid="783408" of Units and Deferred Application</TitleText></Heading><Section lims:inforce-start-date="2018-11-30" lims:lastAmendedDate="2018-11-30" lims:fid="783410" lims:id="783410"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783411" lims:id="783411">Application of subsection <XRefInternal>3</XRefInternal>(1) — substituted units</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783412" lims:id="783412"><Label>(1)</Label><Text>For the purpose of subsection <XRefInternal>3</XRefInternal>(1), a responsible person for a unit (referred to in this section as the “original unit”) that reaches the end of its useful life during a calendar year may apply to the Minister to have another unit (referred to in this section as the “substituted unit”) substituted for the original unit if the following conditions are satisfied:</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783413" lims:id="783413"><Label>(a)</Label><Text>the substituted unit is an existing unit;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783414" lims:id="783414"><Label>(b)</Label><Text>the original unit and the substituted unit have a common owner who has an ownership interest of 50% or more in each of those two units;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783415" lims:id="783415"><Label>(c)</Label><Text>those two units are located in the same province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783416" lims:id="783416"><Label>(d)</Label><Text>the production capacity of the substituted unit, during the calendar year preceding the calendar year in which the application is made, was equal to or greater than the production capacity of the original unit during that preceding calendar year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783417" lims:id="783417"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783418" lims:id="783418">Period of application</MarginalNote><Label>(2)</Label><Text>The application must be made in the period that begins on January 1 and that ends on May 31 of the calendar year during which the unit reaches its end of life.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783419" lims:id="783419"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783420" lims:id="783420">Content of application</MarginalNote><Label>(3)</Label><Text>The application must include the registration number of the original unit and of the substituted unit and information, with supporting documentation, to demonstrate that the conditions of paragraphs (1)(b) to (d) are satisfied.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783421" lims:id="783421"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783422" lims:id="783422">Granting of substitution</MarginalNote><Label>(4)</Label><Text>The Minister must, within 30 days after receiving the application, grant the substitution if the following conditions are satisfied:</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783423" lims:id="783423"><Label>(a)</Label><Text>the substituted unit is not a shut-down unit referred to in subsection <XRefInternal>6</XRefInternal>(4);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783424" lims:id="783424"><Label>(b)</Label><Text>the substituted unit is not involved in an exemption granted under subsection <XRefInternal>14</XRefInternal>(4); and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783425" lims:id="783425"><Label>(c)</Label><Text>the Minister is satisfied that the conditions of paragraphs (1)(a) to (d) are satisfied.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783426" lims:id="783426"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783427" lims:id="783427">Effect</MarginalNote><Label>(5)</Label><Text>On the granting of the substitution, subsection <XRefInternal>3</XRefInternal>(1) applies in respect of the substituted unit rather than the original unit as of the later of</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783428" lims:id="783428"><Label>(a)</Label><Text>July 1, 2015, and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783429" lims:id="783429"><Label>(b)</Label><Text>the beginning of the calendar year that follows the calendar year in which the application is made.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783430" lims:id="783430"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783431" lims:id="783431">Cessation of effect</MarginalNote><Label>(6)</Label><Text>The substitution referred to in subsection (5) ceases to have effect, and subsection <XRefInternal>3</XRefInternal>(1) applies in respect of the original unit, as of the earliest of</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783432" lims:id="783432"><Label>(a)</Label><Text>the calendar year that follows the day on which the responsible person for that unit and the substituted unit sends the Minister a notice indicating that they wish the substitution to no longer have an effect,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783433" lims:id="783433"><Label>(b)</Label><Text>the calendar year that follows the day on which the condition of paragraph (1)(b) is no longer satisfied,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783434" lims:id="783434"><Label>(c)</Label><Text>the calendar year that follows a calendar year during which the production capacity of the original unit was more than the production capacity of the substituted unit referred to in paragraph (1)(d),</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783435" lims:id="783435"><Label>(d)</Label><Text>the calendar year that follows the end of the useful life of the substituted unit, and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783436" lims:id="783436"><Label>(e)</Label><Text>a calendar year during which electricity is produced by the substituted unit by means of thermal energy using fossil fuel other than coal, and not in conjunction with coal.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-11-30" lims:fid="783438" lims:id="783438">SOR/2012-167, s. 5; SOR/2018-263, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="783439" lims:id="783439"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783440" lims:id="783440">Deferral of application of subsection <XRefInternal>3</XRefInternal>(1)</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783441" lims:id="783441"><Label>(1)</Label><Text>A responsible person for an existing unit that ceases to produce electricity after June 30, 2015 (referred to in this section as the “shut-down unit”) may apply to the Minister to have the application of subsection <XRefInternal>3</XRefInternal>(1) deferred in respect of another unit or units (referred to in this section as the “deferred units”) for the number of years in the period that begins on January 1 of the calendar year that follows that cessation and that ends on December 31 of the calendar year in which the useful life of the shut-down unit ends. If the application is granted, the application of subsection <XRefInternal>3</XRefInternal>(1) is, in respect of each calendar year in that period, deferred for the deferred unit and the calendar year that begins after the end of that deferred unit’s useful life that the responsible person specifies in their application.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783442" lims:id="783442"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783443" lims:id="783443">Conditions of application for deferral</MarginalNote><Label>(2)</Label><Text>The application may be made only if the following conditions are satisfied:</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783444" lims:id="783444"><Label>(a)</Label><Text>the shut-down unit and each of the specified deferred units have a common owner who has an ownership interest of 50% or more in the shut-down unit and in each of those specified deferred units;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783445" lims:id="783445"><Label>(b)</Label><Text>the shut-down unit and each of those specified deferred units are located in the same province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783446" lims:id="783446"><Label>(c)</Label><Text>the production capacity of the shut-down unit, during the calendar year preceding the day on which it ceased production, was greater than or equal to the production capacity of each of those specified deferred units during the calendar year preceding the day on which the application was made.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783447" lims:id="783447"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783448" lims:id="783448">Content of application</MarginalNote><Label>(3)</Label><Text>The application must be made on or before May 31 of the calendar year preceding the earliest of the specified calendar years referred to in subsection (1) and must</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783449" lims:id="783449"><Label>(a)</Label><Text>indicate the calendar years included in the period referred to in subsection (1);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783450" lims:id="783450"><Label>(b)</Label><Text>specify the deferred unit referred to in subsection (1) in respect of each of the calendar years referred to in paragraph (a);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783451" lims:id="783451"><Label>(c)</Label><Text>for each of those specified deferred units in respect of each of those calendar years, specify the calendar year that begins after the end of the useful life of the unit for which the application of subsection <XRefInternal>3</XRefInternal>(1) is to be deferred;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783452" lims:id="783452"><Label>(d)</Label><Text>indicate the registration number of the shut-down unit and of each of the specified deferred units; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783453" lims:id="783453"><Label>(e)</Label><Text>include information, with supporting documentation, to demonstrate that the conditions of paragraphs (2)(a) to (c) are satisfied.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783454" lims:id="783454"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783455" lims:id="783455">Granting of deferral</MarginalNote><Label>(4)</Label><Text>The Minister must, within 30 days after receiving the application, grant the deferral if the following conditions are satisfied:</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783456" lims:id="783456"><Label>(a)</Label><Text>the shut-down unit is not a substituted unit referred to in subsection <XRefInternal>5</XRefInternal>(5);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783457" lims:id="783457"><Label>(b)</Label><Text>no deferred unit is a unit that is involved in a temporary exemption granted under subsection <XRefInternal>9</XRefInternal>(3); and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783458" lims:id="783458"><Label>(c)</Label><Text>the Minister is satisfied that the conditions of paragraphs (2)(a) to (c) are satisfied;</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783459" lims:id="783459"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783460" lims:id="783460">No recommencement of shut-down unit</MarginalNote><Label>(5)</Label><Text>It is prohibited for any person to cause the shut-down unit to recommence producing electricity after the application of subsection <XRefInternal>3</XRefInternal>(1) is deferred in respect of a specified deferred unit.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783461" lims:id="783461"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783462" lims:id="783462">Changes to deferred units</MarginalNote><Label>(6)</Label><Text>The responsible person referred to in subsection (1) may change the specified deferred unit in respect of a specified calendar year referred to in paragraph (3)(c) by sending a notice to the Minister if that specified calendar year is not one for which the application of subsection <XRefInternal>3</XRefInternal>(1) has been deferred. The notice must include</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783463" lims:id="783463"><Label>(a)</Label><Text>the registration number of the proposed new specified deferred unit;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783464" lims:id="783464"><Label>(b)</Label><Text>the calendar year that begins after the end of the useful life of the proposed new specified deferred unit for which the application of subsection <XRefInternal>3</XRefInternal>(1) is to be deferred; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783465" lims:id="783465"><Label>(c)</Label><Text>information, with supporting documentation, to demonstrate that the conditions of paragraphs (2)(a) and (b) are satisfied in respect of the proposed new specified deferred unit and the condition of paragraph (2)(c) is satisfied in respect of each specified deferred unit, including the proposed new specified deferred unit, during the calendar year preceding the day on which the notification is sent.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783466" lims:id="783466"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783467" lims:id="783467">Allowance of changes</MarginalNote><Label>(7)</Label><Text>The Minister must, within 30 days after receiving the notification, allow the change if the Minister is satisfied that the demonstration referred to in subsection (6) has been made.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783468" lims:id="783468"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783469" lims:id="783469">Cessation of effect</MarginalNote><Label>(8)</Label><Text>Despite subsection (1), the deferral ceases to have effect and subsection <XRefInternal>3</XRefInternal>(1) applies in respect of the specified deferred units as of the earliest of</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783470" lims:id="783470"><Label>(a)</Label><Text>the calendar year that follows the calendar year in which the application is made, if a shut-down unit referred to in subsection (1) has not ceased to produce electricity by January 1 of that following calendar year,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783471" lims:id="783471"><Label>(b)</Label><Text>any calendar year in which a shut-down unit referred to in subsection (1) recommences to produce electricity,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783472" lims:id="783472"><Label>(c)</Label><Text>the calendar year that follows the day on which the Minister receives a notice from the responsible person for the shut-down unit and the deferred units indicating that they wish the deferral to no longer have an effect,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783473" lims:id="783473"><Label>(d)</Label><Text>the calendar year that follows the day on which the condition of paragraph (2)(a) is no longer satisfied, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783474" lims:id="783474"><Label>(e)</Label><Text>the calendar year that follows a specified calendar year referred to in paragraph (3)(c) in which the specified deferred unit referred to in that paragraph had a production capacity greater than the production capacity of the shut-down unit during the calendar year preceding the day on which it ceased production.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2012-08-30" lims:fid="783475" lims:id="783475" level="2"><TitleText>Emergency Circumstances</TitleText></Heading><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="783476" lims:id="783476"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783477" lims:id="783477">Conditions for application</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783478" lims:id="783478"><Label>(1)</Label><Text>A responsible person for a unit may, under emergency circumstances described in subsection (2), apply to the Minister for an exemption from the application of subsection <XRefInternal>3</XRefInternal>(1) in respect of the unit if the following conditions are satisfied:</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783479" lims:id="783479"><Label>(a)</Label><Text>as a result of the emergency circumstances, there is a disruption, or a significant risk of disruption, to the electricity supply in the province where the unit is located; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783480" lims:id="783480"><Label>(b)</Label><Text>the operation of the unit will end, decrease the risk of, or mitigate the consequences of, the disruption.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783481" lims:id="783481"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783482" lims:id="783482">Criteria of emergency circumstances</MarginalNote><Label>(2)</Label><Text>An emergency circumstance is a circumstance</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783483" lims:id="783483"><Label>(a)</Label><Text>that arises due to an extraordinary, unforeseen and irresistible event; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783484" lims:id="783484"><Label>(b)</Label><Text>under which one or more of the measures referred to in paragraph 1(a) of the <XRefExternal reference-type="regulation" link="SOR-2010-138">Regulations Prescribing Circumstances for Granting Waivers Pursuant to Section 147 of the Act</XRefExternal> has been made or issued in the province where the unit is located.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783485" lims:id="783485"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783486" lims:id="783486">Application</MarginalNote><Label>(3)</Label><Text>The responsible person must, within 15 days after the emergency circumstance arises, provide the Minister with their application. The application must include the unit’s registration number, the date on which the emergency circumstance arose and information, with supporting documentation, to demonstrate that the conditions of paragraphs (1)(a) and (b) are satisfied.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783487" lims:id="783487"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783488" lims:id="783488">Granting of exemption</MarginalNote><Label>(4)</Label><Text>The Minister must, within 30 days after receiving the application, grant the exemption if the Minister is satisfied that the conditions of paragraphs (1)(a) and (b) are satisfied.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783489" lims:id="783489"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783490" lims:id="783490">Period of exemption</MarginalNote><Label>(5)</Label><Text>The exemption has effect as of the day on which the emergency circumstance arose and ceases to have effect on the earliest of</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783491" lims:id="783491"><Label>(a)</Label><Text>the day that is 90 days after that day,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783492" lims:id="783492"><Label>(b)</Label><Text>the day specified by the Minister, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783493" lims:id="783493"><Label>(c)</Label><Text>the earlier of</Text><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="783494" lims:id="783494"><Label>(i)</Label><Text>the day on which the event referred to in paragraph (2)(a) ceases to cause a disruption, or a significant risk of disruption, to the electricity supply in the province where the unit is located, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="783495" lims:id="783495"><Label>(ii)</Label><Text>the day on which the measure, if any, referred to in paragraph (2)(b) ceases to be in effect.</Text></Subparagraph></Paragraph></Subsection></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="783496" lims:id="783496"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783497" lims:id="783497">Extension</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783498" lims:id="783498"><Label>(1)</Label><Text>If paragraphs <XRefInternal>7</XRefInternal>(1)(a) and (b) will continue to apply on and after the day on which an exemption granted under subsection <XRefInternal>7</XRefInternal>(4) is to cease to have effect, the responsible person may, before that day, apply to the Minister for an extension of the exemption.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783499" lims:id="783499"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783500" lims:id="783500">Application</MarginalNote><Label>(2)</Label><Text>The application must include the unit’s registration number and information, with supporting documentation, to demonstrate that</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783501" lims:id="783501"><Label>(a)</Label><Text>paragraphs <XRefInternal>7</XRefInternal>(1)(a) and (b) will continue to apply after the day on which the exemption is to cease to have effect; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783502" lims:id="783502"><Label>(b)</Label><Text>steps — other than the operation of the unit during the period of the exemption — have been, and are being, taken to end, decrease the risk of, or mitigate the consequences of, the disruption.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783503" lims:id="783503"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783504" lims:id="783504">Granting of extension</MarginalNote><Label>(3)</Label><Text>The Minister must, within 15 days after receiving the application, grant the extension if the Minister is satisfied that paragraphs (2)(a) and (b) have been demonstrated.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783505" lims:id="783505"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783506" lims:id="783506">Duration</MarginalNote><Label>(4)</Label><Text>The extension ceases to have effect on the earliest of</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783507" lims:id="783507"><Label>(a)</Label><Text>the day that is 90 days after the day on which the application for the extension was made,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783508" lims:id="783508"><Label>(b)</Label><Text>the day specified by the Minister, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783509" lims:id="783509"><Label>(c)</Label><Text>the day referred to in paragraph <XRefInternal>7</XRefInternal>(5)(c).</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2012-08-30" lims:fid="783510" lims:id="783510" level="2"><TitleText>Carbon Capture and Storage</TitleText></Heading><Heading lims:inforce-start-date="2012-08-30" lims:fid="783511" lims:id="783511" level="3"><TitleText>Temporary Exemption — System to be Constructed</TitleText></Heading><Section lims:inforce-start-date="2018-11-30" lims:lastAmendedDate="2018-11-30" lims:fid="783512" lims:id="783512"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783513" lims:id="783513">Application</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783514" lims:id="783514"><Label>(1)</Label><Text>A responsible person for a new unit or an old unit may apply to the Minister for a temporary exemption from the application of subsection <XRefInternal>3</XRefInternal>(1) in respect of the unit if</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783515" lims:id="783515"><Label>(a)</Label><Text>in the case of a new unit, the unit is designed to permit its integration with a carbon capture and storage system that is to be constructed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783516" lims:id="783516"><Label>(b)</Label><Text>in the case of an old unit, the unit may be retrofitted to permit its integration with a carbon capture and storage system that is to be constructed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783517" lims:id="783517"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783518" lims:id="783518">Granting and content of application</MarginalNote><Label>(2)</Label><Text>The application must indicate the unit’s registration number and include the following supporting documents and information:</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783519" lims:id="783519"><Label>(a)</Label><Text>a declaration that includes statements indicating that</Text><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783520" lims:id="783520"><Label>(i)</Label><Text>based on the economic feasibility study referred to in paragraph (b), the unit, when operating with an integrated carbon capture and storage system is, to the best of the responsible person’s knowledge and belief, economically viable, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783521" lims:id="783521"><Label>(ii)</Label><Text>based on the technical feasibility study referred to in paragraph (c) and the implementation plan referred to in paragraph (e), the responsible person expects to satisfy the requirements set out in section <XRefInternal>10</XRefInternal> and, as a result, to be in compliance with subsection <XRefInternal>3</XRefInternal>(1) by January 1, 2025;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783522" lims:id="783522"><Label>(b)</Label><Text>an economic feasibility study that demonstrates the economic viability of the unit when it operates with an integrated carbon capture and storage system and that</Text><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783523" lims:id="783523"><Label>(i)</Label><Text>provides project cost estimates, with their margin of error, for the construction of the integrated carbon capture and storage system, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783524" lims:id="783524"><Label>(ii)</Label><Text>identifies the source of financing for that construction;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783525" lims:id="783525"><Label>(c)</Label><Text>a technical feasibility study that establishes — based on information referred to in Schedule 2 related to the capture, transportation and storage elements of the carbon capture and storage system — that there are no insurmountable technical barriers to carrying out the following activities:</Text><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783526" lims:id="783526"><Label>(i)</Label><Text>capturing a sufficient volume of CO<Sub>2</Sub> emissions from the combustion of fossil fuels in the unit to enable the responsible person to comply with subsection <XRefInternal>3</XRefInternal>(1),</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783527" lims:id="783527"><Label>(ii)</Label><Text>transporting the captured CO<Sub>2</Sub> emissions to suitable geological sites for storage, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783528" lims:id="783528"><Label>(iii)</Label><Text>storing the captured CO<Sub>2</Sub> emissions in those suitable geological sites;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783529" lims:id="783529"><Label>(d)</Label><Text>a description of any work that has been done to satisfy the requirements set out in section <XRefInternal>10</XRefInternal>, along with the information referred to in Schedule 3 with respect to that work; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783530" lims:id="783530"><Label>(e)</Label><Text>an implementation plan that provides a description of the work to be done, with a schedule for the steps necessary to achieve the following objectives:</Text><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783531" lims:id="783531"><Label>(i)</Label><Text>satisfaction of the requirements set out in section <XRefInternal>10</XRefInternal>, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783532" lims:id="783532"><Label>(ii)</Label><Text>compliance of the responsible person with subsection <XRefInternal>3</XRefInternal>(1) by January 1, 2025 when the unit is operating with an integrated carbon capture and storage system that captures CO<Sub>2</Sub> emissions from the combustion of fossil fuels in the unit in accordance with the laws of Canada or a province that regulate that capture and that transports and stores those emissions in accordance with the laws of Canada or a province, or of the United States or one of its states, that regulate that transportation or storage, as the case may be.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783533" lims:id="783533"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783534" lims:id="783534">Granting of temporary exemption</MarginalNote><Label>(3)</Label><Text>The Minister must, within 120 days after receiving the application, grant the temporary exemption if</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783535" lims:id="783535"><Label>(a)</Label><Text>the application includes the documents referred to in subsection (2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783536" lims:id="783536"><Label>(b)</Label><Text>the information contained in those documents can reasonably be regarded as establishing that</Text><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783537" lims:id="783537"><Label>(i)</Label><Text>the unit, when operating with an integrated carbon capture and storage system, will be economically viable,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783538" lims:id="783538"><Label>(ii)</Label><Text>the capture, transportation and storage elements of the carbon capture and storage system will be technically feasible,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783539" lims:id="783539"><Label>(iii)</Label><Text>if applicable, a requirement set out in section <XRefInternal>10</XRefInternal> has been satisfied by work done before the application was made, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-11-30" lims:fid="783540" lims:id="783540"><Label>(iv)</Label><Text>the responsible person will satisfy the requirements set out in section <XRefInternal>10</XRefInternal> and, as a result, will be in compliance with subsection <XRefInternal>3</XRefInternal>(1) by January 1, 2025 when the unit is operating with an integrated carbon capture and storage system.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783541" lims:id="783541"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783542" lims:id="783542">Duration</MarginalNote><Label>(4)</Label><Text>A temporary exemption, unless revoked under section <XRefInternal>13</XRefInternal>, remains in effect until December 31, 2024.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-11-30" lims:fid="783544" lims:id="783544">SOR/2018-263, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-11-30" lims:lastAmendedDate="2018-11-30" lims:fid="783545" lims:id="783545"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783546" lims:id="783546">Requirements</MarginalNote><Label>10</Label><Text>A responsible person who has been granted a temporary exemption in respect of a unit under subsection <XRefInternal>9</XRefInternal>(3) must satisfy the following requirements:</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783547" lims:id="783547"><Label>(a)</Label><Text>carry out a front end engineering design study by January 1, 2020;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783548" lims:id="783548"><Label>(b)</Label><Text>purchase any major equipment that is necessary for the capture element by January 1, 2021;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783549" lims:id="783549"><Label>(c)</Label><Text>enter into any contract required for the transportation and storage of CO<Sub>2</Sub> emissions from the unit by January 1, 2022;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783550" lims:id="783550"><Label>(d)</Label><Text>take all necessary steps to obtain all permits or approvals required in relation to the construction of the capture element by January 1, 2022; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783551" lims:id="783551"><Label>(e)</Label><Text>ensure that the unit, when operating with an integrated carbon capture and storage system, captures CO<Sub>2</Sub> emissions from the combustion of fossil fuels in the unit in accordance with the laws of Canada or a province that regulate that capture and transports and stores those emissions in accordance with the laws of Canada or a province, or of the United States or one of its states, that regulate that transportation or storage, as the case may be, by January 1, 2024.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-11-30" lims:fid="783553" lims:id="783553">SOR/2018-263, s. 6(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2013-01-01" lims:lastAmendedDate="2013-01-01" lims:fid="783554" lims:id="783554"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="783555" lims:id="783555">Implementation report</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2013-01-01" lims:fid="783556" lims:id="783556"><Label>(1)</Label><Text>A responsible person who has been granted a temporary exemption in respect of a unit must, for each calendar year following the granting of the temporary exemption, provide the Minister with an implementation report that indicates the unit’s registration number and includes supporting documents that contain the following information:</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783557" lims:id="783557"><Label>(a)</Label><Text>the steps taken during that year to construct the capture, transportation and storage elements of the carbon capture and storage system and to integrate those elements with the unit;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783558" lims:id="783558"><Label>(b)</Label><Text>any requirement set out in section <XRefInternal>10</XRefInternal> that was satisfied during that year, along with the information and documents referred to in Schedule 3;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783559" lims:id="783559"><Label>(c)</Label><Text>a description of the manner in which those steps were carried out or those requirements were satisfied;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783560" lims:id="783560"><Label>(d)</Label><Text>any changes, with respect to the information most recently provided to the Minister, to the proposed engineering design for the capture element, to the preferred transportation methods or routes or to the preferred storage sites, for the carbon capture and storage system; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783561" lims:id="783561"><Label>(e)</Label><Text>a description of any steps necessary, with a schedule for those steps, to achieve the following objectives:</Text><Subparagraph lims:inforce-start-date="2013-01-01" lims:fid="783562" lims:id="783562"><Label>(i)</Label><Text>the satisfaction of any requirements set out in section <XRefInternal>10</XRefInternal> that remain to be satisfied, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-01-01" lims:fid="783563" lims:id="783563"><Label>(ii)</Label><Text>the compliance of the responsible person with subsection <XRefInternal>3</XRefInternal>(1) by January 1, 2025 when the unit is operating with an integrated carbon capture and storage system that captures CO<Sub>2</Sub> emissions from the combustion of fossil fuels in the unit in accordance with laws of Canada or a province that regulate that capture and transports and stores those emissions in accordance with laws of Canada or a province, or of the United States or one of its states, that regulate, as the case may be, that transportation or storage.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-01-01" lims:fid="783564" lims:id="783564"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="783565" lims:id="783565">Due date</MarginalNote><Label>(2)</Label><Text>The implementation report must be provided by March 31 of the calendar year that follows the calendar year in question.</Text></Subsection></Section><Section lims:inforce-start-date="2013-01-01" lims:lastAmendedDate="2013-01-01" lims:fid="783566" lims:id="783566"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="783567" lims:id="783567">Updated information</MarginalNote><Label>12</Label><Text>If any event occurs or any circumstance arises that may prejudice the ability of the responsible person to achieve an objective referred to in paragraph <XRefInternal>11</XRefInternal>(1)(e), the responsible person must send to the Minister, without delay, a notice that indicates the unit’s registration number and contains the following information:</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783568" lims:id="783568"><Label>(a)</Label><Text>a description of the event or circumstance and the nature of the prejudice;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783569" lims:id="783569"><Label>(b)</Label><Text>an explanation of how the prejudice is to be overcome in order to ensure that the objective will be achieved; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783570" lims:id="783570"><Label>(c)</Label><Text>in relation to that explanation, an update to any information previously provided to the Minister under paragraphs <XRefInternal>11</XRefInternal>(1)(c) to (e), together with any necessary supporting documents.</Text></Paragraph></Section><Section lims:inforce-start-date="2013-01-01" lims:lastAmendedDate="2013-01-01" lims:fid="783571" lims:id="783571"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="783572" lims:id="783572">Revocation — non-satisfaction or misleading information</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2013-01-01" lims:fid="783573" lims:id="783573"><Label>(1)</Label><Text>The Minister must revoke a temporary exemption granted under subsection <XRefInternal>9</XRefInternal>(3) if</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783574" lims:id="783574"><Label>(a)</Label><Text>the responsible person does not satisfy a requirement set out in section <XRefInternal>10</XRefInternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783575" lims:id="783575"><Label>(b)</Label><Text>any information indicated or contained in the application for the temporary exemption, in an implementation report referred to in section <XRefInternal>11</XRefInternal> or in a notice referred to in section <XRefInternal>12</XRefInternal> is false or misleading.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-01-01" lims:fid="783576" lims:id="783576"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="783577" lims:id="783577">Revocation — implementation report or reasonable grounds</MarginalNote><Label>(2)</Label><Text>The Minister may revoke the temporary exemption if</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783578" lims:id="783578"><Label>(a)</Label><Text>the responsible person has not provided an implementation report in accordance with section <XRefInternal>11</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783579" lims:id="783579"><Label>(b)</Label><Text>there are reasonable grounds for the Minister to believe that the carbon capture and storage system will not operate so as to capture, transport and store CO<Sub>2</Sub> emissions as described in paragraph <XRefInternal>10</XRefInternal>(e) by the date referred to in that paragraph; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783580" lims:id="783580"><Label>(c)</Label><Text>there are reasonable grounds for the Minister to believe that the responsible person will not emit CO<Sub>2</Sub> from the combustion of fossil fuels in the unit in accordance with subsection <XRefInternal>3</XRefInternal>(1) by January 1, 2025.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-01-01" lims:fid="783581" lims:id="783581"><MarginalNote lims:inforce-start-date="2013-01-01" lims:fid="783582" lims:id="783582">Reasons and representations</MarginalNote><Label>(3)</Label><Text>The Minister must not revoke the temporary exemption under subsection (1) or (2) unless the Minister has provided the responsible person with</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783583" lims:id="783583"><Label>(a)</Label><Text>written reasons for the proposed revocation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783584" lims:id="783584"><Label>(b)</Label><Text>an opportunity to be heard, by written representation, in respect of the proposed revocation.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2012-08-30" lims:fid="783585" lims:id="783585" level="3"><TitleText>Twenty-four Month Exemption — Existing Unit with System</TitleText></Heading><Section lims:inforce-start-date="2018-11-30" lims:lastAmendedDate="2018-11-30" lims:fid="783586" lims:id="783586"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783587" lims:id="783587">Exemption</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783588" lims:id="783588"><Label>(1)</Label><Text>A responsible person for an old unit may, on application made to the Minister, be exempted from the application of subsection <XRefInternal>3</XRefInternal>(1) in respect of the old unit for a period of 24 consecutive months that begins on January 1 of the calendar year that follows the calendar year in which the application is made if the following conditions are satisfied:</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783589" lims:id="783589"><Label>(a)</Label><Text>an existing unit and the old unit have a common owner who has a ownership interest of 50% or more in each of those two units;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783590" lims:id="783590"><Label>(b)</Label><Text>the production capacity of the existing unit, during the calendar year preceding the calendar year in which the application is made, was equal to or greater than the production capacity of the old unit during that preceding calendar year;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783591" lims:id="783591"><Label>(c)</Label><Text>the existing unit and the old unit are located in the same province;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783592" lims:id="783592"><Label>(d)</Label><Text>the quantity of CO<Sub>2</Sub> emissions from the combustion of fossil fuels in the existing unit is determined in accordance with a system or method referred to in subsection 20(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783593" lims:id="783593"><Label>(e)</Label><Text>the quantity of CO<Sub>2</Sub> emissions from the combustion of fossil fuels in the existing unit that are captured, transported and stored is determined using a direct measure of the flow of, and the concentration of CO<Sub>2</Sub> in, the emissions from that combustion of fuel;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783594" lims:id="783594"><Label>(f)</Label><Text>the emissions referred to in paragraph (e) are captured in accordance with the laws of Canada or a province that regulate that capture and are transported and stored in accordance with the laws of Canada or a province, or of the United States or one of its states, that regulate that transportation or storage, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783595" lims:id="783595"><Label>(g)</Label><Text>the emissions referred to in paragraph (e) are captured, transported and stored for a period of seven consecutive calendar years;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783596" lims:id="783596"><Label>(h)</Label><Text>the emissions referred to in paragraph (e) comprise at least 30% of the quantity of CO<Sub>2</Sub> emissions produced from the combustion of fossil fuels in the existing unit for each calendar year during that seven-year period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783597" lims:id="783597"><Label>(i)</Label><Text>the existing unit does not reach the end of its useful life during that seven-year period.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783598" lims:id="783598"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783599" lims:id="783599">Application</MarginalNote><Label>(2)</Label><Text>A responsible person for an old unit must apply for the exemption before September 1 of the calendar year preceding the calendar year for which the exemption is sought.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783600" lims:id="783600"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783601" lims:id="783601">Contents</MarginalNote><Label>(3)</Label><Text>The application must include the registration number of the old unit and of the existing unit and information, with supporting documentation, to demonstrate that</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783602" lims:id="783602"><Label>(a)</Label><Text>the conditions of paragraphs (1)(a) to (f), (h) and (i) are satisfied; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783603" lims:id="783603"><Label>(b)</Label><Text>at least 30 consecutive months of the period referred to in paragraph (1)(g) have occurred before the day on which the application is made.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783604" lims:id="783604"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783605" lims:id="783605">Granting of exemption</MarginalNote><Label>(4)</Label><Text>The Minister must, within 30 days after receiving the application, grant the exemption if</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783606" lims:id="783606"><Label>(a)</Label><Text>no exemption referred to in subsection (1) has been previously granted in respect of the old unit;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783607" lims:id="783607"><Label>(b)</Label><Text>no exemption referred to in subsection (1) that involved the existing unit has been previously granted;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783608" lims:id="783608"><Label>(c)</Label><Text>the existing unit referred to in subsection (1) is not a substituted unit referred to in subsection <XRefInternal>5</XRefInternal>(5); However, if no form and format have been so specified, it may be in any form and format.</Text></Subsection></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="783626" lims:id="783626"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783627" lims:id="783627">Record-making</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783628" lims:id="783628"><Label>(1)</Label><Text>A responsible person for a unit must make a record</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783629" lims:id="783629"><Label>(a)</Label><Text>of any notice referred to in subsection <XRefInternal>4</XRefInternal>(3), <XRefInternal>5</XRefInternal>(6) or <XRefInternal>6</XRefInternal>(6) or section <XRefInternal>12</XRefInternal> that was sent to the Minister and the information that was contained in it, as well as any supporting documents;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783630" lims:id="783630"><Label>(b)</Label><Text>of any application referred to in subsection <XRefInternal>5</XRefInternal>(3), <XRefInternal>6</XRefInternal>(3), <XRefInternal>7</XRefInternal>(3), <XRefInternal>8</XRefInternal>(2), <XRefInternal>9</XRefInternal>(2) or <XRefInternal>14</XRefInternal>(3) and the information referred to in the subsection, as well as any supporting documents;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783631" lims:id="783631"><Label>(c)</Label><Text>of every direct measure of the flow of, and the concentration of CO<Sub>2</Sub> in, emissions referred to in paragraph <XRefInternal>14</XRefInternal>(1)(e), subsection <XRefInternal>20</XRefInternal>(2) and the descriptions of E<Sub>non-ccs</Sub> in subsection <XRefInternal>21</XRefInternal>(1) and of E<Sub>ccs</Sub> in section <XRefInternal>22</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783632" lims:id="783632"><Label>(d)</Label><Text>of every measurement and calculation used to determine a value of an element of a formula set out in any of sections <XRefInternal>19</XRefInternal> and <XRefInternal>21</XRefInternal> to <XRefInternal>24</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783633" lims:id="783633"><Label>(e)</Label><Text>that demonstrates that any meter referred to in section <XRefInternal>19</XRefInternal> complies with the requirements of the <XRefExternal reference-type="act" link="E-4">Electricity and Gas Inspection Act</XRefExternal> and the <XRefExternal reference-type="regulation" link="SOR-86-131">Electricity and Gas Inspection Regulations</XRefExternal>, including a certificate referred to in section 14 of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783634" lims:id="783634"><Label>(f)</Label><Text>for each calendar year during which a responsible person used a continuous emission monitoring system referred to in paragraph <XRefInternal>20</XRefInternal>(1)(a), of any document, record or information referred to in section 8 of the Reference Method;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783635" lims:id="783635"><Label>(g)</Label><Text>that demonstrates that the installation, maintenance and calibration of measuring devices referred to in subsection <XRefInternal>25</XRefInternal>(1) was in accordance with that subsection and subsection <XRefInternal>25</XRefInternal>(3) and of every calibration referred to in subsection <XRefInternal>25</XRefInternal>(2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783636" lims:id="783636"><Label>(h)</Label><Text>of the results of the analysis of every sample collected in accordance with section <XRefInternal>27</XRefInternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783637" lims:id="783637"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783638" lims:id="783638">When records made</MarginalNote><Label>(2)</Label><Text>Records referred to in paragraphs (1)(c) to (h) must be made as soon as feasible but not later than 30 days after the information to be recorded becomes available.</Text></Subsection></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="783639" lims:id="783639"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783640" lims:id="783640">Retention of records and reports</MarginalNote><Label>18</Label><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783641" lims:id="783641"><Label>(1)</Label><Text>A responsible person who is required under these Regulations to make a record or send a report or notice must keep the record or a copy of the report or notice, as well as any supporting documents that relate to the information contained in that record or copy, for at least seven years after they make the record or send the report or notice. The record or copy must be kept at the person’s principal place of business in Canada or at any other place in Canada where it can be inspected. If the record or copy is kept at any of those other places, the person must provide the Minister with the civic address of that other place.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783642" lims:id="783642"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783643" lims:id="783643">Change of address</MarginalNote><Label>(2)</Label><Text>If the civic address referred to in subsection (1) changes, the responsible person must notify the minister in writing within 30 days after the change.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-08-30" lims:fid="783644" lims:id="783644" level="1"><Label>PART 3</Label><TitleText>Quantification Rules</TitleText></Heading><Heading lims:inforce-start-date="2012-08-30" lims:fid="783645" lims:id="783645" level="2"><TitleText>Production of Electricity</TitleText></Heading><Section lims:inforce-start-date="2018-11-30" lims:lastAmendedDate="2018-11-30" lims:fid="783646" lims:id="783646"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783647" lims:id="783647">Electricity</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783648" lims:id="783648"><Label>(1)</Label><Text>The quantity of electricity referred to in paragraph <XRefInternal>3</XRefInternal>(2)(a) is to be determined in accordance with the following formula:</Text><FormulaGroup lims:inforce-start-date="2018-11-30" lims:fid="783649" lims:id="783649"><Formula lims:inforce-start-date="2018-11-30" lims:fid="783650" lims:id="783650"><FormulaText>G<Sub>gross</Sub> – G<Sub>aux</Sub></FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2018-11-30" lims:fid="783651" lims:id="783651"><FormulaTerm>G<Sub>gross</Sub></FormulaTerm><Text>is the gross quantity of electricity that is produced by the unit during the calendar year, expressed in GWh and measured at the electrical terminals of the generators of the unit using meters that comply with the requirements of the <XRefExternal reference-type="act" link="E-4">Electricity and Gas Inspection Act</XRefExternal> and the <XRefExternal reference-type="regulation" link="SOR-86-131">Electricity and Gas Inspection Regulations</XRefExternal>; and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2018-11-30" lims:fid="783652" lims:id="783652"><FormulaTerm>G<Sub>aux</Sub></FormulaTerm><Text>is the quantity of electricity that is produced by the unit and used by the power plant in which the unit is located during the calendar year to operate infrastructure and equipment that is attributed to the unit for electricity generation and for separation, but not for pressurization, of CO<Sub>2</Sub>, expressed in GWh, determined in accordance with an appropriate method of attribution, based on data collected using meters that comply with the requirements of the <XRefExternal reference-type="act" link="E-4">Electricity and Gas Inspection Act</XRefExternal> and the <XRefExternal reference-type="regulation" link="SOR-86-131">Electricity and Gas Inspection Regulations</XRefExternal>.</Text></FormulaDefinition></FormulaGroup></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783653" lims:id="783653"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783654" lims:id="783654">Same method of attribution in subsequent years</MarginalNote><Label>(2)</Label><Text>Once a method of attribution is used to make the determination referred to in the description of G<Sub>aux</Sub> for a calendar year, that method of attribution must be used to make that determination for every subsequent calendar year, unless</Text><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783655" lims:id="783655"><Label>(a)</Label><Text>during a subsequent calendar year, a unit located at the power plant ceases to produce electricity or a new unit is added to those located at the power plant; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783656" lims:id="783656"><Label>(b)</Label><Text>during a subsequent calendar year, the operation of any unit located at the power plant is integrated with a carbon capture and storage system.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783657" lims:id="783657"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783658" lims:id="783658">Change of method of attribution</MarginalNote><Label>(3)</Label><Text>If paragraph (2)(a) or (b) applies in a subsequent calendar year, the responsible person must, when making the determination referred to in the description of G<Sub>aux</Sub> in subsection (1) for that subsequent calendar year, use a method of attribution that is appropriate to the circumstances described in that paragraph. To the extent that the emissions from the coal gasification system are not captured, transported and stored as described in subsection <XRefInternal>3</XRefInternal>(5), that quantity must be determined for the purpose of subsection <XRefInternal>3</XRefInternal>(1) by using a direct measure of the flow of, and the concentration of CO<Sub>2</Sub> in, those emissions.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-08-30" lims:fid="783670" lims:id="783670" level="3"><TitleText>Continuous Emissions Monitoring System</TitleText></Heading><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="783671" lims:id="783671"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783672" lims:id="783672">Quantification</MarginalNote><Label>21</Label><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783673" lims:id="783673"><Label>(1)</Label><Text>If paragraph <XRefInternal>20</XRefInternal>(1)(a) applies, the quantity of CO<Sub>2</Sub> emissions referred to in subsection <XRefInternal>20</XRefInternal>(1) is to be determined in accordance with “u”, during the calendar year from the combustion of fuel, as measured by the CEMS in accordance with sections 7.1 to 7.7 of the Reference Method;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783677" lims:id="783677"><FormulaTerm>E<Sub>bio</Sub></FormulaTerm><Text>is the quantity of CO<Sub>2</Sub> emissions, expressed in tonnes, from the combustion of biomass in the unit during the calendar year, determined</Text><FormulaParagraph lims:inforce-start-date="2015-07-01" lims:fid="783678" lims:id="783678"><Label>(a)</Label><Text>by using a fuel-based method</Text><FormulaParagraph lims:inforce-start-date="2015-07-01" lims:fid="783679" lims:id="783679"><Label>(i)</Label><Text>in accordance with paragraph <XRefInternal>24</XRefInternal>(1)(a) or (b), if the unit combusts solid biomass at an average daily rate of less than 3t/day during the given calendar year, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2015-07-01" lims:fid="783680" lims:id="783680"><Label>(ii)</Label><Text>in accordance with the applicable formula set out in one of paragraphs <XRefInternal>23</XRefInternal>(1)(a) to (c) for the type of biomass combusted, in any other case, or</Text></FormulaParagraph></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2015-07-01" lims:fid="783681" lims:id="783681"><Label>(b)</Label><Text>by using the method, based on data from the CEMS, described in subsection (2); and</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783682" lims:id="783682"><FormulaTerm>E<Sub>non-ccs</Sub></FormulaTerm><Text>is the quantity of CO<Sub>2</Sub> emissions, expressed in tonnes, from the combustion of fuel in the unit, including those emissions referred to in subsection <XRefInternal>3</XRefInternal>(4), during the calendar year — other than the quantity of those emissions as measured by the CEMS and set out in the description of E<Sub>u</Sub> — that is determined using a direct measure of the flow of, and the concentration of CO<Sub>2</Sub> in, the emissions from that combustion of fuel but that is not ultimately captured, transported and stored as described in subsection <XRefInternal>3</XRefInternal>(5).</Text></FormulaDefinition></FormulaGroup></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783683" lims:id="783683"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783684" lims:id="783684">E<Sub>bio</Sub> based on CEMS data</MarginalNote><Label>(2)</Label><Text>For the purpose of determining the value of E<Sub>bio</Sub>, the method, based on data from the CEMS, consists of making the following sequence of determinations:</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783685" lims:id="783685"><Label>(a)</Label><Text>the volume of CO<Sub>2</Sub> emitted from combustion of fuel in the unit for each hour of production of electricity during the calendar year determined in accordance with the following formula:</Text><FormulaGroup lims:inforce-start-date="2015-07-01" lims:fid="783686" lims:id="783686"><Formula lims:inforce-start-date="2015-07-01" lims:fid="783687" lims:id="783687"><FormulaText>0.01 × %CO<Sub>2w,h</Sub> × Q<Sub>w,h</Sub> × t<Sub>h</Sub></FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783688" lims:id="783688"><FormulaTerm>%CO<Sub>2w,h</Sub></FormulaTerm><Text>is the average concentration of CO<Sub>2</Sub> in relation to all gases in the stack emitted from the combustion of fuel in the unit during a given hour, “h”, during which the unit produced electricity in the calendar year — or, if applicable, a calculation made in accordance with section 7.4 of the Reference Method of that average concentration of CO<Sub>2</Sub> based on a measurement of the concentration of oxygen (O<Sub>2</Sub>) in those gases in the stack — expressed as a percentage on a wet basis,</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783689" lims:id="783689"><FormulaTerm>Q<Sub>w,h</Sub></FormulaTerm><Text>is the average volumetric flow during that hour, measured on a wet basis by the stack gas volumetric flow monitor, expressed in standard m<Sup>3</Sup>, and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783690" lims:id="783690"><FormulaTerm>t<Sub>h</Sub></FormulaTerm><Text>is the period during which the unit produced electricity, expressed in hours;</Text></FormulaDefinition></FormulaGroup></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783691" lims:id="783691"><Label>(b)</Label><Text>the volume of CO<Sub>2</Sub> emitted from combustion of fossil fuel in the unit during the calendar year, expressed in standard m<Sup>3</Sup> and referred to in this subsection as V<Sub>ff</Sub>, determined in accordance with the following formula:</Text><FormulaGroup lims:inforce-start-date="2015-07-01" lims:fid="783692" lims:id="783692"><Formula lims:inforce-start-date="2015-07-01" lims:fid="783693" lims:id="783693"><ImageGroup lims:inforce-start-date="2015-07-01" lims:fid="783694" lims:id="783694" bilingual="yes" position="center" width="8pc" spanlanguages="no" spanmarginalnotecol="no"><AlternateText>The formula for determining the volume of CO2 emissions emitted from the combustion of fossil fuel in the unit during the calendar year is the sum of the products resulting from the multiplication of Qi, Fc,i and HHVd,i for each fossil fuel type “i” combusted in the unit during the calendar year.</AlternateText><Image lims:id="783695"><FormulaTerm>Q<Sub>i</Sub></FormulaTerm><Text>is the quantity of fossil fuel type “i” combusted in the unit during the calendar year, determined</Text><FormulaParagraph lims:inforce-start-date="2015-07-01" lims:fid="783696" lims:id="783696"><Label>(a)</Label><Text>for a solid fuel, in the same manner as the one used in the determination of M<Sub>f</Sub> in the formula set out in paragraph <XRefInternal>23</XRefInternal>(1)(a) and expressed in tonnes,</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2015-07-01" lims:fid="783697" lims:id="783697"><Label>(b)</Label><Text>for a liquid fuel, in the same manner as the one used in the determination of V<Sub>f</Sub> in the formula set out in paragraph <XRefInternal>23</XRefInternal>(1)(b) and expressed in kL, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2015-07-01" lims:fid="783698" lims:id="783698"><Label>(c)</Label><Text>for a gaseous fuel, in the same manner as the one used in the determination of V<Sub>f</Sub> in the formula set out in paragraph <XRefInternal>23</XRefInternal>(1)(c) and expressed in standard m<Sup>3</Sup>,</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783699" lims:id="783699"><FormulaTerm>i</FormulaTerm><Text>is the i<Sup>th</Sup> fossil fuel type combusted in the unit during the calendar year, with “i” going from the number 1 to n, where n is the number of fossil fuels so combusted,</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783700" lims:id="783700"><FormulaTerm>F<Sub>c,i</Sub></FormulaTerm><Text>is the fuel-specific carbon-based F-factor for each fossil fuel type “i” — being, as the case may be, the default value as set out in column 3 of the table to subsection (3) for that fuel type set out in column 2 or determined for that fuel type in accordance with Appendix A of the Reference Method — expressed in standard m<Sup>3</Sup> of CO<Sub>2</Sub>/GJ,</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783701" lims:id="783701"><FormulaTerm>HHV<Sub>d,i</Sub></FormulaTerm><Text>— expressed in GJ/tonne, for a solid fuel, in GJ/kL, for a liquid fuel, and in GJ/standard m<Sup>3</Sup>, for a gaseous fuel — is, for each fossil fuel type “i”,</Text><FormulaParagraph lims:inforce-start-date="2015-07-01" lims:fid="783702" lims:id="783702"><Label>(a)</Label><Text>the default higher heating value set out in column 2 of Schedule 5 for that fuel type set out in column 1, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2015-07-01" lims:fid="783703" lims:id="783703"><Label>(b)</Label><Text>in the absence of a default higher heating value for that fuel type referred to in paragraph (a), a default higher heating value for that fuel type established by a body that is internationally recognized as being competent to establish default higher heating values for fuels;</Text></FormulaParagraph></FormulaDefinition></FormulaGroup></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783704" lims:id="783704"><Label>(c)</Label><Text>the volume of CO<Sub>2</Sub> emitted from the combustion of biomass in the unit during the calendar year, expressed in standard m<Sup>3</Sup> and referred to in this subsection as V<Sub>bio</Sub>, determined in accordance with the following formula:</Text><FormulaGroup lims:inforce-start-date="2015-07-01" lims:fid="783705" lims:id="783705"><Formula lims:inforce-start-date="2015-07-01" lims:fid="783706" lims:id="783706"><FormulaText>V<Sub>T</Sub> – V<Sub>ff</Sub></FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783707" lims:id="783707"><FormulaTerm>V<Sub>T</Sub></FormulaTerm><Text>is the sum of the volumes of CO<Sub>2</Sub> emitted from combustion of fuel in the unit during each hour of production of electricity during the calendar year, as determined under paragraph (a), and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783708" lims:id="783708"><FormulaTerm>V<Sub>ff</Sub></FormulaTerm><Text>is V<Sub>ff</Sub> determined in accordance with the formula set out in paragraph (b); and</Text></FormulaDefinition></FormulaGroup></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783709" lims:id="783709"><Label>(d)</Label><Text>the quantity of the CO<Sub>2</Sub> emissions from the combustion of biomass in the unit during the calendar year, namely E<Sub>bio</Sub> determined in accordance with the formula set out in subsection (1), based on the following two determinations:</Text><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="783710" lims:id="783710"><Label>(i)</Label><Text>the fraction of the volume of CO<Sub>2</Sub> emissions from all fuel combusted in the unit attributable to the combustion of biomass in the unit during the calendar year, referred to in this section as Bio<Sub>fr</Sub>, determined in accordance with the following formula:</Text><FormulaGroup lims:inforce-start-date="2015-07-01" lims:fid="783711" lims:id="783711"><Formula lims:inforce-start-date="2015-07-01" lims:fid="783712" lims:id="783712"><ImageGroup lims:inforce-start-date="2015-07-01" lims:fid="783713" lims:id="783713" bilingual="yes" position="center" width="3pc" spanlanguages="no" spanmarginalnotecol="no"><AlternateText>The formula for determining the fraction of the volume of CO2 emissions from all fuel combusted in the unit during the calendar year attributable to the combustion of biomass is the quotient of Vbio over VT.</AlternateText><Image source="SOR-2012-167img\SOR-2012-167_ef007.png" /></ImageGroup></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783714" lims:id="783714"><FormulaTerm>V<Sub>bio</Sub></FormulaTerm><Text>is the volume of CO<Sub>2</Sub> emitted from the combustion of biomass in the unit during the calendar year determined in accordance with the formula set out in paragraph (c),</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783715" lims:id="783715"><FormulaTerm>V<Sub>T</Sub></FormulaTerm><Text>is the value of V<Sub>T</Sub> determined in accordance with the formula set out in paragraph (c), and</Text></FormulaDefinition></FormulaGroup></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="783716" lims:id="783716"><Label>(ii)</Label><Text>the quantity of CO<Sub>2</Sub> emissions described by E<Sub>bio</Sub> determined in accordance with the following formula:</Text><FormulaGroup lims:inforce-start-date="2015-07-01" lims:fid="783717" lims:id="783717"><Formula lims:inforce-start-date="2015-07-01" lims:fid="783718" lims:id="783718"><FormulaText>(Bio<Sub>fr</Sub>× E<Sub>u</Sub>) – E<Sub>s</Sub></FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783719" lims:id="783719"><FormulaTerm>Bio<Sub>fr</Sub></FormulaTerm><Text>is the fraction of the volume of CO<Sub>2</Sub> emissions from all fuel combusted in the unit attributable to the combustion of biomass in the unit during the calendar year determined in accordance with the formula set out in subparagraph (i),</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783720" lims:id="783720"><FormulaTerm>E<Sub>u</Sub></FormulaTerm><Text>is the value of E<Sub>u</Sub> determined in the formula set out in subsection (1), and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783721" lims:id="783721"><FormulaTerm>E<Sub>s</Sub></FormulaTerm><Text>is the quantity of CO<Sub>2</Sub> emissions, expressed in tonnes, that is released from the use of sorbent to control the emission of sulphur dioxide from the unit during the calendar year, determined in accordance with the following formula:</Text><FormulaGroup lims:inforce-start-date="2015-07-01" lims:fid="783722" lims:id="783722"><Formula lims:inforce-start-date="2015-07-01" lims:fid="783723" lims:id="783723"><ImageGroup lims:inforce-start-date="2015-07-01" lims:fid="783724" lims:id="783724" bilingual="yes" position="center" width="6pc" spanlanguages="no" spanmarginalnotecol="no"><AlternateText>The formula for determining the value of CO2 emissions released from the use of sorbent during a calendar year is the product resulting from the multiplication of S, R and the quotient of the constant 44 over MMs.</AlternateText><Image source="SOR-2012-167img\SOR-2012-167_ef008.png" /></ImageGroup></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783725" lims:id="783725"><FormulaTerm>S</FormulaTerm><Text>is the quantity of calcium carbonate (CaCO<Sub>3</Sub>) or other sorbent material so used, expressed in tonnes,</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783726" lims:id="783726"><FormulaTerm>R</FormulaTerm><Text>is the stoichiometric ratio, on a mole fraction basis, of CO<Sub>2</Sub> released on usage of one mole of sorbent material, where R=1 if the sorbent material is CaCO<Sub>3</Sub>, and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783727" lims:id="783727"><FormulaTerm>MM<Sub>s</Sub></FormulaTerm><Text>is the molecular mass of the sorbent material, where MM<Sub>s</Sub> = 100 if the sorbent material is CaCO<Sub>3</Sub>.</Text></FormulaDefinition></FormulaGroup></FormulaDefinition></FormulaGroup></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783728" lims:id="783728"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783729" lims:id="783729">Default F-factor</MarginalNote><Label>(3)</Label><Text>The default value for the fuel-specific carbon-based F-factor for certain types of fossil fuel is set out in column 3 of the following quantity of emissions attributable to that unit for the purpose of subsection (1) is determined based on the ratio of the heat input of that unit to the total of the heat input of that unit and of all type, including types of biomass, combusted during the calendar year in a unit located at the power plant with “j” going from the number 1 to m, where m is the number of those fuel types;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783747" lims:id="783747"><FormulaTerm>Q<Sub>ij</Sub></FormulaTerm><Text>is the quantity of fuel type “j” combusted in each unit “i” during the calendar year, determined for a solid fuel, a liquid fuel and a gaseous fuel, respectively, in the manner set out in the description of Q<Sub>uj</Sub>;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783748" lims:id="783748"><FormulaTerm>HHV<Sub>ij</Sub></FormulaTerm><Text>is the higher heating value, determined in accordance with section <XRefInternal>24</XRefInternal> and expressed in the applicable unit of measure referred to in that section, of fuel type “j” combusted during the calendar year in unit “i”; and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2015-07-01" lims:fid="783749" lims:id="783749"><FormulaTerm>E</FormulaTerm><Text>is the quantity of CO<Sub>2</Sub> emissions, expressed in tonnes, from the combustion of fuels in all the units during the calendar year, measured by a CEMS at the common stack in accordance with subsection a unit for a calendar year using a fuel-based method is Es minus Eccs plus the sum of Ei for each fossil fuel “i” combusted in the unit during the calendar year.</AlternateText><Image source="SOR-2012-167img\SOR-2012-167_e005.png" /></ImageGroup></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2018-11-30" lims:fid="783756" lims:id="783756"><FormulaTerm>E<Sub>i</Sub></FormulaTerm><Text>is the quantity of CO<Sub>2</Sub> emissions attributable to the combustion of fossil fuel of type “i” in the unit during the calendar year, expressed in tonnes, determined for that fuel type in accordance with section <XRefInternal>23</XRefInternal> or <XRefInternal>24</XRefInternal>;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2018-11-30" lims:fid="783757" lims:id="783757"><FormulaTerm>i</FormulaTerm><Text>is the i<Sup>th</Sup> type of fossil fuel combusted in the unit during the calendar year, with “i” going from the number 1 to n, where n is the number of types of fossil fuel so combusted;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2018-11-30" lims:fid="783758" lims:id="783758"><FormulaTerm>E<Sub>s</Sub></FormulaTerm><Text>is E<Sub>s</Sub> determined in accordance with the formula set out in subparagraph <XRefInternal>21</XRefInternal>(2)(d)(ii); and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2018-11-30" lims:fid="783759" lims:id="783759"><FormulaTerm>E<Sub>ccs</Sub></FormulaTerm><Text>is the quantity of CO<Sub>2</Sub> in those emissions, expressed in tonnes, from the combustion of fuel in the unit, during the calendar year, that are captured in accordance with the laws of Canada or a province that regulate that capture and that are transported and stored in accordance with the laws of Canada or a province, or of the United States or one of its states, that regulate that transportation or storage, as the case may be, that quantity being determined using a direct measure of the flow of, and the concentration of CO<Sub>2</Sub> in, those CC<Sub>A</Sub> is, based on fuel samples collected in accordance with section <XRefInternal>27</XRefInternal>, to be determined in accordance with the following formula:</Text><ImageGroup attributable to the combustion of the fuel in a unit during a calendar year, expressed in tonnes, may be determined in accordance with subsection (4) based on the following higher heating value of the subsection (6) as provided by the supplier of the fuel to the responsible person but, if not so provided, as so measured by the responsible person; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-30" lims:fid="783814" lims:id="783814"><Label>(b)</Label><Text>in the absence of a measured higher heating value of the fuel referred to in paragraph (a), the default higher heating value, set out in column 2 of Schedule 5, for the fuel’s type, as set out in column 1 but, in the absence of that default higher heating value, a default higher heating value for that fuel type established by a body that is internationally recognized as being competent to establish default higher heating values for fuels.</Text></Paragraph></Subsection><Subsection absence of that default CO<Sub>2</Sub> emission factor, a default CO<Sub>2</Sub> emission factor for that fuel established by a body that is internationally recognized as competent to establish default CO<Sub>2</Sub> emission factors for fuels.</Text></FormulaDefinition></FormulaGroup></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="783838" lims:id="783838"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="783839" lims:id="783839">Weighted average</MarginalNote><Label>(5)</Label><Text>The weighted average higher heating value of the fuel is determined in accordance with the following formula:</Text><ImageGroup lims:inforce-start-date="2018-11-30" lims:fid="783840" lims:id="783840" position="center" width="6pc" bilingual="no" spanlanguages="no" spanmarginalnotecol="no"><AlternateText>The formula for determining the weighted average higher heating value of a fuel is the quotient of the following two sums: the sum of the product resulting from the multiplication of HHVi and Qi for each sampling period “i” and the sum of Qi for each sampling period “i”.</AlternateText><Image source="SOR-2012-167img\SOR-2012-167_ef006.png" /></ImageGroup><FormulaGroup lims:inforce-start-date="2018-11-30" lims:fid="783841" the higher heating value of, as the case may be, each composite sample, or sample, of the fuel for the i<Sup>th</Sup> sampling period measured in accordance with subsection (6), as provided by the supplier of the fuel to the responsible person but, if not so provided, as so measured by the responsible person;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2018-11-30" person must calibrate each of those measuring devices at the greater of the following two frequencies:</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783879" lims:id="783879"><Label>(a)</Label><Text>at least once in every calendar year but at least five months after a previous calibration, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783880" lims:id="783880"><Label>(b)</Label><Text>the minimum frequency recommended by the manufacturer.</Text></Paragraph></Subsection><Subsection measurements</MarginalNote><Label>(3)</Label><Text>Each of those measuring devices must enable measurements to be made with a margin of error of ± 5%.</Text></Subsection></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="783883" lims:id="783883"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783884" referred to in paragraph <XRefInternal>20</XRefInternal>(1)(a) for the purpose of section <XRefInternal>3</XRefInternal> or <XRefInternal>15</XRefInternal> must ensure that the Reference Method is complied with.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783886" lims:id="783886"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783887" lims:id="783887">Certification</MarginalNote><Label>(2)</Label><Text>Before a CEMS referred to in paragraph <XRefInternal>20</XRefInternal>(1)(a) is used for the purpose of that paragraph, it must be certified by the responsible person in accordance with section 5 of the Reference Method.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783888" lims:id="783888"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783889" lims:id="783889">Annual audit</MarginalNote><Label>(3)</Label><Text>For each calendar year during which a responsible person uses a CEMS referred to in paragraph <XRefInternal>20</XRefInternal>(1)(a), an auditor must</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783890" lims:id="783890"><Label>(a)</Label><Text>assess, based on the review referred to in section 6.5.2 of the Reference Method, whether, in the auditor’s opinion, the responsible person’s use of the CEMS complied with the Quality Assurance/Quality Control manual referred to in section 6 of the Reference Method;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783891" lims:id="783891"><Label>(b)</Label><Text>ensure that the Quality Assurance/Quality Control manual has been updated in accordance with sections 6.1 and 6.5.2 of the Reference Method; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783892" lims:id="783892"><Label>(c)</Label><Text>assess whether, in the auditor’s opinion, the responsible person complied with the Reference Method and the CEMS met the specifications set out in the Reference Method, in particular, in its sections 3 and 4.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783893" lims:id="783893"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783894" lims:id="783894">Auditor’s report</MarginalNote><Label>(4)</Label><Text>The responsible person must obtain a report, signed by the auditor, that contains the information set out in Schedule 6 and send the auditor’s report to the Minister with their annual report referred to in section <XRefInternal>15</XRefInternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-08-30" lims:fid="783895" lims:id="783895" level="2"><TitleText>Fuel Sampling and Testing Requirements</TitleText></Heading><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="783896" lims:id="783896"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783897" lims:id="783897">Fuel sampling</MarginalNote><Label>27</Label><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783898" lims:id="783898"><Label>(1)</Label><Text>The determination of the value for the elements related to carbon content and higher heating values referred to in sections <XRefInternal>21</XRefInternal> to <XRefInternal>24</XRefInternal> must be based on fuel samples taken in accordance with this section.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783899" lims:id="783899"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783900" lims:id="783900">Frequency</MarginalNote><Label>(2)</Label><Text>Each fuel sample must be taken at a time and location in the fuel handling system of the power plant that provides the following representative sample of the fuel combusted at the following minimum frequency:</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783901" lims:id="783901"><Label>(a)</Label><Text>for coal other than synthetic gas derived from coal or derived from petroleum coke, one composite sample, during each week that the unit produces electricity, that is prepared in accordance with ASTM D2013 / D2013M - 11, entitled <XRefExternal reference-type="standard">Standard Practice for Preparing Coal Samples for Analysis</XRefExternal>, and that consists of sub-samples taken at least twice from coal that was fed for combustion during that week and at least 48 hours apart, in accordance with</Text><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="783902" lims:id="783902"><Label>(i)</Label><Text>ASTM D2234 / D2234M - 10, entitled <XRefExternal reference-type="standard">Standard Practice for Collection of a Gross Sample of Coal</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="783903" lims:id="783903"><Label>(ii)</Label><Text>ASTM D7430 - 11ae1, entitled <XRefExternal reference-type="standard">Standard Practice for Mechanical Sampling of Coal</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783904" lims:id="783904"><Label>(b)</Label><Text>for a type of solid fuel other than coal, one composite sample per month that consists of sub-samples of fuel of that type, each having the same mass, that were taken from fuel that was fed for combustion during each week that begins in that month and during which the unit produces electricity and that were taken at least 48 hours after any previous sub-sample and after all fuel treatment operations had been carried out but before any mixing of the fuel from which the sub-sample is taken with other fuels;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783905" lims:id="783905"><Label>(c)</Label><Text>for a type of liquid fuel and of a gaseous fuel other than natural gas, one sample per quarter, with each sample of fuel of that type being taken at least one month after any previous sample has been taken; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="783906" lims:id="783906"><Label>(d)</Label><Text>for natural gas, two samples per calendar year, with each sample being taken at least four months after any previous sample has been taken.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783907" lims:id="783907"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783908" lims:id="783908">Additional samples</MarginalNote><Label>(3)</Label><Text>For greater certainty, the responsible person who takes, for the purpose of these Regulations, more samples than the minimum required under subsection (2) must make the determination referred to in subsection (1) based on each sample — and, in the case of composite samples, each sub-sample — taken, including those additional samples.</Text></Subsection></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="783909" lims:id="783909"><MarginalNote lims:id="783911"><Label>(1)</Label><Text>Subject to subsections (2) and (3), if, for any reason beyond the responsible person’s control, the emission-intensity referred to in subsection <XRefInternal>3</XRefInternal>(1) cannot be determined in accordance with a formula set out in any of sections <XRefInternal>19</XRefInternal> and <XRefInternal>21</XRefInternal> to <XRefInternal>24</XRefInternal> because data required to determine the value of an element of that formula has not been obtained for a given period during a calendar year, replacement data for that given period obtained in accordance with an appropriate method must be used to determine that value.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783912" lims:id="783912"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783913" lims:id="783913">Replacement data — CEMS</MarginalNote><Label>(2)</Label><Text>If a CEMS referred to in paragraph <XRefInternal>20</XRefInternal>(1)(a) is used for the determination of an element of a formula set out in section <XRefInternal>21</XRefInternal> but data has not been obtained for that determination during a given period, the replacement data is to be obtained in accordance with section 3.5.2 of the Reference Method.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783914" lims:id="783914"><MarginalNote lims:inforce-start-date="2015-07-01" lims:fid="783915" lims:id="783915">Replacement data — Fuel-based methods</MarginalNote><Label>(3)</Label><Text>If a fuel-based method referred to in paragraph <XRefInternal>20</XRefInternal>(1)(b) is used for the determination of an element — related to the higher heating value, carbon content or molecular mass of a fuel — of a formula set out in any of sections <XRefInternal>21</XRefInternal> to <XRefInternal>24</XRefInternal> for which data has not been obtained during a given period, the replacement data is to be the average of the determinations for that element, using the fuel-based method in question, during the equivalent period prior to and, if available, subsequent to that given period. However, if the determination of that element is not available during the equivalent period prior to that given period, the replacement data is to be the determination for that element, using the fuel-based method in question, during the equivalent period subsequent to the given period.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-01" lims:fid="783916" lims:fid="783967" lims:id="783967"><Label>(b)</Label><Text>the expected location and size of pumping stations, of receipt and delivery points and of any interconnects on the pipeline for each are to be used to transport the captured CO<Sub>2</Sub> emissions are to be obtained and, if required, commissioned and a plan detailing how any required port infrastructure for shipping the captured CO<Sub>2</Sub> emissions on those tankers is to be developed;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783970" lims:id="783970"><Label>(e)</Label><Text>an identification of the potential risks and obstacles, for each preferred route, to the construction and operation of the pipeline or shipping network along that route, including any surface or subsurface land use that may conflict with that construction or operation, along with an explanation of how those risks and obstacles are to be overcome ;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783971" lims:id="783971"><Label>(f)</Label><Text>a list of each environmental, safety and other approval or permit that is required for the construction or operation of the transportation element; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783972" lims:id="783972"><Label>(g)</Label><Text>a list of potential suppliers of equipment, materials or services that are needed for the construction and operation of the transportation element.</Text></Paragraph></Section><Section lims:inforce-start-date="2013-01-01" lims:lastAmendedDate="2013-01-01" lims:fid="783973" lims:id="783973"><Label>3</Label><Text>The following information respecting the storage element of the carbon capture and storage system:</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783974" lims:id="783974"><Label>(a)</Label><Text>an estimation of the volume of CO<Sub>2</Sub> emissions, expressed in standard m<Sup>3</Sup>, to be captured and stored during each calendar year and over the anticipated operating life of the unit;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783975" lims:id="783975"><Label>(b)</Label><Text>an identification of one or more suitable geological sites for storage that are expected to be used to store the captured CO<Sub>2</Sub> emissions, supported by a delineation of the geographical extent of each storage site and at least one study showing that the required capacity to store the sufficient volume of CO<Sub>2</Sub> referred to in subparagraph <XRefInternal>9</XRefInternal>(2)(c)(i) of these Regulations is available based on generally accepted national or international protocols for storage capacity estimation;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783976" lims:id="783976"><Label>(c)</Label><Text>an identification of any requirement under federal or provincial laws for the purity of captured CO<Sub>2</Sub> emissions, along with an explanation of how that requirement is to be met;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783977" lims:id="783977"><Label>(d)</Label><Text>a preliminary assessment of the integrity of the storage element in preserving an impervious barrier to leakage of stored CO<Sub>2</Sub> emissions and of any risk to breaching that integrity, at each feasible storage site referred to in paragraph (b), along with a preliminary strategy to mitigate the risk;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783978" lims:id="783978"><Label>(e)</Label><Text>a preliminary plan for measuring and verifying the volume of stored CO<Sub>2</Sub> emissions and for monitoring any leak of the stored CO<Sub>2</Sub> emissions from the storage element;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783979" lims:id="783979"><Label>(f)</Label><Text>an identification of any surface or subsurface land use that may conflict with the operation of the storage element at each feasible storage site referred to in paragraph (b), along with an explanation of how the conflict is to be resolved in order to ensure access to each of those sites;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783980" lims:id="783980"><Label>(g)</Label><Text>a list of each environmental, safety and other approval or permit that is required for the construction lims:id="783990"><Label>(b)</Label><Text>an estimate of capital cost of the construction project, including a summary of the analysis that led to that estimate and a justification for the margin of error of that estimate;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783991" lims:id="783991"><Label>(c)</Label><Text>a summary of the safety review of the capture lims:id="783995"><Label>(g)</Label><Text>an identification of potential persons with whom agreements can be entered into to carry out the construction of the carbon capture and storage system;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783996" lims:id="783996"><Label>(h)</Label><Text>the name and business address of the persons responsible for the development of the front end engineering design study and a description of their contribution to its development;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="783997" lims:id="783997"><Label>(i)</Label><Text>a description of the capture technology selected in the front end engineering design study for the capture element of the carbon capture and storage system and Release Inventory identification number assigned by the Minister for the purpose of section 48 of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784025" lims:id="784025"><Label>(d)</Label><Text>if applicable, the number of other units located at the power plant in which the unit is located and, for each of those other units, the information referred to in paragraph (a); and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784026" lims:id="784026"><Label>(e)</Label><Text>if applicable, a statement that indicates that the unit shares a common stack with one or more of those other units, along with a statement that identifies each of those other units.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="784027" lims:id="784027"><Label>3</Label><Text>The following information respecting the emission-intensity referred to in subsection <XRefInternal>3</XRefInternal>(1) of these Regulations from the combustion of fuel in the unit — other than a unit referred to in paragraph 4(d) — during the calendar year:</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784028" lims:id="784028"><Label>(a)</Label><Text>the emission-intensity for the unit, namely the ratio of the quantity of CO<Sub>2</Sub> emissions referred to in paragraph (c) to the quantity of electricity referred to in subparagraph (b)(i), expressed in tonnes per GWh;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784029" lims:id="784029"><Label>(b)</Label><Text>in respect of the quantity of electricity produced by the unit</Text><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784030" lims:id="784030"><Label>(i)</Label><Text>that quantity determined in accordance with section <XRefInternal>19</XRefInternal> of these Regulations, expressed in GWh,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784031" lims:id="784031"><Label>(ii)</Label><Text>the value determined for G<Sub>gross</Sub> and G<Sub>aux</Sub> in the formula set out in subsection <XRefInternal>19</XRefInternal>(1) of these Regulations, expressed in GWh,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784032" lims:id="784032"><Label>(iii)</Label><Text>the gross electricity produced by the units located at the power plant for the calendar year, namely the sum of the value determined for G<Sub>gross</Sub> referred to in subparagraph (ii) and of the gross electricity produced by all other units located at the power plant determined in accordance with that description of G<Sub>gross</Sub>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784033" lims:id="784033"><Label>(iv)</Label><Text>the quantity of electricity, expressed in GWh, that is used by the power plant in which the unit is located during the calendar year to operate infrastructure and equipment for electricity generation and for separation, but not pressurization, of CO<Sub>2</Sub>, based on data collected using meters that comply with the requirements of the <XRefExternal reference-type="act" link="E-4">Electricity and Gas Inspection Act</XRefExternal> and the <XRefExternal reference-type="regulation" link="SOR-86-131">Electricity and Gas Inspection Regulations</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784034" lims:id="784034"><Label>(v)</Label><Text>if that calendar year is the calendar year referred to in subsection <XRefInternal>19</XRefInternal>(2) of these Regulations for which a method of attribution was first used, a detailed description of that method of attribution and an explanation of why it is appropriate, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784035" lims:id="784035"><Label>(vi)</Label><Text>if that calendar year is a subsequent calendar year referred to in subsection <XRefInternal>19</XRefInternal>(3) of these Regulations, a detailed description of the method of attribution referred to in that subsection used for that subsequent calendar year and an explanation of why it is appropriate;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784036" lims:id="784036"><Label>(c)</Label><Text>in respect of the quantity of CO<Sub>2</Sub> emissions from the combustion of fuels in the unit,</Text><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784037" lims:id="784037"><Label>(i)</Label><Text>if paragraph <XRefInternal>20</XRefInternal>(1)(a) of these Regulations applies for the determination of that quantity,</Text><Clause lims:inforce-start-date="2015-07-01" lims:fid="784038" lims:id="784038"><Label>(A)</Label><Text>that quantity, expressed in tonnes, determined in accordance with section <XRefInternal>21</XRefInternal> of these Regulations,</Text></Clause><Clause lims:inforce-start-date="2015-07-01" lims:fid="784039" lims:id="784039"><Label>(B)</Label><Text>the values, expressed in tonnes, determined for E<Sub>u</Sub>, E<Sub>bio</Sub> and E<Sub>non-ccs</Sub> in the formula set out in subsection <XRefInternal>21</XRefInternal>(1) of these Regulations,</Text></Clause><Clause lims:inforce-start-date="2015-07-01" lims:fid="784040" lims:id="784040"><Label>(C)</Label><Text>a statement that indicates which of paragraphs (a) and (b) of the description of that E<Sub>bio</Sub> was used to determine the value of that element, and</Text></Clause><Clause lims:inforce-start-date="2015-07-01" lims:fid="784041" lims:id="784041"><Label>(D)</Label><Text>the value, expressed in tonnes, determined for E<Sub>s</Sub> in the formula set out in subparagraph <XRefInternal>21</XRefInternal>(2)(d)(ii) of these Regulations, and</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784042" lims:id="784042"><Label>(ii)</Label><Text>if paragraph <XRefInternal>20</XRefInternal>(1)(b) of these Regulations applies for the determination of that quantity,</Text><Clause lims:inforce-start-date="2015-07-01" lims:fid="784043" lims:id="784043"><Label>(A)</Label><Text>that quantity, expressed in tonnes, determined in accordance with section <XRefInternal>22</XRefInternal> of these Regulations and, as the case may be, section <XRefInternal>23</XRefInternal> or <XRefInternal>24</XRefInternal> of these Regulations,</Text></Clause><Clause lims:inforce-start-date="2015-07-01" lims:fid="784044" lims:id="784044"><Label>(B)</Label><Text>the values, expressed in tonnes, determined for E<Sub>i</Sub> for each fuel combusted, and for E<Sub><Emphasis style="italic">ccs</Emphasis></Sub>, in the formula in section <XRefInternal>22</XRefInternal> of these Regulations,</Text></Clause><Clause lims:inforce-start-date="2015-07-01" lims:fid="784045" lims:id="784045"><Label>(C)</Label><Text>the value, expressed in tonnes, determined for E<Sub>s</Sub> in the formula set out in subparagraph <XRefInternal>21</XRefInternal>(2)(d)(ii) section <XRefInternal>23</XRefInternal> and <XRefInternal>24</XRefInternal> of these Regulations was used to determine the quantity referred to in clause (A),</Text></Clause><Clause lims:inforce-start-date="2015-07-01" lims:fid="784047" lims:id="784047"><Label>(E)</Label><Text>if that quantity was determined in accordance with section <XRefInternal>23</XRefInternal> of these Regulations,</Text><Subclause lims:inforce-start-date="2015-07-01" lims:fid="784048" lims:id="784048"><Label>(I)</Label><Text>the value of CC<Sub>A</Sub> in the formula set out in paragraph <XRefInternal>23</XRefInternal>(1)(a), (b) or (c) of these Regulations, as the case may be, for each fuel combusted, and</Text></Subclause><Subclause lims:inforce-start-date="2015-07-01" lims:fid="784049" lims:id="784049"><Label>(II)</Label><Text>a statement that indicates which of the ASTM standards and of the methods referred to in the description of CC<Sub>i</Sub> in the formula in subsection 23(2) of these Regulations were used to determine the value of CC<Sub>A</Sub> referred to in subclause (I) or, for a sample of gaseous fuel, that indicates that a direct measuring device was used to determine that value, and</Text></Subclause></Clause><Clause lims:inforce-start-date="2015-07-01" lims:fid="784050" lims:id="784050"><Label>(F)</Label><Text>if that quantity was determined in accordance with section <XRefInternal>24</XRefInternal> of these Regulations,</Text><Subclause lims:inforce-start-date="2015-07-01" lims:fid="784051" lims:id="784051"><Label>(I)</Label><Text>for each fuel combusted,</Text><Subsubclause lims:inforce-start-date="2015-07-01" lims:fid="784052" lims:id="784052"><Label>1.</Label><Text>its type,</Text></Subsubclause><Subsubclause lims:inforce-start-date="2015-07-01" lims:fid="784053" lims:id="784053"><Label>2.</Label><Text>a statement that indicates which of paragraphs <XRefInternal>24</XRefInternal>(2)(a) to (d) of these Regulations describes the fuel, and</Text></Subsubclause><Subsubclause lims:inforce-start-date="2015-07-01" lims:fid="784054" lims:id="784054"><Label>3.</Label><Text>in the case of a fuel described by paragraph <XRefInternal>24</XRefInternal>(2)(b) of these Regulations, the average daily rate at which the fuel was combusted,</Text></Subsubclause></Subclause><Subclause lims:inforce-start-date="2015-07-01" lims:fid="784055" lims:id="784055"><Label>(II)</Label><Text>if paragraph <XRefInternal>24</XRefInternal>(1)(a) of these Regulations applies,</Text><Subsubclause lims:inforce-start-date="2015-07-01" lims:fid="784056" lims:id="784056"><Label>1.</Label><Text>the value of HHV, as described in paragraph (a) of that element, in the formula set out in subsection <XRefInternal>24</XRefInternal>(4) of these Regulations, for each fuel combusted,</Text></Subsubclause><Subsubclause lims:inforce-start-date="2015-07-01" lims:fid="784057" lims:id="784057"><Label>2.</Label><Text>if the fuel’s type is set out in column 1 of the applicable table to Schedule 5, its default CO<Sub>2</Sub> emission factor as set out in column 3 and, if that fuel’s type is not so set out, the default CO<Sub>2</Sub> emission factor for that fuel’s type established by a body that is internationally recognized as being competent to establish default CO<Sub>2</Sub> emission factors for fuels and a statement that indicates the name of the body, and</Text></Subsubclause><Subsubclause lims:inforce-start-date="2015-07-01" lims:fid="784058" lims:id="784058"><Label>3.</Label><Text>a statement that indicates which of the ASTM and GPA standards and of the methods referred to in subsection <XRefInternal>24</XRefInternal>(6) of these Regulations were used to determine the measured value of HHV referred to in sub-subclause 1 or, for a gaseous fuel, that indicates that a direct measuring device was used to determine that measured value, and</Text></Subsubclause></Subclause><Subclause lims:inforce-start-date="2015-07-01" lims:fid="784059" lims:id="784059"><Label>(III)</Label><Text>if paragraph <XRefInternal>24</XRefInternal>(1)(b) of these Regulations applies</Text><Subsubclause lims:inforce-start-date="2015-07-01" lims:fid="784060" lims:id="784060"><Label>1.</Label><Text>the default value of HHV, as described in paragraph (b) of that element, in the formula set out in subsection <XRefInternal>24</XRefInternal>(4) of these Regulations, for each fuel combusted,</Text></Subsubclause><Subsubclause lims:inforce-start-date="2015-07-01" lims:fid="784061" lims:id="784061"><Label>2.</Label><Text>a statement that explains the absence of a measured higher heating value and that indicates, if that default higher heating value is established by a body that is internationally recognized as being competent to establish default higher heating values for fuels, the name of the body, and</Text></Subsubclause><Subsubclause lims:inforce-start-date="2015-07-01" lims:fid="784062" lims:id="784062"><Label>3.</Label><Text>if the fuel’s type is set out in column 1 of the applicable table to Schedule 5, its default CO<Sub>2</Sub> emission factor as set out in column 3 and, if that fuel’s type is not so set out, the default CO<Sub>2</Sub> emission factor for that fuel’s type established by a body that is internationally recognized as being competent to establish default CO<Sub>2</Sub> emission factors for fuels and a statement that indicates the name of the body;</Text></Subsubclause></Subclause></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784063" lims:id="784063"><Label>(d)</Label><Text>if applicable, documents that establish that the captured CO<Sub>2</Sub> emissions were captured, transported and stored as described in subsection <XRefInternal>3</XRefInternal>(5) of these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784064" lims:id="784064"><Label>(e)</Label><Text>if applicable, the quantity of CO<Sub>2</Sub> emissions that were captured, determined using a direct measure of the flow of, and the concentration of CO<Sub>2</Sub> in, those emissions; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784065" lims:id="784065"><Label>(f)</Label><Text>for each type of fuel combusted,</Text><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784066" lims:id="784066"><Label>(i)</Label><Text>the type and, if that type is biomass, an explanation of why that type is biomass as defined in subsection <XRefInternal>2</XRefInternal>(1) of these Regulations, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784067" lims:id="784067"><Label>(ii)</Label><Text>the quantity of fuel combusted.</Text></Subparagraph></Paragraph></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="784068" lims:id="784068"><Label>4</Label><Text>Information for the calendar year respecting</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784069" lims:id="784069"><Label>(a)</Label><Text>the number of hours during which the unit produced electricity;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784070" lims:id="784070"><Label>(b)</Label><Text>if a substituted unit referred to in subsection <XRefInternal>5</XRefInternal>(1) of these Regulations has been substituted for an original unit, the production capacity of that substituted unit;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784071" lims:id="784071"><Label>(c)</Label><Text>for a standby unit, the capacity factor for the standby unit;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784072" lims:id="784072"><Label>(d)</Label><Text>for a unit granted an exemption under subsection <XRefInternal>7</XRefInternal>(4) of these Regulations,</Text><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784073" lims:id="784073"><Label>(i)</Label><Text>the emergency period for the calendar year, namely, the period that begins on the first day in the calendar year on which the emergency existed and that ends on the last day in the calendar year on which it existed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784074" lims:id="784074"><Label>(ii)</Label><Text>the number of hours in the emergency period during which the unit operated, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784075" lims:id="784075"><Label>(iii)</Label><Text>the information referred to in item 3 for each emergency period for, and any other period of, the calendar year; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784076" lims:id="784076"><Label>(e)</Label><Text>for an existing unit referred to in subsection <XRefInternal>14</XRefInternal>(4) of these Regulations, the percentage of CO<Sub>2</Sub> emissions from the unit that are captured, transported and stored, along with supporting documents to establish the validity of that percentage.</Text></Paragraph></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="784077" lims:id="784077"><Label>5</Label><Text>A copy of the auditor’s report referred to in subsection <XRefInternal>26</XRefInternal>(4) of these Regulations.</Text></Section><Section lims:inforce-start-date="2015-07-01" lims:lastAmendedDate="2015-07-01" lims:fid="784078" lims:id="784078"><Label>6</Label><Text>If replacement data referred to in section <XRefInternal>28</XRefInternal> of these Regulations was used for a day or days for a given period referred to in subsection <XRefInternal>28</XRefInternal>(1) of these Regulations during the calendar year,</Text><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784079" lims:id="784079"><Label>(a)</Label><Text>the reason for which data required to determine the value of an element of a formula set out in section <XRefInternal>19</XRefInternal> or any of sections <XRefInternal>21</XRefInternal> to <XRefInternal>24</XRefInternal> of these Regulations was not obtained and an explanation as to why that reason was out of the control of the responsible person;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784080" lims:id="784080"><Label>(b)</Label><Text>the element of the formula for which data was not obtained and the date of the day on which the data was not obtained and, if that data was not obtained for a period of several days, the dates of the days on which the period begins and ends; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-01" lims:fid="784081" lims:id="784081"><Label>(c)</Label><Text>the value determined for that element using replacement data, along with details of that determination, including</Text><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784082" lims:id="784082"><Label>(i)</Label><Text>the data used to make that determination for each period of one or several days,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784083" lims:id="784083"><Label>(ii)</Label><Text>the method used to obtain that data, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-07-01" lims:fid="784084" lims:id="784084"><Label>(iii)</Label><Text>in the case of a determination of the value of an element referred to in subsection <XRefInternal>28</XRefInternal>(3) of these Regulations for a given period, a justification for the given period being used as the basis of that
