(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="703630" lims:id="703630" generate-in-text="no"><Text><DefinedTermEn>new employer</DefinedTermEn> means a person or body who, by reason of an agreement with Her Majesty in right of Canada, carries out the activities that were formerly carried out by a portion of the Department of Health. (<DefinedTermFr>nouvel employeur</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="703631" lims:id="703631" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2016-06-23" lims:lastAmendedDate="2016-06-23" lims:fid="703632" lims:id="703632"><Label>2</Label><Subsection lims:inforce-start-date="2016-06-23" lims:fid="703633" lims:id="703633"><Label>(1)</Label><Text>Subject to subsections (2) and (3), these Regulations apply to a person who, by reason of an agreement between Her Majesty in right of Canada and a new employer, ceases to be employed in the public service and becomes employed by the new employer.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-23" lims:fid="703634" lims:id="703634"><Label>(2)</Label><Text>These Regulations do not apply to a person who subsequently becomes re-employed by the new employer.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-23" lims:fid="703635" lims:id="703635"><Label>(3)</Label><Text>Sections 4 to 9 do not apply to a person who has received a return of contributions pursuant to subsection 3(3) or has exercised an option in accordance with subsection 3(4).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-23" lims:fid="703637" lims:id="703637">SOR/2016-203, s. 82(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="703638" lims:id="703638" level="1"><TitleText>Applicable Provisions</TitleText></Heading><Section lims:inforce-start-date="2016-06-23" lims:lastAmendedDate="2016-06-23" lims:fid="703639" lims:id="703639"><Label>3</Label><Subsection lims:inforce-start-date="2016-06-23" lims:fid="703640" lims:id="703640"><Label>(1)</Label><Text>Sections 12 to 13.01 of the Act only apply to a person on and after the date on which that person ceases to be employed by the new employer.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-23" lims:fid="703641" lims:id="703641"><Label>(2)</Label><Text>A person who does not exercise an option in favour of the transfer value referred to in section 13.01 of the Act is deemed to be employed by a <DefinedTermEn>new employer</DefinedTermEn> within the meaning of subsection 83(1) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1358">Public Service Superannuation Regulations</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-23" lims:fid="703642" lims:id="703642"><Label>(3)</Label><Text>However, if on or after September 1, 2002, were it not for these Regulations, a person would be entitled to a return of contributions under subsection 12(3) or 12.1(4) of the Act, they may request, in writing, the return of contributions within one year after the day on which they cease to be employed in the public service and become employed by the new employer, and if, in the same circumstances, a person would be entitled to exercise an option in favour of the transfer value referred to in section 13.01 of the Act, they may exercise the option within the same period.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-23" lims:fid="703643" lims:id="703643"><Label>(4)</Label><Text><Repealed>[Repealed, SOR/2016-203, s. 79]</Repealed></Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-23" lims:fid="703645" lims:id="703645">SOR/2016-203, s. 79</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="703646" lims:id="703646" level="1"><TitleText>Survivor and Children</TitleText></Heading><Section lims:inforce-start-date="2016-06-23" lims:lastAmendedDate="2016-06-23" lims:fid="703647" lims:id="703647"><Label>4</Label><Text>The survivor and children of a person who dies while employed by the new employer are entitled to one of the following benefits to which they would have been entitled if the person had been employed in the public service:</Text><Paragraph lims:inforce-start-date="2016-06-23" lims:fid="703648" lims:id="703648"><Label>(a)</Label><Text>the death benefit under subsection 12(8) or 12.1(8) of the Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-23" lims:fid="703649" lims:id="703649"><Label>(b)</Label><Text>the allowances referred to in subsection 13(3) or 13.001(3) of the Act.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-23" lims:fid="703651" lims:id="703651">SOR/2016-203, s. 80</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2016-06-23" lims:lastAmendedDate="2016-06-23" lims:fid="703652" lims:id="703652"><Label>5</Label><Text><Repealed>[Repealed, SOR/2016-203, s. 80]</Repealed></Text></Section><Section lims:inforce-start-date="2016-06-23" lims:lastAmendedDate="2016-06-23" lims:fid="703653" lims:id="703653"><Label>6</Label><Text>For the purposes of subsection 26(2) of the Act, a child who was born to or adopted by a person or became the stepchild of the person during the period that begins on the date on which the person ceases to be employed in the public service and that ends on the date on which that person ceases to be employed by the new employer is entitled to an allowance under Part I of the Act.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-23" lims:fid="703655" lims:id="703655">SOR/2016-203, s. 82(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="703656" lims:id="703656" level="1"><TitleText>Adaptation of Subsection 10(5) of the Act</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="703657" lims:id="703657"><Label>7</Label><Text>For the purposes of subsection 10(5) of the Act, the one year period referred to in paragraph 10(5)(a) of the Act begins on the date on which the person ceases to be employed by the new employer.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="703658" lims:id="703658" level="1"><TitleText>Adaptation of Sections 12 to 13.01 of the Act</TitleText></Heading><Section lims:inforce-start-date="2016-06-23" lims:lastAmendedDate="2016-06-23" lims:fid="703659" lims:id="703659"><Label>8</Label><Text>For the purposes of sections 12 to 13.01 of the Act, pensionable service includes the period of service with the new employer that begins on the date on which the person ceases to be employed in the public service and that ends on the date on which the person ceases to be employed by the new employer.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-23" lims:fid="703661" lims:id="703661">SOR/2016-203, s. 82(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2016-06-23" lims:lastAmendedDate="2016-06-23" lims:fid="703662" lims:id="703662"><Label>9</Label><Text>For the purposes of sections 12 to 13.01 of the Act, the age of the person when they cease to be employed in the public service is their age on the day on which they cease to be employed by the new employer.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-23" lims:fid="703664" lims:id="703664">SOR/2016-203, s. 81</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="703665" lims:id="703665" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="703666" lims:id="703666"><Label>10</Label><Text>These Regulations are deemed to have come into force on September 1, 2002.</Text></Section></Body></Regulation>
