level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672615" lims:id="672615"><Label>1</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2016-06-22" lims:fid="672616" lims:id="672616" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="D-1">Defence Production Act</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="672617" lims:id="672617" generate-in-text="no"><Text><DefinedTermEn>business day</DefinedTermEn> means a day other than a Saturday or a holiday. (<DefinedTermFr>jour ouvrable</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="672618" lims:id="672618" generate-in-text="no"><Text><DefinedTermEn>international student</DefinedTermEn> means an individual who is authorized by a study permit or by the <XRefExternal reference-type="regulation" link="SOR-2002-227">Immigration and Refugee Protection Regulations</XRefExternal> to engage in studies in Canada and who is not an officer, director or employee of a person registered under these Regulations. (<DefinedTermFr>étudiant étranger</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="672619" lims:id="672619" generate-in-text="no"><Text><DefinedTermEn>permanent resident</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="act">Immigration Act</XRefExternal>. (<DefinedTermFr>résident permanent</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="672620" lims:id="672620" generate-in-text="no"><Text><DefinedTermEn>person</DefinedTermEn> includes a partnership or other business enterprise. (<DefinedTermFr>personne</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="672621" lims:id="672621" generate-in-text="no"><Text><DefinedTermEn>temporary worker</DefinedTermEn> means an officer, director or employee of a person registered under these Regulations who is not</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672622" lims:id="672622"><Label>(a)</Label><Text>a Canadian citizen ordinarily resident in Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672623" lims:id="672623"><Label>(b)</Label><Text>a permanent resident ordinarily resident in Canada. (<DefinedTermFr>travailleur temporaire</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2016-06-22" lims:fid="672624" lims:id="672624" generate-in-text="no"><Text><DefinedTermEn>visitor</DefinedTermEn> means an individual — other than an international student — who is not an officer, director or employee of a person registered under these Regulations and who is not</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672625" lims:id="672625"><Label>(a)</Label><Text>a Canadian citizen ordinarily resident in Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672626" lims:id="672626"><Label>(b)</Label><Text>a permanent resident ordinarily resident in level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="672630" lims:id="672630"><Label>1.1</Label><Text>Part 2 of the Act does not apply to members of the following classes of persons who act in good faith in the course of their duties and employment:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="672631" lims:id="672631"><Label>a)</Label><Text>public officers as defined in subsection 117.07(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="672632" lims:id="672632"><Label>(b)</Label><Text>elected or appointed officials of the federal or a provincial government; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="672633" lims:id="672633"><Label>(c)</Label><Text>members of a visiting force as defined in section 2 of the <XRefExternal reference-type="act" link="V-2">Visiting Forces Act</XRefExternal>.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" level="1"><TitleText>Registration and Registered Persons</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672638" lims:id="672638">SOR/2016-201, s. 2</HistoricalNoteSubItem></HistoricalNote></Heading><Heading lims:inforce-start-date="2016-06-22" lims:fid="672639" lims:id="672639" level="2"><TitleText>Eligibility for Registration</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="672640" lims:id="672640"><Label>2</Label><Text>A person is eligible to apply for registration if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="672641" lims:id="672641"><Label>(a)</Label><Text>in the case of an individual, they carry on business in Canada, give their consent to a security assessment and are</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="672642" lims:id="672642"><Label>(i)</Label><Text>a Canadian citizen ordinarily resident in Canada, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="672643" lims:id="672643"><Label>(ii)</Label><Text>a permanent resident ordinarily resident in Canada; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="672644" lims:id="672644"><Label>(b)</Label><Text>in the case of a corporation, partnership or any other business enterprise, it is either</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="672645" lims:id="672645"><Label>(i)</Label><Text>incorporated under federal or provincial law, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="672646" lims:id="672646"><Label>(ii)</Label><Text>authorized by federal or provincial law to carry on business in Canada.</Text></Subparagraph></Paragraph></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672647" lims:id="672647" level="2"><TitleText>Applications for Registration</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672648" lims:id="672648"><Label>3</Label><Text>A person who is eligible may apply for registration by sending to the Minister on a form supplied by the Minister an application that contains</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672649" lims:id="672649"><Label>(a)</Label><Text>the applicant's legal name, business name, address, telephone numbers for each place of business in Canada and, if applicable, electronic mail and facsimile numbers for each place;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672650" lims:id="672650"><Label>(b)</Label><Text>evidence of the legal status of the applicant's business;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672651" lims:id="672651"><Label>(c)</Label><Text>the name, residential address and position of each director, officer, partner or proprietor of the business;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672652" lims:id="672652"><Label>(d)</Label><Text>the name and address of any owner of 20% or more of the outstanding voting shares or interests of the business and the percentage that each owns;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672653" lims:id="672653"><Label>(e)</Label><Text>the name, date of birth, position, telephone number and, if applicable, facsimile number and email address of the individual who is proposed to be appointed as the designated official;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672654" lims:id="672654"><Label>(f)</Label><Text><Repealed>[Repealed, SOR/2016-201, s. 3]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672655" lims:id="672655"><Label>(g)</Label><Text>a description of the controlled goods that the applicant intends to examine, possess or transfer and the addresses of the locations where those goods will be kept;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672656" lims:id="672656"><Label>(h)</Label><Text>the addresses of the locations where the records required by these Regulations will be kept; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672657" lims:id="672657"><Label>(i)</Label><Text>a statement signed and dated by an individual authorized for that purpose, stating that the information contained in the application is accurate and complete.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672659" lims:id="672659">SOR/2016-201, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672660" lims:id="672660"><Label>3.1</Label><Text>The application shall be accompanied by the consent of the following individuals to a security assessment to be conducted by the Minister in accordance with section 15, including their consent to the disclosure of their personal information to — and its use by — Canadian government entities and credit reporting agencies for the purpose of that assessment:</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672661" lims:id="672661"><Label>(a)</Label><Text>each owner referred to in paragraph 3(d) that is an individual;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672662" lims:id="672662"><Label>(b)</Label><Text>the proposed designated official referred to in paragraph 3(e), unless they were subjected to a security assessment in accordance with section 15 within the previous five years; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672663" lims:id="672663"><Label>(c)</Label><Text>the authorized individual referred to in paragraph 3(i).</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672665" lims:id="672665">SOR/2016-201, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672666" lims:id="672666" level="2"><TitleText>Factor for Consideration</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672667" lims:id="672667"><Label>4</Label><Text>In deciding whether to register an applicant, the Minister shall assess, based on the security assessments referred to in section 3.1 and any other information obtained in respect of the applicant, the extent to which the applicant poses a risk of transferring a controlled good to a person who is neither registered nor exempt from 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672670" lims:id="672670" level="2"><TitleText>Approval</TitleText></Heading><Section lims:inforce-start-date="2010-12-10" lims:lastAmendedDate="2010-12-10" lims:fid="672671" lims:id="672671"><Label>5</Label><Text>If the Minister approves an application for registration, the Minister shall provide a certificate of registration to the applicant that sets out the period for which the registration is valid and any conditions under which they may examine, possess or transfer controlled goods.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-12-10" lims:fid="672673" lims:id="672673">SOR/2010-303, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672674" lims:id="672674" level="2"><TitleText>Denial of Registration</TitleText></Heading><Section lims:inforce-start-date="2010-12-10" lims:lastAmendedDate="2010-12-10" lims:fid="672675" lims:id="672675"><Label>6</Label><Text>If the Minister denies an application for registration, the Minister shall send a notice with reasons for the denial to the applicant.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-12-10" lims:fid="672677" lims:id="672677">SOR/2010-303, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672678" lims:id="672678" level="2"><TitleText>Period of Validity</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="672679" lims:id="672679"><Label>7</Label><Text>The registration of a person is valid for a period not exceeding five years from the date of approval by the Minister.</Text></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672680" lims:id="672680" level="2"><TitleText>Non-assignability</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="672681" lims:id="672681"><Label>8</Label><Text>The registration of a person is not assignable.</Text></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672682" lims:id="672682" level="2"><TitleText>Changes to Application</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672683" lims:id="672683"><Label>9</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672684" lims:id="672684"><Label>(1)</Label><Text>Every applicant and registered person shall advise the Minister of any change in any of the information contained in or accompanying the application for registration within ten business days after the day on which they become aware of the change.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672685" lims:id="672685"><Label>(2)</Label><Text>A registered person shall, by the later of 32 business days before the date of an acquisition or one business day after the day on which they become aware of an acquisition, advise the Minister of the name and address of any person that will, as a result of the acquisition, own 20% or more of the outstanding voting shares or interests of the business.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672687" lims:id="672687">SOR/2016-201, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672688" lims:id="672688" level="2"><TitleText>Conditions of Registration</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672689" lims:id="672689"><Label>10</Label><Text>Every registration of a person is subject to the following conditions:</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672690" lims:id="672690"><Label>(a)</Label><Text>that the person keep and maintain, during the period of registration and for a period of five years after the day on which the person ceases to be registered, records that contain</Text><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672691" lims:id="672691"><Label>(i)</Label><Text>a description of any controlled goods received by the person, the date of their receipt and an identification of the person from whom they were transferred,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672692" lims:id="672692"><Label>(ii)</Label><Text>a description of any controlled goods transferred by the person, the date of their transfer and the identity and address of the person to whom they were transferred, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672693" lims:id="672693"><Label>(iii)</Label><Text>a description of the manner and date of disposition of the controlled goods;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672694" lims:id="672694"><Label>(b)</Label><Text>that the person keep records of the most recent security assessment in respect of each of their officers, directors, employees, temporary workers, international students and visitors who examine, possess or transfer controlled goods and maintain those records — as well as supporting documentation — for a period of two years after the day on which the individual in question ceases to act in that capacity;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672695" lims:id="672695"><Label>(c)</Label><Text>that the person keep a copy of the evidence referred to in subsection 16(2) for a period of two years after the day on which the individual who is exempt ceases to have access to the controlled goods of the registered person;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672696" lims:id="672696"><Label>(d)</Label><Text>that the person meets the requirements set out in section 11 and subsection 12(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672697" lims:id="672697"><Label>(e)</Label><Text>that the person establish and implement a security plan in respect of each place of business in Canada where controlled goods are kept that contains written measures that set out</Text><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672698" lims:id="672698"><Label>(i)</Label><Text>the procedures used by the person to control the examination, possession and transfer of controlled goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672699" lims:id="672699"><Label>(ii)</Label><Text>the procedures for reporting and investigating security breaches in relation to controlled goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672700" lims:id="672700"><Label>(iii)</Label><Text>the description of the responsibilities of the person's security organization and the identity of individuals who are responsible for the security of controlled goods, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672701" lims:id="672701"><Label>(iv)</Label><Text>the contents of security briefings and training programs given to visitors, officers, directors, employees and temporary workers, as the case may be;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672702" lims:id="672702"><Label>(f)</Label><Text>that the person provide training programs in respect of the secure handling of controlled goods for officers, directors, employees and temporary workers who are authorized to possess or examine those goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672703" lims:id="672703"><Label>(g)</Label><Text>that the person provide briefings in respect of the secure handling of controlled goods by visitors who are authorized to examine those goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672704" lims:id="672704"><Label>(h)</Label><Text>that the person advise the Minister of any actual or potential security breach in relation to controlled goods within three days after the day on which they discover the breach;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672705" lims:id="672705"><Label>(i)</Label><Text>that the person make available, at any reasonable time, to the Minister the records referred to in paragraph (a), the records and documents referred to in paragraph (b) and the copy of the evidence referred to in paragraph (c); and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672706" lims:id="672706"><Label>(j)</Label><Text>that the person submit to the Minister, every six months, the name of each individual in respect of whom the designated official conducted a security assessment during the previous six months, as well as the individual’s date of birth and an indication of the extent to which they were authorized to access controlled goods.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672708" lims:id="672708">SOR/2010-303, s. 2; SOR/2016-201, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672709" lims:id="672709" level="2"><TitleText>Designated Officials</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672710" lims:id="672710"><Label>11</Label><Text>An applicant for registration or a registered person may propose to appoint as a designated official only</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672711" lims:id="672711"><Label>(a)</Label><Text>themselves, if they are an individual; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672712" lims:id="672712"><Label>(b)</Label><Text>one of their officers, directors or employees who is either a Canadian citizen ordinarily resident in Canada or a permanent resident ordinarily resident in Canada and who has obtained — or will obtain before the appointment is made — any certification required by the Minister.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672714" lims:id="672714">SOR/2016-201, s. lims:inforce-start-date="2016-06-22" lims:fid="672716" lims:id="672716"><Label>(1)</Label><Text>A registered person shall ensure that a designated official is subjected to a security assessment in accordance with section 15 before their appointment and at least once every five years.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672717" lims:id="672717"><Label>(2)</Label><Text>An individual in respect of whom a security assessment is required under subsection (1) shall provide their consent to the security assessment, including their consent to the disclosure of their personal information to — and its use by — Canadian government entities and credit reporting agencies for the purpose of that assessment.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672718" lims:id="672718"><Label>(3)</Label><Text>The Minister shall, on the basis of the security assessment, accept or reject the individual as a designated official and shall notify the registered person of the acceptance or the reasons for rejection.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672720" lims:id="672720">SOR/2016-201, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672721" lims:id="672721" level="2"><TitleText>Duties of Designated Officials</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672722" lims:id="672722"><Label>13</Label><Text>Every registered person shall ensure that the designated official</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672723" lims:id="672723"><Label>(a)</Label><Text>in respect of each officer, director and employee who is not a temporary worker of the registered person and who requires in the course of their duties access to controlled goods,</Text><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672724" lims:id="672724"><Label>(i)</Label><Text>conducts, at least once every five years and with the consent of the individual concerned, including their consent to the disclosure of their personal information to — and its use by — Canadian government entities and credit reporting agencies for the purpose of the assessment, a security assessment in accordance with section 15,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672725" lims:id="672725"><Label>(ii)</Label><Text>determines, on the basis of the security assessment, the extent to which the individual concerned poses a risk of transferring a controlled good to a person who is neither registered nor exempt from registration,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672726" lims:id="672726"><Label>(iii)</Label><Text>if the designated official is of the opinion that the individual concerned poses a high risk, requests that the Minister conduct his or her own security assessment in respect of the individual concerned and provides to the Minister, for the purpose of carrying out that assessment, all information and evidence obtained by the designated official under subsections 15(2), (4) and (5),</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672727" lims:id="672727"><Label>(iv)</Label><Text>considers any recommendation provided by the Minister under subsection 15.1(2), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672728" lims:id="672728"><Label>(v)</Label><Text>decides the extent to which the registered person ought to authorize the individual concerned to examine, possess or transfer controlled goods;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672729" lims:id="672729"><Label>(b)</Label><Text>verifies the information provided to them by temporary workers, international students and visitors for the purpose of applications for exemption submitted under section 18; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672730" lims:id="672730"><Label>(c)</Label><Text>obtains and maintains any certification required by the Minister.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672732" lims:id="672732">SOR/2016-201, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672733" lims:id="672733" level="2"><TitleText>Scope of Registration</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672734" lims:id="672734"><Label>14</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672735" lims:id="672735"><Label>(1)</Label><Text>The registered person shall be bound by the decision of the designated official under subparagraph 13(a)(v).</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672736" lims:id="672736"><Label>(2)</Label><Text>An authorization by the registered person applies to an officer, director or employee only when that individual is acting in the course of their duties with the registered person.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672738" lims:id="672738">SOR/2016-201, s. 10</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672739" lims:id="672739" level="1"><TitleText>Security Assessments</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672740" lims:id="672740"><Label>15</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672741" lims:id="672741"><Label>(1)</Label><Text>The Minister shall conduct a security assessment in respect of all proposed designated officials and all individuals referred to in paragraphs 3(d) and (i), and the designated official shall conduct a security assessment in respect of all officers, directors and employees referred to in paragraph 13(a), having regard to the information provided under subsection (4).</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672742" lims:id="672742"><Label>(2)</Label><Text>In conducting the security assessment, the Minister may also have regard to other information provided by any person and the designated official may have regard to other information provided by the Minister if the Minister or the designated official, as the case may be, has reasonable grounds to believe that the information is necessary to determine the extent of the risk referred to in subsection (3).</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672743" lims:id="672743"><Label>(3)</Label><Text>The purpose of the security assessment is to determine the extent to which the individual being assessed poses a risk of transferring a controlled good to a person who is neither registered nor exempt from registration.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672744" lims:id="672744"><Label>(4)</Label><Text>The individual who is the subject of the security assessment shall provide the Minister or the designated official, as the case may be, with the following information and, on request, any additional information or evidence that the Minister or the designated official requires to verify it:</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672745" lims:id="672745"><Label>(a)</Label><Text>their name and any previous names;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672746" lims:id="672746"><Label>(b)</Label><Text>their date and place of birth;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672747" lims:id="672747"><Label>(c)</Label><Text>all citizenships and any permanent resident status;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672748" lims:id="672748"><Label>(d)</Label><Text>personal references; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672749" lims:id="672749"><Label>(e)</Label><Text>a description, in respect of the five-year period immediately before the day on which the individual consents to the assessment, of their</Text><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672750" lims:id="672750"><Label>(i)</Label><Text>criminal history,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672751" lims:id="672751"><Label>(ii)</Label><Text>places of residence,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672752" lims:id="672752"><Label>(iii)</Label><Text>education and employment history,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672753" lims:id="672753"><Label>(iv)</Label><Text>financial history,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672754" lims:id="672754"><Label>(v)</Label><Text>history of travel outside of Canada and the United States, including any denial of entry into another country,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672755" lims:id="672755"><Label>(vi)</Label><Text>significant personal and professional associations and relationships that could affect the extent to which the individual poses a risk of transferring a controlled good to a person who is neither registered nor exempt from registration, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672756" lims:id="672756"><Label>(vii)</Label><Text>any security clearance held, denied, suspended or revoked.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672757" lims:id="672757"><Label>(5)</Label><Text>An individual who is or has been the subject of a security assessment shall advise the Minister or the designated official, as the case may be, of any change concerning their criminal history within five business days after the day on which the change occurs.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672758" lims:id="672758"><Label>(6)</Label><Text>The Minister or the designated official, as the case may be, shall reconduct a security assessment if new information is received or if there are other reasonable grounds for doing so.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672760" lims:id="672760">SOR/2010-303, s. 3; lims:id="672761"><Label>15.1</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672762" lims:id="672762"><Label>(1)</Label><Text>If a request is made to the Minister under subparagraph 13(a)(iii), the Minister shall conduct the security assessment of the individual concerned in accordance with section 15.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672763" lims:id="672763"><Label>(2)</Label><Text>The Minister shall advise the designated official of his or her recommendation respecting the extent to which the individual concerned poses a risk of transferring a controlled good to a person who is neither registered nor exempt from registration and the extent to which, in the Minister’s opinion, the individual ought to be authorized to examine, possess or transfer controlled goods.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672765" lims:id="672765">SOR/2016-201, s. 10</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672766" lims:id="672766" level="1"><TitleText>Exemptions</TitleText></Heading><Heading lims:inforce-start-date="2016-06-22" lims:fid="672767" lims:id="672767" level="2"><TitleText>Class of Exempt Individuals</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="672768" lims:id="672768"><Label>16</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="672769" lims:id="672769"><Label>(1)</Label><Text>Subject to subsection (2), an individual is exempt from registration if they are a director, an officer or an employee of a person registered to access controlled goods under the <XRefExternal reference-type="regulation">International Traffic in Arms Regulations</XRefExternal>, Title 22, Parts 120-130 of the <XRefExternal reference-type="regulation">Code of Federal Regulations</XRefExternal> (United States).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="672770" lims:id="672770"><Label>(2)</Label><Text>An individual is exempt from registration from the day on which they provide to the person registered under these Regulations from whom they will obtain access to the controlled goods</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="672771" lims:id="672771"><Label>(a)</Label><Text>evidence of the individual's status as a director, an officer or an employee of the person registered under the regulations referred to in subsection (1);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="672772" lims:id="672772"><Label>(b)</Label><Text>evidence of the registration and eligibility of that person under the <XRefExternal reference-type="regulation">International Traffic in Arms Regulations</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="672773" lims:id="672773"><Label>(c)</Label><Text>evidence of the eligibility of the individual under the <XRefExternal reference-type="regulation">International Traffic in Arms Regulations</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="672774" lims:id="672774"><Label>(3)</Label><Text>An individual is also exempt from registration if they are an officer, employee or elected or appointed official of the United States federal government or of a state or territorial government of the United States and act in good faith in the course of their duties and employment.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="672776" lims:id="672776">SOR/2004-132, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672777" lims:id="672777" level="2"><TitleText>Eligibility for Exemption from Registration</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672778" lims:id="672778"><Label>17</Label><Text>A temporary worker, international student or visitor is eligible for exemption from registration only if a registered person submits to the Minister an application on their behalf in accordance with section 18.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672780" lims:id="672780">SOR/2016-201, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672781" lims:id="672781" level="2"><TitleText>Applications for Exemption from Registration</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672782" lims:id="672782"><Label>18</Label><Text>A registered person may apply to exempt a temporary worker, international student or visitor from registration by sending to the Minister, on a form supplied by the Minister, an application that contains</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672783" lims:id="672783"><Label>(a)</Label><Text>the name of the registered person;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672784" lims:id="672784"><Label>(b)</Label><Text>the name, any previous names, date of birth and citizenships of the temporary worker, international student or visitor;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672785" lims:id="672785"><Label>(c)</Label><Text>in the case of a visitor, their address and the name and address of their employer, if applicable;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672786" lims:id="672786"><Label>(d)</Label><Text>a description, including the country of origin if other than Canada, of the controlled goods that the temporary worker, the international student or the visitor will examine, possess or transfer;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672787" lims:id="672787"><Label>(e)</Label><Text>the expected duration of the temporary worker’s employment or of the international student’s placement with the registered person or the expected duration and purpose of the visit; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672788" lims:id="672788"><Label>(f)</Label><Text>a statement signed and dated by the designated official, stating that</Text><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672789" lims:id="672789"><Label>(i)</Label><Text>the individual for whom the exemption is being sought meets the requirements of the definition of temporary worker, international student or visitor, as the case may be,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672790" lims:id="672790"><Label>(ii)</Label><Text>in the case of a temporary worker or international student, the designated official has contacted their personal references, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672791" lims:id="672791"><Label>(iii)</Label><Text>the information contained in and accompanying the application is accurate and complete.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672793" lims:id="672793">SOR/2016-201, s. 12</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672794" lims:id="672794"><Label>18.1</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672795" lims:id="672795"><Label>(1)</Label><Text>An application for exemption from registration shall be accompanied by the consent of the temporary worker, international student or visitor to a security assessment to be conducted in accordance with section 19, including their consent to the disclosure of their personal information to — and its use by — Canadian government entities for the purpose of the assessment, as well as a copy of their valid passport.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672796" lims:id="672796"><Label>(2)</Label><Text>In the case of a temporary worker or international student, the application shall also be accompanied by their consent to the disclosure of their personal information to — and its use by — credit reporting agencies for the purpose of the security assessment, as well as</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672797" lims:id="672797"><Label>(a)</Label><Text>copies of all identity documents issued to them by the Government of Canada or any province;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672798" lims:id="672798"><Label>(b)</Label><Text>evidence that they are authorized to work or study in Canada, as the case may be, and, in the case of an international student, a document from the academic institution at which they are authorized to study indicating that the work they are doing for the registered person is integral to those studies;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672799" lims:id="672799"><Label>(c)</Label><Text>personal references;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672800" lims:id="672800"><Label>(d)</Label><Text>a description, in respect of the five-year period immediately before the day on which they consent to the assessment, of their</Text><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672801" lims:id="672801"><Label>(i)</Label><Text>criminal history,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672802" lims:id="672802"><Label>(ii)</Label><Text>places of residence,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672803" lims:id="672803"><Label>(iii)</Label><Text>education and employment history, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-06-22" lims:fid="672804" lims:id="672804"><Label>(iv)</Label><Text>history of international travel outside of Canada and the United States, including any denial of entry into another country; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672805" lims:id="672805"><Label>(e)</Label><Text>the original results of a country-wide criminal record check conducted by the relevant authorities in every country other than Canada in which they resided during the period referred to in paragraph (d).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672806" lims:id="672806"><Label>(3)</Label><Text>The temporary worker and the international student shall, on request, provide the designated official with any additional information or evidence that the designated official requires to verify the information provided under subsection (2).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672808" lims:id="672808">SOR/2016-201, s. 12</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-06-22" lims:fid="672809" lims:id="672809" level="2"><TitleText>Security Assessments for Temporary Workers, International Students and Visitors</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672810" lims:id="672810"><Label>19</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672811" lims:id="672811"><Label>(1)</Label><Text>The Minister shall conduct a security assessment in respect of all temporary workers, international students and visitors in respect of whom an application for exemption from registration has been made under section 18, having regard to the information provided under section 18.1 and any other information that the Minister has reasonable grounds to believe is necessary to make a decision under section 20.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672812" lims:id="672812"><Label>(2)</Label><Text>The purpose of the security assessment is to determine the extent to which the individual being assessed poses a risk of transferring a controlled good to a person who is neither registered nor exempt from registration.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672813" lims:id="672813"><Label>(3)</Label><Text>The registered person shall advise the Minister of any change in any of the information contained in or accompanying an application for exemption within five business days after the day on which the change occurs.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672814" lims:id="672814"><Label>(4)</Label><Text>The Minister shall reconduct a security assessment if new information is received or if there are other reasonable grounds for doing so.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672816" lims:id="672816">SOR/2016-201, s. Consideration</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672818" lims:id="672818"><Label>20</Label><Text>The Minister shall, on the basis of the security assessment conducted under section 19, decide whether to approve or deny the application for exemption from registration.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672821" lims:id="672821" level="2"><TitleText>Approval of Application for Exemption</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672822" lims:id="672822"><Label>21</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672823" lims:id="672823"><Label>(1)</Label><Text>If the Minister approves an application for exemption, the Minister shall provide a certificate of exemption from registration to the registered person that sets out the period for which the exemption is valid and any conditions under which the temporary worker, the international student or the visitor concerned may examine, possess or transfer controlled goods.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672824" lims:id="672824"><Label>(2)</Label><Text>The registered person shall provide the temporary worker, the international student or the visitor with a copy of the certificate.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-06-22" lims:fid="672826" lims:id="672826">SOR/2010-303, s. 5; SOR/2016-201, s. Exemption</TitleText></Heading><Section lims:inforce-start-date="2010-12-10" lims:lastAmendedDate="2010-12-10" lims:fid="672828" lims:id="672828"><Label>22</Label><Text>If the Minister denies an lims:id="672832"><Label>23</Label><Text>The exemption of an individual from registration is valid for a period not exceeding three years from the date on which the exemption is approved by the Exemptions</TitleText></Heading><Section lims:inforce-start-date="2016-06-22" lims:lastAmendedDate="2016-06-22" lims:fid="672838" lims:id="672838"><Label>27</Label><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672839" lims:id="672839"><Label>(1)</Label><Text>If the Minister has reasonable grounds to believe that a registered person or an exempt individual poses an undue risk of transferring a controlled good to a person who is neither registered nor exempt from registration, the Minister shall suspend the registration or the exemption.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672840" lims:id="672840"><Label>(2)</Label><Text>The Minister shall revoke the registration or the exemption if he or she determines that the registered person or the exempt individual poses an undue risk of transferring a controlled good to a person who is neither registered nor exempt from registration and that</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672841" lims:id="672841"><Label>(a)</Label><Text>a material fact was, with the intent to mislead, deliberately omitted from or misstated in the application for registration or exemption or in connection with a security assessment referred to in section 3.1, 12 or 19; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672842" lims:id="672842"><Label>(b)</Label><Text>the registered person or the exempt individual is bankrupt.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672843" lims:id="672843"><Label>(3)</Label><Text>The Minister shall reinstate the registration or the exemption if, within 30 days after the date of the notice of suspension or revocation, the registered person makes representations to the Minister that satisfy him or her</Text><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672844" lims:id="672844"><Label>(a)</Label><Text>that there are no longer grounds for the suspension; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-22" lims:fid="672845" lims:id="672845"><Label>(b)</Label><Text>that the revocation was unfounded.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672846" lims:id="672846"><Label>(4)</Label><Text>If the registered person does not, in the case of a suspension, meet the requirements of subsection (3), the Minister shall revoke the registration or the exemption.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672847" lims:id="672847"><Label>(5)</Label><Text>The Minister shall provide to the registered person notice with reasons of any decision to suspend or to revoke a registration or exemption, or not to reinstate a revoked registration or exemption despite representations being made, as well as notice of any decision to reinstate a registration or exemption.</Text></Subsection><Subsection lims:inforce-start-date="2016-06-22" lims:fid="672848" lims:id="672848"><Label>(6)</Label><Text>The registered person shall, within one business day after the day on which they receive a notice from the Minister concerning the exemption of a temporary worker, international student or visitor, provide to that
