(<DefinedTermFr>résident saisonnier</DefinedTermFr>) </Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="644127" lims:id="644127">SI/98-20, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="644128" lims:id="644128" level="1"><TitleText>Remission</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="644129" lims:id="644129"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="644130" lims:id="644130"><Label>(1)</Label><Text>Subject to subsection (2) and section 4, remission is hereby granted of the taxes imposed under Division III of Part IX and any other part of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal>, paid or payable on the importation of household effects by a seasonal resident where the household effects</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="644131" lims:id="644131"><Label>(a)</Label><Text>are imported for the personal use of the seasonal resident or the seasonal resident’s family and are not for any commercial, industrial, occupational or other purpose;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="644132" lims:id="644132"><Label>(b)</Label><Text>are owned by the seasonal resident or the seasonal resident’s family and have been in the possession of and use of the seasonal resident or the seasonal resident’s family before the seasonal resident’s first arrival in Canada to occupy the seasonal residence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="644133" lims:id="644133"><Label>(c)</Label><Text>are not sold or otherwise disposed of in Canada for at least one year after their importation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="644134" lims:id="644134"><Label>(2)</Label><Text>A seasonal resident is entitled to only one remission under this Order.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="644136" lims:id="644136">SI/98-20, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="644137" lims:id="644137"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="644138" lims:id="644138"><Label>(1)</Label><Text>Subject to subsection (2), a seasonal resident’s household effects shall be imported at the time of the first arrival in Canada of the seasonal resident and shall be listed on a customs accounting document.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="644139" lims:id="644139"><Label>(2)</Label><Text>Where household effects that are listed on a customs accounting document referred to in subsection (1) are not imported at the time of the first arrival in Canada of the seasonal resident, the household effects shall be identified on that customs accounting document as household effects that are to follow.</Text></Subsection></Section></Body></Regulation>
