(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618260" lims:id="618260" generate-in-text="no"><Text><DefinedTermEn>condition of public safety concern</DefinedTermEn> means a mental health condition in a person who has been examined by a physician licensed in Canada and for which the physician is of the opinion that the person will likely cause harm to others. (<DefinedTermFr>état préoccupant pour la sécurité publique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618261" lims:id="618261" generate-in-text="no"><Text><DefinedTermEn>disease posing a risk to public health</DefinedTermEn> means a communicable disease</Text><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618262" lims:id="618262"><Label>(a)</Label><Text>that is on the list of national notifiable diseases of the Public Health Agency of Canada, as amended from time to time,</Text><Provision lims:inforce-start-date="2012-06-30" lims:fid="618263" lims:id="618263" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>which is subject to human-to-human transmission and requires public health intervention in accordance with provincial legislation, or</Text></Provision><Provision lims:inforce-start-date="2012-06-30" lims:fid="618264" lims:id="618264" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>for which immunization has been recommended under Canadian medical standards; or</Text></Provision></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618265" lims:id="618265"><Label>(b)</Label><Text>that is referred to in the <XRefExternal reference-type="other">Interim Federal Health Program Policy</XRefExternal> of the Department of Citizenship and Immigration, as amended from time to time. (<DefinedTermFr>maladie présentant un risque pour la santé publique</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618266" lims:id="618266" generate-in-text="no"><Text><DefinedTermEn>expanded health care coverage</DefinedTermEn> means coverage for the following services and products provided in Canada, as defined in the <XRefExternal reference-type="standard">Interim Federal Health Program Policy</XRefExternal> of the Department of Citizenship and Immigration, as amended from time to time: </Text><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618267" lims:id="618267"><Label>(a)</Label><Text>hospital services;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618268" lims:id="618268"><Label>(b)</Label><Text>services of physicians licensed in Canada, registered nurses licensed in Canada and other health care professionals licensed in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618269" lims:id="618269"><Label>(c)</Label><Text>translation services for health purposes;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618270" lims:id="618270"><Label>(d)</Label><Text>laboratory, diagnostic and ambulance services;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618271" lims:id="618271"><Label>(e)</Label><Text>supplemental services; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618272" lims:id="618272"><Label>(f)</Label><Text>supplemental products. (<Emphasis style="italic">couverture des soins de santé élargie</Emphasis>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618273" lims:id="618273" generate-in-text="no"><Text><DefinedTermEn>health care coverage</DefinedTermEn> means coverage for the following services and products provided in Canada only if they are of an urgent or essential nature as defined in the <XRefExternal reference-type="other">Interim Federal Health Program Policy</XRefExternal> of the Department of Citizenship and Immigration, as amended from time to time:</Text><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618274" lims:id="618274"><Label>(a)</Label><Text>hospital services;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618275" lims:id="618275"><Label>(b)</Label><Text>services of physicians licensed in Canada and registered nurses licensed in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618276" lims:id="618276"><Label>(c)</Label><Text>laboratory, diagnostic and ambulance services; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618277" lims:id="618277"><Label>(d)</Label><Text>immunization and medication, only if required to prevent or treat a disease posing a risk to public health or to treat a condition of public safety concern. (<DefinedTermFr>couverture des soins de santé</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618278" lims:id="618278" generate-in-text="no"><Text><DefinedTermEn>immigration medical examination</DefinedTermEn> means a medical examination requested under paragraph 16(2)(b) of the Act and has the meaning assigned to the term <DefinedTermEn>medical examination</DefinedTermEn> in section 29 of the <XRefExternal reference-type="regulation" link="SOR-2002-227">Immigration and Refugee Protection Regulations</XRefExternal>. (<DefinedTermFr>visite médicale d’immigration</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618279" lims:id="618279" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Citizenship and Immigration. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618280" lims:id="618280" generate-in-text="no"><Text><DefinedTermEn>person whose refugee claim has been rejected</DefinedTermEn> means a person </Text><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618281" lims:id="618281"><Label>(a)</Label><Text>whose claim for refugee protection has been finally rejected by the Immigration and Refugee Board and whose right to judicial review, or any appeal of that judicial review, in respect of that claim has been exhausted; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618282" lims:id="618282"><Label>(b)</Label><Text>whose claim is deemed to be rejected under subsections 105(3), 108(3) or 109(3) of the Act. (<DefinedTermFr>personne protégée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618284" lims:id="618284" generate-in-text="no"><Text><DefinedTermEn>public health or public safety health care coverage</DefinedTermEn> means coverage for the following services and products provided in Canada, only if required to diagnose, prevent or treat a disease posing a risk to public health or to diagnose or treat a condition of public safety concern:</Text><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618285" lims:id="618285"><Label>(a)</Label><Text>hospital services;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618286" lims:id="618286"><Label>(b)</Label><Text>services of physicians licensed in Canada and registered nurses licensed in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618287" lims:id="618287"><Label>(c)</Label><Text>laboratory and diagnostic services; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618288" lims:id="618288"><Label>(d)</Label><Text>immunization and medication. (<DefinedTermFr>couverture des soins de santé pour la santé ou la sécurité publiques</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618289" lims:id="618289" generate-in-text="no"><Text><DefinedTermEn>refugee claimant</DefinedTermEn> means a person whose claim for refugee protection is eligible to be referred to the Immigration and Refugee Board and who is awaiting a final determination of that claim by that Board, including a person whose right to judicial review of that determination, or appeal of that judicial review, has not been exhausted. This definition does not include a person whose refugee claim was determined to be abandoned or withdrawn. (<DefinedTermFr>demandeur d’asile</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-06-30" lims:fid="618290" lims:id="618290" generate-in-text="no"><Text><DefinedTermEn>resettled refugee</DefinedTermEn> means a person on whom refugee protection has been conferred under paragraph 95(1)(a) of the Act. (<DefinedTermFr>réfugié réétabli</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2012-06-30" lims:fid="618292" lims:id="618292">SI/2012-49, ss. 1, 6(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2012-06-30" lims:fid="618293" lims:id="618293" level="1"><TitleText>Authorization</TitleText></Heading><Section lims:inforce-start-date="2012-06-30" lims:lastAmendedDate="2012-06-30" lims:fid="618294" lims:id="618294"><Label>2</Label><Text>The Minister is hereby authorized to administer the Interim Federal Health Program in accordance with this Order.</Text></Section><Heading lims:inforce-start-date="2012-06-30" lims:fid="618295" lims:id="618295" level="1"><TitleText>Powers of Minister</TitleText></Heading><Section lims:inforce-start-date="2012-06-30" lims:lastAmendedDate="2012-06-30" lims:fid="618296" lims:id="618296"><Label>3</Label><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618297" lims:id="618297"><Label>(1)</Label><Text>The Minister may pay the cost of health care coverage incurred for protected persons, other than resettled refugees referred to in subsection 6.1(2), for a period set out in the <XRefExternal reference-type="standard">Interim Federal Health Program Policy</XRefExternal> of the Department of Citizenship and Immigration, as amended from time to time.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618298" lims:id="618298"><Label>(2)</Label><Text>Despite subsection (1), the Minister may pay the cost of health care coverage incurred for protected persons who are resettled refugees only while they are under sponsorship under the <XRefExternal reference-type="regulation" link="SOR-2002-227">Immigration and Refugee Protection Regulations</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2012-06-30" lims:fid="618300" lims:id="618300">SI/2012-49, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="618301" lims:id="618301"><Label>4</Label><Subsection lims:inforce-start-date="2012-12-15" lims:fid="618302" lims:id="618302"><Label>(1)</Label><Text>Subject to subsections (2) and (3), the Minister may pay the cost of health care coverage and immigration medical examinations incurred for refugee claimants.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="618303" lims:id="618303"><Label>(2)</Label><Text>The Minister is not authorized to pay, under subsection (1), the cost of health care coverage incurred for refugee claimants while their refugee claims are suspended under subsection 103(1) or 105(1) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="618304" lims:id="618304"><Label>(3)</Label><Text>The Minister is not authorized to pay, under subsection (1), the cost of health care coverage incurred for refugee claimants who are nationals of a country that is, when services or products are provided, designated under subsection 109.1(1) of the Act.</Text></Subsection></Section><Section lims:inforce-start-date="2012-06-30" lims:lastAmendedDate="2012-06-30" lims:fid="618305" lims:id="618305"><Label>5</Label><Text>The Minister may pay the cost of public health or public safety health care coverage incurred for persons whose refugee claims have been rejected except for those whose removal order has been enforced pursuant to section 240 of the <XRefExternal reference-type="regulation" link="SOR-2002-227">Immigration and Refugee Protection Regulations</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="618306" lims:id="618306"><Label>6</Label><Text>The Minister may pay the cost of public health or public safety health care coverage and immigration medical examinations incurred for refugee claimants</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="618307" lims:id="618307"><Label>(a)</Label><Text>while their refugee claims are suspended under subsection 103(1) or 105(1) of the Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="618308" lims:id="618308"><Label>(b)</Label><Text>who are nationals of a country that is, when services or products are provided, designated under subsection 109.1(1) of the Act.</Text></Paragraph></Section><Section lims:inforce-start-date="2012-06-30" lims:lastAmendedDate="2012-06-30" lims:fid="618309" lims:id="618309"><Label>6.1</Label><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618310" lims:id="618310"><Label>(1)</Label><Text>The Minister may pay the cost of expanded health care coverage and immigration medical examinations incurred in Canada for the following persons for a period set out in the <XRefExternal reference-type="standard">Interim Federal Health Program Policy</XRefExternal> of the Department of Citizenship and Immigration, as amended from time to time:</Text><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618311" lims:id="618311"><Label>(a)</Label><Text>persons for whom the Minister exercises a power conferred under subsection 25.1(1) or 25.2(1) of the Act, if they are or were in receipt of governmental resettlement assistance in the form of income support as defined in the <XRefExternal reference-type="standard">Interim Federal Health Program Policy</XRefExternal> of the Department of Citizenship and Immigration, as amended from time to time; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618312" lims:id="618312"><Label>(b)</Label><Text>persons who have been issued a temporary resident permit under section 24 of the Act, if it has been determined, in accordance with ministerial instructions made under subsection 24(3) of the Act, that they are or may be victims of human trafficking.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618313" lims:id="618313"><Label>(2)</Label><Text>The Minister may pay the cost of expanded health care coverage incurred for resettled refugees, if they are or were in receipt of governmental resettlement assistance in the form of income support as defined in the <XRefExternal reference-type="standard">Interim Federal Health Program Policy</XRefExternal> of the Department of Citizenship and Immigration, as amended from time to time, for a period set out in that Policy.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2012-06-30" lims:fid="618315" lims:id="618315">SI/2012-49, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2012-06-30" lims:lastAmendedDate="2012-06-30" lims:fid="618316" lims:id="618316"><Label>7</Label><Text>Despite sections 3 to 6, the Minister may, in exceptional and compelling circumstances, including when the Minister exercises a power conferred under subsection 25.2(1) of the Act, on his or her own initiative and for the period that he or she determines, pay the cost incurred in Canada of any of the following:</Text><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618317" lims:id="618317"><Label>(a)</Label><Text>health care coverage;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618318" lims:id="618318"><Label>(b)</Label><Text>public health or public safety health care coverage;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618319" lims:id="618319"><Label>(c)</Label><Text>immigration medical examinations; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618320" lims:id="618320"><Label>(d)</Label><Text>immunization and medication, only if required to prevent or treat a disease posing a risk to public health or to treat a condition of public safety concern.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2012-06-30" lims:fid="618322" lims:id="618322">SI/2012-49, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2012-06-30" lims:lastAmendedDate="2012-06-30" lims:fid="618323" lims:id="618323"><Label>8</Label><Text>In order to protect the health and safety of Canadians, the Minister may, on his or her own initiative, in exceptional and compelling circumstances, pay the cost of immigration medical examinations, medication or immunization incurred outside Canada that are, in the opinion of the Minister, required prior to departure for Canada for the following persons:</Text><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618324" lims:id="618324"><Label>(a)</Label><Text>resettled refugees; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-30" lims:fid="618325" lims:id="618325"><Label>(b)</Label><Text>foreign nationals in respect of whom the Minister exercises a power conferred under subsection 25.2(1) of the Act.</Text></Paragraph></Section><Section lims:inforce-start-date="2012-06-30" lims:lastAmendedDate="2012-06-30" lims:fid="618326" lims:id="618326"><Label>9</Label><Text>The Minister may pay the cost of health care services and products incurred, in accordance with the <XRefExternal reference-type="other">Interim Federal Health Program Policy</XRefExternal> of the Department of Citizenship and Immigration, as amended from time to time, for foreign nationals or permanent residents who are detained under the Act.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2012-06-30" lims:fid="618328" lims:id="618328">SI/2012-49, s. 6(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2012-06-30" lims:lastAmendedDate="2012-06-30" lims:fid="618329" lims:id="618329"><Label>9.1</Label><Text>Any payment referred to in sections 3 to 9 shall be made in accordance with the benefit grids referred to in the <XRefExternal reference-type="standard">Interim Federal Health Program Policy</XRefExternal> of the Department of Citizenship and Immigration, as amended from time to time.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2012-06-30" lims:fid="618331" lims:id="618331">SI/2012-49, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2012-06-30" lims:fid="618332" lims:id="618332" level="1"><TitleText>Restrictions</TitleText></Heading><Section lims:inforce-start-date="2012-06-30" lims:lastAmendedDate="2012-06-30" lims:fid="618333" lims:id="618333"><Label>10</Label><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618334" lims:id="618334"><Label>(1)</Label><Text>The Minister is not authorized to make a payment under sections 3 to 6 for persons who are or were eligible under any provincial health insurance plan or program, whether or not an application has been made to the plan or program.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618335" lims:id="618335"><Label>(2)</Label><Text>Despite subsection (1), the Minister may pay the cost of immunization and medication incurred for protected persons who are resettled refugees while they are under sponsorship under the <XRefExternal reference-type="regulation" link="SOR-2002-227">Immigration and Refugee Protection Regulations</XRefExternal>, but only if required to prevent or treat a disease posing a risk to public health or to treat a condition of public safety concern.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618336" lims:id="618336"><Label>(3)</Label><Text>The Minister is not authorized to make a payment under section 6.1 for persons referred to in that section for any services or products for which they are eligible under any provincial health insurance plan or program, without regard to the amount that may be recovered under that plan or program for those services or products.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618337" lims:id="618337"><Label>(4)</Label><Text>The Minister is not authorized to make a payment under section 9 for persons referred to in that section who are eligible under any provincial health insurance plan or program, whether or not an application has been made to the plan or program.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618338" lims:id="618338"><Label>(5)</Label><Text>The Minister is not authorized to make a payment under this Order for any services or products for which a person may make a claim under any private insurance plan, without regard to the amount that may be recovered under that plan for those services or products.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-30" lims:fid="618339" lims:id="618339"><Label>(6)</Label><Text>The Minister is not authorized to make a payment under this Order for persons who are Canadian in Council P.C. 157-11/848 of June 20, 1957 continues to apply in respect of health care services and products provided until June 29, 2012 and the Minister may pay the cost of health care services and products provided after that date only in accordance with this Order.</Text></Section><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="618344" lims:id="618344"><Label>12</Label><Text>Subsection 4(3) and paragraph 6(b) do not apply to a refugee claimant whose claim for refugee protection was made prior to the day on which section 12 of the <XRefExternal reference-type="act">Balanced Refugee Reform Act</XRefExternal>, chapter 8 of the Statutes of Canada, 2010, comes into force.</Text></Section><Heading
