link="L-5.8">Canada Lands Surveyors Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344101" lims:id="344101" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344102" lims:id="344102"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344103" lims:id="344103">Definitions</MarginalNote><Label>2</Label><Text>The definitions in this section apply in this Act.</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="344104" lims:id="344104"><Text><DefinedTermEn>Association</DefinedTermEn> means the Association of Canada Lands Surveyors continued by section 4. (<DefinedTermFr>Association</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344105" lims:id="344105"><Text><DefinedTermEn>boundary</DefinedTermEn> means a natural or artificial line on the surface of the earth, below the surface of the earth, in airspace or in or on any structure, the purpose of which is to indicate the extent of a legal interest in land, land under water, water, airspace or natural resources, or in a structure. (<DefinedTermFr>ligne de démarcation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344106" lims:id="344106"><Text><DefinedTermEn>by-law</DefinedTermEn> means a by-law of the Association made under section 18. (<DefinedTermFr>règlement administratif</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344107" lims:id="344107"><Text><DefinedTermEn>cadastral surveying</DefinedTermEn> means surveying in relation to</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344108" lims:id="344108"><Label>(a)</Label><Text>the identification, establishment, documentation or description of a boundary or the position of anything relative to a boundary; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344109" lims:id="344109"><Label>(b)</Label><Text>the generation, manipulation, adjustment, custody, storage, retrieval or display of spatial information that defines a boundary. (<DefinedTermFr>arpentage cadastral</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344110" lims:id="344110"><Text><DefinedTermEn>Canada Lands</DefinedTermEn> means Canada Lands within the meaning of subsection 24(1) of the <XRefExternal reference-type="act" link="L-6">Canada Lands Surveys Act</XRefExternal>. (<DefinedTermFr>terres du Canada</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344111" lims:id="344111"><Text><DefinedTermEn>Canada Lands Surveyor</DefinedTermEn> means a person who holds a commission. (<DefinedTermFr>arpenteur des terres du Canada</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344112" lims:id="344112"><Text><DefinedTermEn>commission</DefinedTermEn> means a commission granted under section 49 or deemed to have been granted under that section by section 48. (<DefinedTermFr>brevet</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344113" lims:id="344113"><Text><DefinedTermEn>Council</DefinedTermEn> means the Council of the Association referred to in section 13. (<DefinedTermFr>conseil</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344114" lims:id="344114"><Text><DefinedTermEn>entity</DefinedTermEn> means a corporation, partnership or unincorporated organization or association, but does not include a department or agency of the government of Canada or of a province. (<DefinedTermFr>entité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344115" lims:id="344115"><Text><DefinedTermEn>licence</DefinedTermEn> means a licence issued under section 53. (<DefinedTermFr>permis</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344116" lims:id="344116"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Natural Resources. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344117" lims:id="344117"><Text><DefinedTermEn>permit</DefinedTermEn> means a permit issued under section 58. (<DefinedTermFr>licence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344118" lims:id="344118"><Text><DefinedTermEn>surveying</DefinedTermEn> means the determination of the form of the earth or the position of natural or artificial things, boundaries or points on, above or under the surface of the earth or the collection, storage, management, integration, analysis or representation of spatial and spatially related information pertaining to the earth or the interpreting of or reporting or advising on that information. (<DefinedTermFr>arpentage</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="344119" lims:id="344119"><Text><DefinedTermEn>Surveyor General</DefinedTermEn> means the Surveyor General within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="L-6">Canada Lands Surveys Act</XRefExternal>. (<DefinedTermFr>arpenteur général</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344120" lims:id="344120" level="1"><TitleText>Her Majesty</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344121" lims:id="344121"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344122" lims:id="344122">Binding on Her Majesty</MarginalNote><Label>3</Label><Text>This Act is binding on Her Majesty in right of Canada or a province.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344123" lims:id="344123" level="1"><TitleText>Association of Canada Lands Surveyors</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344124" lims:id="344124"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344125" lims:id="344125">Association is continued</MarginalNote><Label>4</Label><Text>The Association of Canada Lands Surveyors, a corporation incorporated under Part II of the <XRefExternal reference-type="act" link="C-1.8">Canada Corporations Act</XRefExternal>, being chapter C-32 of the Revised Statutes of Canada, 1970, is hereby continued under this Act.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344126" lims:id="344126"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344127" lims:id="344127">Status and composition of Association</MarginalNote><Label>5</Label><Text>The Association is a body corporate consisting of a governing body and members.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344128" lims:id="344128"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344129" lims:id="344129">Objects</MarginalNote><Label>6</Label><Text>The objects of the Association are</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344130" lims:id="344130"><Label>(a)</Label><Text>to establish and maintain standards of qualifications for Canada Lands Surveyors;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344131" lims:id="344131"><Label>(b)</Label><Text>to regulate Canada Lands Surveyors;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344132" lims:id="344132"><Label>(c)</Label><Text>to establish and maintain standards of conduct, knowledge and skill among members of the Association and permit holders;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344133" lims:id="344133"><Label>(d)</Label><Text>to govern the activities of members of the Association and permit holders;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344134" lims:id="344134"><Label>(e)</Label><Text>to cooperate with other organizations for the advancement of surveying; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344135" lims:id="344135"><Label>(f)</Label><Text>to perform the duties and exercise the powers that are imposed or conferred on the Association by this Act.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344136" lims:id="344136"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344137" lims:id="344137">Minister may act in place of Association</MarginalNote><Label>7</Label><Text>The Minister may take such measures as the Minister considers appropriate to fulfil any object of the Association if the Minister is of the opinion that the Association is not fulfilling it.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344138" lims:id="344138"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344139" lims:id="344139">Capacity of Association</MarginalNote><Label>8</Label><Text>In carrying out its objects, the Association has the capacity of a natural person.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344140" lims:id="344140"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344141" lims:id="344141">Association not agent of Her Majesty</MarginalNote><Label>9</Label><Text>The Association is not an agent of Her Majesty in right of Canada.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344142" lims:id="344142"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344143" lims:id="344143">Head office</MarginalNote><Label>10</Label><Text>The head office of the Association shall be located in Canada at the place stated in the by-laws.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344144" lims:id="344144"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344145" lims:id="344145">Annual meeting</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344146" lims:id="344146"><Label>(1)</Label><Text>The Association shall hold an annual general meeting, within six months after the end of its fiscal year, at a time and place within Canada as may be designated by the Council.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344147" lims:id="344147"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344148" lims:id="344148">Other meetings</MarginalNote><Label>(2)</Label><Text>The Association may hold other general or special meetings as it considers necessary.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344149" lims:id="344149" level="1"><TitleText>President and Vice-president of the Association</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344150" lims:id="344150"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344151" lims:id="344151">President and Vice-President</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344152" lims:id="344152"><Label>(1)</Label><Text>The President and Vice-President of the Association shall be appointed or elected in accordance with the by-laws.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344153" lims:id="344153"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344154" lims:id="344154">Absence or incapacity</MarginalNote><Label>(2)</Label><Text>In the event of the absence or incapacity of the President of the Association, or if that office is vacant, the Vice-President of the Association has all the powers of and may exercise and perform all of the duties of the President of the Association.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344155" lims:id="344155" level="1"><TitleText>Council</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344156" lims:id="344156"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344157" lims:id="344157">Composition and role</MarginalNote><Label>13</Label><Text>The Council is the governing body of the Association and consists of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344158" lims:id="344158"><Label>(a)</Label><Text>the President and Vice-President of the Association;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344159" lims:id="344159"><Label>(b)</Label><Text>the most recent past President of the Association as defined in the by-laws;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344160" lims:id="344160"><Label>(c)</Label><Text>members of the Association, in a number set out in the by-laws, which number may not be less than three, who are elected in accordance with the by-laws;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344161" lims:id="344161"><Label>(d)</Label><Text>the Surveyor General; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344162" lims:id="344162"><Label>(e)</Label><Text>two persons who are not members of the Association and who are appointed by the Minister.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344163" lims:id="344163"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344164" lims:id="344164">Chairperson of the Council</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344165" lims:id="344165"><Label>(1)</Label><Text>The President of the Association is the Chairperson of the Council.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344166" lims:id="344166"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344167" lims:id="344167">Duties of Chairperson</MarginalNote><Label>(2)</Label><Text>The Chairperson of the Council shall preside at meetings of the Council and perform the duties that the Council specifies.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344168" lims:id="344168"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344169" lims:id="344169">Minister may review activities</MarginalNote><Label>15</Label><Text>The Minister may review the activities of the Council and may request that the Council undertake activities that, in the opinion of the Minister, are advisable to carry out the objects of the Association.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344170" lims:id="344170"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344171" lims:id="344171">Filling of vacancies</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344172" lims:id="344172"><Label>(1)</Label><Text>A vacancy on the Council caused by the death, resignation, removal or incapacity to act of a Council member referred to in paragraph 13(c) shall be filled by a member of the Association in the manner set out in the by-laws.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344173" lims:id="344173"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344174" lims:id="344174">Term of office</MarginalNote><Label>(2)</Label><Text>A person appointed or elected to fill a vacancy on the Council shall hold office for the unexpired portion of the term of the Council member being replaced.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344175" lims:id="344175"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344176" lims:id="344176">Consultation</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344177" lims:id="344177"><Label>(1)</Label><Text>The Minister shall not appoint anyone to the Council under paragraph 13(e), or revoke the appointment of a person appointed under that paragraph, without having first consulted the Council.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344178" lims:id="344178"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344179" lims:id="344179">Term of office</MarginalNote><Label>(2)</Label><Text>A Council member appointed under paragraph 13(e) shall be appointed for a term of not more than three years and may be reappointed for one or more terms of not more than three years each.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344180" lims:id="344180"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344181" lims:id="344181">Fees and travelling and living expenses</MarginalNote><Label>(3)</Label><Text>The Minister shall pay Council members appointed under paragraph 13(e), and the Surveyor General, such fees as may be fixed by the Minister and reasonable travelling and living expenses incurred by them in the performance of their duties while absent from their usual place of residence.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344182" lims:id="344182" level="1"><TitleText>By-laws</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344183" lims:id="344183"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344184" lims:id="344184">By-laws</MarginalNote><Label>18</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344185" lims:id="344185"><Label>(1)</Label><Text>The Council may make by-laws respecting any matter necessary to carry on the business and activities of the Association, including by-laws regarding any matter for which by-laws are required by this Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344186" lims:id="344186"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344187" lims:id="344187">When by-law becomes effective</MarginalNote><Label>(2)</Label><Text>A by-law is not effective until it is approved in accordance with the by-laws.</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344188" lims:id="344188" level="1"><TitleText>Council Committees</TitleText></Heading><Heading lims:inforce-start-date="2002-12-31" lims:fid="344189" lims:id="344189" level="2"><TitleText>Establishment</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344190" lims:id="344190"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344191" lims:id="344191">Mandatory committees</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344192" lims:id="344192"><Label>(1)</Label><Text>The Council shall establish the following committees:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344193" lims:id="344193"><Label>(a)</Label><Text>the Executive Committee;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344194" lims:id="344194"><Label>(b)</Label><Text>the Board of Examiners;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344195" lims:id="344195"><Label>(c)</Label><Text>the Complaints Committee; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344196" lims:id="344196"><Label>(d)</Label><Text>the Discipline Committee.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344197" lims:id="344197"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344198" lims:id="344198">Other committees</MarginalNote><Label>(2)</Label><Text>The Council may from time to time as it considers necessary establish committees other than those referred to in subsection (1).</Text></Subsection></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344199" lims:id="344199" level="2"><TitleText>Executive Committee</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344200" lims:id="344200"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344201" lims:id="344201">Role</MarginalNote><Label>20</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344202" lims:id="344202"><Label>(1)</Label><Text>The Executive Committee shall perform such powers of the Council as the Council may delegate to it, other than the power to make regulations or by-laws.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344203" lims:id="344203"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344204" lims:id="344204">Urgent matters</MarginalNote><Label>(2)</Label><Text>Subject to ratification by the Council at its next meeting, the Executive Committee may take any action on any matter that requires immediate action lims:id="344208"><Label>(1)</Label><Text>Subject to section 22, the Board of Examiners has control over all matters relating to the admission and qualifications of candidates for a commission and to lims:id="344210">Admission of candidates</MarginalNote><Label>(2)</Label><Text>The Board of Examiners may admit a person to be a candidate for a commission only if the person has complied with the lims:inforce-start-date="2002-12-31" lims:fid="344212" lims:id="344212">Directions from Council</MarginalNote><Label>22</Label><Text>The Board of Examiners shall comply with any direction given to it by the Council with respect to the exercise of the Board of Examiners’ powers.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344213" lims:id="344213"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344214" lims:id="344214">Recommendations for commissions</MarginalNote><Label>23</Label><Text>The Board of Examiners shall recommend to the Council that a commission be granted to every candidate for a commission who has complied with the requirements specified in the regulations.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344215" lims:id="344215" level="2"><TitleText>Complaints Committee</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344216" lims:id="344216"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344217" lims:id="344217">Role</MarginalNote><Label>24</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344218" lims:id="344218"><Label>(1)</Label><Text>The Complaints Committee shall consider all complaints in writing that are received by the Association regarding the conduct or actions of any member of the Association, Canada Lands Surveyor or permit holder.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344219" lims:id="344219"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344220" lims:id="344220">Rights of Committee</MarginalNote><Label>(2)</Label><Text>Where the Complaints Committee has reasonable grounds to believe that a member of the Association, Canada Lands Surveyor or permit holder against whom a complaint is made has committed an act of professional misconduct or is incompetent, the Complaints Committee, or a person appointed by it for the purpose, may inquire into and examine the surveying activities of the member, Canada Lands Surveyor or permit holder and may enter, at any reasonable time, the business premises of the member, Canada Lands Surveyor or permit holder, other than a dwelling-house, and examine documents and things relative to the subject-matter of the complaint.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344221" lims:id="344221"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344222" lims:id="344222">Operation of data processing systems and copying equipment</MarginalNote><Label>(3)</Label><Text>In carrying out an investigation under this section, the Complaints Committee, or a person appointed by it for the purpose, may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344223" lims:id="344223"><Label>(a)</Label><Text>use or cause to be used any data processing system at the place to examine any data contained in or available to the data processing system;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344224" lims:id="344224"><Label>(b)</Label><Text>reproduce any record or cause it to be reproduced from the data in the form of a printout or other intelligible output and take the printout or other output for examination or copying; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344225" lims:id="344225"><Label>(c)</Label><Text>use or cause to be used any copying equipment at the place to make copies of any record or other document.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344226" lims:id="344226"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344227" lims:id="344227">Requirement to assist</MarginalNote><Label>(4)</Label><Text>Every member of the Association, Canada Lands Surveyor or permit holder in respect of whom a complaint has been received by the Association shall give all reasonable assistance to the Complaints Committee, or to the person appointed by it to conduct the investigation, as the case may be.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344228" lims:id="344228"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344229" lims:id="344229">Decision on complaint</MarginalNote><Label>25</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344230" lims:id="344230"><Label>(1)</Label><Text>After having considered a complaint, the Complaints Committee shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344231" lims:id="344231"><Label>(a)</Label><Text>recommend to the Council that the complaint be dismissed if it is satisfied that the evidence disclosed by the investigation does not support a finding of professional misconduct or incompetence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344232" lims:id="344232"><Label>(b)</Label><Text>recommend to the Council that the complaint be heard by the Discipline Committee if it is satisfied that there is sufficient evidence disclosed by the investigation that could support a finding of professional misconduct or incompetence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344233" lims:id="344233"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344234" lims:id="344234">Opportunity to be heard</MarginalNote><Label>(2)</Label><Text>The Complaints Committee shall not make a recommendation under paragraph (1)(b) unless the Association has notified, in writing, the member of the Association, Canada Lands Surveyor or permit holder who is the subject of the complaint of the receipt of the complaint and the member, Canada Lands Surveyor or permit holder has been provided with at least 30 days in which to submit in writing any explanations or representations that the member, Canada Lands Surveyor or permit holder may wish to make concerning the complaint.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344235" lims:id="344235"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344236" lims:id="344236">Where complaint dismissed by Council</MarginalNote><Label>(3)</Label><Text>Where the Council decides not to deal with a complaint by either accepting a recommendation to dismiss the complaint or by rejecting a recommendation to have the complaint heard by the Discipline Committee, the Association shall so notify the complainant and the member of the Association, Canada Lands Surveyor or permit holder who is the subject of the complaint.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344237" lims:id="344237"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344238" lims:id="344238">Opportunity to be heard</MarginalNote><Label>(4)</Label><Text>The Council shall not reject a recommendation to dismiss a complaint unless the Association has notified, in writing, the member of the Association, Canada Lands Surveyor or permit holder who is the subject of the complaint of the receipt of the complaint and the member, Canada Lands Surveyor or permit holder has been provided with at least 30 days in which to submit in writing any explanations or representations that the member, Canada Lands Surveyor or permit holder may wish to make concerning the complaint.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344239" lims:id="344239"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344240" lims:id="344240">Where recommendation under paragraph (1)(b) accepted</MarginalNote><Label>(5)</Label><Text>Where the Council accepts a recommendation to have a complaint heard by the Discipline Committee, the Association shall so notify the complainant and the member of the Association, Canada Lands Surveyor or permit holder who is the subject of the complaint. The notice to the complainant shall also advise the complainant that the complainant may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344241" lims:id="344241"><Label>(a)</Label><Text>make a request to the Association that a charge under oath be made in the name of the Association and that, if the Association agrees to the request, the Association shall have the responsibility for the payment of expenses and costs of proceeding with the charge; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344242" lims:id="344242"><Label>(b)</Label><Text>personally swear a charge under oath and that, if the complainant does so, the complainant shall have the responsibility for the payment of expenses and costs of proceeding with the charge.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344243" lims:id="344243"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344244" lims:id="344244">Association may proceed on its own</MarginalNote><Label>(6)</Label><Text>If a complainant fails to make a request under paragraph (5)(a) or to swear a charge under paragraph (5)(b) within 30 days after being notified of the right to do so, the Association may, on its own initiative, appoint a person to swear a charge under oath on its behalf and in its name, in which case the Association shall have the responsibility for the payment of expenses and costs of proceeding with the charge.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344245" lims:id="344245"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344246" lims:id="344246">Hearings not required</MarginalNote><Label>26</Label><Text>The Complaints Committee is not required to hold a hearing or to afford to any person an opportunity to make oral submissions before making a recommendation in respect of a complaint.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344247" lims:id="344247"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344248" lims:id="344248">Continuing jurisdiction</MarginalNote><Label>27</Label><Text>The Complaints Committee has jurisdiction to deal with a complaint regarding the conduct or actions of any member of the Association, Canada Lands Surveyor or permit holder notwithstanding that the person or entity who is the subject of the complaint ceases to be a member of the Association or permit holder, as the case may be, after receipt of the complaint by the Association.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344249" lims:id="344249" level="2"><TitleText>Discipline Committee</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344250" lims:id="344250"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344251" lims:id="344251">Role</MarginalNote><Label>28</Label><Text>The Discipline Committee shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344252" lims:id="344252"><Label>(a)</Label><Text>subject to section 29, hear and determine allegations of professional misconduct or incompetence in complaints submitted to it by the Council;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344253" lims:id="344253"><Label>(b)</Label><Text>hear and determine matters referred to it by the Registrar with respect to</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="344254" lims:id="344254"><Label>(i)</Label><Text>the reinstatement of a member in the Association, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="344255" lims:id="344255"><Label>(ii)</Label><Text>the issuance of a new licence or permit to any person or entity whose licence or permit has been revoked; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344256" lims:id="344256"><Label>(c)</Label><Text>perform the duties assigned to it by the Council.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344257" lims:id="344257"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344258" lims:id="344258">Charge necessary</MarginalNote><Label>29</Label><Text>No complaint may be referred to the Discipline Committee unless it has been investigated by the Complaints Committee and converted to a charge sworn under oath.</Text></Section><Section may be, after receipt of the complaint by the Association.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344261" lims:id="344261"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344262" lims:id="344262">Powers</MarginalNote><Label>31</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344263" lims:id="344263"><Label>(1)</Label><Text>Where the Discipline Committee finds a member of the Association, Canada Lands Surveyor or permit holder guilty of professional misconduct or incompetence, the Discipline Committee may take one or more of the following actions:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344264" lims:id="344264"><Label>(a)</Label><Text>cancel the member’s membership in the Association;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344265" lims:id="344265"><Label>(b)</Label><Text>revoke the member’s licence, the Canada Lands Surveyor’s commission or the permit holder’s permit;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344266" lims:id="344266"><Label>(c)</Label><Text>suspend the member’s licence, the Canada Lands Surveyor’s commission or the permit holder’s permit for a period not exceeding two years;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344267" lims:id="344267"><Label>(d)</Label><Text>accept an undertaking that limits the member’s, Canada Lands Surveyor’s or permit holder’s surveying activities to the extent specified in the undertaking;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344268" lims:id="344268"><Label>(e)</Label><Text>impose any of the terms and conditions specified in the regulations on the member’s licence or the permit holder’s permit;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344269" lims:id="344269"><Label>(f)</Label><Text>impose on the member, Canada Lands Surveyor or permit holder a penalty not in excess of $10,000, payable to the Association;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344270" lims:id="344270"><Label>(g)</Label><Text>reprimand the member, Canada Lands Surveyor or permit holder and direct that the reprimand be recorded in the register maintained by the Registrar;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344271" lims:id="344271"><Label>(h)</Label><Text>direct the member, Canada Lands Surveyor or permit holder to reimburse the complainant, the Association or both all or any part of the costs associated with the complaint;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344272" lims:id="344272"><Label>(i)</Label><Text>direct that the members of the Association be notified of any action taken by the Discipline Committee under this section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344273" lims:id="344273"><Label>(j)</Label><Text>take any other action that the Discipline Committee considers appropriate in the circumstances.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344274" lims:id="344274"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344275" lims:id="344275">Decision must be in writing</MarginalNote><Label>(2)</Label><Text>A decision of the Discipline Committee to take any action under this section must be in writing and set out reasons.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344276" lims:id="344276"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344277" lims:id="344277">Service</MarginalNote><Label>(3)</Label><Text>The Discipline Committee shall cause a copy of every decision to take action under this section to be given to the Council and the Association shall cause a copy of the decision to be served on the member of the Association, Canada Lands Surveyor or permit holder to whom the decision relates and on the complainant.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344278" lims:id="344278"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344279" lims:id="344279">Suspension of decision</MarginalNote><Label>(4)</Label><Text>If the Discipline Committee is of the opinion that circumstances warrant it, the Discipline Committee may, subject to such terms and conditions as it directs, suspend any action under subsection (1) for such period as it considers appropriate.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344280" lims:id="344280"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344281" lims:id="344281">Notification of members</MarginalNote><Label>(5)</Label><Text>The Registrar shall notify the members of the Association whenever a membership in the Association is cancelled or a commission, licence or permit is revoked or suspended.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344282" lims:id="344282"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344283" lims:id="344283">Notification of unfounded allegation</MarginalNote><Label>(6)</Label><Text>Where the Discipline Committee finds that an allegation of professional misconduct or incompetence against a member of the Association, Canada Lands Surveyor or permit holder is unfounded, the Registrar shall, on the request of the member, Canada Lands Surveyor or permit holder, notify the members of the Association of that finding.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344284" lims:id="344284"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344285" lims:id="344285">Reimbursement of costs</MarginalNote><Label>(7)</Label><Text>Where the Discipline Committee is of the opinion that proceedings before it in relation to any member of the Association, Canada Lands Surveyor or permit holder are unwarranted, it may recommend to the Council that the Association reimburse the whole or part of the member’s, Canada Lands Surveyor’s or permit holder’s costs.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344286" lims:id="344286"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344287" lims:id="344287">Appeal</MarginalNote><Label>32</Label><Text>A party to a proceeding before the Discipline Committee may, within 30 days after the day on which a notice of a decision is served, appeal the decision to the Federal Court.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344288" lims:id="344288" level="1"><TitleText>Registrar</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344289" lims:id="344289"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344290" lims:id="344290">Appointment</MarginalNote><Label>33</Label><Text>The Council shall appoint a Registrar for the purposes of this Act.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344291" lims:id="344291"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344292" lims:id="344292">Register of surveyors</MarginalNote><Label>34</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344293" lims:id="344293"><Label>(1)</Label><Text>The Registrar shall maintain a register in which is recorded the name of every Canada Lands Surveyor and all other information required to be recorded by the regulations in that register.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344294" lims:id="344294"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344295" lims:id="344295">Register of other information</MarginalNote><Label>(2)</Label><Text>The Registrar shall maintain a register in which is recorded</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344296" lims:id="344296"><Label>(a)</Label><Text>the name and address of every member of the Association who holds a licence, every other member of the Association and every permit holder;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344297" lims:id="344297"><Label>(b)</Label><Text>information that is required to be recorded by the regulations in that register;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344298" lims:id="344298"><Label>(c)</Label><Text>information that is directed to be recorded by the Discipline Committee; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344299" lims:id="344299"><Label>(d)</Label><Text>information that is directed to be recorded by the Council.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344300" lims:id="344300"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344301" lims:id="344301">Obligation to keep records</MarginalNote><Label>(3)</Label><Text>The Registrar shall keep all copies of records and documents relating to the examination of candidates for a commission under the <XRefExternal reference-type="act" link="L-6">Canada Lands Surveys Act</XRefExternal>, the <XRefExternal reference-type="act">Dominion Lands Act</XRefExternal>, being chapter 55 of the Revised Statutes of Canada, 1906 and the <XRefExternal reference-type="act">Dominion Lands Surveys Act</XRefExternal>, being chapter 117 of the Revised Statutes of Canada, 1927 that are provided to the Association by the Surveyor General.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344302" lims:id="344302"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344303" lims:id="344303">Right to inspect registers</MarginalNote><Label>35</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344304" lims:id="344304"><Label>(1)</Label><Text>Every one has the right to inspect the registers during normal business hours.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344305" lims:id="344305"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344306" lims:id="344306">Copies</MarginalNote><Label>(2)</Label><Text>The Registrar shall provide to any person, on payment of a reasonable charge, a copy of any part of a register pertaining to any member of the Association.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344307" lims:id="344307"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344308" lims:id="344308">Proof</MarginalNote><Label>36</Label><Text>A statement containing information from a register and purporting to be certified by the Registrar is admissible in evidence in all courts as proof, in the absence of evidence to the contrary, of the facts stated in the statement without proof of the appointment or signature of the Registrar.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="344309" lims:id="344309" level="1"><TitleText>Immunity</TitleText></Heading><Section conduct</MarginalNote><Label>42</Label><Text>A member of the Association who directs the provision of surveying services is in all respects liable for maintaining the standards of conduct and competence in respect of the provision of those services.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344327" lims:id="344327"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344328" lims:id="344328">Right to enter</MarginalNote><Label>43</Label><Text>A licence holder and any person acting under the direction of a licence holder may, for the purpose of cadastral surveying, enter, pass over and measure the land of any person but shall take all reasonable precautions to avoid causing damage in so doing.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344329" lims:id="344329"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344330" lims:id="344330">Witnesses and evidence</MarginalNote><Label>44</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344331" lims:id="344331"><Label>(1)</Label><Text>When a licence holder who is engaged in a cadastral survey reasonably believes that a person has knowledge of any matter relating to that survey, the licence holder may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344332" lims:id="344332"><Label>(a)</Label><Text>request the person to appear before the licence holder as a witness;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344333" lims:id="344333"><Label>(b)</Label><Text>apply to a justice of the peace for a subpoena compelling the person to appear before the licence holder to give evidence and to bring any documents as may be specified in the subpoena; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344334" lims:id="344334"><Label>(c)</Label><Text>take evidence from any person requested or compelled to appear before the licence holder under oath to be administered by the licence holder.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344335" lims:id="344335"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344336" lims:id="344336">Subpoena</MarginalNote><Label>(2)</Label><Text>On application by a licence holder supported by an affidavit setting out the reasons for requiring the attendance of a witness, a justice of the peace may issue the subpoena referred to in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344337" lims:id="344337"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344338" lims:id="344338">Service and contents of subpoena</MarginalNote><Label>(3)</Label><Text>A subpoena shall either be personally served on the person named in the subpoena or left with an adult person at the residence of the person so named and shall state the time and place at which the hearing before the licence holder will be held.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344339" lims:id="344339"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344340" lims:id="344340">Expenses of witnesses</MarginalNote><Label>(4)</Label><Text>A licence holder shall tender to a subpoenaed witness conduct money in an amount that will compensate the witness for reasonable expenses in attending before the licence holder and, in the event of a dispute as to the amount, the licence holder shall refer the matter to a justice of the peace whose decision shall be final.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344341" lims:id="344341"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344342" lims:id="344342">Warrant for non-appearance</MarginalNote><Label>(5)</Label><Text>Where a person named in a subpoena refuses or fails to appear before the licence holder at the time and place named in the subpoena, the licence holder may apply to a justice of the peace for a warrant against the person and the justice of the peace may issue the warrant.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:fid="344357" lims:id="344357"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344358" lims:id="344358">Cancelling for fraud</MarginalNote><Label>(2)</Label><Text>The Association shall cancel a commission if it finds that the holder has obtained it fraudulently.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="344359" lims:id="344359"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344360" lims:id="344360">When commission cannot be surveying</MarginalNote><Label>50</Label><Text>No person, other than a licence holder or a person acting under the direction of a licence holder, may engage in cadastral surveying on Canada Lands or lims:inforce-start-date="2002-12-31" lims:fid="344365" lims:id="344365">Other surveying</MarginalNote><Label>51</Label><Text>No member of the Association, other than a member who is a licence holder or who is acting under the direction of a licence holder, may engage in surveying on Canada Lands or private lands in a territory.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344366" lims:id="344366"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344367" lims:id="344367">Conditions for licence</MarginalNote><Label>52</Label><Text>An applicant for a licence must</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344368" lims:id="344368"><Label>(a)</Label><Text>hold a five years; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344371" lims:id="344371"><Label>(d)</Label><Text>comply with the licensing requirements prescribed by the regulations and by-laws.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344372" lims:id="344372"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344373" lims:id="344373">Issuance of licence</MarginalNote><Label>53</Label><Text>The Registrar may issue a licence to any person who applies for a lims:id="344412"><Label>(e)</Label><Text>applications for membership in the Association and the renewal and reinstatement of memberships in the Association;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344413" lims:id="344413"><Label>(f)</Label><Text>applications for admission as a candidate for a commission, the requirements of candidates, the cancellation of a candidacy, appeals of decisions, the granting of commissions, and the use of the titles “Canada Lands Surveyor” and “arpenteur des terres du Canada”;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344414" lims:id="344414"><Label>(g)</Label><Text>the examination of candidates for a commission;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344415" lims:id="344415"><Label>(h)</Label><Text>applications for licences and permits and their issuance and renewal, and the reinstatement of licences and permits;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344416" lims:id="344416"><Label>(i)</Label><Text>the terms and conditions under which members of the Association and their employers must have insurance against professional liability;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344417" lims:id="344417"><Label>(j)</Label><Text>the exemption of members of the Association, and their employers, from the requirement to be insured in respect of professional liability;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344418" lims:id="344418"><Label>(k)</Label><Text>the requirement for members of the Association to inform the Registrar of claims against them for professional liability;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344419" lims:id="344419"><Label>(l)</Label><Text>conflict of interest respecting surveying activities and the definition of conduct that constitutes a conflict of interest;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344420" lims:id="344420"><Label>(m)</Label><Text>the issuing and ownership of seals, the certification of documents and drawings by members of the Association, and the form of statements of responsibility, seals and signatures;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344421" lims:id="344421"><Label>(n)</Label><Text>the procedures to be followed by the Association in reviewing the surveying activities of members of the Association to ensure the maintenance of minimum standards of surveying;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344422" lims:id="344422"><Label>(o)</Label><Text>the investigation of complaints, the procedures of the Complaints Committee and the Discipline Committee and the hearing of allegations of professional misconduct or incompetence;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344423" lims:id="344423"><Label>(p)</Label><Text>the definition of professional misconduct and incompetence for the purposes of this Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344424" lims:id="344424"><Label>(q)</Label><Text>any matter who</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344428" lims:id="344428"><Label>(a)</Label><Text>uses the title “Canada Lands Surveyor” or “arpenteur des terres du Canada”, or any addition to or abbreviation of that title, or any words, name or designation that leads to the belief that the person is a Canada Lands Surveyor, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344429" lims:id="344429"><Label>(b)</Label><Text>advertises or purports, in any way or by any means, to be a Canada Lands Surveyor,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="344430" lims:id="344430"><Text>is guilty of an offence and liable on summary conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding six months, or to both.</Text></ContinuedSectionSubsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344431" lims:id="344431"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344432" lims:id="344432">Engaging in cadastral surveying without a licence</MarginalNote><Label>64</Label><Text>Every person, other than a licence holder or a person acting under the direction of a licence holder, who engages or purports to be engaged in cadastral surveying on Canada Lands or on private lands in a territory is guilty of an offence and liable on summary conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding six months, or to both.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344433" lims:id="344433"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344434" lims:id="344434">False statements</MarginalNote><Label>65</Label><Text>Every person who</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344435" lims:id="344435"><Label>(a)</Label><Text>makes or causes to be made any wilful falsification in any matter relating to a register maintained by the Registrar under this Act, or issues a false licence, a false permit or a false document with respect to a register, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="344436" lims:id="344436"><Label>(b)</Label><Text>attempts to obtain a licence or a permit by knowingly making any representation or declaration that is false in a material respect,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="344437" lims:id="344437"><Text>is guilty of an offence and liable on summary conviction to a fine lims:lastAmendedDate="2002-12-31" lims:fid="344443" lims:id="344443"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344444" lims:id="344444">Time for instituting proceedings</MarginalNote><Label>67</Label><Text>Proceedings to obtain a conviction for an offence under sections 63 to 66 shall not be commenced on a date more than five years after the date on which the offence was committed.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344445" lims:id="344445"><MarginalNote notwithstanding any other remedy or any penalty imposed, apply to a court for an order prohibiting the continuation or repetition of the contravention or the carrying out of any activity that will result, or will likely result, in the continuation or repetition of the contravention by the person who has committed the contravention.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:inforce-start-date="2002-12-31" lims:fid="344452" lims:id="344452"><Label>(1)</Label><Text>The Council shall make a report annually to the Minister containing any information that the Minister before the coming into force of this section are, on that coming into force, the President and Vice-President of the new Association and shall hold office as such until the election or appointment of Association</MarginalNote><Label>(2)</Label><Text>For the purpose of paragraph 13(c), the first members of the Council under that paragraph shall be three members of the new Association elected at a meeting of the members of the new Association called for the purpose as soon as practicable after the coming into force of this subsection.</Text></Subsection></Section><Section Lands Surveys Act</XRefExternal> as though that Act had not been amended by this Act.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344499" into force of this section, the Surveyor General shall provide the new Association with a copy of all records and documents in the Surveyor General’s possession relating to the examination of candidates for a commission under the <XRefExternal reference-type="act" link="L-6">Canada Lands Surveys Act</XRefExternal>, the <XRefExternal reference-type="act">Dominion Lands Act</XRefExternal>, being chapter 55 of the Revised Statutes of Canada, 1906 and the <XRefExternal reference-type="act">Dominion Lands Surveys Act</XRefExternal>, being chapter 117 of the Revised Statutes of Canada, 1927.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344501" lims:id="344501"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344502" lims:id="344502">Suspension or cancellation of commissions</MarginalNote><Label>88</Label><Text>The Discipline Committee shall hear and determine, in accordance with section 16 of the <XRefExternal reference-type="act" link="L-6">Canada Lands Surveys Act</XRefExternal>, as that section read immediately before the coming into force of this section, all matters relating to the cancellation or suspension of commissions held by persons to whom a notice referred to in paragraph 16(2)(a) of that Act had been sent by the former Board of Examiners before that day.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344503" lims:id="344503"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="344504" lims:id="344504">Decisions remain in force</MarginalNote><Label>89</Label><Text>Every decision of the former Board of Examiners, including those relating to the cancellation or suspension of commissions, that is in force immediately before the day on which this section comes into force remains in force and is deemed to be a decision of the new Association.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="344505" lims:id="344505"><MarginalNote lims:inforce-start-date="2002-12-31"
