lims:inforce-start-date="2005-10-05" lims:fid="333438" lims:id="333438"><Label>(k)</Label><Text>telecommunications, except in relation to</Text><Subparagraph lims:inforce-start-date="2005-10-05" lims:fid="333439" lims:id="333439"><Label>(i)</Label><Text>the planning and coordination of telecommunication services for departments, boards and agencies of the Government of Canada, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2005-10-05" lims:fid="333440" lims:id="333440"><Label>(ii)</Label><Text>broadcasting, other than in relation to spectrum management and the technical aspects of broadcasting;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333441" lims:id="333441"><Label>(l)</Label><Text>the development and utilization generally of communication undertakings, facilities, systems and services for Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333442" lims:id="333450">Objectives</MarginalNote><Label>5</Label><Text>The Minister shall exercise the powers and perform the duties and functions assigned by subsection 4(1) in a manner that will</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333451" lims:id="333451"><Label>(a)</Label><Text>strengthen the national economy and promote sustainable development;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333452" lims:id="333452"><Label>(b)</Label><Text>promote the mobility of goods, services and factors of production and of trade and commerce in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333453" lims:id="333453"><Label>(c)</Label><Text>increase the international competitiveness of Canadian industry, goods and services and assist in the adjustment to changing domestic and international conditions;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333454" lims:id="333454"><Label>(d)</Label><Text>encourage the fullest and most efficient and effective development and use of science and technology;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333455" lims:id="333455"><Label>(e)</Label><Text>foster and promote science and technology in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333456" lims:id="333456"><Label>(f)</Label><Text>strengthen the framework for the development and efficiency of the Canadian marketplace;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333457" lims:id="333457"><Label>(g)</Label><Text>promote the establishment, development and efficiency of Canadian communications systems and facilities and assist in the adjustment to changing domestic and international conditions;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333458" lims:id="333458"><Label>(h)</Label><Text>stimulate investment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333459" lims:id="333459"><Label>(i)</Label><Text>promote the interests and protection of Canadian consumers.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="333460" lims:id="333460"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="333461" lims:id="333461">Functions</MarginalNote><Label>6</Label><Text>In exercising the powers and performing the duties and functions assigned by subsection 4(1), the Minister shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333462" lims:id="333462"><Label>(a)</Label><Text>initiate, recommend, coordinate, direct, promote and implement national policies, programs, projects and practices with respect to the objectives set out in section 5;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333463" lims:id="333463"><Label>(b)</Label><Text>collect, gather, by survey or otherwise, compile, analyse, coordinate and disseminate information in respect of matters under the Minister’s administration, as well as in relation to trends and developments, both within and outside Canada, in respect of those matters;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333464" lims:id="333464"><Label>(c)</Label><Text>promote, assist and provide support services for, and investment in, Canadian industry, goods, services, science and technology;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333465" lims:id="333465"><Label>(d)</Label><Text>promote cooperation with the governments of provinces and their agencies and non-governmental entities in Canada and participate, as appropriate, in the promotion of cooperation with agencies of other nations and international agencies; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333466" lims:id="333466"><Label>(e)</Label><Text>take any action that may be necessary to secure, by international regulation or otherwise, the rights of Canada in communications matters.</Text></Paragraph></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="333467" lims:id="333467"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="333468" lims:id="333468">Inspection services</MarginalNote><Label>7</Label><Text>The Minister shall provide the inspection services for the protection of Canadians that the Minister considers necessary for the enforcement of any Act under the Minister’s administration, or as the Governor in Council may direct the Minister to provide, and may designate any person as an inspector for the purpose of providing those services.</Text></Section><Heading lims:inforce-start-date="2005-10-05" lims:fid="333469" lims:id="333469" level="1"><Label>PART II</Label><TitleText>Regional Economic Development in Ontario</TitleText></Heading><Section lims:inforce-start-date="2005-10-05" lims:lastAmendedDate="2005-10-05" lims:fid="333470" lims:id="333470"><MarginalNote lims:inforce-start-date="2005-10-05" lims:fid="333471" lims:id="333471">Objectives in relation to regional development in Ontario</MarginalNote><Label>8</Label><Text>The Minister shall exercise the powers and perform the duties and functions assigned by subsection 4(2) in a manner that will</Text><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333472" lims:id="333472"><Label>(a)</Label><Text>promote economic development in areas of Ontario where low incomes and slow economic growth are prevalent or where opportunities for productive employment are inadequate;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333473" lims:id="333473"><Label>(b)</Label><Text>emphasize long-term economic development and sustainable employment and income creation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333474" lims:id="333474"><Label>(c)</Label><Text>focus on small and medium-sized Ontario</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2005-10-05" lims:fid="333479" lims:id="333479"><Label>(1)</Label><Text>In exercising the powers and performing the duties and functions assigned by subsection 4(2), the Minister shall, with respect to regional economic development in Ontario,</Text><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333480" lims:id="333480"><Label>(a)</Label><Text>in cooperation with other concerned ministers and boards and agencies of the Government of Canada, formulate and implement policies, plans and integrated federal approaches;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333481" lims:id="333481"><Label>(b)</Label><Text>coordinate the policies and programs of the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333482" lims:id="333482"><Label>(c)</Label><Text>lead and coordinate the activities of the Government of Canada in the establishment of cooperative relationships with Ontario and with business, labour and other public and private bodies; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333483" lims:id="333483"><Label>(d)</Label><Text>collect, gather, by survey or otherwise, compile, analyse, coordinate and disseminate information.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2005-10-05" lims:fid="333484" lims:id="333484"><MarginalNote lims:inforce-start-date="2005-10-05" lims:fid="333485" lims:id="333485">Coordination</MarginalNote><Label>(2)</Label><Text>In exercising the powers and performing the same duties and functions, the Minister may</Text><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333486" lims:id="333486"><Label>(a)</Label><Text>provide and, where appropriate, coordinate services promoting regional economic development in Ontario including services to develop entrepreneurial talent, support local business associations, stimulate investment and support small- and medium-sized enterprises in that province or any part of that province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2005-10-05" lims:fid="333487" lims:id="333487"><Label>(b)</Label><Text>initiate, recommend, coordinate, direct, promote and lims:fid="333494" lims:id="333494" level="1"><Label>PART III</Label><TitleText>Powers, Duties and Functions of the Registrar General of Canada</TitleText></Heading><Section lims:inforce-start-date="2004-12-15" lims:lastAmendedDate="2004-12-15" lims:fid="333495" lims:id="333495"><MarginalNote lims:inforce-start-date="2004-12-15" lims:fid="333496" lims:id="333496">Obligation to register</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2004-12-15" lims:fid="333497" lims:id="333497"><Label>(1)</Label><Text>The Registrar General of Canada shall register all documents issued under the Great Seal or requiring registration.</Text></Subsection><Subsection lims:inforce-start-date="2004-12-15" lims:fid="333498" lims:id="333498"><MarginalNote lims:inforce-start-date="2004-12-15" lims:fid="333499" lims:id="333499">Deputy Registrars General</MarginalNote><Label>(2)</Label><Text>The Registrar General may appoint one or more Deputy Registrars General from among the officials of the Department and delegate to them such duties and functions as the Registrar General deems documents or of any records in the custody of the Registrar General that are required to be certified or authenticated as being copies of any such documents or registration required shall be made with the Registrar General unless the Governor in Council by order designates another office or department for the filing or lims:inforce-start-date="2002-12-31" lims:fid="333510" lims:id="333510">Special assistance</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="333511" lims:id="333511"><Label>(1)</Label><Text>Where the Governor in Council is of the opinion that it is in the national interest to do so, the Minister may, in exercising the powers and performing the duties and functions assigned by subsection 4(1), develop and implement programs and projects of special assistance to industries, particular industrial or commercial establishments, organizations, persons who are members of a particular category of persons defined by order of the Governor in Council or particular persons to aid economic development, whether through the restructuring, adjusting, rationalizing, establishing or re-establishing, modernizing, expanding or contracting of an industry or particular industrial or commercial establishment or organization in Canada, or otherwise.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="333512" lims:id="333512"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="333513" lims:id="333513">Contents of order</MarginalNote><Label>(2)</Label><Text>Where the Governor in Council makes an order pursuant to subsection (1), the Governor in Council shall also specify or authorize, as the case may be, the actions described in subsection 14(1).</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="333514" lims:id="333514"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="333515" lims:id="333515">Financial assistance</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="333516" lims:id="333516"><Label>(1)</Label><Text>To facilitate the implementation of any program or project of the Minister under this Act, the Minister may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="333517" lims:id="333517"><Label>(a)</Label><Text>make loans to any person;</Text></Paragraph><Paragraph lims:id="333521">Stock options</MarginalNote><Label>(2)</Label><Text>Subject to any regulations made under subsection (3), the Minister may acquire, exercise, assign or sell a stock option or other financial or similar instrument obtained as a condition under which a loan or contribution was made, guarantee given or loan insurance or credit insurance provided under subsection advisory and other committees to advise or assist the Minister or to exercise such powers and perform such duties and functions as the Governor in Council may specify, and may fix the remuneration and request of the Minister, make available to the Minister copies of invoices and other information collected under the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal> on goods imported into Canada and exported from Canada for the purpose of carrying out duties and functions of the Minister under paragraph 6(b).</Text></Subsection><Subsection lims:id="333534">Confidentiality</MarginalNote><Label>(2)</Label><Text>No person employed in the federal public administration who comes into possession of information made available to the Minister under this section shall disclose any such information relating to a particular person, organization or business unless the disclosure is consented to in writing by the person or organization or the owner of the business.</Text></Subsection><Subsection lims:inforce-start-date="2005-12-12" lims:fid="333535" lims:id="333535"><MarginalNote lims:inforce-start-date="2005-12-12" lims:fid="333536" lims:id="333536">Exception</MarginalNote><Label>(3)</Label><Text>Notwithstanding subsection (2), in carrying out duties and functions under paragraph 6(b), the Minister may publish lists of names and addresses of some or all importers or exporters of a product or group of products with trade values aggregated in such a manner as to protect the confidentiality of data concerning individual duties and functions under this Act, the Minister may enter into agreements with the government of any province or any agency thereof, or with any other entity or person, and may make disbursements up to an amount equal to the aggregate of the amounts to be contributed by all parties to the agreement, even before those amounts have been contributed.</Text></Subsection></Section><Section subject to any regulations that the Treasury Board may make for the purposes of this section, fix fees in respect of regulatory processes or approvals provided by the Minister, the Department or any board or agency of the Government of Canada for which the Minister has responsibility.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="333556" the aggregate not exceed an amount sufficient to compensate Her Majesty in right of Canada for any reasonable outlays incurred by Her Majesty for the purpose of providing the regulatory processes or lims:id="333560"><Label>(1)</Label><Text>Before fixing a fee under section 18, 19 or 20, the Minister shall consult with such persons or organizations as the Minister considers to be interested in the lims:id="333562">Publication</MarginalNote><Label>(2)</Label><Text>The Minister shall, within 30 days after the date on which the Minister fixes a fee under section 18, 19 or 20, publish the fee in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> and by such appropriate electronic or other means that the Treasury Board may authorize by
