lims:fid="1169239" lims:id="1169239" format-ref="indent-1-1" language-align="no" list-item="no"><Text>achieving reconciliation with First Nations, the Métis and the Inuit through renewed nation-to-nation, government-to-government and Inuit-Crown relationships based on affirmation and implementation of rights, respect, cooperation and partnership,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169240" lims:id="1169240" format-ref="indent-1-1" language-align="no" list-item="no"><Text>promoting respect for the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>, and</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169241" lims:id="1169241" format-ref="indent-1-1" language-align="no" list-item="no"><Text>implementing the United Nations Declaration on the Rights of Indigenous Peoples;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169242" lims:id="1169242" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And whereas it is appropriate to establish a Department of Indigenous Services and that the Department, in carrying out its activities,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169243" lims:id="1169243" format-ref="indent-1-1" language-align="no" list-item="no"><Text>ensures that Indigenous individuals have access — in accordance with transparent service standards and the needs of each Indigenous group, community or people — to services for which those individuals are eligible,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169244" lims:id="1169244" format-ref="indent-1-1" language-align="no" list-item="no"><Text>takes into account socio-economic gaps that persist between Indigenous individuals and other Canadians with respect to a range of matters as well as social factors having an impact on health and well-being,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169245" lims:id="1169245" format-ref="indent-1-1" language-align="no" list-item="no"><Text>recognizes and promotes Indigenous ways of knowing, being and doing,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169246" lims:id="1169246" format-ref="indent-1-1" language-align="no" list-item="no"><Text>collaborates and cooperates with Indigenous peoples and with the provinces and territories, and</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169247" lims:id="1169247" format-ref="indent-1-1" language-align="no" list-item="no"><Text>implements the gradual transfer of departmental responsibilities to Indigenous organizations;</Text></Provision></Preamble><Enacts definitions apply in this Act.</Text><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169257" lims:id="1169257"><Text><DefinedTermEn>Department</DefinedTermEn> means the department established under section 3. (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169258" lims:id="1169258"><Text><DefinedTermEn>Indigenous governing body</DefinedTermEn> means a council, government or other entity that is authorized to act on behalf of an Indigenous group, community or people that holds rights recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>. (<DefinedTermFr>corps dirigeant autochtone</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169259" lims:id="1169259"><Text><DefinedTermEn>Indigenous organization</DefinedTermEn> means an Indigenous governing body or any other entity that represents the interests of an Indigenous group and its members. (<DefinedTermFr>organisation autochtone</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169260" lims:id="1169260"><Text><DefinedTermEn>Indigenous peoples</DefinedTermEn> has the meaning assigned by the definition <DefinitionRef>aboriginal peoples of Canada </DefinitionRef>in subsection 35(2) of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>. (<DefinedTermFr>peuples autochtones</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169261" lims:id="1169261"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Indigenous Services. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169262" lims:id="1169262" level="1"><TitleText>Establishment of Department</TitleText></Heading><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169263" lims:id="1169263"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169264" lims:id="1169264">Department established</MarginalNote><Label>3</Label><Text>There is established a department of the Government of Canada, called the Department of Indigenous Services, over which the Minister presides.</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169265" lims:id="1169265"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169266" lims:id="1169266">Minister</MarginalNote><Label>4</Label><Text>The Minister, appointed by commission under the Great Seal, holds office during pleasure and has the management and direction of the Department.</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169267" lims:id="1169267"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169268" lims:id="1169268">Deputy Minister</MarginalNote><Label>5</Label><Text>The Governor in Council may appoint a Deputy Minister of Indigenous Services to hold office during pleasure and to be the deputy head of the Department.</Text></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169269" lims:id="1169269" level="1"><TitleText>Powers, Duties and Functions of Minister</TitleText></Heading><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169270" lims:id="1169270"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169271" lims:id="1169271">Powers, duties and functions</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169272" lims:id="1169272"><Label>(1)</Label><Text>The Minister’s powers, duties and functions extend to and include all matters over which Parliament has jurisdiction — and that are not by law assigned to any other department, board or agency of the Government of Canada — relating to the provision of services to Indigenous individuals who, and Indigenous governing bodies that, are eligible to receive those services under an Act of Parliament or a program of the Government of Canada for which the Minister is responsible.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169273" lims:id="1169273"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169274" lims:id="1169274">Ministerial duty</MarginalNote><Label>(2)</Label><Text>The Minister is to ensure that services with respect to the following matters are provided to Indigenous individuals who, and Indigenous governing bodies that, are eligible to receive those services under an Act of Parliament or a program of the Government of Canada for which the Minister is responsible — including, in the case of Indigenous individuals, services provided by Indigenous governing bodies, if applicable:</Text><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169275" lims:id="1169275"><Label>(a)</Label><Text>child and family services;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169276" lims:id="1169276"><Label>(b)</Label><Text>education;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169277" lims:id="1169277"><Label>(c)</Label><Text>health;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169278" lims:id="1169278"><Label>(d)</Label><Text>social development;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169279" lims:id="1169279"><Label>(e)</Label><Text>economic development;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169280" lims:id="1169280"><Label>(f)</Label><Text>housing;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169281" lims:id="1169281"><Label>(g)</Label><Text>infrastructure;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169282" lims:id="1169282"><Label>(h)</Label><Text>emergency management;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169283" lims:id="1169283"><Label>(h.1)</Label><Text>governance; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169284" lims:id="1169284"><Label>(i)</Label><Text>any other matter designated by order of the Governor in Council.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169285" lims:id="1169285"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169286" lims:id="1169286">Collaboration and transfer of responsibilities</MarginalNote><Label>7</Label><Text>In exercising the powers and performing the duties and functions under this Act, the Minister is to</Text><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169287" lims:id="1169287"><Label>(a)</Label><Text>provide Indigenous organizations with an opportunity to collaborate in the development, provision, assessment and improvement of the services referred to in subsection 6(2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169288" lims:id="1169288"><Label>(b)</Label><Text>in accordance with any agreements respecting the transfer of responsibilities that are entered into under section 9, take the appropriate measures to give effect to the gradual transfer to Indigenous organizations of departmental responsibilities with respect to the development and provision of those services.</Text></Paragraph></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169289" lims:id="1169289"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169290" lims:id="1169290">Limitations</MarginalNote><Label>8</Label><Text>For greater certainty, subsection 6(2) and section 7 apply subject to the transfer of responsibilities referred to in paragraph 7(b) and to agreements with Indigenous organizations, including land claims, self-government or self-determination agreements.</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169291" lims:id="1169291"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169292" lims:id="1169292">Agreements</MarginalNote><Label>9</Label><Text>The Minister may enter into agreements with Indigenous organizations and other entities regarding the provision of services referred to in subsection 6(2) and the transfer of responsibilities referred to in paragraph 7(b).</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169293" lims:id="1169293"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169294" lims:id="1169294">Special representatives</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169295" lims:id="1169295"><Label>(1)</Label><Text>The Minister may appoint special representatives to provide him or her with advice on any matter relating to his or her powers, duties and functions under this Act or to any other matter relating to this Act, or to represent him or her in the context of, among other things, any consultation or engagement with an Indigenous organization or Indigenous group, community or people with respect to such a matter.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169296" lims:id="1169296"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169297" lims:id="1169297">Committees</MarginalNote><Label>(2)</Label><Text>The Minister may also establish advisory and other committees to provide him or her with advice on any matter referred to in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169298" lims:id="1169298"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169299" lims:id="1169299">Remuneration and expenses</MarginalNote><Label>(3)</Label><Text>The Minister is to fix the remuneration and expenses to be paid to special representatives and to committee members.</Text></Subsection></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169300" lims:id="1169300"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169301" lims:id="1169301">Provision of services between departments</MarginalNote><Label>11</Label><Text>The Department may provide services to and receive services from the Department of Crown-Indigenous Relations and Northern Affairs — including services to support policy and program implementation — as provided in a written agreement between the Minister and the Minister of Crown-Indigenous Relations or the Minister of Northern Affairs, as the case may be.</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169302" lims:id="1169302"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169303" lims:id="1169303">Collection and use of information</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169304" lims:id="1169304"><Label>(1)</Label><Text>The Minister may, in exercising his or her powers and performing his or her duties or functions under this Act, collect, analyze and interpret documents, information or data in respect of matters under his or her administration.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169305" lims:id="1169305"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169306" lims:id="1169306">Disclosure of information</MarginalNote><Label>(2)</Label><Text>The Minister may, in exercising his or her powers and performing his or her duties or functions under this Act, disclose or permit to be disclosed, in whole or in part, those documents and that information or data to, among others,</Text><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169307" lims:id="1169307"><Label>(a)</Label><Text>the Department of Crown-Indigenous Relations and Northern Affairs;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169308" lims:id="1169308"><Label>(b)</Label><Text>a department named in Schedule I to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, a division or branch of the federal public administration set out in column I of Schedule I.1 to that Act, a corporation named in Schedule II to that Act or a <DefinitionRef>Crown corporation</DefinitionRef> as defined in subsection 83(1) of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169309" lims:id="1169309"><Label>(c)</Label><Text>an Indigenous organization; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169310" lims:id="1169310"><Label>(d)</Label><Text>a not-for-profit entity controlled by Indigenous individuals.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169311" lims:id="1169311"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169312" lims:id="1169312">Exceptions related to disclosure</MarginalNote><Label>(3)</Label><Text>Paragraphs (2)(c) and (d) do not apply in respect of any information, or to any documents or data that would reveal any information,</Text><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169313" lims:id="1169313"><Label>(a)</Label><Text>that is <DefinitionRef>personal information</DefinitionRef> as defined in section 3 of the <XRefExternal reference-type="act" link="P-21">Privacy Act</XRefExternal>, unless</Text><Subparagraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169314" lims:id="1169314"><Label>(i)</Label><Text>the personal information is publicly available,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169315" lims:id="1169315"><Label>(ii)</Label><Text>the individual to whom the personal information relates consents to its disclosure, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169316" lims:id="1169316"><Label>(iii)</Label><Text>the disclosure is for a purpose referred to in any of paragraphs 8(2)(a), (b), (f), (j), (k) or (m) of the <XRefExternal reference-type="act"
