the Abolition of Forced Labour Convention, 1957, adopted in Geneva on June 25, 1957; and the Worst Forms of Child Labour Convention, 1999, adopted at Geneva on June 17, 1999 — is determined to contribute to the fight against modern slavery;</Text></Provision><Provision lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397892" lims:id="1397892" format-ref="indent-0-0"><Text>And whereas Parliament considers that it is essential to contribute to fighting modern slavery, including by imposing reporting obligations on government institutions involved in producing, purchasing or distributing goods in Canada or elsewhere and on entities involved in manufacturing, producing, growing, extracting or processing goods in Canada or elsewhere or in importing goods manufactured, produced, grown, extracted or processed outside Canada;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397893" lims:id="1397893"><Provision lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397894" lims:id="1397894" format-ref="indent-0-0" language-align="yes"><Text>Now, therefore, His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397895" lims:id="1397895"><Heading lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397896" lims:id="1397896" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:lastAmendedDate="2024-01-01" lims:fid="1397897" lims:id="1397897"><MarginalNote lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397898" lims:id="1397898">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="F-10.6">Fighting Against Forced Labour and Child Labour in Supply Chains Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397899" lims:id="1397899" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:lastAmendedDate="2024-01-01" lims:fid="1397900" lims:id="1397900"><MarginalNote lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397901" lims:id="1397901">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397902" lims:id="1397902"><Text><DefinedTermEn>child labour</DefinedTermEn> means labour or services provided or offered to be provided by persons under the age of 18 years and that</Text><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397903" lims:id="1397903"><Label>(a)</Label><Text>are provided or offered to be provided in Canada under circumstances that are contrary to the laws applicable in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397904" lims:id="1397904"><Label>(b)</Label><Text>are provided or offered to be provided under circumstances that are mentally, physically, socially or morally dangerous to them;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397905" lims:id="1397905"><Label>(c)</Label><Text>interfere with their schooling by depriving them of the opportunity to attend school, obliging them to leave school prematurely or requiring them to attempt to combine school attendance with excessively long and heavy work; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397906" lims:id="1397906"><Label>(d)</Label><Text>constitute the worst forms of child labour as defined in article 3 of the Worst Forms of Child Labour Convention, 1999, adopted at Geneva on June 17, 1999. (<DefinedTermFr>travail des enfants</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397907" lims:id="1397907"><Text><DefinedTermEn>entity</DefinedTermEn> means a corporation or a trust, partnership or other unincorporated organization that</Text><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397908" lims:id="1397908"><Label>(a)</Label><Text>is listed on a stock exchange in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397909" lims:id="1397909"><Label>(b)</Label><Text>has a place of business in Canada, does business in Canada or has assets in Canada and that, based on its consolidated financial statements, meets at least two of the following conditions for at least one of its two most recent financial years:</Text><Subparagraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397910" lims:id="1397910"><Label>(i)</Label><Text>it has at least $20 million in assets,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397911" lims:id="1397911"><Label>(ii)</Label><Text>it has generated at least $40 million in revenue, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397912" lims:id="1397912"><Label>(iii)</Label><Text>it employs an average of at least 250 employees; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397913" lims:id="1397913"><Label>(c)</Label><Text>is prescribed by regulations. (<DefinedTermFr>entité</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397914" lims:id="1397914"><Text><DefinedTermEn>forced labour</DefinedTermEn> means labour or service provided or offered to be provided by a person under circumstances that</Text><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397915" lims:id="1397915"><Label>(a)</Label><Text>could reasonably be expected to cause the person to believe their safety or the safety of a person known to them would be threatened if they failed to provide or offer to provide the labour or service; or</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397916" lims:id="1397916"><Label>(b)</Label><Text>constitute forced or compulsory labour as defined in article 2 of the Forced Labour Convention, 1930, adopted in Geneva on June 28, 1930. (<DefinedTermFr>travail forcé</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397917" lims:id="1397917"><Text><DefinedTermEn>governing body</DefinedTermEn> means the body or group of members of the entity with primary responsibility for the governance of the entity. (<DefinedTermFr>corps dirigeant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397918" lims:id="1397918"><Text><DefinedTermEn>government institution</DefinedTermEn> has the same meaning as in section 3 of the <XRefExternal reference-type="act" link="A-1">Access to Information Act</XRefExternal>. (<DefinedTermFr>institution fédérale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397919" lims:id="1397919"><Text><DefinedTermEn>head</DefinedTermEn> has the same meaning as in section 3 of the <XRefExternal reference-type="act" link="A-1">Access to Information Act</XRefExternal>. (<DefinedTermFr>responsable d’institution fédérale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397920" lims:id="1397920"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Public Safety and Emergency Preparedness. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397921" lims:id="1397921"><Text><DefinedTermEn>production of goods</DefinedTermEn> includes the manufacturing, growing, extracting and processing of goods. (<DefinedTermFr>production de marchandises</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397922" lims:id="1397922" level="1"><TitleText>Purpose of Act</TitleText></Heading><Section lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:lastAmendedDate="2024-01-01" lims:fid="1397923" lims:id="1397923"><MarginalNote lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397924" lims:id="1397924">Purpose</MarginalNote><Label>3</Label><Text>The purpose of this Act is to implement Canada’s international commitment to contribute to the fight against forced labour and child labour through the imposition of reporting obligations on</Text><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397925" lims:id="1397925"><Label>(a)</Label><Text>government institutions producing, purchasing or distributing goods in Canada or elsewhere; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397926" lims:id="1397926"><Label>(b)</Label><Text>entities producing goods in Canada or elsewhere or in importing goods produced outside Canada.</Text></Paragraph></Section><Heading lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397927" lims:id="1397927" level="1"><TitleText>His Majesty</TitleText></Heading><Section lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:lastAmendedDate="2024-01-01" lims:fid="1397928" lims:id="1397928"><MarginalNote lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397929" lims:id="1397929">Binding on His Majesty</MarginalNote><Label>4</Label><Text>This Act is binding on His Majesty in right of Canada or a province.</Text></Section><Heading lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397930" lims:id="1397930" level="1"><Label>PART 1</Label><TitleText>Reporting Obligation — Government Institution</TitleText></Heading><Heading lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397931" lims:id="1397931" level="2"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:lastAmendedDate="2024-01-01" lims:fid="1397932" lims:id="1397932"><MarginalNote lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397933" lims:id="1397933">Government institutions</MarginalNote><Label>5</Label><Text>This Part applies to any government institution producing, purchasing or distributing goods in Canada or elsewhere.</Text></Section><Heading lims:inforce-start-date="2023-05-11" lims:enacted-date="2023-05-11" lims:fid="1397934" lims:id="1397934" level="2"><TitleText>Annual Report</TitleText></Heading><Section lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:lastAmendedDate="2024-01-01" lims:fid="1397935" lims:id="1397935"><MarginalNote lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397936" lims:id="1397936">Annual report</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397937" lims:id="1397937"><Label>(1)</Label><Text>The head of every government institution must, on or before May 31 of each year, report to the Minister on the steps the government institution has taken during its previous financial year to prevent and reduce the risk that forced labour or child labour is used at any step of the production of goods produced, purchased or distributed by the government institution.</Text></Subsection><Subsection lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397938" lims:id="1397938"><MarginalNote lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397939" lims:id="1397939">Supplementary information</MarginalNote><Label>(2)</Label><Text>The report must also include the following information in respect of the government institution:</Text><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397940" lims:id="1397940"><Label>(a)</Label><Text>its structure, activities and supply chains;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397941" lims:id="1397941"><Label>(b)</Label><Text>its policies and due diligence processes in relation to forced labour and child labour;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397942" lims:id="1397942"><Label>(c)</Label><Text>the parts of its activities and supply chains that carry a risk of forced labour or child labour being used and the steps it has taken to assess and manage that risk;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397943" lims:id="1397943"><Label>(d)</Label><Text>any measures taken to remediate any forced labour or child labour;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397944" lims:id="1397944"><Label>(e)</Label><Text>any measures taken to remediate the loss of income to the most vulnerable families that results from any measure taken to eliminate the use of forced labour or child labour in its activities and supply chains;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397945" lims:id="1397945"><Label>(f)</Label><Text>the training provided to employees on forced labour and child labour; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397946" lims:id="1397946"><Label>(g)</Label><Text>how the government institution assesses its effectiveness in ensuring that forced labour and child labour are not being used in its activities and supply chains.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397947" lims:id="1397947"><MarginalNote lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1397948" lims:id="1397948">Form and manner</MarginalNote><Label>(3)</Label><Text>The Minister may specify, in writing, the form and manner in which a report is to be provided. lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1398070" lims:id="1398070"><Label>(1)</Label><Text>The Minister must cause to be tabled in each House of Parliament, on or before September 30 of each year or, if a House is not then sitting, on any of the next 30 days on which that House is sitting, a report containing</Text><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1398071" lims:id="1398071"><Label>(a)</Label><Text>a general summary of the activities of government institutions and entities that provided a report under this Act for their previous financial year that carry a risk of forced labour or child labour being used;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1398072" lims:id="1398072"><Label>(b)</Label><Text>the steps that government institutions and entities have taken to assess and manage that risk;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1398073" lims:id="1398073"><Label>(c)</Label><Text>if applicable, measures taken by government institutions and entities to remediate any forced labour or child labour;</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1398074" lims:id="1398074"><Label>(d)</Label><Text>a copy of any order made pursuant to section 18; and</Text></Paragraph><Paragraph lims:inforce-start-date="2024-01-01" lims:enacted-date="2023-05-11" lims:fid="1398075" lims:id="1398075"><Label>(e)</Label><Text>the particulars of any charge laid against a person or entity under lims:fid="1398081" lims:id="1398081"><Label>(1)</Label><Text>At the start of the fifth year after the day on which this section comes into force, a comprehensive review of this Act must be undertaken by the committee of the Senate, of the House of Commons or of both Houses of Parliament that may be designated or established for that purpose.</Text></Subsection><Subsection
