﻿<?xml version="1.0" encoding="utf-8"?><Regulation lims:pit-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:current-date="2019-06-21" lims:inforce-start-date="2006-03-22" lims:fid="598845" lims:id="598845" regulation-type="SOR" xml:lang="en" xmlns:lims="http://justice.gc.ca/lims"><Identification lims:inforce-start-date="2006-03-22" lims:fid="598846" lims:id="598846"><InstrumentNumber>C.R.C., c. 950</InstrumentNumber><ConsolidationDate lims:inforce-start-date="2006-03-22"><Date><YYYY>2019</YYYY><MM>6</MM><DD>22</DD></Date></ConsolidationDate><EnablingAuthority lims:inforce-start-date="2006-03-22" lims:fid="598848" lims:id="598848"><XRefExternal reference-type="act" link="I-5">INDIAN ACT</XRefExternal></EnablingAuthority><ShortTitle lims:inforce-start-date="2006-03-22" lims:fid="598849" lims:id="598849">Indian Band Council Procedure Regulations</ShortTitle><LongTitle lims:inforce-start-date="2006-03-22" lims:fid="598850" lims:id="598850">Regulations Respecting Procedure at Indian Band Council Meetings</LongTitle></Identification><Body lims:inforce-start-date="2006-03-22" lims:fid="598851" lims:id="598851"><Heading lims:inforce-start-date="2006-03-22" lims:fid="598852" lims:id="598852" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598853" lims:id="598853"><Label>1</Label><Text>These Regulations may be cited as the <XRefExternal reference-type="regulation" link="C.R.C.,_c._950">Indian Band Council Procedure Regulations</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="598854" lims:id="598854" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598855" lims:id="598855"><Label>2</Label><Text>In these Regulations,</Text><Definition lims:inforce-start-date="2006-03-22" lims:fid="598856" lims:id="598856" generate-in-text="no"><Text><DefinedTermEn>Assistant Deputy Minister</DefinedTermEn> means the Assistant Deputy Minister, Indian and Eskimo Affairs of the Department; (<DefinedTermFr>sous-ministre adjoint</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="598857" lims:id="598857" generate-in-text="no"><Text><DefinedTermEn>council</DefinedTermEn> means the council of a Band elected pursuant to section 74 of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>; (<DefinedTermFr>conseil</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="598858" lims:id="598858" generate-in-text="no"><Text><DefinedTermEn>Department</DefinedTermEn> means the Department of Indian Affairs and Northern Development; (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="598859" lims:id="598859" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Indian Affairs and Northern Development; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="598860" lims:id="598860" generate-in-text="no"><Text><DefinedTermEn>secretary</DefinedTermEn> means the person appointed by the council of a band to record the minutes of the council meetings; (<DefinedTermFr>secrétaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="598861" lims:id="598861" generate-in-text="no"><Text><DefinedTermEn>superintendent</DefinedTermEn> means the Superintendent or Senior Field Officer of the Indian Affairs Branch in charge of the Agency, and includes the Indian Commissioner for British Columbia, all Regional Supervisors, all Assistants Indian Agency, and any other officer acting under the instructions of the Minister or the Assistant Deputy Minister. (<DefinedTermFr>surintendant</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="598862" lims:id="598862" level="1"><TitleText>Meetings of the Council</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598863" lims:id="598863"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598864" lims:id="598864"><Label>(1)</Label><Text>The first meeting of the council shall be held not later than one month after its election, on a day, hour and place to be stated in a notice given to each member of the council, and meetings shall thereafter be held on such days and at such times as may be necessary for the business of the council or the affairs of the band.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598865" lims:id="598865"><Label>(2)</Label><Text>No member of a council may be absent from meetings of the council for three consecutive meetings without being authorized to do so by the chief of the band or superintendent, with the consent of the majority of the councillors of the band.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598866" lims:id="598866"><Label>4</Label><Text>The chief of the band or superintendent may, at any time, summon a special meeting of the council, and shall summon a special meeting when requested to do so by a majority of the members of the council.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598867" lims:id="598867"><Label>5</Label><Text>The superintendent shall notify each member of the council of the day, hour and place of the meeting.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="598868" lims:id="598868" level="1"><TitleText>Order and Proceedings</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598869" lims:id="598869"><Label>6</Label><Text>A majority of the whole council shall constitute a quorum, but where a council consists of nine or more members five members shall constitute a quorum.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598870" lims:id="598870"><Label>7</Label><Text>If no quorum is present within 1 hour after the time appointed for the meeting, the secretary shall call the roll and take the names of the members then present and the council shall stand adjourned until the next meeting.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598871" lims:id="598871"><Label>8</Label><Text>The chief of the band or, with the consent of the majority of the councillors present at the meeting, the superintendent shall be the presiding officer.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598872" lims:id="598872"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598873" lims:id="598873"><Label>(1)</Label><Text>Upon a quorum being present, the presiding officer shall take the chair and call the meeting to order.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598874" lims:id="598874"><Label>(2)</Label><Text>A chairman shall be chosen</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598875" lims:id="598875"><Label>(a)</Label><Text>in the absence of the chief, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598876" lims:id="598876"><Label>(b)</Label><Text>where the superintendent is not chosen the presiding officer pursuant to section 8,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="598877" lims:id="598877"><Text>from among the members present who shall preside during the meeting or until the arrival of the chief or until the superintendent is chosen as the presiding officer.</Text></ContinuedSectionSubsection></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598878" lims:id="598878"><Label>10</Label><Text>The presiding officer shall maintain order and decide all questions of procedure.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598879" lims:id="598879"><Label>11</Label><Text>The order of business at each regular meeting shall be as follows:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598880" lims:id="598880"><Label>(a)</Label><Text>reading (correction, if any) and adoption of the minutes of the previous meeting;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598881" lims:id="598881"><Label>(b)</Label><Text>unfinished business;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598882" lims:id="598882"><Label>(c)</Label><Text>presentation and reading of correspondence and petitions;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598883" lims:id="598883"><Label>(d)</Label><Text>presentation and consideration of reports of committees;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598884" lims:id="598884"><Label>(e)</Label><Text>new business;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598885" lims:id="598885"><Label>(f)</Label><Text>hearing deputations;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598886" lims:id="598886"><Label>(g)</Label><Text>adjournment.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598887" lims:id="598887"><Label>12</Label><Text>Each resolution shall be presented or read by the mover, and when duly moved and seconded and placed before the meeting by the presiding officer, shall be open for consideration.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598888" lims:id="598888"><Label>13</Label><Text>After a resolution has been placed before the meeting by the presiding officer it shall be deemed to be in the possession of the council, but it may be withdrawn by consent of the majority of the council members present.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598889" lims:id="598889"><Label>14</Label><Text>When any member desires to speak, he shall address his remarks to the presiding officer and confine himself to the question then before the meeting.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598890" lims:id="598890"><Label>15</Label><Text>In the event of more than one member desiring to speak at one time, the presiding officer shall determine who is entitled to speak.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598891" lims:id="598891"><Label>16</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598892" lims:id="598892"><Label>(1)</Label><Text>The presiding officer or any member may call a member to order while speaking and the debate shall then be suspended and the member shall not speak until the point of order is determined.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598893" lims:id="598893"><Label>(2)</Label><Text>A member may speak only once on a point of order.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598894" lims:id="598894"><Label>17</Label><Text>Any member may appeal the decision of the presiding officer to the council and all appeals shall be decided by a majority vote and without debate.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598895" lims:id="598895"><Label>18</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598896" lims:id="598896"><Label>(1)</Label><Text>All questions before the council shall be decided by a majority vote of the councillors present.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598897" lims:id="598897"><Label>(2)</Label><Text>The presiding officer shall not be entitled to vote but whenever the votes are equal the presiding officer, other than the superintendent, shall cast the deciding vote.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598898" lims:id="598898"><Label>19</Label><Text>Every member present when a question is put shall vote thereon unless the council excuses him or unless he is personally interested in the question, in which case he shall not be obliged to vote.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598899" lims:id="598899"><Label>20</Label><Text>A member who refuses to vote shall be deemed to vote in the affirmative.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598900" lims:id="598900"><Label>21</Label><Text>Whenever a division of the council is taken for any purpose, each member present and voting shall announce his vote upon the question openly and individually to the council and, when so requested by any member, the secretary shall record the same.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598901" lims:id="598901"><Label>22</Label><Text>Any member may require the question or resolution under discussion to be read for his information at any period of the debate, but not so as to interrupt a member who is speaking.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598902" lims:id="598902"><Label>23</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598903" lims:id="598903"><Label>(1)</Label><Text>The regular meetings shall be open to members of the band, and no member shall be excluded therefrom except for improper conduct.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="598904" lims:id="598904"><Label>(2)</Label><Text>The presiding officer may expel or exclude from any meeting any person who causes a disturbance at the meeting.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598905" lims:id="598905"><Label>24</Label><Text>The council may at the first meeting thereof appoint in lieu of the committee of the whole council the following standing committees:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598906" lims:id="598906"><Label>(a)</Label><Text>Finance;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598907" lims:id="598907"><Label>(b)</Label><Text>Roads and Bridges; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598908" lims:id="598908"><Label>(c)</Label><Text>Welfare.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598909" lims:id="598909"><Label>25</Label><Text>The council may appoint special committees on any matters as the interests of the band may require.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598910" lims:id="598910"><Label>26</Label><Text>A majority of the members of a committee shall be a quorum.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598911" lims:id="598911"><Label>27</Label><Text>The chief of the band shall <Language xml:lang="la">ex officio</Language> be a member of all committees and be entitled to vote at all meetings thereof, and other members of the council may attend meetings of a committee and may with the consent of the committee take part in the discussion but shall not be entitled to vote.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598912" lims:id="598912"><Label>28</Label><Text>The general duties of standing and special committees are,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598913" lims:id="598913"><Label>(a)</Label><Text>to report to the council from time to time as often as the interests of the band may require, all matters connected with the duties imposed on them respectively and to recommend such action by the council in relation thereto as they may deem necessary and expedient; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598914" lims:id="598914"><Label>(b)</Label><Text>to consider and report upon all matters referred to them by the council or by the chief of the band.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598915" lims:id="598915"><Label>29</Label><Text>Special meetings of committees shall be called at the request of the chairman or a majority of the committee or, in the absence of the chairman on request of the chief of the band or the superintendent.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598916" lims:id="598916"><Label>30</Label><Text>Any representative of the Minister present at a council meeting may</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598917" lims:id="598917"><Label>(a)</Label><Text>address the council, and explain to and advise the members thereof upon their powers and duties;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598918" lims:id="598918"><Label>(b)</Label><Text>explain to and advise the members thereof upon any question of procedure; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="598919" lims:id="598919"><Label>(c)</Label><Text>give such information as may be requested by any member of the council relating to the administration of the affairs of the band.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="598920" lims:id="598920"><Label>31</Label><Text>The council may make such rules of procedure as are not inconsistent with these Regulations in respect of matters not specifically provided for thereby, as it may deem necessary.</Text></Section></Body></Regulation>
