SOR/86-1106, s. 2; SOR/87-165, s. 1; SOR/88-442, s. 2; SOR/98-556, s. 1; SOR/2003-382, s. 7(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502659" lims:id="502659"><Label>4.1 and 4.2</Label><Text><Repealed>[Repealed, SOR/94-209, s. 1]</Repealed></Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502660" lims:id="502660"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502661" lims:id="502661"><Label>(1)</Label><Text>Where mail is addressed to an individual, or to the attention of an individual, at the address of an organization, an association, a corporation or an establishment that has the character of a commercial enterprise, that mail shall not be redirected by the Corporation for delivery to that individual at a forwarding address in or outside Canada, notwithstanding that the individual has filed with the Corporation a request to redirect mail form.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502662" lims:id="502662"><Label>(2)</Label><Text>Subject to sections 6 and 7, where a person files with the Corporation a request to redirect mail form setting out a forwarding address outside Canada, the Corporation shall redirect that person’s mail to the forwarding address unless the sender of the mail requests that it not be redirected.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502663" lims:id="502663"><Label>(3)</Label><Text>Where redirected mail that is letter mail bears on its cover a request for return to sender and the sender has entered into an agreement with the corporation for such return, it shall be returned to the sender.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502664" lims:id="502664"><Label>(4)</Label><Text>If the name of the addressee on addressed admail is followed by the words “or occupant” or similar wording, that mail shall not be redirected by the Corporation.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="502666" lims:id="502666">SOR/79-65, s. 1; SOR/83-61, s. 2; SOR/87-165, s. 3; SOR/88-442, s. 4; SOR/90-16, s. 3; SOR/91-638, s. 2; SOR/98-556, s. 3; SOR/2003-382, s. 9(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502680" lims:id="502680"><Label>8.1</Label><Text><Repealed>[Repealed, SOR/94-209, s. 3]</Repealed></Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502681" lims:id="502681"><Label>8.2</Label><Text>Where an item of mail that consists of international letters, printed papers, small packets or literature for the blind bears an endorsement on the address side indicating that the item is not to be redirected to the addressee, that item shall be treated as undeliverable mail.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="502683" lims:id="502683">SOR/88-442, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502684" lims:id="502684" level="1"><TitleText>Undeliverable Mail</TitleText></Heading><Section lims:inforce-start-date="2006-09-28" lims:lastAmendedDate="2006-09-28" lims:fid="502685" lims:id="502685"><Label>9</Label><Subsection lims:inforce-start-date="2006-09-28" lims:fid="502686" lims:id="502686"><Label>(1)</Label><Text>Subject to sections 10, 12, 14 and 18, undeliverable mail shall be returned to the sender or forwarded to the addressee on payment of the applicable fee.</Text></Subsection><Subsection lims:inforce-start-date="2006-09-28" lims:fid="502687" lims:id="502687"><Label>(2)</Label><Text>Undeliverable mail that is returned to the sender or forwarded to the addressee is also subject to accrued postage due charges, if any.</Text></Subsection><Subsection lims:inforce-start-date="2006-09-28" lims:fid="502688" lims:id="502688"><Label>(2.1)</Label><Text>Despite subsections (1) and (2), mail that is addressed admail or unaddressed admail shall be withheld from delivery by the Corporation and returned to the sender, if</Text><Paragraph lims:inforce-start-date="2006-09-28" lims:fid="502689" lims:id="502689"><Label>(a)</Label><Text>the sender makes a written application to the Corporation for the return of the mail;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-09-28" lims:fid="502690" lims:id="502690"><Label>(b)</Label><Text>the sender’s application stipulates the special circumstances that require the mail to be returned, such as an error or omission made by the sender with respect to the mail;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-09-28" lims:fid="502691" lims:id="502691"><Label>(c)</Label><Text>the sender enters into an agreement with the Corporation for the return of the mail; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-09-28" lims:fid="502692" lims:id="502692"><Label>(d)</Label><Text>the sender agrees to pay the applicable fee.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-09-28" lims:fid="502694" lims:id="502694">SOR/82-29, s. 3; SOR/88-442, s. 5; SOR/90-16, s. 4; SOR/91-183, s. 2; SOR/91-629, s. 1; SOR/91-638, s. 3; SOR/98-556, s. 4; SOR/2003-376, s. 1; SOR/2003-382, s. 10(F); SOR/2006-232, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502695" lims:id="502695" level="1"><TitleText>Handling Procedure</TitleText></Heading><Section lims:inforce-start-date="2010-12-03" lims:lastAmendedDate="2010-12-03" lims:fid="502696" lims:id="502696"><Label>10</Label><Subsection lims:inforce-start-date="2010-12-03" lims:fid="502697" lims:id="502697"><Label>(1)</Label><Text>Subject to subsection (2), undeliverable mail that bears the return address of the sender on its cover shall</Text><Paragraph lims:inforce-start-date="2010-12-03" lims:fid="502698" lims:id="502698"><Label>(a)</Label><Text>if the address of the sender is in Canada, be returned to the sender by the Corporation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-12-03" lims:fid="502699" lims:id="502699"><Label>(b)</Label><Text>if the address of the sender is outside Canada, be handled pursuant to section 15.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-12-03" lims:fid="502700" lims:id="502700"><Label>(2)</Label><Text>If an item of undeliverable mail is incentive letter mail as defined in the <XRefExternal reference-type="other">Canada Postal Guide</XRefExternal>, addressed admail, publications mail or advertising or promotional matter addressed to householders and bears on its cover the return address of a sender in Canada, it must be handled in a manner set out in the <XRefExternal reference-type="other">Canada Postal Guide</XRefExternal>, as it read on June 1, 2010.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-12-03" lims:fid="502702" lims:id="502702">SOR/88-442, s. 6; SOR/88-622, s. 3; SOR/90-803, s. 3; SOR/91-638, s. 4; SOR/2003-376, s. 2; SOR/2003-382, s. 11(F); SOR/2008-285, s. 4; SOR/2010-289, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502703" lims:id="502703"><Label>11</Label><Text>Undeliverable mail that cannot be redirected or returned to the sender owing to an insufficient or incorrect address on the cover of the mail shall be sent to the appropriate regional undeliverable mail office and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502704" lims:id="502704"><Label>(a)</Label><Text>opened to determine whether it contains the address of the sender or addressee, in the case of mail posted in Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502705" lims:id="502705"><Label>(b)</Label><Text>handled pursuant to section 15, in the case of mail posted elsewhere than in Canada.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502706" lims:id="502706" level="1"><TitleText>Handling Procedure for Domestic Undeliverable Mail</TitleText></Heading><Section lims:inforce-start-date="2010-12-03" lims:lastAmendedDate="2010-12-03" lims:fid="502707" lims:id="502707"><Label>12</Label><Subsection lims:inforce-start-date="2010-12-03" lims:fid="502708" lims:id="502708"><Label>(1)</Label><Text>Subject to subsection (2), undeliverable mail that is opened pursuant to section 11 and found to contain the address of the sender or addressee in Canada shall be placed under separate cover and returned to the sender or forwarded to the addressee.</Text></Subsection><Subsection lims:inforce-start-date="2010-12-03" lims:fid="502709" lims:id="502709"><Label>(2)</Label><Text>If an item of undeliverable mail that is opened under section 11 is incentive letter mail as defined in the <XRefExternal reference-type="other">Canada Postal Guide</XRefExternal>, addressed admail, publications mail or advertising or promotional matter addressed to householders, it must be handled in a manner set out in the <XRefExternal reference-type="other">Canada Postal Guide</XRefExternal>, as it read on June 1, 2010.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-12-03" lims:fid="502711" lims:id="502711">SOR/88-442, s. 7; SOR/88-622, s. 4; SOR/90-803, s. 4; SOR/91-638, s. 5; SOR/2003-376, s. 3; SOR/2003-382, s. 11(F); SOR/2008-285, s. 5; SOR/2010-289, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502712" lims:id="502712"><Label>13</Label><Text>Where undeliverable mail, opened pursuant to section 11, does not contain sufficient information to permit the mail to be returned to the sender or forwarded to the addressee, it shall be handled as follows:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502713" lims:id="502713"><Label>(a)</Label><Text>mail with no obvious value shall be destroyed;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502714" lims:id="502714"><Label>(b)</Label><Text>where the mail contains cash, the cash shall be deposited to the credit of the Canada Post Corporation;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502715" lims:id="502715"><Label>(c)</Label><Text>subject to paragraph (d), where the mail contains merchandise, the merchandise shall be sold or otherwise disposed of in a manner approved by the Canada Post Corporation and the proceeds of such disposition shall be deposited to the credit of the Canada Post Corporation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502716" lims:id="502716"><Label>(d)</Label><Text>where the disposition of merchandise in accordance with paragraph (c) would be contrary to any law of Canada or of any province or where, in the opinion of the Canada Post Corporation, the merchandise is dangerous or is of an immoral or indecent character, the merchandise shall be disposed of in a manner approved by the Canada Post Corporation.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="502718" lims:id="502718">SOR/81-841, s. 1; SOR/82-347, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502719" lims:id="502719" level="1"><TitleText>Detained Domestic Undeliverable Mail</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502720" lims:id="502720"><Label>14</Label><Text>Mail posted in Canada, detained by the Minister under paragraph 47(3)(a) of the <XRefExternal reference-type="act" link="C-10">Canada Post Corporation Act</XRefExternal> and declared to be undeliverable mail under paragraph 47(3)(b) or deemed to be undeliverable mail under subsection 47(4) of that Act shall be handled as follows:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502721" lims:id="502721"><Label>(a)</Label><Text>mail</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502722" lims:id="502722"><Label>(i)</Label><Text>with no obvious value,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502723" lims:id="502723"><Label>(ii)</Label><Text>that contravenes any provision of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or other law of Canada, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502724" lims:id="502724"><Label>(iii)</Label><Text>that by order of the Minister may not be returned to the sender</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2006-03-22" lims:fid="502725" lims:id="502725"><Text>shall be destroyed; and</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502726" lims:id="502726"><Label>(b)</Label><Text>mail, other than that referred to in paragraph (a), shall be handled pursuant to sections 10 to 13.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="502728" lims:id="502728">SOR/81-841, s. 2; SOR/98-558, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502729" lims:id="502729" level="1"><TitleText>International Undeliverable Mail</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502730" lims:id="502730"><Label>15</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502731" lims:id="502731"><Label>(1)</Label><Text>Undeliverable mail posted elsewhere than in Canada shall be dealt with as follows:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502732" lims:id="502732"><Label>(a)</Label><Text>where the mail was posted in Australia, Great Britain (including Northern Ireland), the Republic of Ireland, Mexico or the United States with postage thereon paid at the current rate of postage for letters in that country and where the mail bears a return address, with or without a request for return, the mail shall be returned directly to the sender;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502733" lims:id="502733"><Label>(b)</Label><Text>subject to subsection (1.1), where the mail was posted in a country other than a country mentioned in paragraph (a) with postage thereon paid at the current rate of postage for letters in that country, whether or not the mail bears a return address or request for return, the mail shall be returned to an office of exchange of the country of origin; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502734" lims:id="502734"><Label>(c)</Label><Text>mail on which the postage has not been paid at the current rate of postage for letters in the country of origin shall be sent to the appropriate regional undeliverable mail office and handled in accordance with subsections (2) and (3) except that mail referred to in those subsections that is posted in the United States shall be returned to the sender.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502735" lims:id="502735"><Label>(1.1)</Label><Text>Postcards that do not bear a return address and are posted in countries other than those referred to in paragraph (1)(a) shall be destroyed.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502736" lims:id="502736"><Label>(2)</Label><Text>A regional undeliverable mail office shall return</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502737" lims:id="502737"><Label>(a)</Label><Text>undeliverable mail that consists of printed papers and that is registered or bears a request for return, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502738" lims:id="502738"><Label>(b)</Label><Text>mail that consists of small packets, literature for the blind or books whether registered or unregistered,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="502739" lims:id="502739"><Text>to the country of origin of the mail.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502740" lims:id="502740"><Label>(3)</Label><Text>A regional undeliverable mail office shall destroy mail that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502741" lims:id="502741"><Label>(a)</Label><Text>is not registered;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502742" lims:id="502742"><Label>(b)</Label><Text>consists of undeliverable printed papers posted elsewhere than in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502743" lims:id="502743"><Label>(c)</Label><Text>does not bear a request for return.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="502745" lims:id="502745">SOR/82-29, s. 4; SOR/83-623, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502746" lims:id="502746" level="1"><TitleText>Undeliverable International Parcels</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502747" lims:id="502747"><Label>16</Label><Text>Undeliverable mail that consists of parcels posted elsewhere than in Canada and that does not bear a request for abandonment shall be sent to the appropriate exchange office for return to the country of origin.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502748" lims:id="502748" level="1"><TitleText>Newspapers and Periodicals</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="502750" lims:id="502750">SOR/91-183, s. 3</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502751" lims:id="502751"><Label>17</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502752" lims:id="502752"><Label>(1)</Label><Text>Where a subscriber to a newspaper or periodical has moved from the place to which the newspaper or periodical is addressed and</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502753" lims:id="502753"><Label>(a)</Label><Text>has not filed with the Corporation a request to redirect mail form, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502754" lims:id="502754"><Label>(b)</Label><Text>has filed the request referred to in paragraph (a) with the Corporation but the redirection period specified in the request has expired,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="502755" lims:id="502755"><Text>the Corporation may treat the newspaper or periodical as undeliverable mail.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502756" lims:id="502756"><Label>(2)</Label><Text>Where a subscriber referred to in subsection (1) files with the Corporation a request to redirect mail form, the Corporation may notify the publisher of the newspaper or periodical that the address of the subscriber has changed.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="502757" lims:id="502757"><Label>(3)</Label><Text>The notification referred to in subsection (2) shall be in the form set out in Schedule III.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="502759" lims:id="502759">SOR/85-560, s. 1; SOR/87-165, s. 4(F); SOR/90-16, s. 5; SOR/91-183, s. 4; SOR/96-212, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="502760" lims:id="502760" level="1"><TitleText>Detained International Undeliverable Mail</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="502761" lims:id="502761"><Label>18</Label><Text>Mail posted elsewhere than in Canada, detained by the Minister under paragraph 47(3)(a) of the <XRefExternal reference-type="act" link="C-10">Canada Post Corporation Act</XRefExternal> and declared to be undeliverable mail under paragraph 47(3)(b) or deemed to be undeliverable mail under subsection 47(4) of that Act shall be handled as follows:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502762" lims:id="502762"><Label>(a)</Label><Text>mail</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502763" lims:id="502763"><Label>(i)</Label><Text>with no obvious value,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502764" lims:id="502764"><Label>(ii)</Label><Text>that contravenes any provision of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or other law of Canada, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="502765" lims:id="502765"><Label>(iii)</Label><Text>that by order of the Minister may not be returned to the sender</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2006-03-22" lims:fid="502766" lims:id="502766"><Text>shall be destroyed; and</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="502767" lims:id="502767"><Label>(b)</Label><Text>mail, other than that referred to in paragraph (a), shall be handled as set out in sections 15 and 16.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="502769" lims:id="502769">SOR/81-841, s. 3;
