Constitution of Canada, and section 15 of the <XRefExternal reference-type="act">Canadian Charter of Rights and Freedoms</XRefExternal> guarantees that every individual is equal before and under the law and has the right to equal protection and equal benefit of the law without discrimination;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85507" lims:id="85507" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the courts in a majority of the provinces and in one territory have recognized that the right to equality without discrimination requires that couples of the same sex and couples of the opposite sex have equal access to marriage for civil purposes;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85508" lims:id="85508" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the Supreme Court of Canada has recognized that many Canadian couples of the same sex have married in reliance on those court decisions;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85509" lims:id="85509" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS only equal access to marriage for civil purposes would respect the right of couples of the same sex to equality without discrimination, and civil union, as an institution other than marriage, would not offer them that equal access and would violate their human dignity, in breach of the <XRefExternal reference-type="act">Canadian Charter of Rights and Freedoms</XRefExternal>;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85510" lims:id="85510" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the Supreme Court of Canada has determined that the Parliament of Canada has legislative jurisdiction over marriage but does not have the jurisdiction to establish an institution other than marriage for couples of the same sex;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85511" lims:id="85511" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS everyone has the freedom of conscience and religion under section 2 of the <XRefExternal reference-type="act">Canadian Charter of Rights and Freedoms</XRefExternal>;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85512" lims:id="85512" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS nothing in this Act affects the guarantee of freedom of conscience and religion and, in particular, the freedom of members of religious groups to hold and declare their religious beliefs and the freedom of officials of religious groups to refuse to perform marriages that are not in accordance with their religious beliefs;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85513" lims:id="85513" format-ref="indent-0-0" list-item="no" language-align="no"><Text>WHEREAS it is not against the public interest to hold and publicly express diverse views on marriage;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85514" lims:id="85514" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS, in light of those considerations, the Parliament of Canada’s commitment to uphold the right to equality without discrimination precludes the use of section 33 of the <XRefExternal reference-type="act">Canadian Charter of Rights and Freedoms</XRefExternal> to deny the right of couples of the same sex to equal access to marriage for civil purposes;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85515" lims:id="85515" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS marriage is a fundamental institution in Canadian society and the Parliament of Canada has a responsibility to support that institution because it strengthens commitment in relationships and represents the foundation of family life for many Canadians;</Text></Provision><Provision lims:inforce-start-date="2015-06-18" lims:fid="85516" lims:id="85516" format-ref="indent-0-0" language-align="no" list-item="no"><Text>AND WHEREAS, in order to reflect values of tolerance, respect and equality consistent with the <XRefExternal reference-type="act">Canadian Charter of Rights and Freedoms</XRefExternal>, access to marriage for civil purposes should be extended by legislation to couples of the same sex;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2015-06-18" lims:fid="85517" lims:id="85517"><Provision lims:inforce-start-date="2015-06-18" lims:fid="85518" lims:id="85518" format-ref="indent-0-0" list-item="no" language-align="no"><Text>NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="C-31.5">Civil Marriage Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2015-06-18" lims:fid="85522" lims:id="85522" level="1"><Label>PART 1</Label><TitleText>Marriage</TitleText></Heading><Section lims:inforce-start-date="2005-07-20" lims:lastAmendedDate="2005-07-20" lims:fid="85523" lims:id="85523"><MarginalNote lims:inforce-start-date="2005-07-20" lims:fid="85524" lims:id="85524">Marriage — certain aspects of capacity</MarginalNote><Label>2</Label><Text>Marriage, for civil purposes, is the lawful union of two persons to the exclusion of all others.</Text></Section><Section lims:inforce-start-date="2015-06-18" lims:lastAmendedDate="2015-06-18" lims:fid="85525" lims:id="85525"><MarginalNote lims:inforce-start-date="2015-06-18" lims:fid="85526" lims:id="85526">Consent every previous marriage has been dissolved by death or by divorce or declared null by a court order.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-18" lims:fid="85536" lims:id="85537"><MarginalNote lims:inforce-start-date="2005-07-20" lims:fid="85538" lims:id="85538">Religious officials</MarginalNote><Label>3</Label><Text>It is recognized that officials of religious groups are free to refuse to perform marriages that are not in accordance with their religious beliefs.</Text></Section><Section lims:inforce-start-date="2005-07-20" lims:lastAmendedDate="2005-07-20" lims:fid="85539" lims:id="85539"><MarginalNote lims:inforce-start-date="2005-07-20" lims:fid="85540" lims:id="85540">Freedom of conscience and religion and expression of beliefs</MarginalNote><Label>3.1</Label><Text>For greater certainty, no person or organization shall be deprived of any benefit, or be subject to any obligation or sanction, under any law of the Parliament of Canada solely by reason of their exercise, in respect of marriage between persons of the same sex, of the freedom of conscience and religion guaranteed under the <XRefExternal reference-type="act">Canadian Charter of Rights and Freedoms</XRefExternal> or the expression of their beliefs in respect of marriage as the union of a man and woman to the exclusion of all others based on that guaranteed freedom.</Text></Section><Section lims:inforce-start-date="2005-07-20" lims:lastAmendedDate="2005-07-20" lims:fid="85541" lims:id="85541"><MarginalNote lims:inforce-start-date="2005-07-20" lims:fid="85542" lims:id="85542">Marriage not void or voidable</MarginalNote><Label>4</Label><Text>For greater certainty, a marriage is not void or voidable by reason only that the spouses are of the same sex.</Text></Section><Section lims:inforce-start-date="2015-06-18" lims:lastAmendedDate="2015-06-18" lims:fid="85543" lims:id="85543"><MarginalNote lims:inforce-start-date="2015-06-18" lims:fid="85544" lims:id="85544">Marriage of non-resident persons</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2015-06-18" lims:fid="85545" lims:id="85545"><Label>(1)</Label><Text>A marriage that is performed in Canada and that would be valid in Canada if the spouses were domiciled in Canada is valid for the purposes of Canadian law even though either or both of the spouses do not, at the time of the marriage, have the capacity to enter into it under the law of their respective state of domicile.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-18" lims:fid="85546" lims:id="85546"><MarginalNote lims:inforce-start-date="2015-06-18" lims:fid="85547" lims:id="85547">Retroactivity</MarginalNote><Label>(2)</Label><Text>Subsection (1) applies retroactively to a marriage that would have been valid under the law that was applicable in the province where the marriage was performed but for the lack of capacity of either or both of the spouses to enter into it under the law of their respective state of domicile.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-18" lims:fid="85548" lims:id="85548"><MarginalNote lims:inforce-start-date="2015-06-18" lims:fid="85549" lims:id="85549">Order dissolving marriage</MarginalNote><Label>(3)</Label><Text>Any court order, made in Canada or elsewhere before the coming into force of this subsection, that declares the marriage to be null or that grants a divorce to the spouses dissolves the marriage, for the purposes of Canadian law, as of the day on which the order takes effect.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem of <DefinedTermEn>court</DefinedTermEn></MarginalNote><Label>6</Label><Text>In this Part, <DefinedTermEn>court</DefinedTermEn>, in respect of a province, means</Text><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85555" lims:id="85555"><Label>(a)</Label><Text>for Ontario, the Superior Court of Justice;</Text></Paragraph><Paragraph lims:fid="85557" lims:id="85557"><Label>(c)</Label><Text>for Nova Scotia and British Columbia, the Supreme Court of the province;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85558" lims:id="85558"><Label>(d)</Label><Text>for New Brunswick, Manitoba, Saskatchewan and Alberta, the Court of Queen’s Bench for the province;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85559" lims:id="85559"><Label>(e)</Label><Text>for Prince Edward Island and Newfoundland and Labrador, the trial division of the Supreme Court of the province; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85560" lims:id="85560"><Label>(f)</Label><Text>for Yukon and the Northwest Territories, the Supreme Court, and in Nunavut, the Nunavut Court of Justice.</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2013-08-14" lims:fid="85561" lims:id="85561"><Text>It also means any other court in the province whose judges are appointed by the Governor General and that is designated by the Lieutenant Governor in Council of the province as a court for the purposes of this lims:inforce-start-date="2013-08-14" lims:fid="85565" lims:id="85565">Divorce — non-resident spouses</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2013-08-14" lims:fid="85566" lims:id="85566"><Label>(1)</Label><Text>The court of the province where the marriage was performed may, on application, grant the spouses a divorce if</Text><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85567" lims:id="85567"><Label>(a)</Label><Text>there has been a breakdown of the marriage as established by the spouses having lived separate and apart for at least one year before the making of the application;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85568" lims:id="85568"><Label>(b)</Label><Text>neither spouse resides in Canada at the time the application is made; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85569" lims:id="85569"><Label>(c)</Label><Text>each of the spouses is residing — and for at least one year immediately before the application is made, has resided — in a state where a divorce cannot be granted because that state does not recognize the validity of the marriage.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-08-14" lims:fid="85570" lims:id="85570"><MarginalNote lims:inforce-start-date="2013-08-14" lims:fid="85571" lims:id="85571">Application</MarginalNote><Label>(2)</Label><Text>The application may be made by both spouses jointly or by one of the spouses with the other spouse’s consent or, in the absence of that consent, on presentation of an order from the court or a court located in the state where one of the spouses resides that declares that the other spouse</Text><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85572" lims:id="85572"><Label>(a)</Label><Text>is incapable of making decisions about his or her civil status because of a mental disability;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85573" lims:id="85573"><Label>(b)</Label><Text>is unreasonably withholding consent; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85574" lims:id="85574"><Label>(c)</Label><Text>cannot be found.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-08-14" lims:fid="85575" lims:id="85575"><MarginalNote lims:inforce-start-date="2013-08-14" lims:fid="85576" lims:id="85576">Exception if spouse is found</MarginalNote><Label>(3)</Label><Text>Despite paragraph (2)(c), the other spouse’s consent is required if that spouse is found in connection with the service of the authority</DefinedTermEn></MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2013-08-14" lims:fid="85603" lims:id="85603"><Label>(1)</Label><Text>In this section, <DefinedTermEn>competent authority</DefinedTermEn>, in respect of a court in a province, means the body, person or group of persons ordinarily competent under the laws of that province to make rules regulating the practice and procedure in that court.</Text></Subsection><Subsection lims:inforce-start-date="2013-08-14" lims:fid="85604" lims:id="85604"><MarginalNote lims:inforce-start-date="2013-08-14" lims:fid="85605" lims:id="85605">Rules</MarginalNote><Label>(2)</Label><Text>Subject to subsection (3), the competent authority may make rules applicable to any applications made under this Part in a court in a province, including rules</Text><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85606" lims:id="85606"><Label>(a)</Label><Text>regulating the practice and procedure in the court;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85607" lims:id="85607"><Label>(b)</Label><Text>respecting the conduct and disposition of any applications that are made under this Part without an oral hearing;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85608" lims:id="85608"><Label>(c)</Label><Text>prescribing and regulating the duties of the officers of the court; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-08-14" lims:fid="85609" lims:id="85611">Exercise of power</MarginalNote><Label>(3)</Label><Text>The power of a competent authority to make rules for a court must be exercised in the like manner and subject to the like terms
