lims:inforce-start-date="2018-01-01" lims:fid="82820" lims:id="82820">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82821" lims:id="82821"><Label>(1)</Label><Text>The definitions in this subsection apply in this Act.</Text><Definition lims:inforce-start-date="2018-01-01" lims:fid="82822" lims:id="82822"><Text><DefinedTermEn>Canada child benefit</DefinedTermEn> means a deemed overpayment under Subdivision A.1 of Division E of Part I of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>. (<DefinedTermFr>allocation canadienne pour enfants</DefinedTermFr>) </Text></Definition><Definition lims:inforce-start-date="2018-01-01" lims:fid="82823" lims:id="82823"><Text><DefinedTermEn>Canada Learning Bond</DefinedTermEn> means the bond payable or paid under section <XRefInternal>6</XRefInternal>. (<DefinedTermFr>bon d’études</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-01-01" lims:fid="82824" lims:id="82824"><Text><DefinedTermEn>CES grant</DefinedTermEn> means a Canada Education Savings grant payable or paid under section <XRefInternal>5</XRefInternal> or under Part III.1 of the <XRefExternal reference-type="act" link="H-5.8">Department of Human Resources Development Act</XRefExternal>, as it read immediately before the coming into force of section <XRefInternal>19</XRefInternal> of this Act. (<DefinedTermFr>subvention pour l’épargne-études</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-01-01" lims:fid="82825" lims:id="82825"><Text><DefinedTermEn>child tax benefit</DefinedTermEn><Repealed>[Repealed, 2016, c. 12, s. 107]</Repealed></Text></Definition><Definition lims:inforce-start-date="2018-01-01" lims:fid="82826" lims:id="82826"><Text><DefinedTermEn>first threshold</DefinedTermEn> for a particular year means the dollar amount referred to in paragraph 117(2)(a) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>, as adjusted under that Act for the particular year. (<DefinedTermFr>premier seuil</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-01-01" lims:fid="82827" lims:id="82827"><Text><DefinedTermEn>national child benefit supplement</DefinedTermEn><Repealed>[Repealed, 2016, c. 12, s. 107]</Repealed></Text></Definition><Definition lims:inforce-start-date="2018-01-01" lims:fid="82828" lims:id="82828"><Text><DefinedTermEn>prescribed</DefinedTermEn> means prescribed by regulations. (<DefinitionEnOnly>Version anglaise seulement</DefinitionEnOnly>)</Text></Definition><Definition lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="82829" lims:id="1534290"><Text><DefinedTermEn>primary caregiver</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534291" lims:id="1534291"><Label>(a)</Label><Text>in the case of a beneficiary, or a child referred to in subsections 6(1.1) to (1.3) and section 12.2, who is a qualified dependant, the eligible individual in respect of the beneficiary or child; and</Text></Paragraph><Paragraph lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534292" lims:id="1534292"><Label>(b)</Label><Text>in the case of a beneficiary, or a child referred to in subsections 6(1.1) to (1.3) and section 12.2, in respect of whom a special allowance is payable under the <XRefExternal reference-type="act" link="C-28.5">Children’s Special Allowances Act</XRefExternal>, the department, agency or institution that maintains the beneficiary or child. (<DefinedTermFr>responsable</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-01-01" lims:fid="82832" lims:id="82832"><Text><DefinedTermEn>second threshold</DefinedTermEn> for a particular year means the higher dollar amount referred to in paragraph 117(2)(b) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>, lims:id="82835"><Label>(a)</Label><Text>the expressions <DefinitionRef>adjusted income</DefinitionRef>, <DefinitionRef>cohabiting spouse or common-law partner</DefinitionRef>, <DefinitionRef>eligible <DefinitionRef>beneficiary</DefinitionRef>, <DefinitionRef>contribution</DefinitionRef>, <DefinitionRef>designated provincial program</DefinitionRef>, <DefinitionRef>promoter</DefinitionRef>, <DefinitionRef>registered education savings plan</DefinitionRef>, <DefinitionRef>subscriber</DefinitionRef> and <DefinitionRef>trust</DefinitionRef> have the meanings assigned by section 146.1 of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-01-01" lims:fid="82837" lims:id="82837"><Label>(c)</Label><Text>any other expression has the meaning assigned by the <XRefExternal reference-type="act" link="I-3.3">Income Tax level="1"><TitleText>Purpose</TitleText></Heading><Section lims:inforce-start-date="2005-07-01" lims:lastAmendedDate="2005-07-01" lims:fid="82841" lims:id="82841"><MarginalNote lims:inforce-start-date="2005-07-01" lims:fid="82842" lims:id="82842">Purpose</MarginalNote><Label>3</Label><Text>The purpose of this Act is to encourage the financing of children’s post-secondary education through savings, from early childhood, in registered education savings plans.</Text></Section><Section lims:inforce-start-date="2005-07-01" lims:lastAmendedDate="2005-07-01" lims:fid="82843" lims:id="82843"><MarginalNote lims:inforce-start-date="2005-07-01" lims:fid="82844" lims:id="82844">Informational and promotional activities</MarginalNote><Label>3.1</Label><Text>The Minister shall take measures necessary to carry out the purpose set out in section 3, including making known to Canadians, through informational and promotional activities, the existence of CES grants and Canada Learning Bonds and any terms and conditions.</Text></Section><Heading lims:inforce-start-date="2016-12-15" lims:fid="82845" lims:id="82845" level="1"><TitleText>Designation of Minister</TitleText></Heading><Section lims:inforce-start-date="2004-12-15" lims:lastAmendedDate="2004-12-15" lims:fid="82846" lims:id="82846"><MarginalNote lims:inforce-start-date="2004-12-15" lims:fid="82847" lims:id="82847">Power of Governor in Council</MarginalNote><Label>4</Label><Text>The Governor in Council may designate a member of the Queen’s Privy Council for Canada to be the Minister for the purposes of this Act.</Text></Section><Heading lims:inforce-start-date="2016-12-15" lims:fid="82848" lims:id="82848" level="1"><TitleText>Payments</TitleText></Heading><Section lims:inforce-start-date="2018-01-01" lims:lastAmendedDate="2018-01-01" lims:fid="82849" lims:id="82849"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82850" lims:id="82850">CES grants</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82851" lims:id="82851"><Label>(1)</Label><Text>Subject to this Act and the regulations, on application to the Minister in a form and manner approved by the Minister, the Minister may, in respect of any contribution made in 1998 or a subsequent year to a registered education savings plan by or on behalf of a subscriber under the plan in respect of a beneficiary under the plan who is less than 17 years of age at the end of the year preceding the contribution, pay to a trustee of a trust governed by the plan a CES grant for the benefit of the trust. The payment is to be made on any terms and conditions that the Minister may specify by agreement between the Minister and the trustee.</Text></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82852" lims:id="82852"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82853" lims:id="82853">Amount of grant</MarginalNote><Label>(2)</Label><Text>The amount of a CES grant that may be paid for a particular year at any time is equal to the lesser of</Text><Paragraph lims:inforce-start-date="2018-01-01" lims:fid="82854" lims:id="82854"><Label>(a)</Label><Text>20% of the contribution, and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-01-01" lims:fid="82855" lims:id="82855"><Label>(b)</Label><Text>the amount, if any, by which the lesser of</Text><Subparagraph lims:inforce-start-date="2018-01-01" lims:fid="82856" lims:id="82856"><Label>(i)</Label><Text>$1,000, unless the particular year is any of 1998 to 2006, in which case, $800, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-01-01" lims:fid="82857" lims:id="82857"><Label>(ii)</Label><Text>the beneficiary’s unused CES grant room for the particular year at that time</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2018-01-01" lims:fid="82858" lims:id="82858"><Text>exceeds</Text></ContinuedParagraph><Subparagraph lims:inforce-start-date="2018-01-01" lims:fid="82859" lims:id="82859"><Label>(iii)</Label><Text>the total of all CES grants paid before that time — other than those amounts paid under subsection (4) — in respect of contributions made in the particular year in respect of the beneficiary.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82860" lims:id="82860"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82861" lims:id="82861">Unused CES grant room</MarginalNote><Label>(3)</Label><Text>The unused CES grant room for a beneficiary for a particular year at any time is</Text><Paragraph lims:inforce-start-date="2018-01-01" lims:fid="82862" lims:id="82862"><Label>(a)</Label><Text>if the beneficiary was 17 years of age or older at the end of the preceding year, nil; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-01-01" lims:fid="82863" lims:id="82863"><Label>(b)</Label><Text>in any other case, determined by the formula</Text><FormulaGroup lims:inforce-start-date="2018-01-01" lims:fid="82864" lims:id="82864"><Formula lims:inforce-start-date="2018-01-01" lims:fid="82865" lims:id="82865"><FormulaText>$400A + $500B - C</FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2018-01-01" lims:fid="82866" lims:id="82866"><FormulaTerm>A</FormulaTerm><Text>is the number of years after 1997 and before 2007 in which the beneficiary was alive, other than a year throughout which the beneficiary was</Text><FormulaParagraph lims:inforce-start-date="2018-01-01" lims:fid="82867" lims:id="82867"><Label>(i)</Label><Text>an ineligible beneficiary in accord-ance with the regulations, or</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2018-01-01" lims:fid="82868" lims:id="82868"><Label>(ii)</Label><Text>not resident in Canada,</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2018-01-01" lims:fid="82869" lims:id="82869"><FormulaTerm>B</FormulaTerm><Text>is the number of years after 2006 in which the beneficiary was alive, up to and including the particular year, other than a year throughout which the beneficiary was</Text><FormulaParagraph lims:inforce-start-date="2018-01-01" lims:fid="82870" lims:id="82870"><Label>(i)</Label><Text>an ineligible beneficiary in accord-ance with the regulations, or</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2018-01-01" lims:fid="82871" lims:id="82871"><Label>(ii)</Label><Text>not resident in Canada, and</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2018-01-01" lims:fid="82872" lims:id="82872"><FormulaTerm>C</FormulaTerm><Text>is the total of all CES grants paid before that time — other than those amounts paid under subsection (4) — in respect of contributions made in a preceding year in respect of the beneficiary.</Text></FormulaDefinition></FormulaGroup></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82873" lims:id="82873"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82874" lims:id="82874">Additional amount of grant</MarginalNote><Label>(4)</Label><Text>The amount of a CES grant that may be paid for a particular year at any time is increased by the lesser of</Text><Paragraph lims:inforce-start-date="2018-01-01" lims:fid="82875" lims:id="82875"><Label>(a)</Label><Text>the amount that is</Text><Subparagraph lims:inforce-start-date="2018-01-01" lims:fid="82876" lims:id="82876"><Label>(i)</Label><Text>20% of the contribution, if the beneficiary</Text><Clause lims:inforce-start-date="2018-01-01" lims:fid="82877" lims:id="82877"><Label>(A)</Label><Text>is a qualified dependant of an eligible individual whose adjusted income used to determine the amount of a Canada child benefit in respect of January in the particular year is the first threshold for the particular year or less, or</Text></Clause><Clause lims:inforce-start-date="2018-01-01" lims:fid="82878" lims:id="82878"><Label>(B)</Label><Text>is a person in respect of whom a special allowance under the <XRefExternal reference-type="act" link="C-28.5">Children’s Special Allowances Act</XRefExternal> is payable for at least one month in the particular year, and</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2018-01-01" lims:fid="82879" lims:id="82879"><Label>(ii)</Label><Text>10% of the contribution, if the beneficiary is a qualified dependant of an eligible individual whose adjusted income used to determine the amount of a Canada child benefit in respect of January in the particular year is more than the first threshold for the particular year but not more than the second threshold for the particular year, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-01-01" lims:fid="82880" lims:id="82880"><Label>(b)</Label><Text>the amount by which</Text><Subparagraph lims:inforce-start-date="2018-01-01" lims:fid="82881" lims:id="82881"><Label>(i)</Label><Text>$100, in the case of a beneficiary referred to in subparagraph (a)(i), or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-01-01" lims:fid="82882" lims:id="82882"><Label>(ii)</Label><Text>$50, in the case of a beneficiary referred to in subparagraph (a)(ii)</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2018-01-01" lims:fid="82883" lims:id="82883"><Text>exceeds</Text></ContinuedParagraph><Subparagraph lims:inforce-start-date="2018-01-01" lims:fid="82884" lims:id="82884"><Label>(iii)</Label><Text>the total of all amounts paid under this subsection before that time in respect of contributions made in the particular year in respect of the beneficiary.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82885" lims:id="82885"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82886" lims:id="82886">Eligible individual — first month</MarginalNote><Label>(5)</Label><Text>If there has been no determination of eligibility for a Canada child benefit in respect of January in a particular year, the adjusted income to be used for the purposes of subsection (4) is the adjusted income used to determine the amount of a Canada child benefit for the first month in the particular year in respect of which eligibility has been established.</Text></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82887" lims:id="82887"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82888" lims:id="82888">Beneficiary born in December</MarginalNote><Label>(6)</Label><Text>In applying subsection (5) in respect of a beneficiary born in December, the reference to “the first month in the particular year in respect of which eligibility has been established” in that subsection is to be read as a reference to “January of the next year”.</Text></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82889" lims:id="82889"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82890" lims:id="82890">Change in care</MarginalNote><Label>(6.1)</Label><Text>If, in a month following January in a particular year, an individual who was not the primary caregiver of a beneficiary in January of that year becomes the beneficiary’s primary caregiver, then the adjusted income to be used for the purposes of subsection (4) in respect of contributions made to the trustee of the trust designated by that individual or their cohabiting spouse or common-law partner is the adjusted income used to determine the amount of a Canada child benefit for the first month in the particular year in respect of which the individual’s eligibility for the Canada child benefit has been established.</Text></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82891" lims:id="82891"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82892" lims:id="82892">Change in care in December</MarginalNote><Label>(6.2)</Label><Text>In applying subsection (6.1) in respect of a beneficiary for whom the individual becomes the beneficiary’s primary caregiver in December, the reference to “the first month in the particular year in respect of which the individual’s eligibility for the Canada child benefit has been established” in that subsection is to be read as a reference to “January of the next year”.</Text></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82893" lims:id="82893"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82894" lims:id="82894">Designation</MarginalNote><Label>(7)</Label><Text>The amount referred to in subsection (4) is to be paid to the trustee of a trust designated, in the form and manner approved by the Minister, by the primary caregiver of the beneficiary at the time the contribution is made or the primary caregiver’s cohabiting spouse or common-law partner at that time.</Text></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82895" lims:id="82895"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82896" lims:id="82896">More than one designated trust</MarginalNote><Label>(7.1)</Label><Text>If there is more than one trust designated under subsection (7) at the time a contribution is made, the amount referred to in subsection (4) is to be paid to the trustee of the trust to which a contribution is first made.</Text></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82897" lims:id="82897"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82898" lims:id="82898">Additional grant less than maximum amount</MarginalNote><Label>(7.2)</Label><Text>For greater certainty, if there is more than one trust designated under subsection (7) and the total of all amounts paid under subsection (4) to the trustee of the trust to which a contribution is first made is less than the maximum amount that may be paid under subsection (4), then amounts may be paid under subsection (4) to the trustee of any trust designated under subsection (7).</Text></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82899" lims:id="82899"><Label>(8)</Label><Text><Repealed>[Repealed, 2010, c. 12, s. 31]</Repealed></Text></Subsection><Subsection lims:id="82908"><Label>(1)</Label><Text>Subject to this Act and the regulations, on application to the Minister, in the form and manner approved by the Minister, the Minister may, in respect of a beneficiary under a registered education savings plan who was born after 2003 and is less than 21 years of age at the time of the application, pay to a trustee of a trust governed by the plan a Canada Learning Bond for the benefit of the trust. The bond is to be paid on any terms and conditions that the Minister may specify by agreement between the Minister and the trustee.</Text></Subsection><Subsection lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534294" lims:id="1534294"><MarginalNote lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534295" lims:id="1534295">Notice — automatic enrolment</MarginalNote><Label>(1.1)</Label><Text>If the Minister determines that a child born after 2023 would be eligible to have a Canada Learning Bond paid in their respect if they were a beneficiary under a registered education savings plan, the child’s Social Insurance Number is provided to the Minister and the child is not, to the Minister’s knowledge, a beneficiary under such a plan, the Minister must notify the child’s primary caregiver — in the form and manner that the Minister considers appropriate — that the child is eligible to have a Canada Learning Bond paid in their respect and that the Minister will open a registered education savings plan in respect of the child in accordance with subsections (1.2) and (1.3) for the purpose of paying the Canada Learning Bond.</Text></Subsection><Subsection lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534296" lims:id="1534296"><MarginalNote lims:inforce-start-date="2025-06-27" Minister determines that a child born after 2023 would be eligible to have a Canada Learning Bond paid in their respect if they were a beneficiary and the Minister is provided with the child’s Social Insurance Number, the Minister must open a registered education savings plan in respect of the child</Text><Paragraph lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534298" lims:id="1534298"><Label>(a)</Label><Text>if the child is less than three years of age on the day the Minister determines that the child is eligible, no earlier than the day on the child’s primary caregiver or the primary caregiver’s cohabiting spouse or common-law partner has communicated to the Minister, in the form and manner approved by the Minister, their refusal of the payment of a Canada Learning Bond in respect of the child or if the child is a beneficiary.</Text></Subsection><Subsection lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" certainty</MarginalNote><Label>(1.4)</Label><Text>For greater certainty, an application may be made to the Minister under subsection (1) in respect of a person even if a refusal referred to in subsection (1.3) was communicated to the Minister in respect of that person.</Text></Subsection><Subsection lims:inforce-start-date="2018-01-01" lims:fid="82909" lims:id="82909"><MarginalNote lims:inforce-start-date="2018-01-01" lims:fid="82910" lims:id="82910">Amount of bond</MarginalNote><Label>(2)</Label><Text>The amount of a Canada Learning Bond is equal to the sum of the following amounts:</Text><Paragraph lims:inforce-start-date="2018-01-01" lims:fid="82911" lims:id="82911"><Label>(a)</Label><Text>$500 in respect of the first benefit year in which the beneficiary is a person less than 15 years of age at the beginning of the month immediately before the benefit year, or is born during the benefit year or during the month immediately before it, and, for at least one month in that year,</Text><Subparagraph lims:inforce-start-date="2018-01-01" lims:fid="82912" lims:id="82912"><Label>(i)</Label><Text>is a qualified dependant of an eligible individual whose adjusted income used to determine the amount of a Canada child benefit was,</Text><Clause lims:inforce-start-date="2018-01-01" lims:fid="82913" lims:id="82913"><Label>(A)</Label><Text>if the eligible individual has not more than three qualified dependants, less than or equal to the first threshold for the particular year in which the benefit year begins, or</Text></Clause><Clause lims:inforce-start-date="2018-01-01" lims:fid="82914" lims:id="82914"><Label>(B)</Label><Text>if the eligible individual has more than three qualified dependants, less than the amount determined in of a trust designated, in the form and manner approved by the Minister, by the primary caregiver of the beneficiary, the primary caregiver’s cohabiting spouse or common-law partner or, if the lims:inforce-start-date="2007-12-14" lims:fid="82983" lims:id="82983"><Label>(b)</Label><Text>establishing conditions that must be met by a registered education savings plan and by persons in respect of the plan before a CES grant or a Canada Learning Bond may be paid in respect of the plan;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-14" lims:fid="82984" lims:id="82984"><Label>(c)</Label><Text>establishing the manner of determining the amount of a CES grant that may be paid in respect of contributions to registered education savings plans or the amount of a Canada Learning Bond that may be paid into those plans;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534318" lims:id="1534318"><Label>(c.1)</Label><Text>respecting the notice referred to in subsection 6(1.1), including providing for the maximum age of a child in respect of whom a notice is to be provided under that subsection;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534319" lims:id="1534319"><Label>(c.2)</Label><Text>respecting the opening of registered education savings plans by the Minister under subsection 6(1.2), including providing for the maximum age of a child in respect of whom such a plan may be opened under that subsection;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534320" lims:id="1534320"><Label>(c.3)</Label><Text>respecting the refusal referred to in subsection 6(1.3);</Text></Paragraph><Paragraph lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534321" lims:id="1534321"><Label>(c.4)</Label><Text>respecting the administration of the registered education savings plans referred to in section 7.1;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-06-27" lims:enacted-date="2024-06-20" lims:fid="1534322" lims:id="1534322"><Label>(c.5)</Label><Text>respecting agreements made under section 7.1, including specifying terms and conditions to be included in such agreements;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-14" lims:fid="82985" lims:id="82985"><Label>(d)</Label><Text>specifying terms and conditions to be included in agreements entered into between a trustee under a registered education savings plan and the Minister relating to the terms and conditions applicable to the payment of a CES grant or a Canada Learning Bond and specifying, for inclusion in the agreements, in addition to any other conditions that the Minister considers appropriate, the obligations of a trustee under an agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-14" lims:fid="82986" lims:id="82986"><Label>(e)</Label><Text>prescribing the circumstances in which an additional amount may be paid under subsection <XRefInternal>6</XRefInternal>(5) and establishing the manner of determining the amount of the payment;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-14" lims:fid="82987" lims:id="82987"><Label>(f)</Label><Text>specifying terms and conditions to be included in agreements entered into between promoters of registered education savings plans and the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-14" lims:fid="82988" lims:id="82988"><Label>(g)</Label><Text>specifying the requirements of this Act or the regulations relating to the payment of CES grants or Canada Learning Bonds that may be waived by the Minister to avoid undue hardship;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-14" lims:fid="82989" lims:id="82989"><Label>(h)</Label><Text>governing or prohibiting the sharing of CES grants or Canada Learning Bonds, and the earnings generated on them;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-14" lims:fid="82990" lims:id="82990"><Label>(i)</Label><Text>specifying circumstances under which all or part of any amount paid under this Act is to be repaid to the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-14" lims:fid="82991" lims:id="82991"><Label>(j)</Label><Text>specifying circumstances under which the earnings generated on Canada Learning Bonds repaid under regulations made under paragraph (i) are to be repaid to the Minister and establishing the manner of determining the amount of those earnings;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-12-14" lims:fid="82992" lims:id="82992"><Label>(k)</Label><Text>establishing, for the purpose of determining an amount required to
