title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-level="federal" reference-type="act" link="B-9.87">Build Canada Homes level="1"><TitleText>Definitions</TitleText></Heading><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586296" lims:id="1586296"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586297" lims:id="1586297">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586298" lims:id="1586298"><Text><DefinedTermEn>appropriate Minister</DefinedTermEn> means the Minister specified as the appropriate Minister in respect of Canada Lands Company Limited for the purposes of Part X of the <XRefExternal reference-level="federal" reference-type="act" link="F-11">Financial Administration Act</XRefExternal>. (<DefinedTermFr>ministre de tutelle</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586299" lims:id="1586299"><Text><DefinedTermEn>Board</DefinedTermEn> means the board of directors established by section <XRefInternal>7</XRefInternal>. (<DefinedTermFr>conseil</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586300" lims:id="1586300"><Text><DefinedTermEn>Chairperson</DefinedTermEn> means the Chairperson appointed under section <XRefInternal>8</XRefInternal>. (<DefinedTermFr>président</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586301" lims:id="1586301"><Text><DefinedTermEn>Chief Executive Officer</DefinedTermEn> means the Chief Executive Officer appointed under section <XRefInternal>11</XRefInternal>. (<DefinedTermFr>premier dirigeant</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586302" lims:id="1586302"><Text><DefinedTermEn>Corporation</DefinedTermEn> means Build Canada Homes, the corporation established by subsection <XRefInternal>5</XRefInternal>(1). (<DefinedTermFr>Société</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586303" lims:id="1586303"><Text><DefinedTermEn>director</DefinedTermEn> means a director appointed under subsection <XRefInternal>10</XRefInternal>(1). (<DefinedTermFr>administrateur</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586304" lims:id="1586304"><Text><DefinedTermEn>Minister</DefinedTermEn> means the member of the King’s Privy Council for Canada who is designated as the Minister under section <XRefInternal>3</XRefInternal>. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586305" lims:id="1586305"><Text><DefinedTermEn>parent Crown corporation</DefinedTermEn> has the same meaning as in subsection 83(1) of the <XRefExternal reference-type="act" link="F-11">Financial lims:id="1586307"><Text><DefinedTermEn>wholly-owned subsidiary</DefinedTermEn> has the same meaning as in section 83(1) of the <XRefExternal reference-type="act" link="F-11">Financial Administration may, by order, designate a member of the King’s Privy Council for Canada to be the Minister for the purposes of this Act.</Text></Section><Heading lims:inforce-start-date="2026-06-18" lims:enacted-date="2026-06-18" lims:fid="1586311" lims:id="1586311" level="1"><TitleText>Purpose</TitleText></Heading><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586312" lims:id="1586312"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586313" lims:id="1586313">Purpose</MarginalNote><Label>4</Label><Text>The purpose of the Corporation is to promote, support and develop the supply of affordable housing in Canada and to promote innovative and efficient building techniques in the housing construction sector in Canada.</Text></Section><Heading lims:inforce-start-date="2026-06-18" lims:enacted-date="2026-06-18" lims:fid="1586314" lims:id="1586314" level="1"><TitleText>Establishment of Build Canada Homes</TitleText></Heading><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586315" lims:id="1586315"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586316" lims:id="1586316">Establishment</MarginalNote><Label>5</Label><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586317" lims:id="1586317"><Label>(1)</Label><Text>A corporation is established to be known as Build Canada Homes.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586318" lims:id="1586318"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586319" lims:id="1586319">Head office</MarginalNote><Label>(2)</Label><Text>The head office of the Corporation is to be at a place in Canada that is designated by the Governor in Council.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586320" lims:id="1586320"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586321" lims:id="1586321">Capacity</MarginalNote><Label>(3)</Label><Text>The Corporation has the capacity and, subject to this Act, the rights, powers and privileges of a natural person.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586322" lims:id="1586322"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586323" lims:id="1586323">Agent of His Majesty</MarginalNote><Label>6</Label><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586324" lims:id="1586324"><Label>(1)</Label><Text>The Corporation is an agent of His Majesty.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586325" lims:id="1586325"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586326" lims:id="1586326">Contracts</MarginalNote><Label>(2)</Label><Text>The Corporation, or any of its wholly-owned subsidiaries that is an agent of His Majesty, may enter into contracts with His Majesty as though it were not an agent of His Majesty.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586327" lims:id="1586327"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586328" lims:id="1586328">Order</MarginalNote><Label>(3)</Label><Text>Despite subsection (1), the Governor in Council may, by order, declare that the Corporation is not an agent of His Majesty when it is carrying out activities specified in the order.</Text></Subsection></Section><Heading lims:inforce-start-date="2026-06-18" lims:enacted-date="2026-06-18" lims:fid="1586329" lims:id="1586329" level="1"><TitleText>Board of Directors and Chief Executive Officer</TitleText></Heading><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586330" lims:id="1586330"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586331" lims:id="1586331">Establishment and composition</MarginalNote><Label>7</Label><Text>The Corporation has a board of directors consisting of a Chairperson and at least eight but not more than 10 other directors.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586332" lims:id="1586332"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586333" lims:id="1586333">Appointment of Chairperson</MarginalNote><Label>8</Label><Text>The Chairperson is to be appointed by the Governor in Council to hold office during pleasure for any term that the Governor in Council considers appropriate.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586334" lims:id="1586334"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586335" lims:id="1586335">Absence or incapacity — Chairperson</MarginalNote><Label>9</Label><Text>If the Chairperson is absent or incapacitated or if the office of Chairperson is vacant, the Board may designate one of the other directors to exercise the powers and perform the duties and functions of the Chairperson during the absence, incapacity or vacancy, but that director is not to be designated for a period exceeding 90 days without the approval of the Governor in Council.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586336" lims:id="1586336"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586337" lims:id="1586337">Appointment of directors</MarginalNote><Label>10</Label><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586338" lims:id="1586338"><Label>(1)</Label><Text>Each director of the Board, other than the Chairperson, is to be appointed by the Minister, with the approval of the Governor in Council, to hold office during pleasure for a term not exceeding four years that will ensure, as far as possible, the expiry in any one year of the terms of office of not more than one half of the directors.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586339" lims:id="1586339"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586340" lims:id="1586340">Continuation in office</MarginalNote><Label>(2)</Label><Text>Despite subsection (1), if a director is not appointed to take office on the expiry of the term of an incumbent director, other than the Chairperson, the incumbent director continues in the office until their successor is appointed.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586341" lims:id="1586341"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586342" lims:id="1586342">Appointment of Chief Executive Officer</MarginalNote><Label>11</Label><Text>The Chief Executive Officer is to be appointed by the Governor in Council to hold office during pleasure for any term that the Governor in Council considers appropriate.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586343" lims:id="1586343"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586344" lims:id="1586344">Full-time office</MarginalNote><Label>12</Label><Text>The Chief Executive Officer is to carry out the duties and functions of the office on a full-time basis.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586345" lims:id="1586345"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586346" lims:id="1586346">Incapacity or vacancy — Chief Executive Officer</MarginalNote><Label>13</Label><Text>If the Chief Executive Officer is absent or incapacitated or if the office of chief executive officer is vacant, the board may designate any individual to exercise the powers and perform the duties and functions of the Chief Executive Officer during the absence, incapacity or vacancy, but that individual is not to be designated for a period exceeding 90 days without the approval of the Governor in Council.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586347" lims:id="1586347"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586348" lims:id="1586348">Attendance at Board meetings</MarginalNote><Label>14</Label><Text>Subject to the by-laws of the Corporation, the Chief Executive Officer may attend meetings of the Board or any of its committees.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586349" lims:id="1586349"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586350" lims:id="1586350">Consultations</MarginalNote><Label>15</Label><Text>The Minister must consult the Board with respect to the appointment of any individual as Chairperson or Chief Executive Officer.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586351" lims:id="1586351"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586352" lims:id="1586352">Ineligibility for appointment</MarginalNote><Label>16</Label><Text>An individual is not eligible to be appointed, or continue in the office, as the Chief Executive Officer, the Chairperson or a director if the individual</Text><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586353" lims:id="1586353"><Label>(a)</Label><Text>is less than 18 years of age;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586354" lims:id="1586354"><Label>(b)</Label><Text>has the status of bankrupt; or</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586355" lims:id="1586355"><Label>(c)</Label><Text>is a member of the Senate or House of Commons or a member of the legislature of a province.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586356" lims:id="1586356"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586357" lims:id="1586357">Termination of appointment</MarginalNote><Label>17</Label><Text>The Governor in Council may terminate the appointment of, or remove or suspend, any director, including the Chairperson, and the Chief Executive Officer.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586358" lims:id="1586358"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586359" lims:id="1586359">Remuneration</MarginalNote><Label>18</Label><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586360" lims:id="1586360"><Label>(1)</Label><Text>The Chairperson, each of the other directors and the Chief Executive Officer are to be paid by the Corporation remuneration for their services in respect of that office.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586361" lims:id="1586361"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586362" lims:id="1586362">Rate of remuneration</MarginalNote><Label>(2)</Label><Text>The rate of any remuneration paid to the Chairperson, each of the other directors and the Chief Executive Officer is to be fixed by the Governor in Council.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586363" lims:id="1586363"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586364" lims:id="1586364">Committees of Board</MarginalNote><Label>19</Label><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586365" lims:id="1586365"><Label>(1)</Label><Text>The Board may establish any committee of the Board that it considers advisable and may determine the committee’s composition and duties and the tenure of its members.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586366" lims:id="1586366"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586367" lims:id="1586367">Delegation of powers</MarginalNote><Label>(2)</Label><Text>The Board may delegate powers to any of its committees to act in all matters that are not by this Act or by any by-law of the Corporation or resolution of the Board that are not specifically reserved to the Board.</Text></Subsection></Section><Heading lims:inforce-start-date="2026-06-18" lims:enacted-date="2026-06-18" lims:fid="1586368" lims:id="1586368" level="1"><TitleText>Powers</TitleText></Heading><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586369" lims:id="1586369"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586370" lims:id="1586370">Powers</MarginalNote><Label>20</Label><Text>To carry out its purpose, the Corporation may, among other things,</Text><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586371" lims:id="1586371"><Label>(a)</Label><Text>provide advice to federal ministers, departments, commissions, boards and agencies and to <DefinitionRef>Crown corporations</DefinitionRef>, as defined in subsection 83(1) of the <XRefExternal reference-level="federal" reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, on any matter related to its purpose;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586372" lims:id="1586372"><Label>(b)</Label><Text>provide financial assistance to any person or entity, including any level of government in Canada;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586373" lims:id="1586373"><Label>(c)</Label><Text>invest in persons or entities carrying on activities in respect of the supply of affordable housing in Canada, including by acquiring their shares or securities or by making a loan or guarantee to the person or entity;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586374" lims:id="1586374"><Label>(d)</Label><Text>invest in ventures or enterprises, including through the acquisition and development of property, that are likely to benefit the supply of affordable housing or the adoption of innovative and efficient building techniques in Canada;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586375" lims:id="1586375"><Label>(e)</Label><Text>develop land and construct housing in Canada;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586376" lims:id="1586376"><Label>(f)</Label><Text>acquire, hold, manage, exchange, sell or otherwise dispose of or lease any property;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586377" lims:id="1586377"><Label>(g)</Label><Text>take any security or security interest in any property;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586378" lims:id="1586378"><Label>(h)</Label><Text>enter into arrangements or agreements with, and act as agent or mandatary for, any person or entity, including any level of government in Canada, for the provision of services or programs to, by, on behalf of or jointly with that person or entity, and deliver financial assistance or make investments on their behalf under the arrangement or agreement;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586379" lims:id="1586379"><Label>(i)</Label><Text>charge fees for services provided by the Corporation in the exercise of its powers under this Act;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586380" lims:id="1586380"><Label>(j)</Label><Text>collect and disseminate data, in collaboration with any level of government in Canada, in order to monitor and assess the housing sector in Canada and to better inform investment decisions in respect of that sector; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586381" lims:id="1586381"><Label>(k)</Label><Text>do any other thing related to carrying out its purpose that the Governor in Council may, by order, specify.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586382" lims:id="1586382"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586383" lims:id="1586383">Loan guarantees — limitation</MarginalNote><Label>21</Label><Text>Despite paragraph <XRefInternal>20</XRefInternal>(c), the Corporation may provide a loan guarantee only with the Minister of Finance’s approval.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" Corporation</MarginalNote><Label>29</Label><Text>The Minister of Finance may make payments out of the Consolidated Revenue Fund in an aggregate amount not exceeding $11.5 billion, or any other amount that is specified in an appropriation Act or any other Act of Parliament, to fund the operations and activities of the Corporation.</Text></Section><Section in-force="no" regulations to carry out the purposes and provisions of this Act, including regulations setting out requirements in respect of the exercise of the Corporation’s powers under this the Chairperson, the Chief Executive Officer and the officers and employees of the Corporation are deemed to be employees for the purposes of the <XRefExternal reference-level="federal" reference-type="act" link="G-5">Government Employees Compensation Act</XRefExternal> and to be employed in the federal public administration for the purposes of any regulations made under section 9 of the <XRefExternal reference-level="federal" reference-type="act" link="A-2">Aeronautics Act</XRefExternal>.</Text></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586418" Governor in Council may — on the recommendation of the Minister in relation to the Corporation or any wholly-owned subsidiary of the Corporation or of the appropriate Minister in relation to Canada Lands Company Limited or any wholly-owned subsidiary of Canada Lands Company Limited — on any terms and conditions that the Governor in Council considers appropriate, issue a directive to the Corporation or to Canada Lands Company Limited or to any wholly-owned subsidiary of the Corporation or of Canada Lands Company Limited to take any measure referred to in any of sections <XRefInternal>37</XRefInternal>, <XRefInternal>39</XRefInternal> or <XRefInternal>40</XRefInternal>.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586433" Corporation or of Canada Lands Company Limited or of any wholly-owned subsidiary of the Corporation or of Canada Lands Company Limited must comply with a directive issued under subsection (1). Compliance with the issued directive is deemed to be in the best interests of the Corporation, Canada Lands Company Limited or the wholly-owned subsidiary, as the case may connection with that implementation, the Corporation, Canada Lands Company Limited or the wholly-owned subsidiary must notify the Minister or the appropriate Minister, as the case may be, that it has Canada Lands Company Limited that existed on or before the directive is issued lies or may be instituted by anyone against His Majesty or any minister or any employee or agent of His Majesty, or any person engaged to provide advice or services to His Majesty in relation to such an agreement, for anything done or omitted to be done or for anything purported to have been done or omitted to be done under the directive, in the exercise of their powers or the performance of their duties or functions.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586441" lims:id="1586441"><MarginalNote in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586442" lims:id="1586442">Authority — Corporation</MarginalNote><Label>37</Label><Text>If directed by the Governor in Council under subsection <XRefInternal>36</XRefInternal>(1), the Corporation may take any of the following measures:</Text><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586443" lims:id="1586443"><Label>(a)</Label><Text>procure the incorporation of a corporation, securities of which, on incorporation, would be held by, on operating agency</DefinedTermEn> means the special operating agency known as Build Canada Homes created by a decision of the Treasury Board.</Text></Section><Section in-force="no" lims:fid="1586496" lims:id="1586496" type="transitional"><Label>(b)</Label><Text>all obligations and liabilities of His Majesty incurred in respect of the special operating agency are transferred to the Corporation; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2026-06-18" lims:fid="1586497" lims:id="1586497" type="transitional"><Label>(c)</Label><Text>every reference to the special operating agency in a deed, contract, instrument or act or other document is, unless the context requires otherwise, to be read as a reference to the
