lims:fid="3450" lims:id="3450" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3451" lims:id="3451"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3452" lims:id="3452">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2018-04-01" lims:fid="3453" lims:id="3453"><Text><DefinedTermEn>Agreement</DefinedTermEn> means the Anishinabek Nation Education Agreement signed on August 16, 2017, including any amendments made to it. (<DefinedTermFr>Accord</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="3454" lims:id="3454"><Text><DefinedTermEn>band</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>. (<DefinedTermFr>bande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="3455" lims:id="3455"><Text><DefinedTermEn>constitution</DefinedTermEn> means a constitution ratified by a participating First Nation in conformity with the Agreement. (<DefinedTermFr>constitution</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="3456" lims:id="3456"><Text><DefinedTermEn>education</DefinedTermEn> means education programs and services of a nature generally provided to students from junior kindergarten to the end of secondary school in Ontario. (<DefinedTermFr>éducatifs</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="3457" lims:id="3457"><Text><DefinedTermEn>First Nation law</DefinedTermEn> means a law made under section <XRefInternal>7</XRefInternal>. (<DefinedTermFr>texte législatif autochtone</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="3458" lims:id="3458"><Text><DefinedTermEn>participating First Nation</DefinedTermEn> means a band that is named in the schedule. (<DefinedTermFr>première lims:fid="3460" lims:id="3460"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3461" lims:id="3461">Agreement prevails</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3462" lims:id="3462"><Label>(1)</Label><Text>In the event of an inconsistency or conflict between the Agreement and the provisions of any Act of Parliament, or of any regulation made under an Act of Parliament, the Agreement prevails to the extent of the conflict or inconsistency.</Text></Subsection><Subsection lims:inforce-start-date="2022-10-01" lims:enacted-date="2022-06-23" lims:fid="3463" lims:id="1376952"><MarginalNote lims:inforce-start-date="2022-10-01" lims:enacted-date="2022-06-23" lims:fid="1376953" lims:id="1376953">Act prevails</MarginalNote><Label>(2)</Label><Text>Subject to subsection (3), in the event of an inconsistency or conflict between the provisions of this Act and the provisions of any other Act of Parliament, or of any regulation made under any other Act of Parliament, the provisions of this Act prevail to the extent of the inconsistency or conflict.</Text></Subsection><Subsection lims:inforce-start-date="2022-10-01" lims:enacted-date="2022-06-23" lims:fid="1376950" lims:id="1376950"><MarginalNote lims:inforce-start-date="2022-10-01" Act</XRefExternal></MarginalNote><Label>(3)</Label><Text>The provisions of the <XRefExternal reference-type="act" link="A-11.31">Anishinabek Nation Governance Agreement Act</XRefExternal> prevail over the provisions of this Act, and of any regulation made under this Act, to the extent of any inconsistency or conflict between them.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem Act</MarginalNote><Label>4</Label><Text>This Act applies to every participating First Nation.</Text></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3468" lims:id="3468"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3469" lims:id="3469">Agreement given effect</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3470" lims:id="3470"><Label>(1)</Label><Text>The Agreement is approved, given effect and declared valid and has the force of law.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3471" lims:id="3471"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3472" lims:id="3472">For greater certainty</MarginalNote><Label>(2)</Label><Text>For greater certainty, the Agreement is binding on, and may be relied on by, all persons and bodies.</Text></Subsection></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3473" lims:id="3473"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3474" lims:id="3474">Not a treaty</MarginalNote><Label>6</Label><Text>The Agreement is not a treaty within the meaning of section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3475" lims:id="3475"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3476" lims:id="3476">First Nation laws</MarginalNote><Label>7</Label><Text>A participating First Nation may, to the extent provided by the Agreement, make laws respecting education that are applicable on its <DefinitionRef>reserve</DefinitionRef>, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3477" lims:id="3477"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3478" lims:id="3478">Education</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3479" lims:id="3479"><Label>(1)</Label><Text>A participating First Nation must provide or make provision for education for students to the extent provided by the Agreement.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3480" lims:id="3480"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3481" lims:id="3481">Transferability</MarginalNote><Label>(2)</Label><Text>The education provided must, if practicable, be comparable to education provided by the public school system of Ontario, in order to facilitate the transfer of students without academic penalty to and from that school system.</Text></Subsection></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3482" lims:id="3482"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3483" lims:id="3483">Kinoomaadziwin Education Body</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3484" lims:id="3484"><Label>(1)</Label><Text>A corporation without share capital to be known as Kinoomaadziwin Education Body is established to support the delivery of education under this Act.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3485" lims:id="3485"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3486" lims:id="3486">Powers, duties, etc.</MarginalNote><Label>(2)</Label><Text>The powers, duties, functions, role and composition of the Kinoomaadziwin Education Body are to be determined in accordance with the Agreement.</Text></Subsection></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3487" lims:id="3487"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3488" lims:id="3488">Regional Education Council</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3489" lims:id="3489"><Label>(1)</Label><Text>A participating First Nation may, with one or more participating First Nations, establish a Regional Education Council, in accordance with the Agreement, to support the coordination and delivery of education.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3490" lims:id="3490"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3491" lims:id="3491">Powers, duties, etc.</MarginalNote><Label>(2)</Label><Text>The powers, duties, functions, role and composition of the Regional Education Council are to be determined, in accordance with the Agreement, by the participating First Nations that establish it.</Text></Subsection></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3492" lims:id="3492"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3493" lims:id="3493">Local Education Authority</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3494" lims:id="3494"><Label>(1)</Label><Text>A participating First Nation may establish a Local Education Authority, in accordance with the Agreement, to support it in the exercise of its powers, including the power to make First Nation laws.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3495" lims:id="3495"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3496" lims:id="3496">Powers, duties, etc.</MarginalNote><Label>(2)</Label><Text>The powers, duties, functions, role and composition of the Local Education Authority are to be determined, in accordance with the Agreement, by the participating First Nation that establishes it.</Text></Subsection></Section><Heading lims:inforce-start-date="2017-12-14" lims:fid="3497" lims:id="3497" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3498" lims:id="3498"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3499" lims:id="3499"><XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal></MarginalNote><Label>12</Label><Text>On the coming into force of a First Nation law, subsection 114(1) and sections 115 to 117 of the <XRefExternal reference-type="act" link="I-5">Indian Act</XRefExternal> cease to apply to the participating First Nation that made it.</Text></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3500" lims:id="3500"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3501" lims:id="3501">Judicial notice  —  First Nation laws</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3502" lims:id="3502"><Label>(1)</Label><Text>Judicial notice must be taken of a First Nation law that is registered in the official registry of laws maintained by a participating First Nation in accordance with the Agreement.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="3503" lims:id="3503"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3504" lims:id="3504">Evidence</MarginalNote><Label>(2)</Label><Text>In any proceedings, evidence of a First Nation law may be given by the production of a copy of the law, certified to be a true copy by a person authorized by the participating First Nation, without proof of that person’s signature or official character.</Text></Subsection></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3505" lims:id="3505"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3506" lims:id="3506"><XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal></MarginalNote><Label>14</Label><Text>A First Nation law is not a statutory instrument for the purposes of the <XRefExternal reference-type="act" link="S-22">Statutory Instruments Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2017-12-14" lims:fid="3507" lims:id="3507" level="1"><TitleText>Regulations and Orders</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3508" lims:id="3508"><MarginalNote lims:inforce-start-date="2018-04-01" lims:fid="3509" lims:id="3509">Regulations and orders</MarginalNote><Label>15</Label><Text>The Governor in Council may make any regulations or orders that he or she considers necessary for the purpose of carrying out the provisions of this Act, the Agreement or other agreements related to the implementation of the Agreement.</Text></Section><Heading lims:inforce-start-date="2017-12-14" lims:fid="3510" lims:id="3510" level="1"><TitleText>Amendment of Schedule</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="3511" satisfied that the First Nation has, in a manner consistent with the Agreement, ratified the Agreement and has a constitution.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01"
