Order Respecting the Privileges and Immunities in Canada of the North Pacific Marine Science Organization (PICES)

His Excellency the Governor General in Council, on the recommendation of the Secretary of State for External Affairs and the Minister of Finance, pursuant to section 5 of the Foreign Missions and International Organizations ActFootnote *, is pleased hereby to make the annexed Order respecting the privileges and immunities in Canada of the North Pacific Marine Science Organization (PICES).

Short Title

 This Order may be cited as the North Pacific Marine Science Organization Privileges and Immunities Order.

Interpretation

 In this Order,

Agreement

Agreement means the Headquarters Agreement between the Government of Canada and the North Pacific Marine Science Organization (PICES), done at Victoria, January 8, 1993 (CTS 1993/3), as amended by the Exchange of Notes between the Government of Canada and North Pacific Marine Science Organization (PICES), constituting an agreement amending the Agreement, done at Ottawa, May 21, 1997, and at Sidney, May 26, 1997 (CTS 1997/21); (Accord)

Convention

Convention means the Convention on the Privileges and Immunities of the United Nations; (Convention)

Organization

Organization means the North Pacific Marine Science Organization. (Organisation)

Vienna Convention

Vienna Convention means the Vienna Convention on Diplomatic Relations set out in Schedule I to the Foreign Missions and International Organizations Act. (Convention de Vienne)

Privileges and Immunities

  •  (1) The Organization shall have in Canada the legal capacities of a body corporate and to the extent specified in Articles 2, 3, 4 and 5 of the Agreement, the privileges and immunities set out in Article II of the Convention.

  • (2) Representatives of foreign states that are members of the Governing Council of the Organization shall have in Canada, to the extent specified in Article 6 of the Agreement, privileges and immunities comparable to the privileges and immunities accorded in Canada to diplomatic representatives under the Vienna Convention.

  • (3) The Chairman of the Governing Council of the Organization, and the Vice-Chairman when acting as Chairman, shall have in Canada, to the extent specified in Article 7 of the Agreement, privileges and immunities comparable to the privileges and immunities accorded in Canada to diplomatic representatives under the Convention.

  • (4) Officials of the Organization shall have in Canada, to the extent specified in paragraphs (1) to (3) of Article 8 and Article 10 of the Agreement, the privileges and immunities set out in Section 18 of Article V of the Convention.

  • (5) Experts performing missions for the Organization shall have in Canada, to the extent specified in Article 11 of the Agreement, the privileges and immunities set out in Article VI of the Convention.
