Order Granting Authority to Regulate the Marketing in Interprovincial and Export Trade of Hogs Produced in the Province of New Brunswick

His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture, pursuant to section 2 of the Agricultural Products Marketing Act, is pleased hereby to make the annexed Order granting authority to regulate the marketing in interprovincial and export trade of hogs produced in the Province of New Brunswick.

Short Title

 This Order may be cited as the New Brunswick Hog Order.

Interpretation

 In this Order,

Act

Act means the Farm Products Marketing Act of New Brunswick; (Loi)

hog

hog means any animal of the porcine species produced in New Brunswick; (porc)

Local Board

Local Board means the New Brunswick Hog Marketing Board; (Office)

Plan

Plan means any plan for the marketing of hogs, established and amended from time to time pursuant to the Acts and any Regulations made pursuant to the Acts to give effect to the Plan. (plan)

Interprovincial and Export Trade

 The Local Board is authorized to regulate the marketing of hogs in interprovincial and export trade and for those purposes may, with respect to persons and property situated within the Province of New Brunswick, exercise all or any powers like the powers exercisable by it in relation to the marketing of hogs locally within that Province under the Act and the Plan.

Levies

 The Local Board is authorized, in relation to the powers granted to it by section 3 with respect to the marketing of hogs in interprovincial and export trade, to make orders fixing levies or charges and imposing them on and collecting them from persons described in section 3 who are engaged in the marketing of hogs and, for such purposes, classifying such persons into groups and fixing the levies or charges payable by the members of the different groups in different amounts; and the Local Board may use such levies or charges for its purposes, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of hogs, and the equalization or adjustment among producers of hogs of moneys realized from the sale thereof during such period or periods of time as it may determine.
