Order Granting Authority to Regulate the Marketing of Vegetables for Processing Produced in Ontario

His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture, pursuant to section 2 of the Agricultural Products Marketing Act, is pleased hereby to revoke the Ontario Vegetable Growers’ Marketing-for-Processing Order made by Order in Council P.C. 1977-652 of 17th March, 1977Footnote 1 and to make the annexed Order granting authority to regulate the marketing of vegetables for processing produced in Ontario in substitution therefor.

Short Title

 This Order may be cited as the Ontario Vegetable Growers’ Marketing-for-Processing Order.

Interpretation

 In this Order,

Act

Act means The Farm Products Marketing Act of Ontario; (Loi)

Board

Board means the Farm Products Marketing Board of Ontario established pursuant to the Act; (Régie)

Commodity Board

Commodity Board means The Ontario Vegetable Growers’ Marketing Board established pursuant to the Act; (Office)

Plan

Plan means a plan for the marketing of vegetables established pursuant to the Act, and any regulations made pursuant to the Act to give effect to the Plan; (plan)

processing

processing means

  • (a) canning, dehydrating, drying, freezing, pickling or processing a vegetable with sugar or sulphur dioxide or any other chemical or by heat,

  • (b) combining or mixing a vegetable with one or more other vegetables, or

  • (c) entering into a contract for the purchase of vegetables for the purpose of performing on the vegetables any of the operations mentioned in paragraph (a) or (b); (transformation)

producer

producer means a person engaged in the production of vegetables; (producteur)

vegetable

vegetable means green and wax beans, lima beans, red beets, cabbage, carrots, cauliflower, sweet corn, cucumbers, green peas, pumpkins, squash or tomatoes produced in Ontario and used for processing purposes. (légume)

Interprovincial and Export Trade

 The Commodity Board and the Board are each authorized to regulate the marketing of vegetables in interprovincial and export trade and for such purposes may, with respect to persons and property situated within the Province of Ontario, exercise all or any powers like the powers exercisable by each of them respectively in relation to the marketing of vegetables locally within that Province under the Act and the Plan.

Levies

 The Commodity Board and the Board are each authorized, in relation to the powers granted to them under section 3 with respect to the marketing of vegetables in interprovincial and export trade, to make orders fixing, imposing and collecting levies or charges from persons referred to in section 3 who are engaged in the marketing of vegetables and for such purpose classifying such persons into groups and fixing the levies or charges payable by the members of the different groups in different amounts and the Commodity Board and the Board may use such levies or charges for their purposes, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of vegetables and the equalization or adjustment among producers of vegetables of moneys realized from the sale thereof during such period or periods of time as the Commodity Board or the Board may determine.
