Whereas the Canadian Radio-television and Telecommunications Commission rendered Decisions CRTC 99-109 through 99-112, on May 21, 1999 issuing broadcasting licences for four new French-language national television specialty services called Canal Fiction, Canal Histoire, Canal Z, aux limites du savoir and Canal Évasion;
Whereas, subsequent to the rendering of the said decisions, the Governor in Council has received a petition requesting that the Decisions CRTC 99-109 through 99-112 be referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing;
And whereas the Governor in Council, having considered the petition, is not satisfied that Decisions CRTC 99-109 through 99-112 derogate from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decisions CRTC 99-109 through 99-112 of May 21, 1999 back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
