Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 97-193 on May 8, 1997 approving applications by TELUS Cable Holdings Inc. (TELUS), under the Broadcasting Act, for licences to carry on broadcasting distribution undertakings (BDUs) for the purpose of conducting market and technical trials involving up to 2,000 individual subscribers in Calgary and up to 1,400 individual subscribers in Edmonton;

Whereas, subsequent to the rendering of Decision CRTC 97-193, the Governor in Council has received petitions requesting that the said decision be referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing;

And whereas the Governor in Council, having considered the petitions, is not satisfied that Decision CRTC 97-193 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 97-193 of May 8, 1997 back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
