Order Declining to Set Aside or to Refer Back to the CRTC a Decision Respecting Various Cable Distribution Undertakings

Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 95-591 on August 24, 1995, approving the applications to amend the broadcasting licences of various cable distribution undertakings by authorizing the licensees to originate a video games service as a special programming service;
Whereas, subsequent to the rendering of Decision CRTC 95-591, the Governor in Council has received a petition requesting that the said decision be set aside;
And Whereas the Governor in Council, having considered this petition, is not satisfied that Decision CRTC 95-591 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 95-591 of August 24, 1995, back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
