Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 93-37 on January 29, 1993 approving the applications by CHUM Limited for authority to acquire the assets of the radio programming undertakings for CKLW and CKLW-FM Windsor from Trillium Cable Communications Limited, and for broadcasting licences to continue the operation of the said undertakings;
Whereas, subsequent to the rendering of Decision CRTC 93-37, the Governor in Council has received a petition requesting that the said decision be set aside;
And Whereas the Governor in Council, having considered the petition, is not satisfied that Decision CRTC 93-37 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 93-37 of January 29, 1993, back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
