CANADA SHIPPING ACT, 2001

Regulations Respecting the Fees Payable for the Inspection of Ships and Other Vessels

Short Title

 These Regulations may be cited as the Board of Steamship Inspection Scale of Fees.

Interpretation

 In these Regulations,

Act

Act means the Canada Shipping Act; (Loi)

Administration

Administration, in respect of a ship’s equipment, means the Government of the State whose flag the ship is entitled to fly; (Administration)

certificate

certificate means any certificate issued pursuant to section 318 or 319 of the Act; (certificat)

first inspection

first inspection includes all inspections of a ship made by an inspector prior to the issuance of the first certificate in respect of that ship; (première inspection)

inspector

inspector means a steamship inspector appointed under the Act; (inspecteur)

length

length means

  • (a) in the case of a ship that is registered under the Act or required by the Act to be registered,

    • (i) the distance from the fore part of the uppermost end of the stem to the aft side of the head of the stern post, except that if a stern post is not fitted to the ship the measurement shall be taken to the foreside of the head of the rudder stock,

    • (ii) if the ship has no rudder stock or has a rudder stock situated outside of the hull at the stern, the distance from the foreside of the foremost permanent structure to the aft side of the aftermost permanent structure of the ship not including guards or rubbing strakes, or

    • (iii) if the ship is double-ended, the distance from the aft side of the forward rudder stock to the foreside of the after rudder stock, and

  • (b) in the case of a ship other than a ship described in paragraph (a), the horizontal distance measured between perpendiculars erected at the extreme ends of the outside of the hull; (longueur)

non-Canadian ship

non-Canadian ship means a ship registered elsewhere than in Canada; (navire non canadien)

Safety Convention Certificate

Safety Convention Certificate means a certificate issued under the provisions of the International Convention for the Safety of Life at Sea, 1974. (certificat selon la Convention de sécurité)

Application

 These Regulations

  • (a) except Part III, apply in respect of Canadian ships; and

  • (b) apply in respect of non-Canadian ships.

PART IGeneral

Payment of Fees

 The fees set out in these Regulations in respect of services performed by the Marine Safety Branch of the Department of Transport under Part V or Part XV of the Act or regulations made pursuant to those Parts shall be paid to any officer of that Branch.

Proportionate Fees

 When a ship is inspected at any time within a period of 12 months after the date of the last annual inspection, a new certificate valid for 12 months may be issued upon the payment by the owner of the ship of one-twelfth of the appropriate annual fee for that ship, as specified in section 11 or 12, for each month or part thereof that has elapsed since the date of the last annual inspection.

Extension

 A fee of $100 is payable for the extension of a short-term certificate or a letter of compliance, other than a letter of compliance referred to in column I of item 7 or 8 of the table to section 30, in relation to an inspection referred to in any of sections 10 to 14, 24, 30, 31 and 34.

Inspections Outside Canada

 In addition to any expenses payable under section 313 of the Act, the fee payable for inspection of a ship outside Canada is an amount equal to the total of

  • (a) the appropriate fee for each survey, inspection or service referred to in sections 10 to 14, 24, 25, 28 to 31 and 34; and

  • (b) $400 for each day, or part thereof, that an inspector is outside Canada to make the inspection.

First Inspection

  •  (1) The fee payable for the first inspection of a ship of less than 25 tons, gross tonnage, is an amount equal to $286 plus:

    • (a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, twice the fee set out in column II of that item;

    • (b) for a non-passenger ship, other than a ship referred to in paragraph (c), having a gross tonnage set out in column I of an item of Table II to section 11, twice the fee set out in column II of the item; or

    • (c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, the fee set out in column II of the item.

  • (2) The fee payable for the first inspection of a ship of 25 tons, gross tonnage, or more, is an amount equal to $1,152 plus:

    • (a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, twice the fee set out in column II of that item;

    • (b) for a non-passenger ship, other than a ship referred to in paragraph (c), having a gross tonnage set out in column I of an item of Table II to section 11, twice the fee set out in column II of the item; or

    • (c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, the fee set out in column II of the item.

Re-inspection

  •  (1) The fee payable for the re-inspection of a ship of less than 25 tons gross tonnage that was registered in Canada, then registered elsewhere than in Canada and is then again registered in Canada, is an amount equal to $286 plus:

    • (a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, one and one-half times the fee set out in column II of the item;

    • (b) for a non-passenger ship, other than a ship referred to in paragraph (c), having a gross tonnage set out in column I of an item of Table II to section 11, one and one-half times the fee set out in column II of the item; or

    • (c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, three quarters of the fee set out in column II of the item.

  • (2) The fee payable for the re-inspection of a ship of 25 tons gross tonnage or more that was registered in Canada, then registered elsewhere than in Canada and is then again registered in Canada, is an amount equal to $1,152 plus:

    • (a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, one and one-half times the fee set out in column II of that item;

    • (b) for a non-passenger ship, other than a ship referred to in paragraph (c), having a gross tonnage set out in column I of an item of Table II to section 11, one and one-half times the fee set out in column II of the item; or

    • (c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, three quarters of the fee set out in column II of the item.

Periodical Inspection of Self-Propelled Ships

  •  (1) The fee payable for each annual, quadrennial or quinquennial inspection of a self-propelled ship that is subject to annual inspection, subsequent to the first inspection, is

    • (a) where the ship is a passenger ship having a gross tonnage referred to in an item set out in Column I of Table I to this section, the amount set out for that item in Column II of that Table; and

    • (b) where the ship is a non-passenger ship having a gross tonnage set out in column I of Table II to this section, the fee set out in column II.

    • (b) for a non-passenger ship having a gross tonnage set out in column I of Table II to this section, twice the fee set out in column II.

  • (3) The fees calculated in accordance with subsection (1) or (2) shall be rounded to the nearest whole dollar or, if the amount is equidistant from two whole dollars, to the higher thereof.

Periodical Inspection of Non-Self-Propelled Ships

  •  (1) The fee payable for each annual, quadrennial or quinquennial inspection of a non-self-propelled ship that is subject to annual inspections, subsequent to the first inspection, is

    • (a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, one-half of the fee set out in column II of that item;

    • (b) for a non-passenger ship, other than a ship referred to in paragraph (c), having a gross tonnage set out in column I of an item of Table II to section 11, one half of the fee set out in column II of the item; or

    • (c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, one half of the fee set out in column II of the item.

  • (2) The fee payable for each quadrennial or quinquennial inspection of a non-self-propelled ship that is not subject to annual inspections, subsequent to the first inspection, is

    • (a) for a passenger ship having a gross tonnage set out in column I of an item of Table I to section 11, the fee set out in column II of that item;

    • (b) for a non-passenger ship, other than a ship referred to in paragraph (c), having a gross tonnage set out in column I of an item of Table II to section 11, the fee set out in column II of the item; or

    • (c) for an unmanned, non-self-propelled ship, including deck cargo barges and barges that carry oil in bulk, having a gross tonnage set out in column I of an item of Table II to section 11, one half of the fee set out in column II of the item.

  • (3) The fees calculated in accordance with subsection (1) or (2) shall be rounded to the nearest whole dollar or, if the amount is equidistant from two whole dollars, to the higher thereof.

 Notwithstanding paragraphs 12(1)(b) and (2)(b), the fee payable in respect of each annual, quadrennial or quinquennial inspection, subsequent to the first inspection, of a non-passenger, non-self-propelled ship having a gross tonnage set out in column I of an item of the table to this section, where the ship is not subject to periodical inspection of the hull, is the fee set out in column II of that item.
