Whereas the Minister of the Environment and the government of the Province of Alberta have agreed in writing dated June 1, 1994, that there are in force by or under the laws of the Province of Albertaprovisions that are equivalent to the provisions of certain regulations made under subsection 34(1)* of the Canadian Environmental Protection Act**; andS.C. 1989, c. 9, s. 2R.S., c. 16 (4th Supp.)provisions that are similar to sections 108 to 110 of that Act for the investigation of alleged offences under Alberta’s environmental legislation;Whereas, pursuant to subsection 34(7) of the Canadian Environmental Protection Act**, the Minister of the Environment published in the Canada Gazette Part I on July 23, 1994, a copy of the said agreement;And Whereas, pursuant to subsection 48(1) of that Act, the Minister of the Environment published in the Canada Gazette Part I on July 23, 1994, a copy of the proposed Order declaring that the provisions of certain regulations made under subsection 34(1) of the Canadian Environmental Protection Act do not apply in the Province of Alberta, substantially in the form annexed hereto;Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of the Environment, pursuant to subsection 34(6)*** of the Canadian Environmental Protection Act**, is pleased hereby to make the annexed Order declaring that the provisions of certain regulations made under subsection 34(1) of the Canadian Environmental Protection Act do not apply in the Province of Alberta, effective on the date of registration thereof by the Clerk of the Privy Council.S.C. 1992, c. 1, s. 144 (Sch. VII, item 15)Short TitleThis Order may be cited as the Alberta Equivalency Order.DeclarationThe provisions of the following regulations that are made under subsection 34(1) of the Canadian Environmental Protection Act do not apply in the Province of Alberta:Vinyl Chloride Release Regulations, SOR/92-631;Secondary Lead Smelter Release Regulations, SOR/91-155;Pulp and Paper Mill Effluent Chlorinated Dioxins and Furans Regulations, SOR/92-267; andsubsections 4(1), 6(2), paragraph 6(3)(b), sections 7 and 9 of the Pulp and Paper Mill Defoamer and Wood Chip Regulations, SOR/92-268.
