Whereas, pursuant to subsection 150(1) of the Canada-Newfoundland Atlantic Accord Implementation Act*, a copy of the proposed Regulations respecting oil and gas operations in the Newfoundland offshore area was published in the Canada Gazette Part I on February 13, 1988 and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Energy, Mines and Resources with respect thereto;S.C. 1987, c. 3And Whereas, pursuant to section 7 of the Canada-Newfoundland Atlantic Accord Implementation Act*, the Minister of Energy, Mines and Resources has consulted the Minister of Energy for the Province of Newfoundland with respect to the proposed Regulations and the Minister of Energy for the Province of Newfoundland has given approval to the making of the said Regulations;Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Energy, Mines and Resources, pursuant to subsection 149(1) of the Canada-Newfoundland Atlantic Accord Implementation Act*, is pleased hereby to make the annexed Regulations respecting oil and gas operations in the Newfoundland offshore area.Short TitleThese Regulations may be cited as the Newfoundland Offshore Area Oil and Gas Operations Regulations.InterpretationIn these Regulations,Act means the Canada–Newfoundland and Labrador Atlantic Accord Implementation Act; (Loi)operating licence means an operating licence issued pursuant to section 138 of the Act. (permis de travaux)2014, c. 13, s. 116Operating LicenceAn application for an operating licence may be made byan individual who is 18 years of age or over;a corporation registered under The Corporations Act, Chapter 12 of the Statutes of Newfoundland, 1986; ora corporation that is entitled to carry on business in any province.Every application for an operating licence shallbe in writing;contain the name and address of the applicant;be sent to the Chief Conservation Officer; andbe accompanied by a fee of $25 payable to the Receiver General.No person shall assign or transfer an operating licence and any purported assignment or transfer of an operating licence is void.Work AuthorizationNo holder of an operating licence shall carry out any geotechnical or engineering feasibility program, environmental study, geophysical or geological program, diving program or other work or activity that is required by the Act to be authorized unlessthat work or activity is expressly authorized pursuant to regulations made under the Act; orthe holder has obtained a written authorization pursuant to paragraph 138(1)(b) of the Act.Reporting of SpillsAny person who, pursuant to subsection 161(2) of the Act, reports a spill shall do so by informing the Chief Conservation Officer forthwith of the circumstances and relevant details of the spill by the most rapid and practical means possible.AMENDMENTS NOT IN FORCE
